This permit, issued on July 31, 2018 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
x suo3ect m lines, imprisonment or civu action; or may cause me permit to be null and void.
Dockinz Facility
1) This permit authorizes only the docks, piers, and other structures and uses located in or over the
water that are expressly and specifically set forth in the permit application. No other structure,
whether floating or stationary, shall become a permanent part of this docking facility without permit
modification. No non -water dependent uses of structures shall be conducted on, in or over Public
Trust waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced
throughout the entire existence of the permitted structure.

This permit action may be appealed by the pennittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2021
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

3) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the
permitted activity without having it transferred to a third party.
4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
5) This permit authorizes a maximum of 3 formalized boat slips. Docking space on the landward side of the
floating dock indicating Slip No. 3 is not authorized under this permit.
6) This permit does not authorize any tie pilings associated with the docking facility.
7) The docks and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structures and the adjacent property owners' riparian access corridors.
8) No portion of the authorized docking facility shall extend more than one quarter of the width of the water
body. Measurements to determine the width of the water body shall be made from the waterward edge of
any coastal wetland vegetation which borders the water body.
9) In order to ensure compliance with Conditions 6-8, an as -built survey shall be performed of the docking
facility and copies of the survey provided to the Division of Coastal Management within 60 days of
completion of construction of this portion of the project.
10) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
Excavation
11) Excavation shall not exceed -6' below the normal low water. In no case shall the depth of excavation
exceed the depth of connecting waters.
12) No vegetated wetlands shall be excavated or filled. No excavation shall take place within 10' of any
Coastal Wetlands.
13) The temporary placement of double handling of fill materials within waters or vegetated wetlands is not
authorized.
14) No excavation shall take place at any time outside of the alignment indicated on the attached workplan
drawings.
15) All excavated materials shall be confined above normal high water and landward of regularly or
irregularly flooded Coastal Wetlands behind adequate dikes or other retaining structures to prevent
spillover of solids into any Coastal Wetlands or surrounding waters.

16) The spoil disposal area & offloading site shall be inspected and approved by a representative of the
Division of Coastal Management prior to the commencement of any dredging activities.
Maintenance Clause
17) The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of any
maintenance work authorized by this permit, and such notification shall include:
A. The number of the original permit.
B. A statement that no dimensional changes are proposed.
C. A copy of the original permit plans with cross -hatching indicating the area to be maintained, the
area to be used for spoil disposal, and the estimated amount of material to be removed. The
location, design and holding capacity of the spoil disposal site shall be approved by a representative
of the Division prior to the initiation of any maintenance dredging activities.
D. The date of map revision and the permittee's signature shown anew on the original plan.
General
18) The pemuttee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
19) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
20) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at [phone] prior to the commencement of any
such activity for this determination. The pemuttee is fiuther advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers assigned the proposed project Action ID No. SAW-2018-
00411.
NOTE: The N.C. Division of Water Resources assigned the proposed project DWR Project No. 2018-
0281.

Thanks Heather. I note in your letter to me information for protesting the issuance of this permit. To
clarify my previous communication, the concern I raised was the initial application had them using my
property as a disposal/transfer site for the spoil and no agreement had been made with me for that. I
also was concerned that there was encroachment into the riparian areas. It appears all those
concerns have been addressed in the permit, and I have no objection to it's issuance. Best of luck to
them in their project and thank you and your team for your good work.

To install a new docking station located at 21 Causeway Drive OIB NC.
Remove 8x40 wood docks, 4x16 wood ramps, and a 4x24' wood walkway.
Remove 3 center pilings that hold old wood floating dock.
Remove walkway pilings and walkway
Install aluminum floating docks, 802, 8x20, 8x28 , 8x12 to create two L shape docking systems.
Provide 2 aluminum ramps.(4x24) to floating docks from new walkways to docking station
Wedging
We propose to dredge as indicated on drawing D1
We are using a long reach excavator on barge to excavate to a floating dump box.
We are then using another long reach excavator to remove spoils from land to dump truck on site.
We will then truck spoils to Cama approved site as indicated on agents form for disposal.
We will tarp area from floating barge to seawall to catch any spoils through removal.
Upland Development
The existing bulkhead has a 2' wide wood cap on it now .We are proposing to replace the wood 2' wide
walkway and installing a new 4'wide wood walkway for about 40' along existing bulkhead. This will allow
access to the 2 ramps at the new docking station.

received your letters about your issues. We have checked with Cama and the City of OIB on the
regulations that you have mentioned.
The City of OIB and Cama have said that we are in compliance with what we have proposed. The owner

station, located at 21 Causeway Dr. OIB NC and adjacent to the man- made canal in Ocean Isle NC.
We are including a stamped engineer drawing as to all alignments required by Cama. We have pulled
back the docks landward to open up the canal channel to ease navigation and to abide to Cama
regulations.

SUBJECT: Coastal Area Management Act (CAMA) Permit Application Submittal for
The Bonanza Group, 21 Causeway Drive, Brunswick County
Dear Mr. West:
This letter is in response to the above referenced CAMA permit application, which was accepted
as complete by the Division's Wilmington office on February 13, 2018, and placed on hold
pending an additional information request on April 25, 2018. It has since been determined that
additional information will be required prior to the Division taking final action on your
application. These required items are summarized below:
1) As previously discussed, the riparian corridor depicted on the plan does not appear
to conform to the methodology for establishing corridors as described in 15A 07H
.0209(b)(6)(I): "The line of division of areas of riparian access shall be established
by drawing a line along the channel or deep water in front of the properties, then
drawing a line perpendicular to the line of the channel so that it intersects with the
shore at the point the upland property line meets the water's edge." Please verify
on the plans that the riparian lines have been established as described above.
Please also include the 15' setback lines on the plans.
2) Due to the revisions that have been made to the project, the adjacent riparian
property owners need to be notified. Additionally, it has come to our attention that
the property to the north is now owned by McMullan Properties, whose mailing
address is: 870 Old Canton Road, Marietta, GA 30068. The notification of adjacent
property owners should be sent Certified Mail- Return Receipt requested and
should include a copy of the application forms, narrative and plans. Notice should
also include instructions that the property owner should contact the Division of
Coastal Management (to my attention, with my contact info listed in the footer of
this letter) with any comments within 30 days and that no response will be
considered no objection.

3) . Please check the proposed dredge volume on the MP-2 form. The proposed
volume appears to be inconsistent with the dimensions given on the form.
Additionally, the name of the adjacent riparian property owner to the north should
be updated on the MP-1 form to reflect current ownership.
Therefore, it is necessary that processing of your permit application remain in abeyance in
accordance with 15A NCAC 07J.0204(d) until all items described above and in the 4/25/18 letter
have been addressed and either the adjacent property owners' 30-day comment period has
elapsed, or we are in receipt of their signed statements of no objection from both adjacent
property owners.

Thanks for your email. I am asking Rick to have their surveyor show how they determined the riparian lines so we can
get clarification and confirm whether they have been propel established. As for the dredge spoil offloading,_I have -.__-
spoken to Rick and he said they were initially exploring use of your ramp, but since they didn't work out an agreement
with you, they have made an alternate plan to offload onto Bonanza Group's property using the excavator.
And the attachments I mentioned in my last email were those that were attached to the email from Rick West.
As for vessels currently crossing the riparian line, l can say that our rules pertaining to the 15' setback and riparian
corridor only address the location of structures, notthat of the vessels.
Again, I've asked that the drawing be modified to better establish,the riparian lines the 15'setbacks, and once that is .
complete, I will have them send you a copy. If you let me know what else you feel is unclear from the information that
was provided to you, I will do my best to have them clarify that for you.
In the meantime, please let me know if you have any questions or if I can be of further assistance. I'm going to be out of
the office Monday morning, and will be in the Morehead City office Monday afternoon, out again in Brunswick County

Thanks Heather. I understand there is some confusion on this matter as I acquired the property after
-The only notice I have received is the one Rick sent me this past week which is the modification
request for me to sign off. Some time ago Rick gave.me a copy of his major application, but it is a
poorly legible copy and I am uncertain what l am looking at. I would appreciate a legible copy of the
entire application package.
-1 raised the disposal issue with you[and Sean] because it is my understanding that it was Bonanza's
plan to use my boat ramp as the site where.they offload the barge onto dump trucks. There is no
agreement in place with me to allow that and it will be necessary for there to be a formal agreement.
It is my understanding that establishing a disposal plan is a requirement of LAMA.
-Although I see on the plan modification the docks are kept outside the'15' riparian corridor, currently
their boats are protruding beyond their riparian area and across my property line. This issue will
'cause a problem once I develop my property.
-Comments regarding the site plan they presented to me:
*shouldn't it show the edge of the channel and channel centerline for the. existing 40' wide canal?
*shouldn't the riparian corridors start at MHW on the side property boundaries and extend out to the
channel centerline to intersect at 90degrees?
*shouldn't a 15' offset from this line be shown on the plan?

Hello Mr. McMullan,
We did ask that the Bonanza Group renotify you since the initially proposed project has been
modified since you were first notified. We currently have the project on hold pending resolution of
some issues with permitting that have come to light which required a redesign. The new proposal still
keeps the dock more than 15' from your shared riparian line, but would shift it landward a few feet in
order to meet our'% width rule. However, the majority of the changes to the plan are located on the
opposite side of the property. Please see the attachments in the email Mr. West sent you. If you have
any trouble opening them; let me know and I can try to resend them to you. We (DCM) just wanted to

be sire_yiu were notified of the change as your due process, in case the changes would be of any
concern to you. Mr. West should be mailing you hard copies as well.
As for your concerns regarding the spoil disposal, I did not receive any information about your
concerns from Sean, but the project narrative states they plan to use a long -reach excavator. to
transport the dredge spoil from the barge into a lined dump truck.

Dear Ms. Coats,
We have received the Adjacent Property Owner Waiver Form dated 5/25/18 from Mr. Rick
West, Agent for American Aquatics. It was received via email on 5/28/18 by our property
manager, CAM. We object to this proposal and we do not wish to waive any riparian access
setback requirement at this time.
Specifically, our objection is based on concern that the proposed project's request for a
major permit to dock more than 2 boats will diminish the value of our adjacent property
and negatively impact the usage, and navigation of the canal by all property owners within
the immediate vicinity.
To fit 3 separate slips, the proposal designates "slip 3" at the end of the dock closest to our
property line. The design would allow a boat to be tied up perpendicular to the shore and
parallel to our property line. A boat of any size docked in this slip would sit within the
setback and encroach on our property line potentially impacting access to our docking area
and our use of the water.
American Aquatics does not appear to have enough shoreline to justify the ability to
maintain 3 separate slips for boat docking without overcrowding and effecting canal
navigation and usage. Property owners with nearly identical canal frontage like the lot
directly across from 21 Causeway, Causeway, 32 The Peninsula, only have docking
capability for 2 boats. We are also concerned that this could set a precedent for property
owners with similar size canal frontage to expand their docking capabilities further
hampering overall usage.
We are happy to address any questions and concerns, and thank you for allowing us this
opportunity to voice our concerns.

project is located at 21 Causeway Drive in Ocean Isle Beach.
Areas of Environmental Concern (AFC's) impacted by the proposal are EW, CW and PT.
Waters at the project site are classified as SA; HQW and are not open to the harvesting of
shellfish. The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the Town of Ocean Isle Land Use Plan
and offer the following comments.
The general area of the project is classified Commercial, while the AECs impacted by the
work are classified as Commercial. In general, the Town of Ocean Isle Beach allows
development in Commercial classified AECs, which is consistent with the State's
minimum use standards. The Town of Ocean Isle Beach Land Use Plan contains some
policies, which exceed the State's minimum use standards. However, none of these
standards appear to be applicable to this proposal.
This project appears to be consistent with the Town of Ocean Isle Beach Land Use Plan.

The total area for the docking facility was calculated as follows: RE

Total = 476 square feet
It is the staff's recommendation to that the proposal to remove the existing docking structures and construct
a new commercial docking facility capable of accommodating up to 4 vessels appears CONSISTENT with the
Rules of 15A NCAC 71-1.0206 (d) Use Standards for Estuarine Waters, Rules of 15A NCAC 7H.0207 (d) Use
Standards for Public Trust Areas and the rules of 15 NCAC 7H.0208 (b) (6) Specific Use Standards for Piers and
Docking Facilities.
It is staffs recommendation that proposed excavation of the canal associated with the proposed new slips is
CONSISTENT with the Rules of 15A NCAC 7H .0208 (b) Specific Use Standards (1) which states Navigation
channels, canals and boat basins shall be aligned or located so as to avoid primary nursery areas, shellfish
beds, beds of submerged aquatic vegetation as defined by the MFC, or areas of coastal wetlands except as
otherwise allowed in this Subchapter. However, particular care should be taken during excavation to ensure
that material/spillage from the excavator is prevented from entering the wetlands as it is transported to the
truck stored on the high ground.
I have no objections to the proposed project. Any permit issued should include the standard major permit
conditions for piers and docking facilities and for excavation and fill.

Approval of 401 Water Quality Certification with Additional Conditions
Dear Mr. Montgomery,
You have our approval, in accordance with the attached conditions and those listed below, to
impact 0.034 acres (1,500 square feet) of open waters to perform maintenance dredging of a man-
made canal as described in your application received by the N.C. Division of Water Resources
(DWR) on February 15, 2018. After reviewing your application, we have decided that the impacts
are covered by General Water Quality Certification Number 4144 (GC4144).
In addition, you should obtain or otherwise comply with any other required federal, state or local
permits before you go ahead with your project including (but not limited to) Erosion and Sediment
Control, Non -discharge, and stormwater regulations. Also, this approval to proceed with your
proposed impacts or to conduct impacts to waters as depicted in your application shall expire upon
expiration of the 404 Permit. This Certification can also be found on line at:

This approval is for the purpose and design that you described in your application. If you change
your project, you must notify us and you may be required to send us a new application. If the
property is sold, the new owner must be given a copy of this Certification and approval letter and
is thereby responsible for complying with all conditions. If total fills for this project (now or in
the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may
be required as described in 15A NCAC 21-1.0506 (h). This approval requires you to follow the
conditions listed in the attached certification and any additional conditions listed below.
The Additional Conditions of the Certification are:
This approval is for the purpose and design described in your application. The plans and
specifications for this project are incorporated by reference as part of the Certification. If you
change your project, you must notify the Division and you may be required to submit a new
application package with the appropriate fee. If the property is sold, the new owner must be

with all conditions. Any new owner must notify the Division and request the Certification be
issued in their name {I 5A NCAC 02H .0501 and .0502}.
2. Any final construction plans for this project must include or reference the application and
plans approved by the Division under this authorization letter and certification. The
applicant will also be required to evaluate all acquired permits to assure that they are
consistent and all relative impacts are accounted for and shown on the construction plans.
[15A NCAC 02H .0502 (b) and 15A NCAC 02H .0506 (4)] The applicant shall require his
contractors (and/or agents) to comply with all of the terms of this Certification, and shall
provide each of its contractors (and/or agents) a copy of this Certification.
3. Turbidity Standard
The turbidity standard of 25 NTUs (Nephelometric Turbidity Units) shall not be
exceeded as described in 15 A NCAC 213 .0220. Appropriate sediment and erosion
control practices must be used to meet this standard. Turbidity curtains shall be used as
appropriate. Please notify this Office if any turbidity issues arise at 910.796.7215
4. This General Certification shall expire on the same day as the expiration date of the
corresponding General Permit. The conditions in effect on the date of issuance of the
Certification for a specific project shall remain in effect for the life of the project,
regardless of the expiration of this Certification.
The permittee shall require its contractors and/or agents to comply with the terms of this
permit in the construction and maintenance of this project, and shall provide each of its
contractors and/or agents associated with the construction or maintenance of this project a
copy of this certification. A copy of this certification including all conditions shall be
available at the project site during the construction and maintenance of this project. [15A
NCAC 021-1.0507 (c) and 15A NCAC 02H .0506 (b)(2) and (c)(2)]
6. Continuing Compliance:
The applicant/pertnittee and their authorized agents shall conduct all activities in a
manner consistent with State water quality standards (including any requirements
resulting from compliance with 303(d) of the Clean Water Act), and any other
appropriate requirements of State and Federal law. If the Division determines that such
standards or laws are not being met, including failure to sustain a designated or achieved
use, or that State or Federal law is being violated, or that further conditions are necessary
to assure compliance, than the Division may reevaluate and modify this General Water
Quality Certification. [ 15A NCAC 02H .0507(d)]

All mechanized equipment operated near surface waters or wetlands will be regularly
inspected and maintained to prevent contamination of waters and wetlands from fuels,
lubricants, hydraulic fluids or other potential toxic chemicals. In the event of a
hydrocarbon or chemical spill, the permittee/contractor shall immediately contact the
Division of Water Quality, between the hours of 8 am to 5 pm at the Wilmington
Regional Office at 910.796.7215 and after hours and on weekends call [phone].
Management of such spills shall comply with provisions of the North Carolina Oil
Pollution and Hazardous Substances Control Act. [15A NCAC 02H .0506 (b)(3) and
(c)(3), 15A NCAC 02B .0200 (3)(f), and GS 143 Article 21A].
8. Fueling, lubrication and general equipment maintenance should not take place within 50
feet of a waterbody or wetlands to prevent contamination by fuel and oils. [15A NCAC
02H .0506 (b)(3) and (c)(3)-and 15A NCAC 02B .0200 (3)(f)].
9. This certification grants permission to the director, an authorized representative of the
Director, or DEQ staff, upon the presentation of proper credentials, to enter the property
during normal business hours 15A NCAC 02H.0502(e).
10. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or
applicable Buffer Rules, and any subsequent modifications, the applicant and/or
authorized agent is required to return a completed certificate of completion form to the
NCDEQ DWR 401 and Buffers Unit North Carolina Division of Water Resources, 1617
Mail Service Center, Raleigh, NC, 27699 within ten days of project completion. The
certification of completion is available at:

Violations of any condition herein set forth may result in revocation of this Certification
and may result in criminal and/or civil penalties. The authorization to proceed with your
proposed impacts or to conduct impacts to waters as depicted in your application and as
authorized by this Certification shall expire upon expiration of the 404 or CAMA Permit.
This approval and its conditions are final and binding unless contested.
This Certification can be contested as provided in Articles 3 and 4 of General Statute 150B by
filing a written petition for an administrative hearing to the Office of Administrative Hearings
(hereby known as OAH). A petition form may be obtained from the OAH at
httn://www.ncoah.com/ or by calling the OAH Clerk's Office at [phone] for
information. Within sixty (60) calendar days of receipt of this notice, a petition must be filed
with the OAH. A petition is considered filed when the original and, one (1) copy along with any

PROJECT DESCRIPTION:

The project site is located at 21 Causeway Drive, adjacent to a man-made canal, in the Town of Ocean Isle Beach,
Brunswick County. To find the project site, travel south on US Highway 17 to Ocean Isle Beach Road SW. Turn left
onto Ocean Isle Beach Road SW and travel approximately 4 miles to the Ocean Isle Beach high rise bridge. Cross the
bridge and continue along Causeway Dr. approximately 0.25 miles. The project site will be located on the left-hand
side of the road.
The lot is approximately 0.24 acres with approximately 107' of shoreline frontage. The lot averages 4.0' above
Normal High Water (NHW) and the shoreline has been stabilized with an existing vinyl bulkhead. The applicant
maintains a commercial building with parking on the high ground. The high ground vegetation consists primarily of
lawn grass and ornamental landscaping. LAMA Minor Permit # 17-49 was recently issued by the Town of Ocean Isle
Beach for the construction of a new deck measuring approximately 16'x 24' within the 75' Coastal Shoreline AEC, of
which approximately 144 sq. ft. is located within the 30' Coastal Shoreline buffer. Coastal Wetlands are present
waterward of the existing bulkhead and consist primarily of Smooth Cord Grass (Sporting alternifloro). The Coastal
Wetlands range in width from approximately 20' near the northern property boundary to approximately 5' in width
near the southern property boundary and NHW meets the face of the bulkhead. An existing docking facility extends
east from the bulkhead which consists of a 30' long by 4' wide fixed pier connected via access ramp to an existing 8'
wide by 60' long floating dock which runs parallel to the shoreline. The existing floating dock is located
approximately 20' waterward of the edge of marsh vegetation and allows for the dockage of two (2) vessels on the
waterward side. A boatlift measuring 14' wide by 14' long is located on the southern end of the existing floating dock.
Water depths adjacent to the existing floating dock in the area of the existing slips ranges from approximately -2.5 to
-3.0' at Mean Low Water (MLW) (see Sheet No. 2A of 5).
The Town of Ocean Isle Beach Land Use Plan classifies the adjacent high ground portion of the project area as
Commercial. The waters of the man-made canal are classified SA; HQW by the Division of Water Resources. They are
NOT designated as a Primary Nursery Area by the N.C. Division of Marine Fisheries and they are CLOSED to the
harvest of shellfish. There are no known archaeological resources within the project vicinity.
10. PROPOSED PROJECT:
The applicant proposes to remove the existing docking facility structures and construct a new commercial
docking facility with associated excavation of an existing canal. The dimensions of the proposed area of
excavation would be approximately 90' in length and would range from approximately 5' in width on the north
side of the project area to approximately 26' in width on the south side of the project area (see Sheet No. 26 of
5). The proposed boat basin would have a final project depth of -6' at MLW and would tie into the existing water
depths within the adjacent man-made canal. As proposed, the applicant would maintain a 10' buffer from the
coastal wetland vegetation. Excavation of the basin would be accomplished by using a long reach excavator on a
floating barge. The applicant is proposing to use a separate long reach excavator located on the high ground to
transfer the spoils from the floating barge to dump trucks. As stated in the applicant's narrative, a tarp would be
secured temporarily over the wetlands to catch any spoils that may fall off the bucket of the excavator. The
applicant states that the excavated material would then be transported offsite location to the Ike Williamson
disposal facility located at 5399 Oak Tree Lane in Ocean Isle Beach, Brunswick County. The fill would be used to
continue to fill in an existing borrow pit on the property measuring approximately 25,000 sq. ft. in area.
Authorization from the property owner of record, Mr. Williamson, has been provided authorizing the spoil
disposal at this location.

The applicant is proposing to remove the existing 8' in width by 60' in length floating dock and 44o i4i?)access
pier and ramp. The proposed new docking facility would consist of two separate access points located off a
proposed 4' in width by 50' in length boardwalk which would be constructed on the high ground adjacent to the
existing bulkhead within the 30' Coastal Shoreline buffer. The proposed connecting ramp access on the north
side of the property would lead down to a L-shaped floating dock measuring approximately 6' in width by 10' in
length perpendicular to the canal and approximately 8' in width by 32' in length parallel with the canal. The 8' x
32' proposed floating dock would allow for dockage only on the waterward side, accommodating Slip #4. The
applicant is proposing a second access ramp located of the south side bulkhead that would lead to a floating
dock measuring approximately 8' in width by 20' in length oriented perpendicular to the canal. As proposed, the
south side of this proposed floating dock would be designated as Slip # 1. Two tie pilings are proposed centered
between the two floating docks to accommodate proposed Slips # 2 and # 3 (see Sheet No. 2B of 5). The
proposed floating docks would be located a maximum of approximately 24' waterward of the edge of marsh
vegetation, in alignment with the adjacent docking facility to the south, Captain's Landing. This distance does not
appear to exceed the width distance of the canal which measures approximately 95' to 100' in width.
According to (Sheet No. 4 of 5), the proposed floating dock would not encroach into the OIB dredge channel,
which is located approximately 30' waterward of the edge of marsh vegetation. There are no proposed
encroachments into either adjacent 15' Riparian Corridor Setback. Existing water depths in the proposed area of
excavation and dockage range from 0' to -4' at MLW (see Sheet No. 2A of 5).
11. ANTICIPATED IMPACTS:
The proposed area of excavation would result in the disturbance of approximately 1,500 square feet of shallow
bottom. According to the application, approximately 250 cubic yards of spoil material would be excavated from
below MHW. The final project depth would be -6' at MLW and would conned to the existing depths of the
dredged channel. The spoil disposal area would result in approximately 25,000 square feet of disturbance at the
existing borrow pit disposal site. Short term increases in turbidity can be expected during dredging activity. The
excavation of the basin by mechanical means will create steep side slopes and subsequent sloughing, thereby
increasing the top width dimensions of the proposed project. As proposed, the applicant would maintain a 10'
buffer from the existing coastal wetlands to prevent disturbance to the areas resulting from sloughing. The
proposed use of long reach excavator to transfer spoils from the floating barge to a truck located on high ground
could result in material being deposited in the Coastal Wetlands. The applicant has proposed to string a
temporary tarp over the Coastal Wetlands to help prevent any inadvertent impacts to the Coastal Wetlands
during construction. The proposed docking facility would incorporate approximately 476 square feet of Estuarine
and Public Trust Waters Areas of Environmental Concern. As proposed, the docking facility would provide
mooring for four (4) vessels.

The Division of Coastal Management hereby acknowledges receipt of your CAMA Major Permit application, acting as agent
for The Bonanza Group, for State approval for development of the property located at 21 Causeway Dr., Ocean Isle Beach, adjacent
to a manmade canal contiguous with the AIW W in Brunswick County. The application was received as complete on February 13,
2018, and appears to be adequate for processing at this time. The projected deadline for making a decision is April 29, 2018. An
additional 75-day review period is provided by law when such time is necessary to complete the review. If you have not been
notified of a final action by the initial deadline stated above, you should consider the review period extended. Under those
circumstances, this letter will serve as your notice of an extended review. However, an additional letter will be provided on or about
the 75th day.
If this agency does not render a permit decision within 70 days from February 13, 2018, you may request a meeting
with the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a meeting
will be held within five working days from the receipt of your written request and shall include the property owner, developer,
and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development. Enclosed
you will find a 'Notice of Permit Filing" postcard which must be posted at the property of your proposed development. You should
post this notice at a conspicuous point along your property where it can be observed from a public road. Some examples would be:
Nailing the notice card to a telephone pole or tree along the road right-of-way fronting your property, or at a point along the road
right-of-way where a private road would lead one into your property. Failure to post this notice could result in an incomplete
application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the appropriate State
or Federal agency. Please contact me if you have any questions and notify me in writing if you wish to receive a copy of my field
report and/or comments from reviewing agencies.

Areas of Environmental Concern designated under the CAMA: On February 12, 2018, Jerry
Lowery proposed to install a boathouse at 124 Bell Pointe Rd., adjacent to Hobart
Justice Canal, in Sneads Ferry, Onslow County; and on February 13, 2018, The Bonanza
Group proposed to remove an existing docking facility and construct a new commercial
docking facility with associated excavation at 21 Causeway Dr., adjacent to a man-made
canal in Ocean Isle Beach, Brunswick County. Copies of these applications can be examined

SUBJECT: Coastal Area Management Act (CAMA) Permit Application Submittal for

Dear Mr. West:
This letter is in response to the above referenced CAMA permit application, which was accepted
as complete by the Division's Wilmington office on February 13, 2018. Processing of the
application is ongoing. However, it has been determined that additional information will be
required prior to the Division taking final action on your application. These required items are
summarized below:
1) The dimensions provided for the proposed L-shape dock in the narrative are
inconsistent with those given on the MP-4 form and on the plans. Additionally, the
plans are not accurately drawn to scale, and it cannot be confirmed whether the
proposed work would meet the '/4 width of the waterbody requirement. Please
submit a revised plan that accurately depicts existing and proposed conditions,
including accurate widths of the waterbody and marsh vegetation across the
property and accurate dimensions and locations of all proposed development.
Please ensure the channel width and location and the proposed dredging
dimensions are also accurately depicted on the plan relative to the proposed work
and the marsh vegetation. Please also provide clarification of the anticipated
lengths of the vessels utilizing Slips 1-3 and the anticipated boat beam width for
Slip 4 so the potential impacts to navigation can be better established. Please also
note that the L-shape floating dock is shown on the plans as being partially located
within the 15' setback to the north and that all structures in their entirety will need
to be located outside of the 15' setbacks.
2) The adjacent property owner (Captains Landing COA, Inc.) has expressed
concerns regarding the project's impact to navigation. It is requested that you also
provide a response to the concerns outlined in the attached letter.

Therefore, it is necessary that processing of your permit application be placed in abeyance until
such time as you have submitted accurate plans and addressed these concerns. If you can provide
to this office with the requested information within five working days from the date of this letter,
DCM staff will continue processing of the application and the processing clock will not be
suspended. If the required information is not received in this office within the specified
timeframe, processing of the application will be suspended in accordance with 15A NCAC
07J.0204(d) until such time as the requested information is provided.
Additional time is also needed for this office to complete the review and make a decision on your
request. Therefore, it is necessary that the standard review time be extended. An additional 75
days is provided by G.S. 113A-122(c). However, we expect to take action prior to that time and
will do so as soon as possible.
