This permit, issued on October 3i, 2018 is subject to compliance with the application (where consistent
with the permit), all applicable regulations; special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause me permu io oe aua anu voiu.
Docking & Access Facilities
1) Except as altered herein, this permit authorizes only the docks, piers, and other structures and uses
located in or over the water that are expressly and specifically set forth in the permit application. No
other structures, whether floating or stationary, shall become a permanent part of the docking &
access facilities without permit modification. No non -water dependent uses of structures shall be
conducted on, in or over Public Trust waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced
throughout the entire existence of the permitted structures.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2021
in issuing this permit; the State of North Carolina agrees that
your project is consistent with the.North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
3) In accordance with commitments made by the permittee,. and in order to, comply with the City of
Wilmington's Land Development Code, this permit does not authorize any new structures exceeding 6'
in width. As such, the proposed 16' by 16' gazebo and associated stepdown on the AIW W facility is not
authorized.

4) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
5) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structures in order to make them more visible during hours of darkness j
or inclement weather.
6) This permit authorizes a,maximum of 2 formalized boat slips associated with the Cedar Island Basin
docking facility.
7) The piers shall have a minimum setback distance of 15 feet between any parts of the structures and the
adjacent property owners' riparian access corridors.
8) This permit does not authorize any tie pilings associated with the authorized structures.
9) No portion of the authorized facilities shall extend past the alignment depicted on the plans.
10) Any portion of the permitted access piers built over Coastal Wetlands shall not exceed six feet in width .
and shall be elevated a minimum of three feet over the wetland substrate as measured from the bottom of
the decking.
11) No attempt shall be made. by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
12) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with
T15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation
within the PNA shall be permitted. New dredging in any manner, including "kicking" with boat
propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire
existence of the permitted structures.
General
13) The pernuttee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
14) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.

15) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structures or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
16) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized. within 30 feet of the normal high water level.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of General Permit
197800056 (Action ID No. SAW-2017-01054), which was issued on 7/27/17.
NOTE: The N.C. Division of Water Resources assigned the proposed project DWR Project No. 2017-
0892.
NOTE: An application processing fee of $250 was received by DCM for this project.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where
applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -colored
form) is retained by you and it must be available on site when the project is inspected for compliance. Please sign
both the gold original and the white copy and return the white copy to this office in the enclosed envelope. Signing
the permit and proceeding means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-
121.1 or 113-229..Your petition for a hearing must be filed in accordance with NCGS Chapter 1508 with the Office
of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20)
days of this decision on your permit. You should also be aware that another qualified party may submit an
objection to the issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be
carried out in accordance with your application. Modifications, time extensions, and future maintenance requires
additional approval: Please read your permit carefully prior to starting work and review all project plans, as
approved'. If you plan to have the work done by a contractor, it would be to your benefit to be sure that he fully
understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request
that you complete and mail the yellow Notice Card just prior to work initiation. However, if questions arise
concerning permit conditions, environmental safeguards, or problem areas, you may contact Department
personnel at any time for assistance. By working in accordance with the permit, you will be helping to protect our

Recommendations for State Permit — Timothy and Lisa Bodeman 7/13/2017
The total area of platform was calculated as follows:
Shoreline length = 346' x 8 sq. ft. = 2000 sq. ft. maximum allowable
Proposed gazebo (AIWW) = 16' x 16' = 256 sq. ft.
Proposed step down (AIWW) = 16' x 4' = 64 sq. ft.
Existing floating dock (basin) = 30' x 8' = 240 sq. ft.
Total = 560 sq. ft.
It appears that the project is CONSISTENT with the use standards set forth in NCAC 07H
.0208(b)(6), including the eight -square foot rule, the quarter width Wile, and would not encroach
into the 15' adjacent riparian corridor setback requirement. The proposed facility would meet the
80' AIWW setback. This office has no objection to the proposed work, provided it is consistent
with all other state and federal permitting requirements. In the absence of any concerns from the
commenting agencies, it is recommended that a permit be issued subject to the standard
conditions for private docking facilities.

This project is consistent with the 2006 Wilmington -New Hanover County Joint
Land Use Plan Update.
The applicant proposes to construct an observation pier on the AIWW and a new access
pier for a docking facility in the Cedar Island Basin. The project is located at 2 Cedar
Island, adjacent to the AIWW and Masonboro Sound in Wilmington, New Hanover
County.
Areas of Environmental Concern (AEC's) impacted by the proposal are EW and PT.
Waters at the project site are classified as SA-ORW and are open to the harvesting of
shellfish. The area is a Primary Nursery Area.
I have reviewed this proposal for consistency with the 2006 Wilmington -New Hanover
County CAMA Land Use Plan and offer the following comments.
The general area of the project is classified as Residential/Conservation.
In general, Wilmington -New Hanover County allows development in Residential and
Conservation classified AECs, which is consistent with the State's minimum use
standards. The Wilmington -New Hanover County Land Use Plan contains some policies,
which exceed the State's minimum use standards, however none of these policies are
applicable to this project.
This project appears to be consistent with the 2006 Wilmington -New Hanover
County Joint Land Use Plan Update.

Dear Mr. Shirley:
Through coordination with the North Carolina Division of Coastal Management, and on
behalf of Timothy and Lisa Bodeman, we have learned of your request to construct an
observation platform into the AIW W, and to replace an access pier at an existing docking facility
into the Cedar Island Basin, at 2 Cedar Island, in Wilmington, New Hanover County, North
Carolina. Coordinates are: 34.18807 N,-77.83206 W.
On January 1, 2017, we renewed General (Regional) Permit No. 197800056, (copy
enclosed), that authorizes the maintenance, repair, construction and installation of piers, docks,
boathouses and boat shelters, mooring piles, dolphins, jetties and breakwater structures in
navigable waters of the United States in the State of North Carolina pursuant to Section 10 of the
Rivers and Harbors Act of 1899. General Permit No. 197800056 expires December 31, 2021.
Your work is authorized provided it is accomplished in strict accordance with your
submitted plans, the enclosed general and special conditions.
Please read the enclosed permit to prevent an unintentional violation of Federal law. As
this Department of the Army regional general permit does not relieve you of the responsibility to
obtain any other required approvals, you should contact appropriate State and local agencies
before beginning work.

Dear Mr. Shirley:
This letter is in response to the above referenced CAMA permit application, which was accepted
as complete by the Division's Wilmington office on July 12, 2017. Processing of the application
is ongoing. However, it has been determined that additional information will be required prior to
the Division taking final action on your application. These required items are summarized
below:
1) Adequate proof of notification has not been submitted for the two adjacent riparian
property owners along the AIWW. Please submit green cards showing proof of
notification of these property owners, signed statements of no objection. If the
certified mail was unclaimed and a green card was not returned to you, please
submit proof that the notification was sent to the correct mailing address, or
renotify the adjacent property owner via Certified Mail -Return Receipt Requested.
If you can provide to this office the green cards and/or signed statement(s) of no objection within
five working days from the date of this letter, DCM staff will continue processing of the
application and the processing clock will not be suspended. If the required information is not
received in this office within the specified timeframe, processing of the application will be
suspended in accordance with 15A NCAC 07J.0204(d) until such time as the requested
information is provided and the adjacent property owner's 30-day comment period has elapsed.

Dear Sir:
This letter is in response to your application request as acting agent for Timothy and Lisa '
Bodeman under the Coastal Area Management Act (CAMA) to construct a new access pier on
the AIW W and reconstruct a pier in the Cedar Island basin adjacent to the subject property in
New Hanover County. On September 15, 2017, processing of your application was placed on
hold pending receipt of adjacent riparian property owner notifications and resolution of issues
related to the City of Wilmington's Land Development Code. This. office received the adjacent
riparian property owner notifications on September 20, 2017 and the application remained on.
hold to allow for discussions with the City. This office received communication on October 18,
2018 thatyou wished to condition out the portions of the project that do not currently meet the
local City of Wilmington's ordinances. Therefore, processing of your permit application has
officially resumed as of that date, and the 75 day deadline would have been October A, 2018.
Although processing of the application is nearing completion, additional time is needed for this .
office to complete the review and make a decision on your request. Therefore, it is necessary that
the standard review time be extended. An additional 75 days is provided by G.S. 113A-122(c)
which would make January 11, 2019, the. new deadline for reaching a decision on your request.
However, we expect to take action prior to that time and will do so as soon as possible.

9. PROJECT DESCRIPTION:
The project site is located at 2 Cedar Island, adjacent to the AIWW/Masonboro Sound located in the
City of Wilmington, New Hanover County. To locate the property from Oleander Dr. (NC Highway17),
turn onto Greenville Loop Road and travel approximately 0.8 miles. Turn left onto Old Military Road
and travel approximately 0.5 miles east and the property of interest will be an undeveloped lot on the left
side of the road.
The lot is approximately 5 acres with approximately 275' of shoreline frontage on the AIWW and
approximately 71' of shoreline frontage on the Cedar Island Basin. The lot averages approximately 7'
above normal high water level. The lot is currently undeveloped. Highground vegetation consists of
lawn grasses and native trees/shrubs including Live Oak and various pine species. Waterward of the
upland vegetation is an area of high marsh approximately 30' wide, consisting of mixed coastal wetlands
and "404 type" vegetation, including: Salt Meadow Grass (Spartina patens) and Sea Ox-eye (Borrichia
frutescens). The property transitions from high marsh to low marsh in an area approximately 370' wide
extending to the AIWW. This area primarily consists of Smooth Cordgrass (Spartina alternii fora).
There is a remnant/dilapidated pier extending from the shoreline to the AIWW that is approximately
422' in length. No permit could be located for that facility. There is an access pier and floating dock
extending into the cedar island basin with a shoreline stabilized by a timber bulkhead and an existing
concrete boat ramp. The access pier is approximately 30' in length by 6' in width and the floating dock
is approximately 30' in length and 8' in width and was authorized by GP #46143 issued on 11/21/2006.
The docking facility extends from the most western portion of the property in a westerly direction
perpendicular into the Cedar Island Basin.
The Wilmington/New Hanover County Land Use Plan classifies the adjacent waters as Conservation,
and the adjacent high ground portion of the project area as Resource Protection. The waters of the
AIWW and Masonboro Sound are classified SA-ORW by the Division of Water Resources. They are
designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are
OPEN to the harvest of shellfish.

The applicant proposes to construct an observation pier on the AIWW and a new access pier for a
docking facility in the Cedar Island Basin. The observation pier would extend from the existing high
ground area on the AIWW shoreline approximately 450' and would end in a gazebo measuring 16' in
length by 16' in width over open water. A 4' wide by 16' long stepdown would be constructed along the
northern edge of the gazebo (see Sheet 7 of 8). The water depth at the waterward end of the pier would
be -4' at NLW and no slips are proposed (see Sheet 8 of 8). The water body measures 645' in width and
the pier would extend approximately 78' beyond the waterward edge of the Coastal Wetlands, which
would conform to the '/. width rule. The structure would be approximately 46' landward of the USACE
AIWW setback.
On the Cedar Island Basin docking facility, a new access pier measuring 6' in width by 36' in length
would be constructed to access the existing 2 slip docking facility (see Sheet 3 of 8). No changes are
proposed to the existing bulkhead, boat ramp, or floating dock. RECEIVED

10. ANTICIPATED IMPACTS
The proposed pier system construction would incorporate 2,924 sq. ft. of Estuarine Waters and Pubic
Trust Area and would shade approximately 1,362 sq. ft. of Coastal Wetlands, vegetated primarily with
Smooth Cordgrass (Spartina alternii fora). The proposed pier would extend approximately 78' into a
waterbody, which measures approximately 645' across. This distance would conform with the 1/4 width
rule and the established pier lengths. As proposed, the applicant's proposal would not encroach into the
80-foot setback from the AIW W. The new access pier on the Cedar Island Basin would impact
approximately 36 additional sq. ft. of high ground and the remaining 180 sq. ft. would occupy an area
currently usurped by the existing access pier. Minor increases in turbidity should be expected during
construction.

To whom it may concern,
On behalf of Mr. & Mrs. Tim Bodeman at 2 Cedar Island, we are applying for
a CAMA Major Permit to construct a new dock facility on the ICWW and to modify
their existing dock facility in Cedar Island Basin. Their existing dock facility on the
ICWW was destroyed during Hurricane Matthew (2016) and now stands in total
disrepair. We are proposing to completely remove and dispose of all components of
the damaged facility and then to rebuild in the same footprint as the existing in order
to reduce impacts to the adjacent coastal wetlands. The proposed new dock facility
on the ICWW is not intended to serve as a formalized docking facility; but, to serve
as access to the ICWW for recreation - fishing, swimming, kayaks, & paddleboards.
Also, we are proposing to repair and modify their existing dock facility inside
Cedar Island Basin. The existing fixed portion of the dock facility is in need of re -
framing and re -decking. We are also proposing to extend the 6' access pier by 16'
towards the upland side in order to eliminate the current ramped access. The new 6'
access pier would be level for easier access.

The Division of Coastal Management hereby acknowledges receipt of your application, as acting agent for Timothy
and Lisa Bodeman, for State approval for development of the subject property located at 2 Cedar Island, adjacent to
the Atlantic Intracoastal Waterway and Masonboro Sound, in Wilmington, New Hanover County. It was received as
complete on July 12, 2017 and appears to be adequate for processing at this time. The projected deadline for making
a decision is September 25, 2017. An additional 75-day review period is provided by law when such time is
necessary to complete the review. If you have not been notified of a final action by the initial deadline stated above,
you should consider the review period extended. Under those circumstances, this letter will serve as your notice of
an extended review. However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from July 12, 2017, you may request a meeting with
the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a
meeting will be held within five working days from the receipt of your written request and shall include the property
owner, developer, and project designer/consultant.
NCGS I I3A-119(b) requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from
a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property; or at a point along the road right-of-way where a private road would lead one into your
property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the appropriate
State or Federal agency. Please contact me if you have any questions and notify me in writing if you wish to receive
a copy of my field report and/or comments from reviewing agencies.

The Department of Environmental Quality hereby gives public notice as required by
NCGS 113A-119(b) that the following applications were submitted for development permits in
Areas of Environmental Concern as designated under the CAMA: On July 12, 2017, Timothy
and Lisa Bodeman proposed to construct an observation pier on the AIWW, and replace an
access pier into the Cedar Island Basin, tit 2 Cedar Island, in Wilmington, New Hanover
County, and on July 13, 2017, Middle Island POA proposed to replace a community
docking facility and boat ramp at the end of Cape Creek Rd., adjacent to Cape Creek /
AIWW, on Bald Head Island, in Brunswick County. Copies of the applications can be
examined or copied at the office of Courtney Spears (Bodeman), or Tara MacPherson (Middle
Point), N.C. Dept. of Environmental Quality, Division of Coastal Management, 127 Cardinal
Drive Ext., Wilmington, NC 28405, (910-796-7215) during normal business hours.
Comments mailed to Braxton C. Davis, Director, Division of Coastal Management, 400
Commerce Avenue, Morehead City, NC 28557-3421, prior to August 10, 2017 will be
