Authorizing development in Carteret County at within Bogue Sound. at 253 Bell Street. in
Cedar Point as requested in the permittee's application dated 1/23/18, including
attached workplan drawings (3), Sheets 1-3 of 3, all dated 1/23/18.
This permit, issued on April 5, 2018 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
ri mese terms may oe subject to noes, imprisonment or civil action; or may cause the permit to be null and void.
Docking Facility Expansion
1) This permit authorizes only the boatlift addition, and uses located in or over the water that are
expressly and specifically set forth in the permit application. No other structure, whether floating or
stationary, shall become a permanent part of this docking facility without permit modification. No
non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without
permit modification.
2) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the
U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum,
permanent reflectors shall be attached to the structure in order to make it more visible during hours of
darkness or inclement weather.

This permit action may be appealed by the pernmittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance. .
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2021
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

This permit authorizes an additional formalized boat slip, for a maximum of 3 formalized boat slips.
Should the lot to the east be sold prior to the initiation of the docking facility expansion, or sold prior to
the commencement of the docking facility expansion, the pernttee shall obtain a written agreement
from the new owner of the Lot to the east, waiving the 15 foot riparian corridor setback and submit it to
the Division of Coastal Management prior to initiating construction of the docking facility expansion.
General
This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the
permitted activity without having it transferred to a third parry.
The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
E; This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
The U.S. Army Corps of Engineers authorized the project by way of Nationwide Permit
197800056 (Action ID SAW-2018-00355) issued 3/20/18.
The N.C. Division of Water Resources assigned the project DWR Project No. 2018-0288.
E:' ' Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 808-2808 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.
An application processing fee of $250 was received by DCM for this project.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and
where applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The
original (buff -colored form) is retained by you and it must be available on site when the project is
inspected for compliance. Please sign both the original and the copy and return the copy to this office in
the enclosed envelope. Signing the permit and proceeding means you have waived your right of appeal
described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS
113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter
150B with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714,
(919) 733-2698 within twenty (20) days of this decision on your permit. You should also be aware that
another qualified party may submit an objection to the issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work
must be carried out in accordance with your application. Modifications, time extensions, and future
maintenance requires additional approval. Please read your permit carefully prior to starting work and
review all project plans, as approved. If you are having the work done by a contractor, it would be to your
benefit to be sure that he fully understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we
request that you complete and mail the enclosed Notice Card just prior to work initiation. However, if
questions arise concerning permit conditions, environmental safeguards, or problem areas, you may
contact Department personnel at any time for assistance. By working in accordance with the permit, you
will be helping to protect our vitally important coastal resources.

8. PROJECT SUMMARY: The applicant is proposing to install a ' boatlift on an
existing dock in order to add a third slip.

9. NARRATIVE DESCRIPTION: The Baysden project is located at 253 Bell St. in Cedar
Point on Bogue Sound in Carteret County. Bell St. extends South off of Hwy. 24 in Cedar
Point. Mr. Baysden's lot is at the terminus of Bell St.
The parcel is 16,376ft2 in its entirety and has 78.69' of shoreline. Existing onsite is a
single family residence, bulkhead and a two slip dock. Similar residences exist on either
side of the property.
The Shoreline contains no coastal or Section 404 Wetlands, as the entirety of its shoreline
is stabilized by bulkhead. The width of Bogue Sound at this point is approximately 500'.
The AIWW passes directly offshore of the site. The subaqueous substrates along the
shoreline are predominately sand and silt.
The Division of Water Resources classifies this area of Bogue Sound as SA-ORW waters.
This is not a Primary Nursery Area. This portion of Bogue Sound is open to harvesting
shellfish. There are no SAV's surrounding this dock. The parcel is classified in the Cedar
Point LUP as Existing Core Area.
10. PROJECT DESCRIPTION: The applicant is proposing to construct a ' boatlift on
an existing two slip dock. There would be a total of 3 slips at this docking facility. No
additional platform area would be constructed. Water depths in this area range from -2' to
-6' at Mean Low Water. The proposed lift would encroach into the easternmost 15' riparian
setback. A waiver has been obtained from this property owner. The entire docking facility
will be 110' from the AIWW setback.
11. ANTICIPATED IMPACTS: The proposed boatlift would create a total of three slips at
this docking facility. An additional 169ft2 of Public Trust Area would be incorporated.
Temporary turbidity could occur during setting of pilings.

Consistency Determination: The request is consistent with/not in conflict with the 2012 Town of
Cedar Point Land Use Plan certified by the CRC on February 7, 2013.
Overview: The applicant is proposing to install a 13' x 13' boatlift on an existing dock in order to
add a third slip at 253 Bell St., Cedar Point, Carteret County, North Carolina. The parcel is 16,376ft2
and has 78.69' of shoreline. Existing site improvements include a single-family home, dock, and
bulkhead.
The project is in Estuarine Waters (EW) and Public Trust Area (PTA) Areas of Environmental
Concern (AEC). The project is located on Bogue Sound, whose width at the site is approximately
500'. The AIWW passes directly offshore of the site. The waters of Bogue Sound at the site are
classified as SA/ORW, are open to the taking of shellfish, and is not designated as a Primary Nursery
Area. There is no SAV surrounding the existing dock, and the shoreline contains no Coastal or
Section 404 Wetlands. 1,050'shoreline is stabilized by bulkheads and contains no coastal orSection
404 Wetlands.
Anticipated impacts: The proposed boatlift would create a total of three (3) slips at this docking
facility. An additional 169ft2 of PTA would be incorporated. Temporary turbidity could occur during
pile driving. The proposed boat lift would encroach into the easternmost 15' riparian setback. A
waiver has been obtained from this property owner. The entire docking facility will be 110' from
the AIWW setback.
Basis for Determination:
The project site is in the Town of Cedar Point and is subject to the town's 2012 Land Use Plan. The
Future Land Use Map (FLUM) designates the site as "Existing Core Area" with subject AECs defined
as "Conservation and Open Space".
Land Use Policies: The LUP does not contain any policies applicable to this request.

bbatlifton an existing dock in order to add a third (3`d) slip at253 Bell Street, adjacent to Cedar
Point Beach, in Cedar Point, Carteret County; North Carolina. Coordinates are: 34.6731 N,
-77.0900 W.
Your proposal continues to be consistent with the provisions and objectives of general
permit No. 197800056 (copy enclosed) for construction activities that receive authorization from
the State of North Carolina. Therefore, you may commence construction activity in strict
accordance with applicable State authorization, attached Federal special conditions, Guidelines.
for Avoiding.Impacts to the West -Indian Manatee; and the approved plan. Failure to comply
with the State authorization or conditions of the Federal permit could result in civiband/or
administrative penalties.
If any change in your work is required because of unforeseen or altered conditions or for
any other reason, plans revised to show the change must be sent promptly to this office and the
North Carolina Division of Coastal Management prior to performing any such change or
alteration. Such action is necessary as revised plans must be reviewed and the authorization
modified. Your Department of the Army permit will expire on December 31, 2021,

The NC Division of Coastal Management hereby acknowledges receipt of your application for State
approval for development in the New River. The complete package was received on 2/20/18. The
projected deadline for making a decision is 5/4/18. An additional 75-day review period is provided by law
when such time is necessary to complete the review. If you have not been notified of a final action by the
initial deadline stated above, you should consider the review period extended. Under those circumstances,
this letter will serve as your notice of an extended review. However, an additional letter will be provided
on or about the 75th day.
If this agency does not render a permit decision within 70 days from 2/20/ 18, you may request a meeting
with the Director of the Division of Coastal Management and permit staff to discuss the status of your
project. Such a meeting will be held within five working days from the receipt of your written request and
shall include the property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing postcard which must be posted at the
property of your proposed development. You should post this notice at a conspicuous point along your
property where it can be observed from a public road. Some examples would be: Nailing the notice card
to a telephone pole or tree along the road right-of-way fronting your property, or at a point along the road
right-of-way where a private road would lead one into your property. Failure to post this notice could
result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the
appropriate State or Federal agency. Please contact me if you have any questions and notify me in
writing if you wish to receive a copy of my field report and/or comments from reviewing agencies.
