Upland Development
1) Unless specifically alte;ed herein, this permit authorizes: the grading and other land disturbing
activities associated with the development of the above refeienoed,property, including the homesite,
driveway, bridge, and other_associatediifrastructtire, all as expressly and specifically set forth in the
attached permit application and workplan drawings.
2) The authorized -bridge shall be elevated a minimum of 6' abovenormal.Iugh water level when
crossing. any ofthe three depicted canals.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date:

Any maintenance work or project modification not covered

ADDITIONAL CONDITIONS
Wooden Access Bridge
3) The wooden access bridge shall be built as depicted on the attached workplan drawin s. AUG Z 2o 18
4) The alignment of the authorized access bridge crossing over coastal wetlands must be staked.prior tPhTey
initiation of construction. This staked alignment shall be approved by a representative of the Division of
Coastal Management prior to the commencement of any construction of the bridge crossing.
5) The permitted bridge. must be elevated a. minimum of three (3) feet over the wetland substrate as
measurement from the bottom of the decking.
6) The permitted shall take all necessary precautions to minimize damage to.any coastat wetland areas
during the construction of the authorized bridge. Construction .mats shall be used when crossing any
wetland area. Any spoil material resulting from. the installation of the bridge structure shallbe removed
from the wetland area to an approved high ground location.
') All construction. mats shall be removed immediately upon completion of the construction of the
authorized bridge.
8) At no time shall building materials or construction debris be stored, stockpiled, or left in coastal
wetlands.
Stormwater
9) A Stormwater Management review will be required for this project. A Stormwater Permit shall be
obtained and a copy provided to DCM prior to the initiation of the authorized development. Submit this
plan to the Department of Energy, Mineral, and Land Resources, Stormwater Section, 127 Cardinal
Drive Extension,Wilmington, NC 28405.
Sedimentation & Erosion Control "
10) In order to protect water quality, nmoff from construction shall not visibly increase theamount of
suspended sediments in adjacent waters.
11) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property.
12) Aground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of
any phase of grading on cut or filled slopes.
Cultural Resources
13) Prior to the. initiation of any land -disturbing activities authorized by this permit, the permittee shall, in
coordination with the N.C. Department of Natural and Cultural Resources (NCDCR), develop and
implement an archaeological survey of the proposed project area. Initiation of permitted land -disturbing
activities shall not begin until written approval is obtained from NCDNCR, and a copy of such approval
has been submitted to the Division of Coastal Management.

14) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
15) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
16) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United State's in the public
interest. '
17) No excavation or filling of any open rvater'area or.vegetated wetlands is authorized by this permit.
NOTE: The permittee is advised that a Driveway Permit from the NC Department of Transportation will
be required.
NOTE: Future development of the pemiittee's property may require a modification ofthis.permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activityforthis determination. The permittee is further advised that manyhon-water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals orauthorizations that may be required.
NOTE: The U.S. Army Corps of Engineers assigned the proposed project Action ID No. SAW-2016-
00222.
NOTE: The N.C.- Division of Water Resources assigned the proposed project DWR Project No. 2018-
1001.
NOTE: An application processing fee of $400 was received by DCM for this project. This fee also
satisfied the Section 401 application processing fee requirements of the Division of Water
Resources.

Hey Greg, good morning.
We circulated the application package for Mr. Barnes bridge/home project last week and Courtney Spears picked up i
a discrepancy that I missed. Specifically, the missing green card from the adjacent riparian notification to Notes and
Notes, Inc. If you have the signed certified mail receipt for them, please forward that along, and if not can you please
notify?
Also, it appears the drawings have the same number. Could you please have Charles re -number the drawings and send
new set. We wont need a revision on the JD, but the site plan drawings should have different nos. And, if they could
print to scale that would be nice too.

RECOMMENDATIONS FOR: Richard Barnes July 11, 2018
It appears the proposed bridge, driveway and home construction is CONSISTENT with 15A
NCAC 07H .0205: Coastal Wetlands and 15A NCAC 07H .0209: Coastal Shorelines. Based on
these findings, it is staffs recommendation that a permit be issued to authorize the access bridge,
driveway and house construction with the following conditions:
This permit authorizes the temporary impact of 22' by 258' within Coastal and §404 type
wetlands for a bridge crossing (which is to be 6' above the normal high water level)
2. This permit authorizes the construction of an approximately 1,380 sq. ft. residence with
pervious driveway within the 575' ORW-AEC resulting in 1.6% impervious surfaces.
4. All unconsolidated material resulting from associated grading and landscaping shall be
retained on site by effective sedimentation and erosion control measures. Prior to any land -
disturbing activities, a barrier line of filter cloth must be installed between the land
disturbing activity and the adjacent marsh or water areas, until such time as the area
has been properly stabilized with a vegetative cover. In order to protect water quality,
runoff from the construction must not visibly increase the amount of suspended sediments
in adjacent waters.
5. No attempt will be made by the permittee to prevent the full and free use by the public of
all navigable waters at or adjacent to the authorized work.
6. The authorized structure and associated activity must not cause an unacceptable
interference with navigation.
7. This permit does not authorize the excavation or filling of wetlands, even temporarily.
8. Future development on the permittee's property may require a modification of this permit.
Contact a representative of this Division at (910) 796-7215 prior to commencement of any
such activity for this determination.
9. The construction of the proposed project shall be in compliance with all local, State and
Federal regulations and associated permit conditions.
12. The permittee shall maintain the authorized work in good condition and in conformance
with the terms and conditions of this permit. The permittee is not relieved of this
requirement if he abandons the project without having the permit transferred to a third -
party.

On July 13, 2018, the Wilmington Regional Office received notification that the subject proposed project has triggered a
review for the applicability of the 2017 state stormwater rules under one of the following:

3. The project does not require either an Erosion and Sedimentation Control Plan or a CAMA Major Development
Permit, but meets one of the following criteria:
a. The non-residential project proposes to cumulatively add 10,000 square feet or more of built -upon area;
or,
b. The residential project is within''/z mile of and draining to SA waters, and proposes in excess of 10,000 sf
of built -upon area that results in a density of 12% or more.
4. The project is part of a larger common plan of development;
5. The proposed project impacts an existing state stormwater management permit.
Per North Carolina Administrative Code Section 02H.1001 (3) a Stormwater Management Permit from the Division of
Energy, Mineral and Land Resources, is required if any one of more of the above triggers applies to the project. Please
understand that the NPDES 010000 Federal Construction Stormwater Permit that is issued with the Erosion and
Sedimentation Control Plan approval letter is NOT the required Coastal Stormwater Management Permit. Any
construction on the subject site, prior to receipt of the required Coastal Stormwater permit, will constitute a violation of
15A NCAC 2H.1000 and may result in appropriate enforcement action by this Office.
Please submit either a Stormwater Permit Application Package including 2 sets of plans, completed application form,
fee, and supporting documentation, or a written response regarding the status of this project and the expected submittal
date, to this Office no later than A, C`A li3 2011 . Failure to respond to this request may result in the initiation of
enforcement action, and construction may experience a subsequent delay. If the project is located within the jurisdiction of
any local government holding an NPDES post -construction stormwater permit issued by the Division of Energy, Mineral
and Land Resources, please contact that unit of local government for information on submitting the stormwater
application to them.

I wanted to follow-up to the voicemail I left for you. Due to comments from SHPO, no upland land disturbance is
authorized until a Phase II site assessment (and maybe Phase III) has been completed. To access the site and complete
the assessments, the bridge is required.
My question is, similar to SHPO and as noted in the CAMA permit, is State Stormwater ok with the conditions limiting no
upland development until both SHPO and Stormwater authorization have been received but construction of the bridge is
permissible at this point? We don't want to permit any upland development now since the results of the archaeological
assessments may change what was previously shown.

The 10,000 sf and <12% only applies in the
(Please forgive the highlighting, but I wanted. to make sure you read that.)
There are 3 triggers for when a residential project must obtain a stormwater permit. If any ® of the
triggers is "pulled", a stormwater permit is required. In the case where a CAMA Major permit is
required, demonstrating that there is <=10,000 sf and <12% no longer applies, since the mere fact
that a CAMA Major permit is required is sufficient to require a stormwater permit. At this point,
assuming this is a CAMA Major application, you can either apply for a General Permit for a single
family lot (requires low density to be met), or apply for an individual low density permit if the density is
12% or less, or apply for an individual high density permit with SCM's to treat the runoff.
If the lot is within the 575' ORW AEC, then the low density limit is still 12%, but the maximum high
density limit is 25% with treatment.
In the of a CAMA Major, and if no SEC plan approval is required for the lot, then you have to
deal with the third trigger (<10,000 sf and <12% density) in orderto determine if the project requires a
stormwater permit.

'!hank you for your July 12, 2018, memorandum concerning the above -referenced undertaking. We have
reviewed the materials submitted and object to the project for reasons described in the following comments.
There is one known archaeological site within the proposed project area, 31 ON256, that has been deemed
potentially eligible for listing the National Register of Historic Places. 'Iltis site was first identified in 1978 and
further assessed in 1987. It exhibits intact prehistoric features, an excellent degree of preservation, and
contains shell concentrations, lithics, ceramics, and human retrains, that liken- represent the remains of a
Middle Woodland through late Woodland prehistoric habitation site.
Prior to the initiation of any ground disturbing activities, we recommend that a comprehensive assessment be
conducted by an experienced archaeologist to identify, evaluate, and subsequently develop a mitigation plan for
any archaeological remains.
The resulting archaeological report should follow the North Carolina Office of State Archaeology /ln$aeoiogiroi
hu rskga[ion S/andards and Gaideiinei. The report and appropriate site forms should be forwarded to us for review
and comment as soon as they are available and well in advance of any construction activities.
The above comments are offered in accordance with Section 106 of the National Historic Preservation Act and
the regulations of the Advisory Council on Historic Preservation at 36 CFR 800. If you have any questions

You have our approval, in accordance with the attached conditions and those listed below, to construct
and elevated bridge over coastal and Section 404 wetlands in order for development of a single-family
residence as described in your application received by the N.C. Division of Water Resources (DWR) on
July 18, 2018. After reviewing your application, we have decided that the impacts are covered by
General Water Quality Certification Number 4144 (GC4144).
This Certification allows you to use the Nationwide Permit 18 when issued by the US Army Corps of
Engineers and the CAMA Major Permit when issued by the Division of Coastal Management. In addition,
you should obtain or otherwise comply with any other required federal, state or local permits before you
go ahead with your project including (but not limited to) Erosion and Sediment Control, Non -discharge,
and stormwater regulations. Also, this approval to proceed with your proposed impacts or to conduct
impacts to waters as depicted in your application shall expire upon expiration of the 404 Permit. This

one acre of wetland or 150 linear feet of stream, compensatory mitigation may be required as,described
in 15A NCAC 2H .0506 (h). This approval requires you to follow the conditions listed in the attached
certification and any additional conditions listed below.
The Additional Conditions of the Certification are:
1. This approval is for the purpose and design described in your application. The plans and
specifications for this project are incorporated by reference as part of the Certification. If you
change your project, you must notify the Division and you may be required to submit a new
application package with the appropriate fee. If the property is sold, the new owner must be given a
copy of this approval letter and General Certification and is responsible for complying with all
conditions. Any new owner must notify the Division and request the Certification be issued in their
name (15A NCAC 02H .0501 and .0502).
2. Any final construction plans for this project must include or reference the application and plans
approved by the Division under this authorization letter and certification. The applicant will also be
required to evaluate all acquired permits to assure that they are consistent and all relative impacts are
accounted for and shown on the construction plans. [15A NCAC 02H .0502 (b) and 15A NCAC 02H .0506
(4)] The applicant shall require his contractors (and/or agents) to comply with all of the terms of this
Certification, and shall provide each of its contractors (and/or agents) a copy of this Certification.
3. Turbidity Standard
The turbidity standard of 25 NTUs (Nephelometric Turbidity Units) shall not be exceeded as described in
15 A NCAC 2B .0220. Appropriate sediment and erosion control practices must be used to meet this
standard. Turbidity curtains shall be used as appropriate. Please notify this Office if any turbidity
issues arise at 910.796.7215
4. This General Certification shall expire on the same day as the expiration date of the
corresponding General Permit. The conditions in effect on the date of issuance of the Certification for a
specific project shall remain in effect for the life of the project, regardless of the expiration of this
Certification.
5. The permittee shall require its contractors and/or agents to comply with the terms of this
permit in the construction and maintenance of this project, and shall provide each of its contractors
and/or agents associated with the construction or maintenance of this project a copy of this
certification. A copy of this certification including all conditions shall be available at the project site
during the construction and maintenance of this project. [15A NCAC 02H .0507 (c) and 15A NCAC 02H
.0506 (b)(2) and (c)(2)]
6. Continuing Compliance:
The applicant/permittee and their authorized agents shall conduct all activities in a manner consistent
with State water quality standards (including any requirements resulting from compliance with 303(d) of
the Clean Water Act), and any other appropriate requirements of State and Federal law. If the Division

determines that such standards or laws are not being met, including failure to sustain a designated or
achieved use, or that State or Federal law is being violated, or that further conditions are necessary to
assure compliance, than the Division may reevaluate and modify this General Water Quality
Certification. [15A NCAC 02H .0507(d)]
7. All mechanized equipment operated near surface waters or wetlands will be regularly inspected
and maintained to prevent contamination of waters and wetlands from fuels, lubricants, hydraulic fluids
or other potential toxic chemicals. In the event of a hydrocarbon or chemical spill, the
permittee/contractor shall immediately contact the Division of Water Quality, between the hours of 8
am to 5 pm at the Wilmington Regional Office at 910.796.7215 and after hours and on weekends call
(800) 85"368. Management of such spills shall comply with provisions of the North Carolina Oil
Pollution and Hazardous Substances Control Act. [15A NCAC 02H .0506 (b)(3) and (c►(3), 15A NCAC 02B
.0200 (3)(f), and GS 143 Article 21A].
8. Fueling, lubrication and general equipment maintenance should not take place within 50 feet of
a waterbody or wetlands to prevent contamination by fuel and oils. [15A NCAC 02H .0506 (b)(3) and
(c)(3) and 15A NCAC 02B .0200 (3)(f)].
9. This certification grants permission to the director, an authorized representative of the Director,
or DEQ staff, upon the presentation of proper credentials, to enter the property during normal business
hours 15A NCAC 02H.0502(e).
10. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or applicable Buffer
Rules, and any subsequent modifications, the applicant and/or authorized agent is required to return a
completed certificate of completion form to the NCDEQ DWR 401 and Buffers Unit North Carolina
Division of Water Resources, 1617 Mail Service Center, Raleigh, NC, 27699 within ten days of project
completion. The certification of completion is available at:

Violations of any condition herein set forth may result in revocation of this Certification and may
result in criminal and/or civil penalties. The authorization to proceed with your proposed impacts or to

This approval and its conditions are final and binding unless contested.

This project appears to be consistent and not in confect with the North Topsail Beach
Land Use Plan update.
The applicant proposes to install a bridge and driveway, and a single-family residence
along NC Highway 210 in North Topsail Beach, Onslow County.
Areas of Environmental Concern (AEC's) impacted by the proposal are EW, PT, CW and
ES. Waters at the site are classified as SA-ORW and are open to the harvesting of
shellfish. The area is a primary nursery area.
I have reviewed this proposal for consistency with the North Topsail Beach Land Use
Plan and offer the following comments.
The general area of the project is classified Developed, while the AECs impacted by the
work are classified as Conservation.
In general, the North Topsail Beach Land Use Plan allows development in Developed
classified AECs which is consistent with the State's minimum use standards. The North
Topsail Beach Land Use Plan contains some policies, which exceed the State's minimum
use standards. However, none of these more restrictive policies appear to be applicable
to this project.
Provided all other local, state and federal requirements can be met, this project
appears to be consistent with the North Topsail Beach Land Use Plan Update.

The 10,000 sf and <12% only applies in the
(Please forgive the highlighting, but I wanted to make sure you read that.)
There are 3 triggers for when a residential, project must obtain a stormwater permit. If any ® of the
triggers is "pulled", a stormwater permit is required. In the case where a CAMA Major permit is
required, demonstrating that there is <=10,000 sf and <12% no longer applies, since the mere fact
that a CAMA Major permit is required is sufficient to require a stormwater permit. At this point,
assuming this is a CAMA Major application, you can either apply for a General Permit for a single
family lot (requires low density to be met), or apply for an individual low density permit if the density is
12% or less, or apply for an individual high density permit with SCM's to treat the runoff.
If the lot is within the 575' ORW AEC, then the low density limit is still 12%, but the maximum high
density limit is 25% with treatment.
In the of a CAMA Major, and if no SEC plan approval is required for the lot, then you have to
deal with the third trigger (<10,000 sf and <12% density) in order to determine if the project requires a
stormwater permit.

9. PROJECT DESCRIPTION
The applicant's property is a 108-acre tract of land located along Island Drive (NC Highway
210), approximately 0.5 miles south of North Topsail Beach Town Hall, in North Topsail Beach,
Onslow County. The property is identified as Parcel 046191, according to the Onslow County
GIS.
The property encompasses high ground area, open water and wetlands (Coastal and §404), and
spans from Island Drive west to the eastern edge of the Atlantic Intracoastal Waterway. The
elevation of the property is approximately 5'-7' above normal high water. There are no man-
made features located on this property at present. High ground vegetation on the property
includes: Sweet Bay (Magnolia virginiana), Long Leaf Pine (Pinus palustris), Laurel Oak
(Quercus laurifolia), Yaupon (Ilex vomitoria), Catbrier (Smilax sp.), Ragweed (Ambrosia sp.) and
Virginia Creeper (Parthenocissus quinquefolia). The lot includes a wide span of wetland area
vegetated primarily by Smooth Cordgrass (Spartina alternii lora), intermixed with Salt Grass
(Distichlis spicata), interspersed with Sea Lavender (Limoium carolinanum), Sea Ox-eye
(Borrichia frutescens) and monospecific stands of Black -Needle Rush (Juncus roemerianus).
Small hummocks vegetated with Red Cedar (Juniper virginiona), Marsh Elder (Iva frutescens),
Wax Myrtle (Myrica cerifera) and Poison Ivy (Rhos radicans) are also scattered within this
coastal wetland area. The tract grades back up into high ground vegetated with Yaupon (Ilex
vomitoria), Sweet Bay (Magnolia virginiana), Live Oaks (Quercus sp.), Wax Myrtles (Myrica
cerifera), Grape vines (Vitis sp.), and Poison Ivy (Rhus radicans) along the edge of the AIW W.
The waters adjacent to the project are classified as SA-ORW, by the Division of Water
Resources. The area IS designated a Primary Nursery Area and is also OPEN to the taking of
shellfish.
10. PROPOSED PROJECT
The applicant proposes to install a bridge (crossing open water, Coastal and §404 type wetlands),
driveway and single-family residence at the subject property.
Beginning along the edge of Island Drive (NC Highway 210), the applicant proposes to construct
a private wooden bridge measuring approximately 2 P-22' in width x 258' in length. An 18'
(long) x 80' (wide) asphalt approach would be constructed along the shoulder of Island Drive,
and would tie into the existing roadway, joining Island Drive and the proposed bridge. The
asphalt approach would extend toward the west and would terminate approximately 30' from the
normal high water (NHW) line, which also is the upper limits of a joint Coastal/§404 type
wetland line. From that point, the bridge would extend toward the west, traversing approximately
256' of mixed wetland (Coastal and §404 type) and open water area, before terminating onto high
ground located on the opposing side of an open water bay with a series of finger canals/mosquito
ditches. According to the site plans and application package, the proposed bridge would measure
approximately 22' in width x 258' in length, and would be elevated a minimum of 6' above the
normal water level. Although this area is tidally influenced, water passage into the bay/cove for
which the proposed bridge is planned, is provided by a deteriorated culvert/check dam that's
located along northern side of the adjacent property (to the north).

The bridge is proposed to be constructed using pressure treated piles, structural lumber and wood
decking. As noted on the site plans, the bridge pilings would be installed on 6' centers. A guard
rail would be also constructed along each side of the bridge for protection and stability.
Based on the design, the applicant would avoid any excavation and/or fill in both wetlands and
open water; however, the approaches would be graded and contoured to meet the elevations of the
timber bridge and Island Drive.
In additional to the proposed bridge, the applicant is requesting authorization to construct a
pervious drive (consisting of a 4"-6" layer of Grade 57 Stone on top of a geotextile fabric base)
and single-family residence on the subject property. As depicted on the site plan, the proposed
gravel drive would originate along the western edge of the proposed bridge and would extend
toward the west approximately 145 linear feet. According to the site plan(s), the driveway would
measure approximately 20' in width. Just west of the driveways terminus, the applicant proposes
to install a residential dwelling (with a proposed footprint of 30' x 46') and 17' x 22' septic area.
The proposed residence would be constructed outside the 30' Coastal Shoreline buffer area, but
entirely within the 575' Outstanding Resource Water (ORW) Estuarine Shoreline AEC. As
proposed, approximately 17,424 sq. ft. of high ground would be impacted/disturbed because of
the driveway and home construction. Additionally, approximately 6,611 sq. ft. of impervious
coverage (or 1.6% of the lot within the ORW-AEC) would be associated with the proposed
development. The site plan indicates the proposed residence and other structures associated with
the house would be located approximately 250' from the high water line surrounding the
property.
10. ANTICIPATED IMPACTS
The proposed bridge would result in a 4,928 sq. ft. of Coastal and §404 type wetland shading and
temporary impacts from the bridge construction. The construction of the residence with
associated landscaping, driveway and septic system on uplands, would disturb approximately
17,424 sq. ft. and would result in a 1.6 % impervious area within the 575' Area of Environmental
Concern (AEC).

The property is located off Highway 210 (Island Drive) just south and west of the 210 bridge over the intracoastaI
waterway in North Topsail Beach, Onslow County (See Appendix A).
The property is currently undeveloped in inaccessible. The applicant, Richard Barnes, proposes to construct a
wooden bridge from Island Drive/Highway 210, to the delineated uplands on the property (See Appendix A).
Only one single family residence is proposed at this time.
Due to the Town of North Topsail Beach zoning requirements, the bridge is proposed with a 20-foot wide road
with an overall width of 22 feet. The Town also requires installation of a water line, fire hydrant and risers to
support any future development. Bridge construction and water line details will be prepared by an engineer
prior to construction.
The bridge is proposed at the narrowest crossing point between Island Drive and the upland portion of the
property to minimize wetland impact to the greatest extent possible. Bridge pilings will be driven to further
minimize impacts and be elevated at least 6 feet above NHW.

Hey Greg,
I called earlier this morning and left a message so you can disregard that by replying to this email.
With regard to Mr. Barnes CAMA major permit application, I was looking for a site plan that would show the exact
location of the proposed bridge in relation to the entire property, and cant find one. The survey prepared by Riggs shows
the proposed bridge being installed close to the southern property line, but it doesn't show the exact location in relation
to the overall property, nor does it depict any open water finger canals/cuts beneath the bridge. I'm making this
comparison based on Google earth imagery as well as the approved 404 delineation.

The Division of Coastal Managements Wilmington Regional office received a CAMA Major Permit application from you
on May 30, 2018, requesting approval for development activities at the subject address. In reviewing your application,
we have discovered that additional information is needed to complete the review process. Accordingly, I am requesting
that you submit the following additional information to this office:
1) At your convenience, please provide a site plan showing the proposed bridge crossing in relation to the entire
parcel, as well as all finger ditches, and fringes of all wetlands.
You may send the requested information to me direct at the below address.
In accordance with the Department of Environment and Natural Resources regulations, we note that the partial
application, as submitted on May 30, 2018, is incomplete for processing. Upon resubmission of a complete application,
a local decision will be made in 150 days, provided this period is not extended as provided by law. Please contact me at

Dear Mr. Finch:
The Division of Coastal Management hereby acknowledges that on July 10, 2018, we received a complete
CAMA Major Permit application from you (with exception of the signed certified mail receipts), acting as
agent on behalf of Richard Barnes, requesting State approval for development of property located along
NC Highway 210 in North Topsail Beach, Onslow County, and identified as Parcel ID 046191. The
projected deadline for making a decision on your permit application is September 23, 2018. An additional
75-day review period is provided by law when such time is necessary to complete the review. If you have
not been notified of a final action by the initial deadline stated above, you should consider the review
period extended. Under those circumstances, this letter will serve as your notice of an extended review.
However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from July 10, 2018, you may request a.
meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of
your project. Such a meeting will be held within five working days from the receipt of your written
request and shall include the property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the
property of your proposed development. You should post this notice at a conspicuous point along your
property where it can be observed from a public road. Some examples would be: Nailing the notice card
to a telephone pole or tree along the road right-of-way fronting your property; or at a point along the road
right-of-way where a private road would lead one into your property. Failure to post this notice could
result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the
appropriate State or Federal agency. Please contact me if you have any questions and notify me in
writing if you wish to receive a copy of my field report and/or comments from reviewing agencies.

Areas of Environmental Concern as designated under the CAMA: Donald Warren, William Rawls &
William Chapman proposed to construct a shared dock at 6418 Providence Point Rd., adjacent to
Howe Creek, in New Hanover County; and Richard Barnes proposed to construct a single-family
residence and bridge off Island Dr. (Hwy 210), adjacent to the AIWW, in North Topsail Beach,
Onslow County. Copies of these applications can be examined or copied at the office of Courtney Spears
