Doeldne Facility
1) This permit authorizes only the docks, piers, and other structures and uses located in or over the
water that are expressly and specifically set forth in the permit application. No other structure,
whether floating or stationary, shall become a permanent part of this docking facility without permit
modification. No non -water dependent uses of structures shall be conducted on, in or over Public
Trust waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced
throughout the entire existence of the permitted structure.

ADDITIONAL CONDITIONS
3) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
5) This permit authorizes a maximum of 3 formalized boat slips.
6) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure and the adjacent property -owners' riparian access corridors.
7) Any portion of the permitted access pier and docking facilities built over Coastal Wetlands shall not
exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as
measured from the bottom of the decking.
8) The authorized structures and associated activity shall not cause an unacceptable interference with
navigation, and shall not exceed the established pier head line.
9) An as-built,.survey shall be performed on the docking facility, including the riparian corridor lines, and
copies of the survey provided to the Division of Coastal Management, within sixty (60) days of
completion of construction of the project.
10) The authorized covered platform shall not be enclosed. Any material used on the sides shall not obstruct
view and shall be permeable to air and water. Screen or wire on the sides along with benches and knee
walls are permitted. Lattice is specifically excluded from being used under this authorization.
11) The roof of the covered platform shall not be designed for second story use.
12) _ The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with
T15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation
within the PNA shall be permitted. Dredging in any manner, including kicking with boat propellers, is

15) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
16) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit.
NOTE: Future development of the pemvttee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of General Permit
197800056 (Action ID No. SAW-2018-00843), which was issued on 7/3/18.
NOTE: The N.C. Division of Water Resources assigned the proposed project DWR Project No. 2018-
0719.
NOTE: An application processing fee of $250 was received by DCM for this project.
NOTE: The permittee is advised that a local floodplain development permit will be required. Please
contact the Town of Sunset Beach at 910-579-0068.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where
applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -colored
form) is retained by you and it must be available on site when the project is inspected for compliance. Please sign
both the gold original and the white copy and return the white copy to this office in the enclosed envelope. Signing
the permit and proceeding means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-
121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office
of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20)
days of this decision on your. permit. You should also be aware that another qualified party may submit an
objection to the issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be
carried out in accordance with your application. Modifications, time extensions, and future maintenance requires
additional approval. Please read your permit carefully prior to starting work and review all project plans, as
approved. If you plan to have the work done by a contractor, it would be to your benefit to be sure that he fully
understands all permit requirements.
. From time to time, Department personnel will visit the project site. To facilitate this review, we request
that you complete and mail the yellow Notice Card just prior to work initiation. However, if questions arise
concerning permit conditions, environmental safeguards, or problem areas, you may contact Department
personnel at any time for assistance. By working in accordance with the permit, you will be helping to protect our
vitally important coastal resources.

It has been quite the endeavor to find someone that could produce the drawings the DCM is requesting. However, I
believe this should do it (see attached). I have corrected the length of the proposed dock (i.e. from 650'to 675'). This
has also been changed on Page 1 of MP-4 (see attached).

Hi Dana,
The match lines/property lines on these drawings do not align. It is very difficult to tell where the pier alignment is
relative to the property lines by piecing these three drawings together. Between drawings 1 and 2 there even appear to
be inconsistencies on the pier alignment/scaling from the property line.
I discussed with Doug, and we really need to see the whole pier alignment on one drawing. This will help to avoid any
scaling issues and will clearly show the entire alignment of the pier relative to the property lines. If we can get an
updated drawing that meets that criteria by Tues/Wed next week we should be able to continue moving forward,
otherwise we will have to place the project on hold.

Thank you for the response. We need to see an updated version of the plan view drawing that was originally submitted
with the permit application. The plan view should clearly show where the pier will run relative to the appropriate
setbacks and where everything falls within the riparian corridor. With the attachment (aerial) you provided it is not clear
how the waterward end of the pier will be impacted by aligning with the property lines. Please let me know if there are
any questions.

Recommendations for State Permit — Fred Baldino 5/18/17
The -total area of the docking facility was calculated as follows:
Shoreline length = 80 linear ft. x 8 = 640 sq. ft. allowable.
JProposed Fixed Pier 1: 4 & x 650 ft. = 2600 sq. ft. (Not counted due to Access)
Proposed Fixed Gazebo: 10 ft. x 10 ft. =100 sq. ft.
Proposed Floating Platform: 12 ft. x 6 ft. = 72 sq. ft.
Proposed Boatlift: 12 ft. x 12 ft. = 144 sq. ft. (Not counted towards platform sq. ft. allowance)
Total =172 sq. ft.
It is staffs recommendation that the extending the proposed docking facility appears CONSISTENT with the use
standards set forth in 15A NCAC 07H.0208 (b) (6) (B) which limits the shaded area impact for docks and
mooring facilities to 8 sq. ft. per liner foot of shoreline, excluding the access pier and open water slips in the
calculation.
The proposed length of the facility appears to be INCONSISTENT with portions of the use standards set forth in
15A NCAC 07H.0208 (b)(6)(Gxiii). The docking facility would not conform to the '/4 width distance and would
exceed the '/4 width of the waterbody by 21 ft. However, the docking facility would not exceed 1/3 of the width
of the waterbody and would be within the pierhead line of existing adjacent piers, one of which is located
approximately 100 ft. to the east. The proposed pier length is CONSISTENT with 15A NCAC 07H.0208
(bx6XG)(i) and (ii) and would not exceed the U.S. Army Corps of Engineers 80' Federal Channel Setback, nor
the established pier head line.
The length of the proposed docking facility is potentially CONSISTENT with the use standards set forth in 15A
NCAC 07H.0208 (b)(6)(H), which states, "Piers or docking facilities longer than 400 feet shall be permitted only
if the proposed length gives access to deeper water at a rate of at least 1 foot each 100-foot increment of length
longer than 400 feet, or, if the additional length is necessary to span some obstruction to navigation.
Measurements to determine lengths shall be made from the waterward edge of any coastal wetland vegetation that
borders the waterbody." The facility as proposed, would have a total length of approximately 637 ft. waterward of
NHW, however it would extend approximately 165 ft. waterward of the edge of Coastal Wetland Vegetation,
where according to the applicant, it would achieve water depths measuring approximately — 3 ft. @ MLW at the
terminal end. The majority of the water depth is gained within the last 100 ft. of the proposed docking facility.
This office has no objection to the proposed work, provided it is consistent with all other local, state; and federal
regulations. Any permit issued should include standard conditions of private docking facilities.

Sunset Beach, Brunswick County
Date: July 16, 2018
The applicant proposes to construct a private pier and docking facility capable of
accommodating of up to three (3) vessels. The project is located at 719 Shoreline Drive
East, adjacent to the AIWW in Sunset Beach, Brunswick County.
Areas of Environmental Concern (AFC's) impacted by the proposal are ES, EW PTA,
and CW.
Waters at the project site are classified as SA; HQW and are not open to the harvesting of
shellfish. The area is a Primary Nursery Area.
I have reviewed this proposal for consistency with the Town of Sunset Beach Land Use
Plan and offer the following comments.
The general area of the project is classified Residential, while the AECs impacted by the
work are classified as Conservation.
In general, the Town of Sunset Beach allows development in Conservation classified
AECs which is consistent with the State's minimum use standards. The Town of Sunset
Beach Land Use Plan contains some policies, which exceed the State's minimum use
standards. However, none of these standards appear to be applicable to this proposal.
Provided all local, state and federal requirements can be met, this project appears to
be consistent with the Town of Sunset Beach Land Use Plan.

*I'm trying to figure out how to deal with the dock since the square footage is over our GP 56 limit. It may be that we
can grandfather the facility since the majority is a replace in place and looks like the dock was expanded back between
1993-1998. 1 don't believe we have a record of a permit either. Or they may have to redesign to get the platform to 400
square feet. It is currently 16'X35' which is 560 square feet. Not sure though ... I'll follow up.

On January 1, 2017, we renewed General (Regional) Permit No. 197800056, (copy enclosed), that
authorizes the maintenance, repair, construction and installation of piers, docks, boathouses and boat
shelters, mooring piles, dolphins, jetties and breakwater structures in navigable waters of the United States
in the State of North Carolina pursuant to Section 10 of the Rivers and Harbors Act of 1899. General
Permit No. 197800056 expires December 31, 2021.
Your work is authorized provided it is accomplished in strict accordance with your submitted plans,
the enclosed general and special conditions.

9. PROJECT DESCRIPTION
The applicant's property is located at 719 Shoreline Dr. W., adjacent to the AIWW in the town of Sunset Beach,
Brunswick County. Directions from Highway 17 south of Shallotte: Turn Left onto Seaside Rd. SW/NC-904 and
travel approximately 3.60 miles. Turn right onto Sunset Blvd N/NC -179 Bus and travel approximately 1.7 miles.
Take the 2nd exit at the traffic circle to stay on Sunset Blvd N. and turn right onto Shoreline Drive West. The
project site will be located on the left-hand side of the street.
The project site measures approximately .5 acres in area and is currently developed with a single-family
residence. The property has approximately 80 feet of shoreline frontage with an existing bulkhead and maintains
an elevation approximately 10 ft. above Normal High Water (NHW). High ground vegetation consists mainly of
hardwoods, including live oaks, which transitions to Section 404 Wetlands and Coastal Wetlands. The Coastal
Wetland area extends approximately 470 ft. waterward of the NHW mark and consists primarily of Bullrush
(Scirpus sp.), Black Needlerush (Juncus roemerianus), Spike Grass (Distichlis spicata) and Smooth Cord Grass
(Spartina alterniora). There is a drainage way on the western side of the property and NHW extends almost to
Shoreline Drive West in this area.
The waters of the AIW W are classified SA; HQW by the Division of Water Resources and ARE designated as a
Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are CLOSED to the harvest of
shellfish.
10. PROPOSED PROJECT:
The applicant proposes to construct a private pier and docking facility capable of accommodating of up to three
(3) vessels. The proposed project would consist of a pier measuring approximately 4 ft. in width by 650 ft. in
length, which would span an area of Coastal Wetlands measuring approximately 470 ft. in width. The pier would
terminate at a covered gazebo measuring approximately 10 ft. in width by 10 ft. in length (See Dock Plan 1 of 2).
A floating dock measuring approximately 6 ft. in width by 12 ft. in length is proposed to extend off the eastern
corner of the platform and run parallel to the shoreline approximately 7 ft. off the riparian corridor setback line. A
boatlift measuring 12 ft in length by 12 ft. in width is proposed off the western side of the gazebo approximately
1 ft. from the riparian corridor setback line.
According to the application, water depths in the vicinity of the proposed slips range from approximately -2.1 ft.
to -3 ft. @ Normal Low Water (NLW). NOTE: These depths have not been verified by DCM Fisheries at this
time. The proposed docking facility would extend a total distance of approximately 165 ft. into a water body
measuring approximately 575 ft. in width. As proposed, the docking facility would exceed 1/4 width of the AIW W,
which is 144 ft. from the edge of wetlands, but would not exceed 1/3 of the waterbody width. The proposed
docking facility would be approximately 33 ft. from the U.S. Army Corps of Engineers 80' Federal Channel
Setback. The docking facility, as proposed, would not exceed the established pier head line.
11. ANTICIPATED IMPACTS
The proposed docking facility would incorporate approximately 952 sq. ft. of Estuarine and Public Trust Area and
would shade approximately 1,872 sq. ft. of Coastal Wetlands in a designated Primary Nursery Area. Minor
increases in turbidity should be expected during construction. The proposed configuration of the docking facility
would provide docking space for three (3) vessels in reported water depths ranging from approximately 2.1 ft. to 3
ft. @NLW.

Project Narrative
A. Introduction
Southern Environmental Group, Inc. has been retained by the property owner (see Attachment 1), Fred &
Nancy Baldino (herein referred to as the "Applicant"), to secure a NC Division of Coastal Management
CAMA Major Permit, for a dock that is prosed to extend more than 400 linear feet past the normal high water
line.
B. Property Characteristics
1. Project Address: 719 Shoreline Drive West, Sunset Beach, NC (see Attachment 2)
2. Parcel IDs: 255LA012 (see Attachment 3)
3. Existing Conditions: There is an existing dwelling (approximately 3600 SF of built upon area) on the
property.
4. Wetlands and waters of the US (WOTUS): The site exhibits both US Army Corps Engineers' (USACE)
Section 404 and Section 10 wetlands and abuts the Atlantic Intercoastal Waterway (ICWW).
5. Receiving stream name and classification: This portion of the ICWW is classified as SA; HQW by the
NC Division of Water Resources.
6. Primary Nursery Area (PNA): This section of the ICWW is classified as PNA (see Attachment 4).
7. Essential Fish Habitat: The proposed work is not anticipated to impact essential fish habitat.
8. Water depths at normal low water (NLW): Water depths were taken on 12/5/17 at 3:30pm. On that day,
low tide was predicted to be at 3:46pm, with an estimated tidal coefficient of 94, producing a -0.6' NLL W
tidal height, at the Sunset Beach Bridge ICWW tidal gauge. Measurement were taken at approximately
10' intervals, extending from the NLW line waterward, and for a distance of 30 feet, where the depth was
measured at -2.4' or -3.0' taking into account the tidal coefficient (see Attachment 5).
9. Length of Shoreline: 80 linear feet (see Attachment 6)
10. Width of Waterbody: +/- 575' (see Attachment 6)
11. Substrate: The substrate, under the proposed gazebo, floating platform and boat lift, is sandy, with a thin
layer of silt.
12. Submerged Aquatic Vegetation (94i9: No SAVs exist within the project area.
C. Proposed Work
The Applicant intends to construct a 4' wide by 650' long fixed, slatted pier, which will be elevated at least 3'
above the substrate in all areas where crossing wetlands. At the terminus of the pier will be a 10' x 10' (100 SF),
fixed, covered gazebo, witl, le' x 12' (72 SF) floating platform that will extend off the east side of the gazebo and
will provide for loading and unloading. Lastly, a 12' x 12' boat lift will be installed to the west of the proposed
gazebo. Please refer to Attachment 6 for details). The Applicant intends to utilize the docking facility for pleasure
and private use.
The proposed structures have been positioned not to extend waterward of the designated pier head line, as
determined by Sean Farrell, or USACE Navigational Channel Setback, which is located approximately 30'
waterward of the proposed structures (see Attachment 6 for details). No part of the proposed structures will
encroach into the associated riparian corridors. Both adjacent riparian property owners have been notified of the
proposed development and each has signed the applicableAv�9 foOttachment 7).

Machinery, such as a pile driver and barge will be utilized to install the necessary pilings. The barge will either be
tied to a piling or relocated when not in use. At no time will the barge be allowed to rest on the bottom or extend
waterward of the USACE navigational setback. Typical marine dock and pier material will be used to construct
the structure.
Very little land disturbing will take place with this project and no impervious surface area is being proposed.

The Department of Environmental Quality hereby gives public notice as required by
NCGS 113A-119(b) that the following applications were submitted for development permits in
Areas of Environmental Concern as designated under the CAMA, in New Hanover County on
May 10, 2018: Stuart Bayley proposed to construct a bulkhead and docking facility at 311
Florida Ave., adjacent to the CB Yacht Basin, in Carolina Beach; and Robert & Sharon
Allan proposed to construct a docking facility at 5939 Nautical Isle Ct, adjacent to the AIWW
in Wilmington. On May 14, 2018, Fred Baldino proposed to construct a private docking
facility at 719 Shoreline Dr. W., adjacent to the AIWW, in Sunset Beach, Brunswick County.
Copies of these applications can be examined or copied at the office of Courtney Spears (NH
Co), and Tara MacPherson (BR Co.), N.C. Dept. of Environmental Quality, Division of Coastal

The Division of Coastal Management hereby acknowledges receipt of your application, as acting
agent for Mr. Fred Badino, for State approval for development of property located at 719 Shoreline Drive
West Drive located in Sunset Beach, Brunswick County. It was received as complete on May 14, 2018
and appears to be adequate for processing at this time. The projected deadline for making a decision July
28, 2017. An additional 75-day review period is provided by law when such time is necessary to
complete the review. If you have not been notified of a final action by the initial deadline stated above,
you should consider the review period extended. Under those circumstances, this letter will serve as your
notice of an extended review. However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from May 14, 2018 you may
request a meeting with the Director of the Division of Coastal Management and permit staff to discuss the
status of your project. Such a meeting will be held within five working days from the receipt of your
written request and shall include the property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must be
posted at the property of your proposed development. You should post this notice at a conspicuous point
along your property where it can be observed from a public road. Some examples would be: Nailing the
notice card to a telephone pole or tree along the road right-of-way fronting your property; or at a point
along the road right-of-way where a private road would lead one into your property. Failure to post this
notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted
by the appropriate State or Federal agency. Please contact me if you have any questions and notify me in
writing if you wish to receive a copy of my field report and/or comments from reviewing agencies.

A few corrections that I need:
The narrative and MP-2 state that the floating dock is 4 x 12 at 72 sq ft. (Should be 48 sq ft) but the MP-
1(5)(d) states that it is a 10 x 4 floating platform... which is it? I also wanted to double check on that 4 ft
width measurement... it does not seem very wide so I want to make sure that is right.
Please list the adjacent property owners and addresses on the MP-1 form and on the plan view
drawing, please label the boat slips, indicate the scale and add a north arrow.

Hi Dana, Please fill in the adjacent property owner information on the MP-1 form. The cross view
drawing does not show the water depth at the landward side of the boatlift, please add that. The dock
plan and aerial that you provided with water depths don't jive. One has the 3 ft. contour at the pier
head line and one is over. Which is it?? Also, I am not sure which scale you are using, but please send a
dock plan and cross section that are to scale and please label the scale on each drawing.
