This permit, issued on Aueust 23, 2018 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, 'special conditions and notes set forth below. Any violation of these terms may
De subject to nnes, imprisonment or Civil action; or may cause the permit to be nun and void.
Oyster Bae Sills
1) The location and alignment of the oyster bag sills shall be staked by the permittee and approved by a
representative of the Division of Coastal Management within a maximum of 30 days. prior to the start
of any construction.
2) The authorized oyster bag sills shall adhere to the location and alignment depicted on the attached
workplan drawings.
3) Both ends of each oyster bag sill shall be marked with yellow reflectors extending at least three feet
above normal high water level.
(See attached sheets for Additional Conditions)
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be, accessible- on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on , .
December 31, 2021
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
4) The oyster bag sill material shall be free from loose dirt or any pollutant. The oyster bags shall be of a
size sufficient to prevent their'movemeni from the approved alignment by wave or current action.
5) The permiftee shall be'responsible for ensuring that any oyster bags that are displaced from the approved
alignment are replaced to their authorized location.
6) No backfill of the oyster bag sills or any other filling of wetlands, estuarine waters, public trust areas,
established oyster reefs, submerged aquatic vegetation, or high ground is'authorized by this permit.
7) The temporary placement or double handling of fill materials within waters or vegetated wetlands is not
authorized.
8) No attempt shall be made by the permittee to prevent the free and full use by the public of all navigable
waters at or adjacent to the authorized work.
9) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage or injury to the authorized structure or work
which may be caused from existing or future operations undertaken by the United States in the public
interest.
10) The permittee shalt maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party:
11) In order to further Protect the endangered West Indian Manatee; 7'richechur manatus, the applicant must
implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein.

12) This permit does not grant any property rights or exclusive privileges.
13) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
14) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water

The applicant is proposing to install oyster shells in bags to create 4 new oyster sills
within Bald Head Creek in the Village of Bald Head Island in Brunswick County.
Areas of Environmental Concern (AEC's) impacted by the proposal are EW and PTA.
The area is open to the harvesting of shellfish and is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the Bald Head Island Land Use Plan
and offer the following comments.
The general area of the project is classified as Low Density Residential and Conservation.
In general, Bald Head Island allows development which is consistent with the State's
minimum use standards. The Village of Bald Head Island Land Use Plan contains some
policies, which exceed the State's minimum use standards. However, none of these
policies appear to be applicable to this proposal.
This project is consistent with the Village of Bald Head Island Land Use Plan.

Your work is authorized by the above referenced permit provided it is accomplished in strict accordance with the enclosed
Conditions, your application received in our office on 6/27/2018, and the enclosed plans Bald Head Creek Oyster Sites 2018:
Sheets 1-6 dated 03/08/2018. Any violation of the attached conditions or deviation from your submitted plans may subject the
permittee to a stop work order, a restoration order, a Class I administrative penalty, and/or appropriate legal action.
This verification will remain valid until the expiration date identified below unless the nationwide authorization is modified, suspended
or revoked. If, prior to the expiration date identified below, the nationwide permit authorization is reissued and/or modified, this
verification will remain valid until the expiration date identified below, provided it complies with all requirements of the modified
nationwide permit. If the nationwide permit authorization expires or is suspended, revoked, or is modified, such that the activity would
no longer comply with the terms and conditions of the nationwide permit, activities which have commenced (i.e., are under construction)
or are under contract to commence in reliance upon the nationwide permit, will remain authorized provided the activity is completed
within twelve months of the date of the nationwide permit's expiration, modification or revocation, unless discretionary authority has
been exercised on a case -by -case basis to modify, suspend or revoke the authorization.
Activities subject to Section 404 (as indicated above) may also require an individual Section 401 Water Quality Certification. You
should contact the NC Division of Water Resources (telephone 919-807-6300) to determine Section 401 requirements.
For activities occurring within the twenty coastal counties subject to regulation under the Coastal Area Management Act (CAMA), prior
to beginning work you must contact the N.C. Division of Coastal Management in Wilmington, NC, at (910) 796-7215.
This Department of the Army verification does not relieve the permittee of the responsibility to obtain any other required Federal, State
or local approvals/permits.

Oyster bags in Bald Head Creek. Project Narrative
Bald head creek situated at the mouth of Cape Fear River between Bald Head Island and Middle
Island is a relatively pristine creek used for a variety of different recreational activities such as
fishing, canoeing and boating.
We the Bald Head Island Conservancy in collaboration with a group of local volunteers and the
Village of Bald Head Island propose to add oyster shells filled in bags to 4 different locations in
the creek. The oyster shells added to these 4 locations will provide the foundations for further
oyster growth that will likely result in even better water quality throughout the creek to the
benefit of all users of the creek as well as a breeding ground for many different commercially
caught fish in the ocean surrounding bald head island.
We propose to use the bags to secure the oyster shells stay in place and we will only place the
bags in areas with no current vegetation. None of the 4 sites are near private property and the
sites will not impact boat traffic in the creek.

RECOMMENDATIONS FOR— Bald Head Creek Oyster Project June 20, 2018
It is the opinion of this office that the proposed work is CONSISTENT with the Use Standards for
Estuarine Waters and Public Trust Areas, as set forth in NCAC 07H .0206 & .0207. In the absence of
any concerns from the commenting agencies, it is recommended that a permit be issued subject to the
standard marsh sill and following conditions:
In order to protect water quality, runoff from the construction must not visibly increase the
amount of suspended sediments in adjacent waters.
2. The alignment of the permitted oyster bag sills shall be staked by the permittee and approved
by a representative of the Division of Coastal Management within a maximum of 30 days
prior to the start of construction.
3. The permittee and his contractor shall schedule a pre -construction conference with the
Division of Coastal Management and the U.S. Army Corps of Engineers prior to the initiation
of any work.
4. All new oyster bags shall not be placed in areas where there is an existing oyster reef.
5. No filling of coastal wetland areas is authorized by this permit.
6. Appropriate sedimentation and erosion control devices, measures or structures must be
implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses
and property (e.g. silt fence, diversion swales or berms, sand fence, etc.).
NOTE: This permit does not eliminate the need to obtain any additional state, federal or
local permits, approvals or authorizations that may be required.

The Department of Environmental Quality hereby gives public notice as required by NCGS 113A-
119(b) that the following applications were submitted on June 11, 2018 for development permits in Areas
of Environmental Concern on Bald Head Island, in Brunswick County, as designated under the CAMA:
The Bald Head Island Conservancy proposed to create four new oyster sills within Bald Head
Creek, adjacent to N. Bald Head Wynd; and William Waddell proposed to replace an existing bulkhead,
add a walkway and riprap at 14 Windward Cf., adjacent to Bald Head Creek. Copies of these applications
can be examined or copied at the office of Tara MacPherson, N.C. Dept. of Environmental Quality,

To find the project site from the Bald Head Island Ferry Landing travel on Marina Wynd and turn
right onto N. Bald Head Wynd. Travel approximately 0.3 miles to the public boat access, which will
be on your left. The first and northern most oyster sill site will be accessible from either adjacent
channel leading to the main run of Bald Head Creek. The project sites are located within Bald Head
Creek adjacent to North Bald Head Wynd. The contact for the project is Mr. Poul Lindegaard of the
Bald Head Conservancy. He can be reached at 910 457-0089 Ext. 21. The entire project site is
bordered by undeveloped State of North Carolina Owned marshland.
Bald Head Island is part of an island group known as Smith Island, located at the confluence of the
Cape Fear River and Atlantic Ocean between Fort Fisher and Oak Island/Caswell Beach in Brunswick
County. The island is accessed by private boat or a private ferry service from Southport. This project
area is located within Bald Head Creek in the northwestern part of the island and encompasses
approximately 3000 linear ft. Adjacent vegetation that exists in the creek consists primarily of Smooth
Cord Grass (Spartina alternii lora). Water depths within the project area range from -0 ft. to -4. ft. at
Normal Low Water (NLW). The project area is located within the Estuarine Water and Public Trust
Areas of Environmental Concern (AECs).
The Village of Bald Head Island Land Use Plan classifies adjacent waters as Conservation, and the
adjacent high ground portion of the project area as Low Density Residential. The waters of Bald Head
Creek are classified as SA/HQW by the North Carolina Division of Water Resources. The waters are
not designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are
OPEN to the harvesting of shellfish.

The applicant is proposing to install oyster shell in netted bags at four locations within Bald Head
Creek for water quality and habitat improvement. According to the applicant, the four oyster sill
sites proposed within the creek are outside of the existing channel and are not within coastal wetland
areas. As proposed, oyster shell within netted bags, measuring approximately 8 inches wide and 16
inches long, would be placed at each project site providing a foundation for future oyster growth.
The number of bags and alignment varies at each site (see MP-2 and Sheets 3-6) All four proposed
sills will be in areas where water depths are -0 ft. at Normal Low Water. All 4 project sites are
within an approximately 3,200 linear ft. section of Bald Head Creek (see Sheet 1 of 6).
Specific dimensions for each project site are outlined in Sheets 3 to 6 of 6. Project Site 1 is proposed
as a 50 ft. long by 4 ft. wide oyster sill consisting of approximately 225 bags. Project Site 2 is
proposed as a 7 ft. long by 4 ft. wide oyster sill consisting of approximately 30 bags. Project Site 3 is
proposed as an 18 ft. long by 4 ft. wide oyster sill consisting of approximately 80 bags, this site is
adjacent to an existing natural oyster reef. Project Site 4 is proposed as a 50 ft. long by 4 ft. wide
oyster sill consisting of approximately 225 bags. All proposed project sites will have a maximum
height of 1 ft. Bags are not proposed to be stacked and will be placed in a single layer. All work is
proposed to be conducted via boat from Bald Head Creek and oyster bags would be placed by hand,RECIVED

10. ANTICIPATED IMPACTS:
The proposed oyster sill structures would incorporate approximately 500 sq. ft. of Estuarine Waters
and Pubic Trust Area within Bald Head Creek. The proposed sills would extend along the shoreline in
4 locations within Bald Head Creek, which measures approximately 232 ft. - 340 ft. across in these
areas. The structures would be located in water depths of -0 ft. at NLW and would not result in any
Coastal Wetland impacts. The proposed sills would not encroach into either the existing channel or
private property. Minor increases in turbidity should be expected during construction.

Oyster bags in Bald Head Creek. Project Narrative
Bald head creek situated at the mouth of Cape Fear River between Bald Head Island and Middle
Island is a relatively pristine creek used for a variety of different recreational activities such as
fishing, canoeing and boating.
We the Bald Head Island Conservancy in collaboration with a group of local volunteers and the
Village of Bald Head Island propose to add oyster shells filled in bags to 4 different locations in
the creek. The oyster shells added to these 4 locations will provide the foundations for further
oyster growth that will likely result in even better water quality throughout the creek to the
benefit of all users of the creek as well as a breeding ground for many different commercially
caught fish in the ocean surrounding bald head island.
We propose to use the bags to secure the oyster shells stay in place and we will only place the
bags in areas with no current vegetation. None of the 4 sites are near private property and the
sites will not impact boat traffic in the creek.

DCM-MHD CITY
Bald head creek situated at the mouth of Cape Fear River between Bald Head Island and Middle
Island is a relatively pristine creek used for a variety of different recreational activities such as
fishing, canoeing and boating.
We the Bald Head Island Conservancy in collaboration with a group of local volunteers and the
Village of Bald Head Island propose to add oyster shells filled in bags to 4 different locations in
the creek. The oyster shells added to these 4 locations will provide the foundations for further
oyster growth that will likely result in even better water quality throughout the creek to the
benefit of all users of the creek as well as a breeding ground for many different commercially
caught fish in the ocean surrounding bald head island.
We propose to use the bags to secure the oyster shells stay in place and we will only place the
bags in areas with no current vegetation. None of the 4 sites are near private property and the
sites will not impact boat traffic in the creek.

The Division of Coastal Management hereby acknowledges receipt of your application for State approval
to install four oyster sills in Bald Head Creek located at Bald Head Island, Brunswick County. It was received as
complete on June It, 2018 and appears to be adequate for processing at this time. The projected deadline for
making a decision is August 25, 2018. An additional 75-day review period is provided by law when such time is
necessary to complete the review. If you have not been notified of a final action by the initial deadline stated above,
you should consider the review period extended. Under those circumstances, this letter will serve as your notice of
an extended review. However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from June It, 2018, you may request a
meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of your
project. Such a meeting will be held within five working days from the receipt of your written request and shall
include the property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of
your proposed development. You should post this notice at a conspicuous point along your property where it can be
observed from a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the
road right-of-way fronting your property; or at a point along the road right-of-way where a private road would lead
one into your properly. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the
appropriate State or Federal agency. Please contact me if you have any questions and notify me in writing if you
wish to receive a copy of my field report and/or comments from reviewing agencies.
