Authorizing development in Beaufort County at on Tranters Creek, at 102 Arbor Drive,
near Washington as requested in the pernuttee's application dated 11/6/17, including attached
workplan drawings (2), both dated 10/25/17.
This permit, issued on March 2, 2018 is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
)r mese terms may be subject to tines, imprisonment or civil action; or may cause the permit to be null anct vota.
Docking Facility
1) This permit authorizes only the additional lift bunks and boathouse over existing and proposed lifts,
and other structures and uses located in or over the water that are expressly and specifically set forth
in the permit application. No other structure, whether floating or stationary, shall become a
permanent part of this docking facility without permit modification. No non -water dependent uses of
structures shall be conducted on, in or over Public Trust waters without permit modification.
2) The pemiittee shall install and maintain at his expense any signal lights or signals prescribed by the
U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum,
permanent reflectors shall be attached to the structure in order to make it more visible during hours of
darkness or inclement weather.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2021
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
This permit authorizes an additional formalized slip, for a maximum of 3 formalized boat slips.
The boathouse shall not be completely enclosed or have side coverage more than one half the height of
the side, from the roof waterward.
` The authorized boathouse shall be single story, and shall not be designed to allow for second story use.
o attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
aters at or adjacent to the authorized work.
General
permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
en approval of the Division of Coastal Management.
The permittee shall maintain the authorized work in good condition and in conformance with the terms
.and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
Ei , This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action ID SAW-2018-00134), issued 3/2/18.
The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4144 and assigned the project DWR Project No. 2017-1644.
GE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 946-6481 prior to the commencement of any
such activity for this determination. The permittee is further advised that many land disturbing
activities are not authorized within 50 feet of the normal water level unless specifically exempted
by Environmental Management Commission's (EMC) Tar Pamlico/Neuse River buffer
regulations in place at the time of such development.
An application processing fee of $250 was received by DCM for this project.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and
where applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The
original (buff -colored form) is retained by you and it must be available on site when the project is
inspected for compliance. Please sign both the original and the copy and return the copy to this office in
the enclosed envelope. Signing the permit and proceeding means you have waived your right of appeal
described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS
113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter
150B with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714,
(919) 733-2698 within twenty (20) days of this decision on your permit. You should also be aware that
another qualified party may submit an objection to the issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work
must be carried out in accordance with your application. Modifications, time extensions, and future
maintenance requires additional approval. Please read your permit carefully prior to starting work and
review all project plans, as approved. If you are having the work done by a contractor, it would be to your
benefit to be sure that he fully understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we
request that you complete and mail the enclosed Notice Card just prior to work initiation. However, if
questions arise concerning permit conditions, environmental safeguards, or problem areas, you may
contact Department personnel at any time for assistance. By working in accordance with the permit, you
will be helping to protect our vitally important coastal resources.

to undertake development activities to add an additional slip and boathouse, on Tranters Creek,
in Beaufort County.
Although processing of the application is nearing completion, additional time is needed for this

Staff has reviewed the proposed project regarding rules found in Subchapter 7H concerning development in a
Public Trust Area. It is staff s recommendation that the proposed project appears consistent with 15A NCAC 07H
.0208 as described below.
This office feels the development is consistent with 15A NCAC 07H .0208(bx6)(B) which states in part that
"The total square footage of shaded impact for docks and mooring facilities allowed shall be eight square feet per
linear foot of shoreline with a maximum of 2,000 square feet". The applicant has proposed a total of 969 square feet
of platform. The total platform allowed on this property with 125 linear feet of shoreline is 1,000 square feet.
Staff recommends the permit be issued with standard conditions for docking facilities.

Consistency Determination: The request is consistent with/not in conflict with the 2007 City of
Washington CAMA Core Land Use Plan certified by the CRC on November 30, 2007.
Overview: The .5-acre property has approximately" 125 linear feet of shoreline. Existing site
improvements includes a single-family residence, retaining wall, 400ft2 boathouse, uncovered 13'
x 13' boatlift and 400 ft2 of uncovered platform. The applicant also has an uncovered deck located
immediately landward of the bulkhead. The applicant is proposing to add two additional bunk
boards to the existing uncovered boatlift to create an additional slip, as well as cover the boatlift
with a 12' 6" x 13' 7" roof at 102 Arbor Drive, in the City of Washington ETJ, Beaufort County, North
Carolina.
The project is in the Public Trust Area (PTA) Areas of Environmental Concern (AEC). The project is
located along the Tranters Creek; the water is classified as C/SW/NSW, are closed to the taking of
shellfish. The project is located within the Tar -Pamlico Basin and subject to the Tar -Pamlico Basin
Buffer Regulations. A review of PNA, SAV, and archaeological/cultural resources was not provided.
Anticipated impacts resulting from this project are expected to include: the additional shading of
169 ft2 of creek bottom, for a total shading impact of 969 ftZ.
Basis for Determination:
The project site is in the ETJ of the City of Washington and is subject to the town's 2007 Land Use
Plan. The Future Land Use Map (FLUM) designates the site as Medium Density Residential.
Medium Density Residential is defined in the LUP as follows (pg. 227): The Medium Density
Residential land use category is primarily intended for residential development of single-family
homes on lots between 8,000 and 14,000 square feet in size. Residential densities shall be three (3)
to five (5) dwelling units per acre, depending on lot size. This land use category also allows for

Planned Unit Developments (PUD). PUDs are developments that allow for innovation in land use
that varies from standard single-family/single use projects as long as they meet certain minimum
standards, such as density remaining below or equal to one dwelling unit per every 6,000 square
feet of land.
Allowable Density: Densities will be three (3) to five (5) dwelling units per acre, depending on lot
size.
Impervious Surface: The maximum impervious surface shall be 40% coverage of a parcel. Where
impervious surface coverage exceeds 2535, an on -site stormwater management plan will be
required. This plan should address the first 1-112 inches of rainfall on -site.
Maximum Building Height: The maximum building height shall be 50 feet.
Permitted Uses: Single-family residential, open space, recreation, and conservation
Land Use Policies: The following LUP policies may be applicable to this request.
P.29 (pg. 193) Except for policy P.74 and implementing actions 1.24 and 1.25, residential, commercial, and
industrial development which meets 15A NCAC 7H use standards will be allowed in estuarine horeline,
estuarine water, and public trust areas. Policy P.74 and implementing actions 1.24 and 1.25 are more
restrictive than 15A NCAC 7H because the city desires greater control/protection.
P.34 (pg. 194) As stated elsewhere in this plan, with the exception of policy P.74 and implementing actions
1.24 and 1.25, the City of Washington supports the enforcement of 15A NCAC 7H in areas of environmental
concern.
P.69 (pg. 205) The City of Washington supports the Tar -Pamlico River Basin Water Quality Management
Plan and the Tar -Pamlico stormwater rule (see pages 99-100 Billand 102-106).

Mr. Anderson has submitted a CAMA Major Permit request for development onsite his
property. The project site is a single-family residential lot with a bulkheaded shoreline located off
SR 1455 at 102 Arbor Drive on Tranters Creek near the City of Washington in Beaufort County,
North Carolina. The lot is approximately .5 acres (21,780 ft2) in size and has approximately 125
linear feet of shoreline. Man-made features on the lot include a single-family residence, retaining
wall, f 400 square foot boathouse, uncovered 13' x 13' boatlift and 400 square foot of uncovered
platform (total existing platform square footage including the boathouse and platform is 800). The
applicant also has an uncovered deck located immediately landward of the bulkhead. The boathouse
is oriented parallel to the bulkhead while the uncovered boatlift is perpendicular to the bulkhead.
CAMA General Permit No. 68423-B was issued on 20 April 2017 for the construction of these water
dependent structures.
Tranters Creek is approximately 220 feet in width at the project site. Water depth at the
terminal end of the docking facility is approximately 30 feet below Normal Water Level(NWL). The
existing number of slips is two. Landward of the NWL the elevation gradually slopes upward to an
approximate elevation of ±10' above the NWL. The lot is mostly vegetated with lawn grasses,
ornamental shrubs and lawn trees. There are no Coastal Wetlands located at the project location.
Both the adjacent upstream and downstream property is a developed single-family residential lot
with a pier and a bulkheaded shoreline.
Tranters Creek is classified as C SwNSW by the Environmental Management Commission at
the project site. Tranters Creek at this location is designated Inland Waters and is not open to shell
fishing. The project is located within the Tar -Pamlico River Basin and therefore subject to the Tar -
Pamlico Basin Buffer Regulations.
Project description
The applicant proposes to add two additional bunk boards to the existing uncovered boatlift
to create an additional slip, as well as cover the boatlift with a 12'6" x 13' 7 ' roof. This will create a
total of 3 slips and will create the total shading impacts of 969 W. This new development is located
greater than 15' from the adjacent riparian property line.
Anticipated impacts
The project will result in the shading of an additional 169 ft2 of Creek bottom. The total
platform square footage will be 969 ft2. The docking facility will have a total of 3 fixed slips.

The NC Division of Coastal Management hereby acknowledges receipt of your application for
State approval for development of your property located off SR 1455 at 102 Arbor Drive on
Tranters Creek near the City of Washington in Beaufort County, North Carolina. It was received
on 6 November 2017, and appears to be adequate for processing at this time. The projected
deadline for making a decision is 20 January 2018. An additional 75-day review period is provided
by law when such time is necessary to complete the review. If you have not been notified of a final
action by the initial deadline stated above, you should consider the review period extended. Under
those circumstances, this letter will serve as your notice of an extended review. However, an
additional letter will be provided on or about the 75th day. Kelly Spivey, Field Representative for
the Division of Coastal Management is responsible for processing your permit and he can be
