Mr. Brad Connell ^ March 9, 2022 t NC Division of Coastal Management O 400 Commerce Ave. Morehead City, NC 28577 Re: 110/108 Branson Lane, Gloucester, NC Mr. Connell, I object to the proposal of a dock and 4 boat slips being built on the above property and I DO NOT wish to waive the 15' setback requirement. I have read the conditions required for building piers and docking facilities in North Carolina, and it appears most requirements have been met by the proposal. However, the drawing that I was provided does not show my property line or the Riparian Access Corridor lines for any property, which I believe are a requirement for the permit. I am concerned that the dock could extend into my Riparian Access Corridor due to the bend in the shoreline. I would like to see a drawing including my property, the Riparian Access Corridor lines, and the channel along with the proposed dock alignment. Also, an area that does not comply with state guidelines is that it will "significantly affect ...scenic values" of my property. Although there are other docks on Sleepy Creek that are close to the same length of the proposed dock, the ones near my property are much shorter and less impactful to my view. The approximate 45-degree angle that the shoreline takes in this section of the creek adds to the invasive visual effect to my property of such a long dock. Another concern is that Sleepy Creek has gifted up considerably since I've obtained this property and will continue to do so. It won't be long before these docks and slips will not have access to deep enough water to be useful for the purpose they were built. There will be no access to a channel for boating without extending the dock further, which is not appropriate. Sleepy Creek is a pristine body of water which I'm told is lending itself more to less intrusive water sports like kayaking and paddleboarding. For the record, I would like it to be noted that I oppose this proposal. I have attached a photo of the completed Adjacent Riparian Property Owner Notification/Waiver form, as well. The owner proposes to build a fixed dock. You also asked about the distance to get to 2' of water from where the lifts will be. Prior to his departure from DCM, Ryan Davenport determined that the pier length for this project is limited to the established 175' pier head line along this shoreline, as measured from the waterward edge of marsh. Due to this limitation the surveyor who provided the normal low water depths took few soundings beyond the 175' measurement. However, using the data he has he extrapolated an estimated distance of about 50' from the proposed lift locations to 2' normal low water. A question has arisen regarding the moratorium for in -water work. Does the moratorium only apply to installation of pilings, or are girders, stringers, decking, etc. also included in this moratorium? I have highlighted recommendations from your emails and have listed below a summary of the conditions you are recommending for this project, as I understand. I have discussed the conditions with the owner, who has agreed to comply. Please note that he prefers the sling style lifts. The substrate appeared to be fairly soft and easily disturbed (i.e. turbidity increases easily when sediment is disturbed). With that in mind, there is some concern with the water depths being under 2 feet. Use of a lift with that type of substrate has the potential to re -suspend material with each use. Using a sling style would cause less impact than a hard lift that doesn't have stops. Including stops at the recommended 18 inches above the substrate helps to minimize impacts with hard lifts, but that puts a fairly significant restriction on when vessels can get in and out. I think that if the applicant is willing to include the stops at 18 inches, that would be the preferred option. If that poses too much of a restriction, I think that a sling style would be acceptable. I also noticed lots of little clumps of shellfish scattered throughout the area. I wasn't completely sure of the structure's potential alignment, so I can't say for sure that there will or will not be any within the footprint. I'd recommend that it be positioned in a way to minimize shellfish disturbance (i.e. trying to avoid piling placement where there's a shellfish cluster, maximum piling spacing, etc.). If any shellfish are in an unavoidable location, they should be relocated to a nearby location outside of the impact area. I can provide additional guidance on this if necessary. I do have a couple follow-up questions, but these shouldn't impact my thoughts on the project. First, how far is it to get to 2 feet of water from where the lifts will be? Also, was this going to be a floating dock or will it be fixed? The plans make it seem like it'll be fixed, but I wanted to just check on that. Overall, my site visit didn't change my opinion. I didn't see any reason to object to the permit, as long as the above recommendations and the moratorium are included as conditions. Jimmy, We appreciate your agreeing to make an onsite visit, hopefully next week, to confirm no objections from DMF regarding the proposed 4-slip shared dock to serve the Sleepy Creek Subdivision in Gloucester, Carteret County. The proposed dock would overlap the shared property line between Lots 8 and 9, located at 110 Branson Lane and 108 Branson Lane. DCM is limiting the dock length to 175', measured from the waterward edge of any wetlands bordering the site. Attached is a copy of the Sleepy Creek Subdivision plat, a report of normal low water depths (prepared by Brent Lanier, PLS of the Lanier Surveying Company) with an aerial photo with water depths and a drawing of the proposed dock layout. Please note that the dock layout was prepared by our client. Based on a review by my project engineer the design should be considered for illustrative purposes only, and will likely require some revisions to the internal slip dimensions as shown within the t-head platform. I've reviewed everything you sent over and have the following thoughts/recommendations/etc. Your email notes that the applicant would like to construct a joint pier with 4 slips. DMF typically recommends that subdivisions utilize "community piers" rather than individual piers for properties. Therefore, the proposal to build a shared structure is aligned with minimization measures typically recommended by DMF. Incorporating the grated fiberglass materials can result in a significant reduction in shading, depending on the material design (various options offer various levels of light penetration). In regards to the vessel slips, the preference would be to include slings rather than a conventional lift. If a conventional lift is used, incorporating stops at approximately 18 inches should help to minimize impacts associated with continued use. But, as noted above, the preference is to use a sling -style lift, as these have been found to be less impactful than conventional lifts. DMF would also consider including sling -style lifts or stops on conventional lifts as additional minimization measures. As this area is designated as PNA, the only recommendation that I'd make based on what was provided is adherence to the standard I April through 30 September moratorium for in -water work. Hi Jimmy, Thank you for accepting my call this afternoon We are working with an owner whose property fronts Sleepy Creek in Gloucester in Carteret County. He has purchased an entire undeveloped subdivision (Sleepy Creek Subdivision) for the use of his family. He would like to build a 4-slip dock for his family members' use. The subdivision contains 3 waterfront lots and a common area that has a small section of waterfront. He would like to build a joint pier on the property line between 2 of the lots under a general CAMA permit that allows up to 4 slips for joint piers. Sleepy Creek is a PNA. CAMA is restricting the length of the pier to 175' (measured from waterward edge of coastal wetland vegetation) to comply with the existing pier head line along this waterbody. Please see the attached report of water depths prepared by surveyor Brent Lanier (Lanier Surveying Company). While we were able to get -2.0' NLW along the pier head line at an adjacent property (157 Boardman Road), we are getting - 1.7' NLW between Lot 8 (110 Branson Lane) and Lot 9 (108 Branson Lane) at 175'. As a result, DCM cannot issue a general permit and a major permit will be required. Please note that the owner will also be held to the pier head line (175') under a major permit.
