To Whom It May Concern:
Through coordination with the North Carolina Division of Coastal Management, we have
learned of your request to modify the work associated with your Department of the Army (DA)
permit issued on March 20, 2018, which authorized the construction of a commercial docking
facility, new restaurant, and to install rip rap along the shoreline at a site located adjacent to the
AIWW and Holden Beach Bridge, at 1299 Cedar Landing Road, Supply Brunswick County,
North Carolina. The requested modifications include requests to modify the existing permit by
relocating the authorized floating dock and extension of the authorized pier. The request states
that the pier would be extended 5' waterward and relocate the floating dock 5' waterward.
Your proposal continues to be consistent with the provisions and objectives of general
permit No. 19800291 (copy enclosed). The permit is hereby modified. It is understood that all
other conditions of your permit remain applicable. The expiration date of your DA permit is
December 31, 2021.

Mr. Michael Norton, acting agent for 2 Chairz, LLC, is requesting a Minor Modification to State Permit No. 21-18, for
the relocation of the authorized floating dock and extension of the authorized pier. The request states that the pier
would be extended 5' waterward and relocate the floating dock 5' waterward. As proposed, all pilings would be landward
of the floating docking and the Federal Channel Setback, however, the floating dock would encroach 5' into the channel
setback. No additional slips are being proposed. According to an e-mail (enclosed) from Justin Amette, CIV USARMY
CESAW dated June 18, 2018, the Navigation Branch would not object the floating dock encroaching into the setback
as long as the pilings do not.

On behalf of the subject project owners, we submit this Minor Modification Request for
proposed changes to the previously approved pier and floating dock. The project permit references
are: Coastal Resource Commission Permit No. 21-18, issued on March 7, 2018 and Action ID No.
SAW-2017-01994. Enclosed you will find revised plan sheets, and revised project narrative with
new paragraph detailing the revisions to the plan.
As depicted in the attached revised plan sheets and revised narrative, the following changes
are proposed:
• Shift floating dock 5' toward the centerline of channel.
III Extend 6' wide pier 5' toward the centerline of channel.
• Reconfigure the location of floating dock pilings to be outside of the navigation channel
setback line.

The approved plans (attached) show the 8' x 110' float outside the setback. The request is move the entire 8'x110'

I think this is the second modification to their plan that I have seen to this point. Do you know how far into the setback
the outside edge of the floater will be? Typically, we would not object to the change in plans as long as the piles are
outside of the setback, however with the change in plans we would need to know the size of the floater they would like
to put into the setback. Thanks.

I had a pre -construction meeting with the owner of 2 Chairz, LLC at 1299 Cedar Landing Road, Supply. They have a
major permit (#21-18) (USACE Action ID: SAW-2017-01994) to build a restaurant and a floating dock. As proposed, the
floating dock is outside the USACE setback. The owner would like to move the floating dock in to the setback while
keeping the piles outside the setback. He claims that there is insufficient water depth for larger vessels at MLW. What
is your recommendation for this request?

I'm waiting to hear back from Navigation on the Stewart dock, and will let you know what they say asap.
Other projects:
Received comments on Williams, Rider, & Southport Marina and need to send my comments/recommendations to you.
Christy is working on the Porter's Neck HOA project, and will copy you on our authorization. It is being reviewed under
RGP 125 and NWP 35
If Rizzo is just upland development the Corps has no comment.
Also have no comment/no objection to the Sam Cross mod. That one was in my inbox-came in on September 10.
Not sure, but I think the 2 Chairz mod was issued on our end and DCM should have been copied on that. I'll have to
check and get back with you.

I hate to bug you about this, but did you hear from Nav on the Stewart dock in CB? The contractor called me twice
yesterday since they are out there working currently so they're very eager to know if they can proceed.
Also, just wanted to touch base on the following CAMA Major Permit apps. We are hitting our 75 day mark in the next
few days on these two. I can extend the review period if need be, and that's totally fine, just wanted to check with you
first:
- Michael Williams, Pender Co. 104 Inlet Ct., you mentioned earlier it was going 291

- John and Carol Rider, NH Co. CB, 1614 Island Marina Drive, I've gotten concerned comments from a couple agencies on
this one so it may need to be extended anyways
There are also several minor mods in the works that I've been getting calls about, but those are usually last priority for
most.
- Porters Neck HOA (SAW 2015-01096), extend boat ramp on Bald Eagle Lane, NH Co.
- Dave Rizzo (SAW 2017-02583), change in impervious surface coverage for upland development Bald Eagle Lane, NH Co.
- 2 Chairz, LLC (SAW 2017-01994), move float into USACE setback by 8% but pilings will be outside setback, Brooks
coordinated with Justin in an email dated 6/18/18 where Justin said it would be ok, 1299 Cedar Landing Road, Bruns Co.
- Southport Marina (SAW 2001-00941, SAW 2006-32803) change in dredge depth/footprint, 606 W St in Southport,
Bruns. Co.
- Samuel Cross, (GP 56 SAW 2018-00351) add walkway to access authorized boatlift, 50 Raeford St, OIB, Bruns. Co. .

Hope you fared the storm well and are on the way back to normal. Just got a quick question for you. We issued a CAMA
Major Permit to Jeff and Jennifer Stewart at 201 Peninsula Drive in CB (you processed it as a 291- Action ID SAW-2018-
1401/201). Charles Duncan, the contractor is asking if they can move the floats out further into the water body (see
attached). Would this require additional authorization from the Corps? I know you're probably swamped, but Debbie
wanted me to run it by you before we can determine with we can do a refinement or a modification.

No problem! So it looks like the 2 Chairs mod letter never got issued, it was just filed. Since Nav has no objection to the
proposal I will issue a letter noting the plan revision. All other conditions will remain unchanged.

SUBJECT Permit Modification Request to State Permit No. 21.18, 2 Chairz, LLC,1299 Cedar Landing, near Supply,
in Brunswick County
Mr. Michael Norton, acting agent for 2 Chairz, LLC, is requesting a Minor Modification to State Permit No. 21-18, for
the relocation of the authorized floating dock and extension of the authorized pier. The request states that the pier
would be extended 5' waterward and relocate the floating dock 5' waterward. As proposed, all pilings would be landward
of the floating docking and the Federal Channel Setback, however, the floating dock would encroach 5' into the channel
setback. No additional slips are being proposed. According to an e-mail (enclosed) from Justin Arnette, CIV USARMY
CESAW dated June 18, 2018, the Navigation Branch would not object the floating dock encroaching into the setback
as long as the pilings do not.
State Permit No. 21-18 was originally issued on March 7, 2018 for construction of a restaurant, commercial docking
facility and a hprap revetment adjacent to the Atlantic Intracoastal Waterway. This permit is currently due to expire on
December 31, 2021.
This office has no objection to the modification of State Permit No. 21-18. Mr. Norton has submitted a check (check
No. 5585) in the fee amount of $100.
By copy of this memo, DCM is requesting that the USACE, DWR, DCM-Fisheries, and the LPO provide any
comments that your agency may have on the proposed project to Courtney Spears of DCM's Wilmington office
within 14 days of receipt of this memo.

I think this is the second modification to their plan that I have seen to this point. Do you know how far into the setback
the outside edge of the floater will be? Typically, we would not object to the change in plans as long as the piles are
outside of the setback, however with the change in plans we would need to know the size of the floater they would like

major permit (#21-18) (USACE Action ID: SAW-2017-01994) to build a restaurant and a floating dock. As proposed, the
floating dock is outside the USACE setback. The owner would like to move the floating dock in to the setback while
keeping the piles outside the setback. He claims that there is insufficient water depth for larger vessels at MLW. What
is your recommendation for this request?
