1) Unless specifically altered herein, this Minor Modification authorizes the upland redevelopment, all
as expressly and specifically set forth in the attached letter and workplan drawings. Any additional
development activities may require a modification of this permit.
Stormwater Management
2) The Division of Energy, Mineral and Land Resources (DEMLR) has determined this project will
require a Stormwater Management modification. The permittee shall receive a Stormwater
Management modification from DEMLR prior to the initiation of any construction. Any violation of
the permit approved by DEMLR shall be considered a violation of this CAMA permit.

I have had a chance to look at the revised plan sets and the attachments included with this email. This site was
permitted as a low density project with a BUA limit of 12%. In reading the description in the attached memo, the
impervious coverage is proposed to increase to 15.44%. This exceeds their original low density permit allowance. A
state stormwater permit modification will be required to demonstrate how this change will allow this site to continue to
meet the state stormwater rules and regulations.

The Cullipher Group, P.A. is requesting a minor modification to an existing LAMA Major Permit
#: 14-19 for the Shore Front RV Park located in Stella, NC. The tract's area is 12.04 acres with
approximately 3.54 acres of 404 wetlands and 0.83 acres of Coastal Wetlands on site. It is located along
the shore of White Oak River, SA;HQW (Stream Index: 20-(18)). To the north and east of the proposed
site is an open field with a single family residence and farm land; to the south is the White Oak River and
to the west is an existing RV Park owned and operated by the First & Last Child, LLC. The site is generally
mounded on the east side in the middle of the tract and runoff travels to the north and west to existing
wetlands and to the south toward White Oak River. A significant portion of the tract is in the flood zone:
AE9. The Owner is currently in the process of developing the tract per the existing permit. Erosion
Control measures have been installed, some grading and fill work has begun per the originally approved
drawings but, no impervious has been installed and none of the approved wetlands impacts or marina
components have begun.

These existing permits allowed for a low density development of a 56 lot RV park with a 56 slip
marina. The original design called for open slotted decks to be used at each RV lot to achieve low
density of 12% impervious coverage. The proposed modification requests that these open slotted decks
allowed to be covered porches, creating a high -density stormwater permit request. Transitioning from
low -density to high -density changes the means of stormwater conveyance, increases land disturbance
by less than 0.25 acres (for added swales, infiltration basin berm) and the inclusion of stormwater
infiltration basins. All other components shall remain as originally permitted. The marina layout and 56
slips remain unchanged; the fire apparatus road's location and alignment are the same and shall remain
washed #57 stone with its affiliated approved 404 wetland impacts staying the same; The number of RV
lots, road alignment and daily septic flows shall remain the same as will the water supply and other
utilities.
The proposed covered porches are not allowed to be greater than 300 SF in size and a typical
porch is 30'x10'. The addition of this 300 SF impervious area to all 56 RV lots is an increase of 16,800 SF
impervious area. The proposed total impervious is 75,416.46 SF, making the project 15.44% impervious.
Other technical changes consist of additional land disturbance within the 75' AEC for additional grading
for swales and the infiltration basin #1. There is also additional impervious within the 75' AEC for the
proposed porches at RV Lots 31-35.

The project does not vary from the previously approved permit with exception to each RV space is
proposed to have a covered deck. These covered decks cause the the impervious area to be greater
than 12% of the project area and now the site requires stormwater collection and treatment.

RV Spaces, road, utilities and storm drainage shall be constructed with typical grading and utility
installation equipment; backhoe, bull dozer, paving machines, etc.

activities consits of 2 infiltration basins, stormwater collection swales and piping and covered porches

This permit, issued on March 1, 2019 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
n mese terms may oe subject to rmes, unpnsonment or civil action; or may cause the permit to be null and void.
Marina
1) This permit authorizes only the docks, piers, platform, boat lifts and kayak launch, and other
structures and uses located in or over the water that are expressly and specifically set forth in the
permit application. No other structure, whether floating or stationary, shall become a permanent part
of this marina facility without permit modification. No non -water dependent uses of structures shall
be conducted on, in or over Public Trust waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
marina. Any sewage discharge at the marina shall be considered a violation of this permit for which
the permittee is responsible. This prohibition shall be applied and enforced throughout the entire
existence of the permitted structure.

This permit action may be appealed by the permittee or other Sinned by the authority of the Secretary of DEO and the
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2022
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

3) Any portion of the permitted access pier built over Coastal Wetlands shall not exceed six feet in width
and -shall -be elevated a minimum of threefeetover the wetland substrate -as measured fromthebottom of
the decking.
4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
5) This permit authorizes a maximum of 56 formalized boat slips.
6) The marina shall display a sign showing the location of the nearest pumpout facility, including other
appropriate waste disposal information, at the entrance and exit from the main pier.
7) This permit does not authorize the docking of any vessel equipped with a holding tank or similar waste
sanitation device.
8) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
9) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with
NCAC 15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or
excavation within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat
propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire
existence of the permitted structure.
Shoreline Stabilization - Bulkhead
10) The bulkhead shall be constructed in accordance with the alignment depicted on the attached workplan
drawings.
11) No vegetated wetlands or open water shall be excavated or filled, even temporarily.
12) The alignment of the authorized bulkhead shall be staked by the permittee and verified by a -
representative of the Division of Coastal Management within a maximum of 30 days prior to the start of
construction.
13) The bulkhead shall be constructed prior to any backfilling activities.
14) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the
structure.
15) The fill material shall be clean and free of any pollutants except in trace quantities.
16) All backfill material shall be obtained from a high ground source and confined behind the permitted
bulkhead.

17) No backfill material is to be placed within 30 feet of the normal high water line, except that which will
be used to backfill the area behind the permitted bulkhead.
Sedimentation and Erosion Control
18) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of
grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately
landward of the bulkhead cap immediately following completion of backfilling activities.
19) An Erosion and Sedimentation Control Plan will be required for this project. This plan must be filed at
least thirty (30) days prior to the beginning of any land disturbing activity. Submit this plan to the
Division of Energy, Mineral and Land Resources, Land Quality Section, 127 Cardinal Drive Extension,
Wilmington, NC 28405.
Upland Development
20) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities
associated with the development of the above referenced property, including the 56 RV lots, roads,
parking spaces, and other associated infrastructure, all as expressly and specifically set forth in the
attached permit application and workplan drawings.
Stormwater Management
21) The Division of Energy, Mineral and Land Resources (DEMLR) has determined this project will require
a Stormwater Management permit. The permittee shall receive a Stormwater Management pemut from
DEMLR prior to the initiation of any construction. Any violation of the permit approved by DEMLR
shall be considered a violation of this CAMA permit.
Easement
22) An Easement from the Department of Administration's State Property Office may be required under
N.C.G.S. 146-12(e). The permittee shall contact the State Property Office prior to the initiation of
construction of any structures over state-owned submerged lands to determine if such an easement will
be required. Any required easements shall be obtained, and a copy provided to the Division of Coastal
Management, prior to the construction of any new boat slips or other docking facilities authorized under
this permit.
USACE Conditions
23) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must
implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly adhere to all
requirements therein. The guidelines can be found at http://www.fws.gov/nc-
es/mammal/manatee_guidelines.pdf.
24) In order to compensate for impacts associated with this permit, mitigation shall be provided in
accordance with the provisions outlined on the most recent version of the attached Compensatory

25) This permit shall not be assigned, transferred, -sold, or otherwise disposed of to,a third party without the
written approval of the Division of Coastal Management.
26) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the
permitted activity without having it transferred to a third party.
27) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The permittee is advised that if water utilities or new wells are required to service the authorized
development, plans and specifications for all new waterlines should be submitted and approved
by the Public Water Supply Section prior to the initiation of construction. Furthermore, water
supply wells must be approved by the county in which the subject property is located, and local
cross -connection requirements maybe required. Public Water Supply can be contacted at (910)

NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000,291 (Action ID SAW-2015-02554) issued 2/26/19.
NOTE: The N.C. Division.of Water Resources authorized the proposed project by way of General Water
Quality Certification 4144 and assigned the project DWR Project No. 2018-1471.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 808-2808 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal water level.
NOTE: An application processing fee of $400 was received by DCM for this project. This fee also
satisfied the Section 401 application processing fee requirements of the Division of Water
Resources.
