Sunset Beach NC 28468 Authorizing development in Brunswick County at adi. to Sunset Beach and seaward of 3rd through 13m St. in Sunset Beach , as requested in the permittee's application dated 8/17/21, including attached workplan drawings (6) Sheets 1-6 of 6 all dated 8/17/21. This permit, issued on March 4, 2022 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to oe mutt ana vota. Excavation 11) No excavation shall take place outside of the area indicated on the workplan drawings. 2) Excavation shall not exceed -5 feet with a -I foot over dredge allowance, all below the mean low water level. In no case shall the depth of excavation exceed the depth of connecting waters. 3) The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2025 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee L s 1 Town of Sunset Beach ADDITIONAL CONDITIONS Permit No. 79-19 Page 2 of 4 4) In order to ensure compliance with the conditions of this Permit, and in order to ensure that each proposed excavation event follows the authorized alignment as depicted in the attached workplan drawings, the permittee and his contractor shall schedule a pre -construction conference with the Division of Coastal Management, the U.S. Army Corps of Engineers, the N.C. Wildlife Resources Commission, and N.C. Division of Water Resources prior to the initiation of any dredging or mobilization activities. In order to facilitate these discussions a complete set of project plans shall be provided to all listed agencies at the time of each request for a pre -construction conference. Primary Offload Site - Seaside Rd._ 5) Unless specifically altered herein, this permit authorizes one temporary gabion offload ramp, as indicated on the attached workplan drawings. 6) Placement of fill materials below normal water level shall be limited to one temporary gabion offload ramp. 7) No open water shall be excavated or filled, even temporarily, outside of the approved temporary gabion offload ramp alignment. 8) The alignment of the authorized temporary gabion offload ramp shall be verified by a representative of the Division of Coastal Management. 4) The gabion offload ramp shall be marked at 50-fdot intervals, starting with the landward edge of the structure and concluding at the terminal end, with yellow reflectors.extending at least three feet above mean high water. 5) The temporary gabion offload ramp fill material shall consist of clean granite, marl, or broken concrete with no exposed rebar. The temporary gabion offload ramp shall be of a sufficient size and design to prevent its movement from the approved alignment by wave or current action. The permittee shall be responsible for immediate removal of any materials or debris that becomes dislodged or moves outside the authorized.alignment. 6) The authorized temporary gabion offload ramp shall be dismantled upon the conclusion of dredging activities authorized under this major modification. All land above mean high water shall be regraded to preconstruction conditions at the conclusion of dredging activities. 7) The temporary gabion bulkhead located at the secondary offload site is only authorized in the event that the primary offload site located at Seaside Rd. is not used. In the event that the primary offload site is constructed but not used, the permittee shall dismantle. the primary offload site before construction of the secondary offload site can begin. I Town of Sunset Beach Permit No. 79-19 Page 3 of 4 ADDITIONAL CONDITIONS Secondary Offload Site - Cobia St. 8) No open water shall be excavated or filled, even temporarily, outside of the approved temporary gabion bulkhead alignment. 9) The alignment of the authorized temporary gabion bulkhead shall be staked by the permittee and verified by a representative of the Division of Coastal Management 10) The temporary gabion bulkhead shall extend a maximum of 7 foot waterward from the waterward edge of the existing bulkhead at any point along its alignment at the time of construction. 11) The temporary gabion bulkhead fill material shall consist of clean granite, marl, or broken concrete with no exposed rebar. Temporary gabion bulkhead shall be of a sufficient size and design to prevent its movement from the approved alignment by wave or current action. The permittee shall be responsible for immediate removal of any materials or debris that becomes dislodged or moves outside the authorized alignment. 12) No backfill material is to be placed within 30 feet of the mean high-water level, except that which will be used to backfill the area behind the permitted temporary gabion bulkhead and the existing bulkhead. 13) The authorized temporary gabion bulkhead shall be dismantled upon the conclusion of dredging activities authorized under this major modification. The fill material between the existing bulkhead and the temporary gabion bulkhead shall be removed in concurrence with the temporary gabion bulkhead removal. Dredge Material Disposal 14) The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. 15) No dredge material shall be placed within 30 feet of the mean high-water line. 16) No excavated or fill material shall be placed at any time in any vegetated wetlands/marsh or surrounding waters outside of the alignment of the fill area indicated on the workplan drawing(s). 17) The permittee and/or their contractor shall take all necessary precautions to ensure that the dredge material is properly contained during transport to the disposal site, and that all the proper coordination has taken place with the local or state governments to ensure that any damage to public streets caused by transport of the dredge material has been addressed. 18) All mechanized equipment will be regularly inspected and maintained to prevent contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of a spill of petroleum products or any other hazardous waste, the permittee shall immediately report it to the National Response Center at (800) 424-8802 and provisions of the North Carolina Oil Pollution and Hazardous Substances Control Act will be followed. r _ a Town of Sunset Beach ADDITIONAL CONDITIONS Oyster Relocation Permit No. 79-19 Page 4 of 4 19) Prior to the initiation of any dredging activities, the permittee shall, in coordination with the Division of Marine Fisheries, develop and implement an oyster relocation plan. Contact the Division of Marine Fisheries at (252) 808-8050 to initiate the required coordination. Notice of satisfactory completion of relocation efforts shall be provided to the Division of Coastal Management prior to initiation of dredging. Sedimentation and Erosion Control 20) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 21) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. General 22) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 23) All construction debris associated with the removal or construction of the permitted docking facilities shall be contained within the authorized project area and disposed of in an approved upland location. 24) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers has assigned the proposed project Action ID SAW-2019- 01.155. NOTE: The N.C. Division of Water Resources authorized the proposed project by way of 401 Water Quality Certification #W0004284 and assigned the project DWR Project No. 200201580. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high-water level. NOTE: An application processing fee of $475 was received by DCM for this project. Turbidity Standard The Permittee shall adhere specially to 15A NCAC 02B .0220 Tidal Salt Water Quality Standards for Class SC Waters.(12) pH: shall be normal for waters in the area, which generally shall range between 6.8 and 8.5 except that swamp waters may have a pH as low as 4.3 if it is the result of natural conditions; (19) Turbidity: the turbidity in the receiving water shall not exceed 25 NTU; if turbidity exceeds this level due to natural background conditions, the existing turbidity level shall not be increased. [15A NCAC 02B .0220] The Permittee shall conduct the following dredging effluent monitoring: Samples shall be collected at daily time intervals of one hour after system start-up, midway of the dredge process (6 hours) and one hour prior to system shutdown assuming a 12 hour day. The sampling shall be done following the longshore current just beyond the nea.rshore placement at 1000' and 2000' intervals beyond the discharge point. If the turbidity is above 25 NTU at the 2000' point, a third sample should be taken at the point where the turbidity is 25 NTU and that distance noted in the record. The Permittee shall maintain a record of the daily equipment calibration and sample results at the required sampling intervals. 4. Please understand that the waters around your project area have been identified by the Division of Marine Fisheries as Primary Nursery Area (PNA). Should the need for dredging within the proposed project area arise in the future, please be aware that new dredging within a PNA is not permitted under 15A NCAC 02B .0221 as it results in degradation of water quality standards and therefore is considered a water quality violation. 5. Eastern Channel Area is classified as SA;HQW by the Division of Water Resources (DWR) and has been determined to be a Primary Nursery Area (PNA) by the Division of Marine Fisheries (DMF). Please understand that the waters around your project area have been identified as a PNA, and should requests for dredging within the proposed project area arise in the future, they will be denied. Please be aware that new dredging within a PNA is not permitted under 15A NCAC 02B .0220. This activity results in degradation of water quality standards and is therefore considered a water quality violation. Any turbidity standard violations of waters going into these creeks are also considered Water Quality Violations. 6. The effluent water from the dredge spoil shall not be released into open shellfish waters unless Shellfish Sanitation and the DWR Wilmington (910-796-7215) Regional Office is notified and provide approval prior to the release. 7. The permittee shall report to the DWR Wilmington Regional Office any noncompliance with, and/or any violation of, stream or wetland standards [15A NCAC 02B .0200], including but not DocuSign Envelope ID: 3AB98D3F-C907-4A7A-AE76-C77565971C37 Town of Sunset Beach Navigation Project D W Rk20020158v4/ W Q0004284 Page 6 of 7 limited to sediment impacts to streams or wetlands. Information shall be provided orally within 24 hours (or the next business day if a weekend or holiday) from the time the permittee became aware of the non-compliance circumstances. S. No waste, spoil, solids, or fill of any kind shall occur in wetlands or waters beyond the footprint of the approved impacts (including temporary impacts). 9. When applicable, all construction activities shall be performed and maintained in full compliance with G.S. Chapter 113A Article 4 (Sediment and Pollution Control Act of 1973). Regardless of applicability of the Sediment and Pollution Control Act, all projects shall incorporate appropriate Best Management Practices for the control of sediment and erosion so that no violations of state water quality standards, statutes, or rules occur. Design, installation, operation, and maintenance of all sediment and erosion control measures shall be equal to or exceed the requirements specified in the most recent version of the North Carolina Sediment and Erosion Control Manual, or for linear transportation projects, the North Caroline Department of Transportation Sediment and Erosion Control Manual. All devices shall be maintained on all construction sites, borrow sites, and waste pile (spoil) sites, including contractor -owned or leased borrow pits associated with the project. Sufficient materials required for stabilization and/or repair of erosion control measures and stormwater routing and treatment shall be on site at all times. For borrow pit sites, the erosion and sediment control measures shall be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Surface Mining Manual. Reclamation measures and implementation shall comply with the reclamation in accordance with the requirements of the Sedimentation Pollution Control Act and the. Mining Act of 1971. 10. All mechanized equipment operated near surface waters shall be inspected and maintained regularly to prevent contamination of surface waters from fuels, lubricants, hydraulic fluids, or other toxic materials. Construction shall be staged in order to minimize the exposure of equipment to surface waters to the maximum extent practicable. Fueling, lubrication, and general equipment maintenance shall be performed in a manner to prevent, to the maximum extent practicable, contamination of surface waters by fuels and oils. 11. In accordance with 143-215.85(b), the permittee shall report any petroleum spill of 25 gallons or more; any spill regardless of amount that causes a sheen on surface waters; any petroleum spill regardless of amount occurring within 100 feet of surface waters; and any petroleum spill less than 25 gallons that cannot be cleaned up within 24 hours. 12. The permittee shall require its contractors and/or agents to comply with the terms and conditions of this permit in the construction and maintenance of this project, and shall provide each of its contractors and/or agents associated with the construction or maintenance of this project with a copy of this General Certification. A copy of this General Certification shall be available at the project site during the construction and maintenance of this project. This approval to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application shall expire upon expiration of the 404 or CAMA Permit. The conditions in effect on the date of issuance shall remain in effect for the life of the project, regardless of the expiration date of this Certification. The proposed project areas are in waters closed to shellfishing. Shellfish taken from closed waters should only be relocated to waters that are also closed to shellfishing. PROJECT DESCRIPTION: This is a second major modification request to State Permit No. 79-19. The project area is the Bay Area between 1503 & 1711 Canal Drive and between 1811 street to the Inlet, the end of Cobia Street and the end of Seaside Drive on the mainland, Brunswick County. The new proposed channel realignment extends the Bay Area primary channel by approximately 200 ft. along the southern shoreline and adds a secondary channel along the northern shoreline. The new proposal would add 0.3 acres of open water impact and increase the dredge volume by approximately 4,700 cubic yards. Both channels are proposed to be excavated to — 6 ft. MLW (- 5 +1). Two offload sites are proposed with temporary structures. One is located at the end of Cobia Street adjacent to the Feeder Channel on Sunset Beach and the other is at the end of Seaside Drive on the mainland adjacent to the A1WW and north of Jinks Creek. The original project area is on the eastern end of Sunset Beach between the island and Tubbs Inlet. The project is comprised of 4 man- made canals that connect to a Feeder Channel and a Bay Area to the south. Both the Feeder Channel and the Bay Area connect to South Jinks Creek. The shoreline of the Finger Canals is stabilized primarily by bulkheads, with some sections of riprap. The man-made canals border narrow residential lots heavily developed with single family residences and private docking facilities. The width of the canals is approximately 90 ft. and there are areas of oysters and coastal wetlands, mostly consisting of Salt Marsh Cordgrass (Spartina altern j?ora), established along the 3,200 linear ft. project area. The 3,500 linear ft. Feeder Channel project area is stabilized by bulkheads with undeveloped lots to the north. To the south, the Bay Area is stabilized primarily by bulkheads, with some rip rap and sparse vegetation including Sea Oxeye and Salt Marsh Cordgrass. The Bay Area project extends 2,200 linear ft. to the east with widths ranging from 130 ft. in with to 470 ft. nearest the confluence with Jinks Creek. Both the Feeder Channel and the Bay Area connect to the 1,700 linear ft. South Jinks Creek project to the east, which transitions into the Atlantic Ocean through Tubbs Inlet to the south and to the AI W W to the north. State Permit No. 79-19 was issued by CRC-VR-20-09 and Permit No. 79-19 was issued on March 3, 2020 for the excavation of the Finger Canals, Feeder Channel, Bay Area and South Jinks Creek with both upland disposal and beach fill. The depth of excavation was authorized to — 5 ft. below MLW for Finger Canals and to — 6 ft. below MLW for the Bay Area and South Jinks Creek. The dredging of the South links Creek area was proposed to be dredged to a final depth of -6 ft. (- 5 Ft. + 1 ft. over dredge) at MLW in an area measuring approximately 1,750 ft. in length by 100 ft. in width for a total volume of 40,500 cubic yards of material. The proposed template had a 5:1 slope throughout the dredge footprint. A previous maintenance event of the Finger Canals and Feeder Channel was conducted under State Permit No. 45-02, which expired on December 31, 2005. The dredging event authorized the removal of 38,164 cubic yards with excavation to a depth of— 5.2 ft. at MLW, this was the first maintenance event for the feeder system since State Permit No. 211-85. A Major Modification was issued on 9/10/20 for a nearshore placement are seaward of Sunset Beach between 31 through 131 streets. The placement of approximately 40,500 cubic yards within the nearshore area adjacent to Sunset Beach would impact up to 9.2 acres of coastal habitat within the project area. No work has been completed at this time. State Permit no. 79-19 is due to expire on 12/31 /24. This application references a Sediment Analysis for the Re -aligned channel(See Narrative and Tab F), SPBO conservation measures (Tab L), an EFH and Biological Assessment (Tabs H and I), Manatee Avoidance Guidelines (Tab J) and NMFS Recommendations (Tab K). Most documents were submitted with the previous project proposal and are being re -submitted for the proposed Bay Area channel re-alignment. The applicant has also included the certified property notifications that were sent out to property owners CEI t are closest to the proposed primary and secondary channels (see Attached documentation). Page 3 The area adjacent to the Bay Area is classified as Island Residential Sunset Beach Future Land Use Plan Map. The waters of the Bay Area are classified as SC by the Division of Water Resources. They ARE NOT designated as a Primary Nursery Area by (PNA) the N.C. Division of Marine Fisheries and they are CLOSED to shellfishing. 10, PROPOSED PROJECT: The applicant is proposing to re -align the primary channel and add a secondary channel within the Bay Area adjacent to the Town of Sunset Beach and install temporary structures at two offload sites. The project Narrative states that the proposed dredging project would change the authorized template for the Bay Area maintenance dredging in order to allow more local homeowners to access the channel from their individual docks. The original Bay Area footprint was a 2200 ft. long by 80 ft. wide channel that essentially went through the middle of the Bay Area connecting to South Jinks Creek. The proposed new alignment would result in two new channels, one primary channel along the southern Bay Area and one secondary channel along the northern Bay Area, from station 12+00 to station 24+00 (see Narrative and sheet C-102). The primary channel would be 1200 ft. long with a 30 ft. bottom cut extending up to a 55 ft. top cut with a 3:1 channel side slopes. The secondary channel would be 1000 ft. long with a 20 ft. bottom cut extending up to a 45 ft. top cut with a 3:1 channel side slopes. Both channels are proposed to be dredged to the original project depth of-6 ft. at MLW (-5+1). The channels would connect to South Jinks Creek which has an authorized project depth of -6 ft. at MLW. The new 2.3-acre impact increases slightly from the original alignment as does the dredge volume. According to the application, the dredge volume will increase from 12,200 CY to 16,894 CY within the Bay Area and the spoil will be placed in the previously permitted spoil site located at Georgetown Road. The application indicates that all dredging operations in this area would be conducted between October I and March 311 and that a minimum 10 ft. buffer would be maintained from any Coastal Wetland Areas (see Tab G for Marsh boundaries). All work will be performed via bucket to barge. The application also contains a proposal to construct two temporary structures at two new offload sites to dispose of non -beach compatible materials. The primary offload site is at the end of Seaside Road along the AIW W on the mainland side across from North Jinks Creek (see Narrative, sheet S-502 and Tab N). This site would accommodate disposal barges and would require navigation through North Jinks Creek. The applicant has provided a hydrographic survey of North Jinks Creek (see Map No. 6 dated 9/16/20). A letter of objection was received by an adjacent riparian owner to the offload site, but no material is proposed to be stored onsite (see letter dated 9/9/21 from James and Danna Collins). This site is void of Coastal Wetlands, although there are wetlands present adjacent to the site. A temporary 100 ft. long by 24 ft. wide gabion filled offload ramp is proposed at this location for offloading whit wou impact approximately 2,400 sq. ft. of bottom habitat within Estuarine Waters and Public Trust Area. The ramp would be placed on a geotextile grip and filter fabric to limit vertical movement. The secondary offload site is at the end of Cobia street, which is located directly adjacent to the Feeder Canal north of the Bay Area (see Narrative and sheet S-501). There are no Coastal Wetlands adjacent to this street end. A temporal heaths proposed, measuring 36 ft. long by 6 ft. wide, using #57 stone filled gabions waterward of the existing bulkhead to ensure that heavy equipment would not compromise the existing bulkhead. According to the application, the gabion filled wall would extend a maximum of 7 ft. waterward of NHW and would be placed on a geotextile grid with filter fabric temporarily impacting up to 252 sq. ft. of Estuarine Waters and Public Trust Area. The proposal includes a shellfish relocation effort prior to bulkhead installation (see Attached Plan). All temporary structures would be relocated at project completion. ANTICIPATED IMPACTS: The proposed excavation of approximately 16,894 cubic yards of material would disturb up to 2.3 acres of shallow bottom habitat within the project area expanding the previously authorized dredge footprint. The final project depth would be -6 ft. at MLW in the Bay Area, this would connect to — 6 ft. at MLW in S. Jinks, but would not connect to deeper water within greater Jinks Creek and Tubbs Inlet. The Town previously obtained CRC Variance No. CRC-VR-20-09 for the proposed maintenance dredging without a connection to deeper waters as required by rule 15A NCAC 711.0208 (b)(F). The impacts of both proposed offload sites would temporarily impact approximately 2,652 sq. ft. of bottom habitat outside of any Coastal Wetland Areas. Note: A Letter of Support for the project was received by DCM on 9/17/21 from Neal and Bren Harm and a Letter of Objection to the Offload site located at Seaside Road was received by DCM on 9/9/21. Both letters are included. Note: The last remaining property (the Mathers at 413 18th Street) continues to show "In Transit, Arriving Late" on the USPS tracking site (see attached). This is the second mailing (the first mailing went out on August 201, 2021) to the Mathers property that the Postal Service does not seem to be able to deliver. Sunset Beach lies in Brunswick County, along the southern coastal border of North Carolina, adjacent to Ocean Isle Beach. The proposed project will occur along the eastern border of Sunset Beach, within the interior waters of Tubbs Inlet. Figure 1 shows the proposed project area in relation to Brunswick County. The Town also requests authorization to construct a temporary offloading ramp at the terminus of Seaside Drive. Finally, authorization is requested to install a temporary bulkhead to aid in stabilizing the material offloading site at the previously authorized Cobia Street offloading site. The Town intends to offer both of these sites to the selected dredging contractor for their use. The contactor may choose either one or both of these sites for offloading. PROJECT PURPOSE AND NEED The previously permitted Bay Area channel helps to address the long-term erosion patterM}lM recreational navigation access to the residential system. However, the previous alignment does not consider the unintended impacts of the additional dredging necessary for the local homec,, access the newly dredged channel from their individual docks. PROPOSED MODIFCATION Bay Area Dredge Template The currently permitted dredge template for the Bay Area currently extends through the approximate middle of the water body and terminates at the south Jinks Creek confluence with an 80-ft width. The modification request realigns the channel terminus from one (1) wide channel to two (2) narrower channels comprising of a primary and secondary navigation route. The primary channel extends along the southern Bay Area shoreline and maintains a 50-ft to 55-ft width (top cut), while the secondary channel follows the northern shoreline at a 40-ft to 45-ft width (top cut). The maximum dredge depth remains -6-ft MLW (-5+1) with 3:1 channel side slopes. Similar to the original alignment, the average depth in the Bay Area system will be increased from approximately -2-ft to -3-ft MLW to -6-ft (-5+1) MLW. Figure 2 shows a plan view comparison of the currently permitted alignment and the proposed realignment for the Bay Area and Tab E provides the permit drawings. The realignment extends the Bay Area primary channel by approximately 200-ft by following the southern shoreline until the template joins with south links Creek. Overall, the realignment initiates at station 12+00 from the original template and terminates at approximate station 24+00 in the south Jinks Creek confluence. The impact area for the original alignment equaled approximately 2.0 acres (86,277-ft2) and the realigned channel covers approximately 2.3 acres (101,176 ft'), inclusive of both the primary and secondary channels. As shown above, the dredge volume increased from 12,200 CY (original channel) to 16,894 CY with the new alignment. Figure 2. The modification request does not change the material placement site or dredging methodology. The Bay Area will be mechanically dredged with material placement occurring in an upland landfill facility. The dredging operations will be conducted between October 1" and March 31" to reduce the potential for environmental impacts. In addition, the dredge footprint will provide a minimum 10-ft buffer from any area of coastal wetland identified at the time of construction. As shown in Tab G (Marsh Habitat Boundary), coastal wetlands have encroached within or close to the anticipated dredge area of the Bay Area but have not established near the Cobia Street terminus material off-loading site. Therefore, to minimize potential impacts to the marsh grass, no dredging will take place within 10 feet of any area of coastal wetlands. The 30-ft buffer should allow the channel adequate space to equilibrate without eroding the coastal marshes. During construction, the dredge equipment shall be prohibited from entering the buffer zone. Offloading Sites As was stated above, the Town intends to offer two offload sites to the chosen dredging contractor for their use. The contactor may choose to utilize either one or both of these sites for material offloading. Cobia Street - This contingency offload site will only be utilized if the primary offload site is unable to be utilized due to logistical consideration. A temporary bulkhead will be installed within the Feeder Channel at the terminus of Cobia Street (Figure 3). This temporary bulkhead will help to ensure that the existing bulkhead at this location will not be structurally compromised as a result of heavy equipment operation. The bulkhead will be comprised of a 36' by 6' gabion wall backfilled with a 36' by 1' placement of DOT #57 stone to stabilize the existing vinyl sheetpile wall. Figure 4 provides a ground level photograph of the existing sheetpile wall. The gabion filled structure will extend approximately 7-ft seaward of the existing wall and will be placed on a geotextile grid and filter fabric to limit vertical movement. To minimize the potential for shellfish impacts, any shellfish within the footprint of the temporary structure will be relocated prior to the bulkhead installation. The shellfish relocation will be conducted in conjunction with the relocation efforts already required for the dredge footprint in the Feeder Channel. Seaside Road (Primary Offloading Site) —An offloading site will be constructed at the end of Seaside Road, along the Atlantic Intracoastal Waterway (See Figure 5). This offload site will handle non -beach compatible materials resulting from the dredging of the Bay Area, South links Creek, the feeder canal and finger canals. It is anticipated that disposal barges will be able to traverse North links Creek at and around high tide. There is currently an unvegetated beach at the site (see Figure 6). In order to allow for land -based equipment to be able to access barges containing spoil material, a temporary 100' by 24' gabion offloading ramp will be constructed in this location. The temporary gabion ramp will be placed on a geotextile grid and filter fabric to limit vertical movement. All materials will be fully removed following project completion. The construction of the temporary gabion ramp will impact 2,400 sf of bottom habitat. No coastal wetlands will be filled by the construction of the temporary ramp. Seaside Road Material Offloading Site ADDITIONAL ENVIRONMENTAL CONCERNS RECEIVED AUG 2 3 2021 ACM WILMINGTON, NC As part of the previously permitted components of this project, the applicant conducted studies to evaluate potential impacts to managed or endangered species that may occur as a result of the overall project. While these reports were completed as part of the original permit submittals, the findings should reasonably be expected to apply to the proposed realigned channel. Tab H provides an Essential Fish Habitat (EFH) assessment and Tab I provides a Biological Assessment (BA) for the project. Generally, the referenced reports support the project should not adversely impact any threatened or managed species. Additional precautions proposed for the maintenance project include following U.S. Fish and RECEIVED 13 OCT (y 2021 DCM-MHD CITY Town of Sunset Beach Navigation Project Bay Area Realignment Project Narrative Wildlife Service (USFWS) recommended guidelines for avoiding impacts to West Indian Manatee and recommendations provided by the National Marine Fisheries Service (NMFS) to help protect sea turtles and smalltooth sawfish. Tab J (Manatee Avoidance Guidelines) shows the manatee guidelines while Tab K (NMFS Recommendations) provides the sea turtle and smalltooth sawfish precautions. HISTORIC RESOURCES The applicant has also contacted the State Historic Preservation Office (SHPO) as part of the original permit submittals to inquire on any known historic resources In the area such as shipwrecks or archeological artifacts. These inquiries did not identify any known resources with the potential to be impacted by the project. Tab L (SHPO Resource Review) provides the written response from SHPO. It is again reasonably expected that these findings may be also be applied to proposed project modification. SUMMARY The Town of Sunset Beach requests a permit modification to realign the proposed Bay Area channel, install a temporary bulkhead at the Cobia Street terminus, and construct a temporary offloading ramp at Seaside Road to support material offloading efforts. The Bay Area realignment will assist in reducing future dredging impacts anticipated by property owners requesting personal access to the navigation channel. These modifications will provide a viable plan for completing the dredging efforts with minimal environmental impacts. The project provides a key element for the Town and residents to manage the established navigation corridors on the east end of Sunset Beach. The project will help restore navigation access to the waterway systems on the east end of Sunset Beach while maintaining a buffer zone between the work area and any coastal marsh or wetland habitat. The project will also relocate shellfish located near the temporary bulkhead installation to reduce the potential for impacts. All materials installed as part of the temporary bulkhead will be removed at the completion of work. The work will also follow additional guidelines and recommendations provided by USFWS and NMFS to further minimize the potential for environmental impacts during construction. The project will adhere to environmental moratoria design to protect juvenile fish and shellfish. Additionally, the project will follow construction guidelines designed to protect manatee, sea turtle, and smalltooth sawfish. ADDITIONAL ITEMS RELATED TO CAMA PERMIT APPLICATION PACKAGE State Environmental Policy Act (SEPA) Compliance § 113A-12(6) states that the preparation of an environmental document shall not be required for projects that require a Coastal Area Management Act major permit. Therefore, no SEPA document will be prepared for the proposed project modification. Application Fee A permit application processing fee of $475 will be provided separately. As a homeowner and full-time resident, this is a long time coming and very much welcomed. I understand the changes that have been requested by Moffatt & Nichol. I fully support and agree with these changes. The addition of the landing off of Seaside Drive will greatly reduce the truck traffic on the island and shorten the distance to the offload site. This is a good thing for everyone and the environment. In regards to the project in general, it is important to note that those living on the water and that have the most personal Impact are supportive of this project. We all have docks and moved to Sunset for the water and being able to enjoy it. I paddle these waters daily from my backyard on Canal Drive. The part of Jinks that crosses the Bay is no longer a creek. It is filled with decades of neglect. Those of us around the water call it Jinks Beach. The two or three that have been in opposition have provided no support and only offer opinions not backed by the studies and the modeling. It is unfortunate as it has cost this town a lot of extra time. My neighbors on the island can't wait for this project to begin. Pictures below were taken this past year at two different times. Sunset Beach. If that lot is used, it will substantially reduce the value of our property. Access to that lot is only via the small gravel road(Pecan Ave) adjacent to our property; that road is not sufficient to handle large trucks to haul away the spoils. The looks and smell of the spoils just a few yards away from our unit will be terrible. Due to our advancing age and difficulty traveling from Ca. we can no longer use the unit as our vacation home and six months ago we contacted a real estate agent to sell it. It is on the market. We respectfully request that the proposed Pecan Ave site next to our duplex unit not be used for the dredging spoils. Following approval from the North Carolina Division of Marine Fisheries (NCDMF), the relocation plan outlined herein will be implemented prior to the onset of any dredging actives. It should also be noted that this plan is similar to a shellfish relocation plan that was developed, approved by NCDMF and implemented for the Old Ferry Channel dredging project in Carteret County earlier this year. It is anticipated that the shellfish relocation efforts outlined in this document will take place in October of 2021. Relevant CAMA Permit Conditions The following conditions of CAMA Permit No. 132-18 (Mary's and Turtle's Creeks) and Permit 79- 19 (South Jinks Creek, Bay Area, Feeder Canal, and Finger Canals) are relevant to this relocation plan: 2.1. Mary's and Turtle's Creeks Condition 2 Excavation shall not exceed -6 feet below the mean low water level at the mouth of the creeks and -4 feet below mean low water at the head of creeks. In no case shall the depth of excavation exceed the depth of connecting waters. Condition 9 Prior to the initiation of any dredging activities within Mary's and/or Turtle Creeks, the permittee shall, in coordination with the Division of Marine Fisheries, develop and implement an oyster relocation plan for the Mary's and/or Turtle Creeks oyster population(s). Contact the Division of Marine Fisheries at (252) 808-8050 to initiate the required coordination. Notice of satisfactory completion of the relocation efforts shall be provided to the Division of Coastal Management prior to initiation of dredging in Mary's and/or Turtle Creeks. 2.2. South Jinks Creek, Bay Area, Feeder Canal and Finger Canals Condition 2 In keeping with the Variance (CRC-VR-19-09) granted by the Coastal Resources Commission (CRC) on February 12, 2020, and the order signed by the CRC Chairman on February 25, 2020, the depth of excavation shall not exceed -6 feet below the mean low water level for South Jinks Creek and the Bay Area, and -5 feet below mean low water level for the Finger Canals. In no case shall the depth of excavation exceed the depth of connecting waters. Shellfish Relocation Plan • Relocation is proposed within all the dredge footprints of the areas indicated in Figure 2. • Relocation not proposed for any areas that fall below dredge depths authorized in CAMA Permit 132-18 and CAMA Permit 79-19. • Channel alignments will be programmed into a GPS. The GPS unit will be utilized in the field to locate areas proposed for dredging. NOTE: It should be noted that the Town is currently pursuing a modification to the authorized dredge alignment within the Bay Area. Shellfish relocation efforts will take place within the new dredge areas as opposed to the originally authorized alignment. • Relocation efforts will be staged from adjacent shorelines. • A skiff or two -person vessel, such as a kayak or canoe, will be used for collection. More than one vessel may be utilized in an effort to expedite completion of the plan. • Shellfish will be found by raking the bottom, either from a vessel or standing in the water. All shellfish found will be initially stored in oyster bags. • Once an oyster bag is full, the shellfish will be relocated to an area that is: o Outside of the dredge area, but in the same general area, and o Has an existing presence of shellfish, Approximate GPS location(s) for each relocation area will be recorded. Representative photos will be taken during various steps in the relocation process. • A Marine Patrol officer will be contacted 3-5 days before initiation of relocation efforts. Daily notifications of progress made, and anticipated work schedules/completion dates will also be provided to Marine Patrol (alternative notification procedures/schedules will be followed at request of Marine Patrol). • Notification of project completion will be provided to the North Carolina Division of Coastal Management (NCDCM) and NCDMF upon project completion. • A summary report for this relocation effort will be prepared and submitted to NCDMF and NCDCM within 30 days of completion of shellfish relocation efforts.
