This permit, issued on March 24, 2022 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may me suoJecr ro lines, imprisonment or ctvu action; or may cause me permit to oe nun ana vora. 1) In accordance with commitments made by the permittee by email dated March 18, 2022, the originally proposed dredge Zone A is hereby deleted. Any and all reference to the dredging of Zone A in the referenced letter is hereby considered null and void. Excavation — Zone B 2) Unless specifically altered herein, this Minor Modification authorizes the one-time excavation of material within "Zone B" of S. Jinks Creek and dredge material disposal at the previously permitted near -shore placement area, all as expressly and specifically set forth in the attached letter and workplan drawings. Any additional development activities may require a modification of this permit. (See attached sheet for additional conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2025 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. In no case shall the depth of excavation exceed the depth of connecting waters. 4) No excavation shall take place outside of the area indicated on the workplan drawings. 5) In order to protect juvenile shrimp and finfish populations, no excavation or filling shall be permitted between April I and September 30 of any year without the prior approval of the Division of Coastal Management, in consultation with appropriate resource agencies Near Shore Disposal 6) Should dredging operations encounter sand deemed non -compatible with 15A NCAC 07H .0312 (Technical Standards for Beach Fill Projects), the dredge operator shall immediately cease operation and contact the NCDCM. Dredge operation shall resume only after resolution of the issue of sand compatibility. 7) No excavation of filling of wetlands is authorized by this permit. 8) This authorizes a one-time event for nearshore disposal, as depicted on the attached workplan drawings. Any request to carry out additional activities may require a modification of this permit. General 9) No attempt shall be made by the permittee to precent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 10) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 11) The permittee shall obtain any necessary authorizations or approvals from the U.S. Army Corps of Engineers and the North Carolina Division of Water Resources prior to initiation of any permitted activity. Unless specifically altered herein, the permittee shall adhere to all conditions of the Federal and State approvals once issued 12) This Minor Modification shall be attached to the original Permit No. 79-19, which was issued to the permittee on 10/28/19, as well as all subsequent modifications, refinements, and renewals, and copies of all documents must be readily available on site when Division personnel inspect the project for compliance. 13) All conditions and stipulations of the active permit remain in force unless specifically altered herein. The depth of excavation was authorized to — 5 ft. below MLW for Finger Canals and to — 6 ft. below MLW for the Bay Area and South Jinks Creek, A Major Modification was issued on 9/10/20 for a nearshore placement are seaward of Sunset Beach between 3rd through 13th streets. The placement of approximately 40,500 cubic yards within the nearshore area adjacent to Sunset Beach would impact up to 9.2 acres of coastal habitat within the project area. An additional Major Modification was issued on March 4, 2022 to re -align the primary channel and add a secondary channel within the Bay Area adjacent to the Town of Sunset Beach and install temporary structures at two offload sites. State Permit No. 79-19 is due to expire on December 31, 2025. The permittee is requesting authorization to conduct additional dredging within South Jinks Creek. According to the proposal, the western shoal has shifted and thus the current dredging project no longer connects to existing deep water creating hazardous navigation and tidally dependent access. The Town of Sunset Beach is requesting to dredge two remaining portions of the shoal to a depth of -3 ft. at MLW between Station 51+00 and 57+50 (see Attached Drawings dated received on March 10, 2022). Proposed excavation in Areas A and B would occur west of the boundary shown on the permit and would be between 20 ft. and 105 fLin width. Estimated volumes of material to be excavated within Areas A and B are approximately 2,415 Cubic Yards and 1,280 cubic yards respectively (See Table 1). The applicant states that the vibracore data for the shoaled areas meets the guidelines for beach quality sand and this area is located within the shoal system. The proposed disposal area is within the previously permitted nearshore placement area. Specific authorization has been given by each riparian property owner for this temporary relocation (see attached). The docks would be stored adjacent to the Majestic Oaks Offload Area outside of coastal wetland shellfish areas. Two temporary piles would be installed and the relocated floating docks would be tied together. All floating docks would be re -installed on the original pilings once excavation is complete in these areas (see Sheet 1 and 2 f 2 dated 3/8/24). Upon review of the information provided, the Division of Coastal Management has determined that the proposed action continues to be consistent with existing State rules and regulations and is in keeping with the original purpose and intent of the permit. I hereby submit this Letter of Refinement authorizing the modification of State Permit No. #79-19, as described in your request originally received by DCM March 11, 2024. By copy of this letter we are notifying the US Army Corps of Engineers, Division of Marina Fisheries and the Division of Water Resources of our action. Please note this refinement does not alleviate the need to obtain any other local, state or federal permits. Permit No. 79-19 was issued for the dredging of the Sunset Beach Bay Area, Feeder Channel, and Finger Canals. The request in this letter is for approval of a dock relocation plan for the specified docks in the Feeder Channel and Finger Canal A. Work is currently underway on the mechanical dredging of Finger Canal A. The Contractor has identified 8 docks within the Feeder Channel and Finger Canal A that require temporary relocation (see attached Sheet 1). As can be seen from this figure, each of the docks are located completely within the shellfish relocation extent that occurred within the Feeder Chanel/Finger Canal A and was deemed complete by NC DMF. The existing location of these docks prohibits movement of the dredge through this area. Written approval by the homeowner will be obtained prior to moving the docks. The docks will be disconnected from their piles and moved to a centralized location in the Bay Area offshore of the Town owned property at Majestic Oak, which is devoid of marsh grass and shellfish located. The docks will be moved at a sufficient tide elevation as to not impact the bottom during removal and transit. The Contractor has noted that the piles will not need to be removed to provide adequate width for transiting these waterways. One dock will be secured by installing two temporary piles and the remaining docks will be tied off to this dock. The dock relocation site will be located approximately 45 ft off the existing marsh grass (see attached Sheet 2), which provides adequate depth as to allow the docks to remain floating independent of tide elevation. The elevation at this location is approximately -1 ft to -1.5 ft MLW based on the preconstruction survey. The NOAA tide predictions at Sunset Beach show the minimum water elevation within the remaining work window in these channels is -0.74 ft MLW on March 12, 2024 and -0.67 ft MLW on April 8, 2024 (see Figure 1). Upon completion of dredging within Finger Canal A, the docks will be reinstalled on the piles in their original location and the two temporary piles installed within the dock relocation site will be removed in their entirety.
