This permit, issued on May 28, 2019 is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fires, imprisonment or civil action; or may cause the permit to be null and void.
Ocean Hazard Development
1) Unless specifically altered herein, this permit authorizes the land disturbing activities associated with
the development of the above referenced property, including the water utility lines, all as expressly
and specifically set forth in the attached permit application and workplan drawings. Any additional
land disturbing activities and/or construction may require a modification of this permit. Contact a
Division of Coastal Management representative at [phone] for this determination.
2) No work shall take place on any property until such time as the permittee has obtained proper legal
authority (i.e. deeds, easements, right of way encroachment agreements, etc.) for said property.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2022
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
3) All construction within the Ocean Hazard AEC shall comply with all applicable requirements of the
N.C. Building Code and the local flood damage prevention ordinance as required by the National Flood
Insurance Program. If any provisions of the building code or the flood damage prevention ordinance are
inconsistent with any of the following AEC standards, the more restrictive standard shall apply.
4) Prior to the initiation of construction within the Ocean Hazard AEC, a representative of the Division of
Coastal Management shall stake the first line of stable, natural vegetation and appropriate structure
setbacks. These setback determinations shall replace those done at the time the permit application was
processed and approved. Construction shall begin within sixty days of this determination or the
measurement is void and shall be re-established. In the case of a major shoreline change within that
period, a new setback determination shall be required before construction begins.
5) Any structure authorized by this permit shall be relocated or dismantled when it becomes imminently
threatened by changes in shoreline configuration. The structure(s) shall be relocated or dismantled
within two (2) years of the time when it becomes imminently threatened, and in any case, upon its
collapse or subsidence. However, if natural shoreline recovery or beach re -nourishment takes place
within two (2) years of the time the structure becomes imminently threatened, so that the structure is no
longer imminently threatened, then it need not be relocated or dismantled at that time. This condition
shall not affect the 'permit holder's right to seek authorization of temporary protective measures allowed
under CRC Rules.
Sedimentation and Erosion Control & Stormwater Management
6) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, etc.).
7) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of
any phase of grading on cut or filled slopes.
NOTE: An Erosion and Sedimentation Control Plan and Stormwater Plan may be required for this project.
This plan shall be filed at least thirty (30) days prior to the beginning of any land disturbing

8) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
9) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.

NOTE: Any proposed encroachment into any NC Department of Transportation Right of Way may require
an encroachment easement from the NC Department of Transportation.
NOTE: Plans and specifications should be submitted and approved by the N.C. Division of Water
Resources - Public Water Supply Section prior to the initiation of construction. Please contact the
Public Water Supply Section at [phone].
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit. Contact
a representative of the Division at [phone] prior to the commencement of any such activity
for this determination.
NOTE: An application processing fee of $400 was received by DCM for this project.

The applicant proposes to install 3,800 linear feet of new water main. The project is
located between Stone Street and Raleigh Street in Wrightsville Beach.
Areas of Environmental Concern (AEC's) impacted by the proposal are OEA. Waters at
the project site are classified as SA, HQW and are not open to the harvesting of shellfish.
The area is not a Primary Nursery Area
I have reviewed this proposal for consistency with the Wrightsville Beach Land Use Plan
Update and offer the following comments.
The general area of the project is classified as Central Business District and Residential.
In general, the Wrightsville Beach Land Use Plan contains policies, which allows
development in Central Business District and Residential classified AECs, which is
consistent with the State's minimum use standards. The Wrightsville Beach Land Use
Plan contains some policies, which exceed the State's minimum use standards. However,
none of these policies appear to be applicable to this project.
This project is consistent with the Wrightsville Beach Land Use Plan Update.

Through coordination with the North Carolina Division of Coastal Management
(NCDCM), we have received a copy of your request dated February 22, 2019 to replace and
install 3,800 linear feet of a water main line located between Stone Street and Raleigh Street in
Wrightsville Beach, New Hanover County, North Carolina.
A review of your plans reveals that the proposed project will not involve work in wetlands,
waters of the United States or navigable waters of the United States. Therefore, no Department
of the Army authorization is required for your work. Should your proposed scope of work
change, please contact this office to discuss possible required authorization. Please be advised
that this does not relieve you of the need to obtain all necessary authorizations, including a valid
permit from NCDCM, prior to beginning work.

The North Carolina Natural Heritage Program (NCNHP) appreciates the opportunity to provide
information about natural heritage resources for the project referenced above.
A query of the NCNHP database indicates that there are records for rare species, important natural
communities, natural areas, and/or conservation/managed areas within the proposed project
boundary. These results are presented in the attached 'Documented Occurrences' tables and map.
The attached 'Potential Occurrences' table summarizes rare species and natural communities that
have been documented within a one -mile radius of the property boundary. The proximity of these
records suggests that these natural heritage elements may potentially be present in the project area
if suitable habitat exists. Tables of natural areas and conservation/managed areas within a one -mile
radius of the project area, if any, are also included in this report.
If a Federally -listed species is documented within the project area or indicated within a one -mile
radius of the project area, the NCNHP recommends contacting the US Fish and Wildlife Service
(USFWS) for guidance. Contact information for USFWS offices in North Carolina is found here:

Please note that natural heritage element data are maintained for the purposes of conservation
planning, project review, and scientific research, and are not intended for use as the primary criteria

Not necessarily, just wanted to reach out to make sure they were being received and reviewed since I haven't received
any response since we started the e-distribution. It may just be coincidence that since we started none of the projects
have DOT issues. We typically will only ask for input if there appears there might be encroachment into DOT ROW or
some other potential concern. Doug asked me to check with you before we move forward on this one in particular. Hope

Sean Kenyon,with.McKim and Creed is going to inquire with the Town regarding the status of acquiring the
easements..Attached -is a map showing the -line that needs easements. (line from E. Columbia Street to E.
Raleigh Street). If it ends up taking awhile to.acquire the.easeirieiiis, :would'the Town be_ able to obtain -a
CAMA Major Permit for the remainder of the project so that they can begin working on those sections this
fall? Then they can apply for a modification once the easements are in place to finish the project. If -this is
possible, would the modification have to go back out on public notice? I wasn't sure since the current public
notice already included this line.
We are just trying to look at all of the options for this one. Let me know what you think.

8. PROJECT DESCRIPTION:
The project site is located between Stone Street and Raleigh Street in Wrightsville Beach,
adjacent to the Atlantic Ocean, in New Hanover County. To locate the property from the
Wilmington Regional Office, turn left onto Eastwood Road/US 74 E and travel approx. 4.19
miles to Wrightsville Beach. Turn left at the stop light at the intersection of Waynick Blvd.
Stone Street will be on your right as the road joins N. Lumina Avenue. This is the starting point
of the project.
The project site consists of approximately 1.7 acres with an average elevation ranging from 5' to
12' above normal high water (NHW). The majority of the project area consists of a maintained
public utility easement and roadside right-of-way (ROW). Residential dwellings and some
commercial properties surround the entire project area. Existing vegetation consists of various
grasses and ornamental landscaping. There are no wetlands within the project area.
The Town of Wrightsville Beach Land Use Plan classifies the adjacent high ground as Central
Business and Residential. The waters of the Atlantic Ocean are classified SB by the Division of
Water Resources. They are not designated as a Primary Nursery Area by the N.C. Division of
Marine Fisheries and they are Closed to the harvest of shellfish. The project site is located within
an area of the Town of Wrightsville Beach that undergoes beach nourishment. The erosion rate
for this area is two feet (2) per year, according to the 2013 Erosion Rate Maps, creating a total
Ocean Erodible Area (OEA) AEC of 180'.
9. PROPOSED PROJECT:
The applicant is proposing to install 3,800 linear feet of new water main line. As proposed, the
new water line would be 4" in diameter by 3,800 linear feet and would be located between Stone
Street and Raleigh Street. The new line would be replacing the existing 2" galvanized steel water
line that was originally installed in the 1930's. The majority of the existing line would be
abandoned and left in place with the exception of a few areas where the existing line would need
to be removed due to lack of space. The proposed 4" line would be placed at a minimum of 3'
below grade with a construction corridor of approx. 15'-20' in width and would serve the
existing residences on each street adjacent to each new line. Each end of the proposed new line
would connect to the existing 8" PVC water main located on Lumina Avenue within the NC
DOT ROW (see Sheets 3 and 4 of 4).
The application states, that all work along Stone St., Oceanic St., Birmingham St., E. Columbia
St., E. Atlanta St. and E. Charlotte St. would be located within a public utility easement.
However, the new line from Stone St. to Birmingham St. would be located outside of private
property and not within a utility easement. The line from E. Columbia St., to Raleigh St. would
be located within private property and the Town is in the process of obtaining easements through
the properties and will provide a copy of the easements to DCM once obtained.

As proposed, most of the work would be located landward of the OEA AEC and all work would
be landward of the Static Vegetation Line as well as the First Line of Stable Natural Vegetation
(which was flagged by DCM Staff on 1/9/19) (see Sheet 3 of 4).
10. ANTICIPATED IMPACTS:
The installation of the new water line would result in a total high ground disturbance of approx.
1.7 acres of which, approx. 0.80 acres would be located within the Ocean Erodible AEC. As
proposed, all land disturbing activity would be located landward of the Static Vegetation Line as
well as the First Line of Stable Natural Vegetation. There are no proposed impacts to the frontal
dune system.

I. Introduction
The Town of Wrightsville Beach plans to install approximately 3,800 linear feet of 4" water line between Stone
Street and Raleigh Street in Wrightsville Beach, NC (New Hanover County). The new water line will replace
existing lines that were installed in the 1930's and will serve the existing houses on the streets adjacent to
each line. The existing lines are made of 2" galvanized steel and over the years a significant amount of scale
has built up in the pipes to the point where the lines are not giving adequate pressure to residences. Portions
of the project area are located within the Ocean Erodible Area of Environmental Concern and a Public Water
Supply permit is required from the NC Division of Water Resources.
II. Existing Conditions
The project area consists of 3,800 linear feet of waterline corridor. Portions of the corridor are located within
a Town of Wrightsville Beach Right -Of -Way along Stone Street, Oceanic Street, Birmingham Street, E.
Columbia Street, E. Atlanta Street, and E. Charlotte Street. Most of the lines running parallel to the ocean will
be located within a public utility easement. However, the line from Stone Street to Birmingham Street is
outside of private property and therefore is not within a utility easement. The line that will run from E.
Columbia Street to E. Raleigh Street is currently within private property and the Town will acquire easements
through this property. The easements will be submitted to DCM as soon as they are available. The lines will
connect into an existing 8" water line located within a NC DOT Right -Of -Way along Lumina Avenue and are
part of the Town's municipal water treatment system.
The site is located adjacent to the Atlantic Ocean and portions of the project area are located within the
Ocean Erodible Area of Environmental Concern. The majority of the project area lies within the FEMA-
designated AE flood zone (Base Flood Elevation 11). A small portion of the site located between Stone Street
and E. Birmingham Street is located within the VE flood zone (Base Flood Elevation 16). Land Management
Group (LMG) evaluated the project area in November of 2018. It consists of a maintained utility line corridor
and/or road right-of-way. No wetlands or waters of the US were observed within the project area. Brooks
Surgan of the NC Division of Coastal Management staked the first line of stable vegetation on January 91h
2019.
III. Project Description
The majority of the existing 2" water line will be abandoned and left in place. However, there will be a few
areas where the line will need to be removed to allow adequate room to install the new line. The contractor
will dig a trench a minimum of 3 feet deep. The excavated material will be stockpiled adjacent to the
construction corridor. If it is found to be of acceptable quality, it will be used to fill the trench back in. If the
material is not acceptable, it will be removed from the site and disposed of by the contractor. These lines will
serve the existing houses on each street adjacent to each line. The construction corridor will be approximately
15-20'. It will connect on each end to the existing 8" PVC wr

The Division of Coastal Management hereby acknowledges receipt of your application, as acting agent for the Town
of Wrightsville Beach, for State approval for development of the subject properties located between Stone Street and
Raleigh Street, adjacent to the Atlantic Ocean, in the Town of Wrightsville Beach, New Hanover County. It was
received as complete on March 13, 2019 and appears to be adequate for processing at this time. The projected
deadline for making a decision is May 27, 2019. An additional 75-day review period is provided by law when such
time is necessary to complete the review. If you have not been notified of a final action by the initial deadline stated
above, you should consider the review period extended. Under those circumstances, this letter will serve as your
notice of an extended review. However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from March 13, 2019, you may request a meeting
with the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such
a meeting will be held within five working days from the receipt of your written request and shall include the
property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development
Enclosed you will find a 'Notice of Permit Filing" postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from
a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property; or at a point along the road right-of-way where a private road would lead one into your
property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the appropriate
State or Federal agency. Please contact me if you have any questions and notify me in writing if you wish to receive
a copy of my field report and/or comments from reviewing agencies.

existing lines that were installed in the 1930's. Adjacent riparian property owners to
the project are required by the permit application process to be notified.

as it has been submitted to NC DCM is provided here. If you have objections to the
project, please indicate on the enclosed form and return to Ms. Debbie Wilson, NC

This notice is intended to make you, the applicant, aware of the
special risks and conditions associated with development in this
area, which is subject to natural hazards such us storms, erosion
and currents. The rules of the Coastal Resources Commission
require thatyou receive an AGC Razard Notice and acknowledge
that notice in writing before a permit for development can be
issued.
The Commission's rules on building standards, oceanfront
setbacks and dune attentions are designed to minimize, but not
eliminate, property toss from hazards. By granting permits, the
Coastal Resources Commission does not guarantee die safety of
the development and aseumes no liability for future damage to
the development. Permits issued in die Ocean Hazard Area of
Environmental Concern include the condition thar structures be
relocated ordismantled iflheybecome imminently threatened by
changes in shoreline configuration. The structures). must be
relocated or dismantled within two (2) years of becoming
imminently threatened, acid in any case upon its collapse or
subsidence.
The best available information, as accepted by the Coastal
Resources Commission, indicates that the annual long-term
average ocean erosion rate for the area where your property is
located is? _ feet per year.
The rate was established by careful analysis of aerial. photographs
of the coastline taken over the past 50 years.
Studies also indicate that the shoreline could move as much as
300 _feet landward in a major storm.
The flood waters in amnjor storm are predicted to be about
14 feet deep in this area.
Preferred oceanfront protection measures are beach nourishment
and relocation of threatened structures. Bard erosion control
structures such na bul kheads, seawalls, revetments, groins, jetties
and breakwaters are prohibited. Temporary sand bags may be
authorized under certain conditions.

In areas subject to sudden and massive storms and erosion, permits
issued for development in this area expire on December I I of the
third year fallowing the year in which the permit was issued.
Shortly before work begins on the project site, the Local Pennit
Officer must be contacted to determine the vegetation line and
setback distance at your site. If die property has seen I ittie change
since the dme of permit issuance, and the proposed development
can still meet die setback requirement, the LPO will inform you
that youmay begin work. Substantial progress on the project
must be made within 60 days of this setback determination, or
the setback must be remeasured, Also, (he occurrence of a major
shoreline change as die result ofa storm within the 60•day period
will necessitate remeasurement of the setback. It is important
that you check with the LPO before die permit expires for olTcial
approval to continue the work after the permit has expired,
