This permit, issued on September 23, 2019 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Ocean hazard Development 1) Unless specifically altered herein, this permit authorizes the land disturbing activities associated with the development of the above referenced property, including the redevelopment of the bath houses, parking areas, medians, storm drains, and utility lines, all as expressly and specifically set forth in the attached permit application and workplan drawings. Any additional land disturbing activities and/or construction may require a modification of this permit. Contact a Division of Coastal Management representative at (910)796-7215 for this determination. RECEIVED 2) No development is authorized outside the bounds of the permittee's property. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Signature of Permittee Town•of Wrightsville Beach Permit No. 78-19 Page 2 of 3 ADDITIONAL CONDITIONS 3) During the sea turtle season (May 1 through November 15 of any year) no heavy equipment shall use, _ traverse, or be stored on the beach. 4) During the sea turtle season (May 1 through November 15 of any year), nighttime lighting associated with development activities shall be minimized. Lighting shall be limited to the immediate construction area and shall be minimized through reduction, shielding, lowering, and appropriate placement to avoid excess illumination of the water surface and nesting beach. 5) All construction within the Ocean Hazard AEC shall comply with all applicable requirements of the N.C. Building Code and the local flood damage -prevention ordinance as required by the National Flood Insurance Program. If any provisions of the building code or the flood damage prevention ordinance are inconsistent with any of the following AEC standards, the more restrictive standard shall apply. 6) Prior to the initiation of construction within the Ocean Hazard AEC, a.representative of the Division of Coastal. Management shall stake the first •line of stable,natural vegetation and appropriate structure setbacks. These setback determinations shall replace those done at the time the permit application was .processed and approved. Construction shall begin within sixty days of this determination or the measurement is void and shall be re-established: In the case of a major shoreline change within that period, a new setback determination shall -be required before construction begins. 7) All buildings in the Ocean Hazard Area of Environmental Concern shall be on pilings not less than 8 inches in diameter if round, or 8 inches to a side if square. 8) All foundations shall be adequately designed to be stable during applicable fluctuations in ground elevation and wave forces during a 100-year storm. 9) All pilings shall have a tip penetration. greater than eight feet below the lowest ground elevation under the structures. 10) Any structure authorized by this permit shall be relocated or dismantled when it becomes imminently threatened by changes in shoreline configuration. The structure(s) sball.be relocated or dismantled within two (2) years of the time when it becomes imminently threatened, and in any case, upon its collapse or subsidence. However,,if natural shoreline recovery or beach re -nourishment takes place within two (2) years of the time the structure becomes imminently threatened, so that the structure is no longer imminently threatened, then it need not be relocated or dismantled at that time. This condition shall not affect the permit holder's right to seek authorization of temporary protective measures allowed under CRC Rules. Sedimentation and Erosion Control 11) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.). 12) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of __ any phase of grading on cut or filled slopes. Town of Wrightsville Beach Permit No. 78-19 Page 3 of 3 ADDITIONAL CONDITIONS NOTE: An Erosion and Sedimentation Control Plan will be required for this project. This plan must be filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this plan to the Division of Energy, Mineral & Land Resources, Land Quality Section, 127 Cardinal Drive Extension, Wilmington, NC 28405. Stormwater Management 13) Prior to the initiation of any upland development activities, the pemrittee shall'apply for and obtain a stormwater management plan permit from the Division of Energy, Mineral and Land Resources (DEMLR), and provide a copy of this permit to DCM. Any violation of the permit approved by the DEMLR shall be considered a violation of this CAMA permit. General 14) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 15) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. NOTE: In order to protect hatchling loggerhead sea turtles, all lights on the building face, including balcony lights on the ocean side of all structures should be eliminated. Where ocean side lighting is required, alternatives including shading, screening, or replacing fixtures with modern alternative light sources should be utilized. Parking lots, streets, tennis courts, walkways, dune crossovers, pools and other areas requiring lights should be illuminated with light fixtures located close to the ground to minimize casting direct light on the beach and dunes. For more information on the proper design of ocean side lighting, contact the N.C. Wildlife Resources Commission at (252) 948-3916. NOTE: Plans and specifications should be submitted and approved by the N.C. Division of Water Resources - Public Water Supply Section prior to construction of the water main. Please contact the Public Water Supply Section at (910) 796-7215. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. NOTE: NOTE: NOTE: The N.C. It is staff s recommendation that the proposed resurfacing of the roadway, reconfiguration of the parldng areas, medians, storm drains and utility lines within the 180' Ocean Hazard AEC is CONSISTENT with the Use Standards for Ocean Hazard Areas, as set forth in 15A NCAC 07H. 07H .0306. It is the staffs recommendation that the proposed new bathroom facilities is INCONSISTENT with the Use Standards for Ocean Hazard Areas, as set forth in 15A NCAC 07H. 07H .0306(a)(12)(A-E). Specifically, 15A NCAC 07H .0306(a)(12)(C) states that "no portion of a building or structure, including roof overhangs and elevated portions that are cantilevered, knee braced, or otherwise extended beyond the support of pilings or footings, extends oceanward of the landward -most adjacent building or structure. The Town of Wrightsville Beach has the Static Line Exception, however, as proposed, the new bathroom facilities would be located waterward of the landward most adjacent structure. Therefore, it is staffs recommendation that this portion of the permit be Denied. PROJECT DESCRIPTION: The project site is located along Salisbury Street from Banks Channel to the Atlantic Ocean in Wrightsville Beach, in New Hanover County. To locate the property from the Wilmington Regional Office, turn left onto Eastwood Road/US 74 E and travel approx. 3.2 miles to Wrightsville Beach. Travel over the bridge and take a slight left onto W. Salisbury Street and travel approx. 1.0 miles to the start of the project on the south side of Banks Channel. The project site consists of approximately 4.38 acres with an average elevation of approx. 12' above normal high water (NHW) and has approx. 128' of shoreline along Banks Channel (which is bulkheaded) and approx. 128' of shoreline along the Atlantic Ocean. The project area consists of the sidewalks, parking areas and medians from Banks Channel along W. Salisbury St. and E. Salisbury St. and includes the public facilities located at the oceanward end of E. Salisbury St. Residential dwellings and some commercial properties surround the entire project area and existing vegetation consists of various grasses and ornamental landscaping. There are no wetlands within the project area The Town of Wrightsville Beach Land Use Plan classifies the adjacent high ground as Central Business and Residential. The waters Banks Channel and the Atlantic Ocean are classified SB by the Division of Water Resources. They are not designated as a Division of Marine Fisheries and they are Closed to the harvest oP f sh llfish.The project site is N.C. located within an area of the Town of Wrightsville Beach that undergoes beach nourishment. The erosion rate for this area is two feet (2') per year, according to the 2013 Erosion Rate Maps, creating a total Ocean Erodible Area (OEA) AEC of 180'. 9. PROPOSED PROJECT: The applicant is proposing to redevelop the ocean access park facilities, resurface, reconfigure the parking areas, medians, storm drains and utility lines from Banks Channel to the ocean access park. As proposed, the existing public bathroom facilities located at the ocean access area would be removed and 2 new structures would be constructed to include bathrooms, outdoor showers and decking and benches. According to the site plan (see Sheets 3 & 5 of 6) approx. 472 sq. ft. of the proposed structurally independent decking would be located within the 60' small structure setback and the main structures (including all roofed areas) would be located landward of the 60' ocean hazard setback and the static vegetation line. The two proposed buildings, would be connected by a roof creating a gazebo and would result in a total footprint of approx. 1,600 sq. ft. (see Sheets 3, 5 and 6 of 6). This area of Wrightsville Beach utilizes a pre -nourishment or "static" vegetation line since 1980. The Town of Wrightsville Beach has obtained and renewed the Static Line Exception designation as per 15A NCAC 07J .1200. However, as proposed, the new bathroom facilities would be located waterward of the landward most adjacent building and landward of the 60' p setback from the First Line of Stable Natural Vegetation (which was flagged by DCM Staff on 0 1/3/19). g The applicant is also proposing to reconfigure the existing sidewalks, parking areas, medians, O resurface the existing road and install new water and sewer lines connecting to the adjacent n bathroom facilities. As proposed, there would be approx. 4,391 sq. ft. of asphalt / roadways and --1 7,355 sq. ft. of concrete / sidewalks that would be located within the 180' Ocean Erodible Area of Town of Wrightsville Beach Page 3 of 3 Environmental Concern (AEC) resulting in an increase of approx. 1,103 sq. ft. of impervious surface. The resurfacing of the roadway as well as the reconfiguration of the parking areas and medians would encompass the entire stretch of East and West Salisbury Street from the ocean access park to Banks Channel. No new impervious surface area is being proposed within the 30' Coastal Shoreline Buffer located adjacent to Banks Channel, however, there would be an additional 579 sq. ft. of impervious surface coverage within the 75' Estuarine Shoreline AEC for the reconfiguration of the medians, road and sidewalks (see Sheet 4 of 6). The application states that all stormwater features would be located outside of the AEC's and would connect to existing drainage and new infiltration trenches. 10. ANTICIPATED IMPACTS: The redevelopment of the ocean access park facilities, resurfacing of the roadway, reconfiguring of the parking areas, medians, storm drains and utility lines would result in a total high ground disturbance of approx. 4.381 acres of which, approx. 0.38 acres (16,900 sq. ft.) would be located within the 180' Ocean Erodible AEC and approx. 0.22 acres (9,589 sq. ft.) within the 75' Estuarine Shoreline AEC no new impervious surface coverage is proposed within the 30' Coastal Shoreline Buffer. The application states that sewer and water supply services would be provided by the local municipality. As proposed, all roofed covered structures would be located landward of the Static Vegetation Line but would not meet the 60' setback from the Static Vegetation Line. However, one issue that concerns us as owners of the Silver Gull Motel, is that, on the proposed drawing, it shows an encroachment into our driveway by a concrete median. This should be moved back to allow easy ingress and egress of the driveway. The other concern that we have is that the roof drain for the Silver Gull Motel is being blocked now by construction debris. I have concerns as to where the drainage is going when you finish. This drain line runs to the edge of our property on Salisbury Street, ocean front. Do you have any suggestions on how we can rectify this problem? The configuration of the lot precludes the placement of a building or structure in line with the landward most adjacent building since the entirety of the lot is located seaward of the 1939 building line and adjacent structures. The existing structures on the lot have been there approximately 30 years or more. These existing structures are being used to show the average line of development per o7H .03o6 (a)12(c) (i.e. on a "case by case basis"). The proposed redevelopment will not extend seaward of the existing structures or proposed average construction line, and will be no less than 30 times the shoreline erosion rate or 6o feet. See attached figure(s) for reference. As we discussed, in the summer of 2018, the North Carolina General Assembly passed HB 1004, SL 2018-103 authorizing the Town to construct "public restrooms, gazebos, and,typical park facilities in such public squares or parks" as well as "the construction of public beach access facilities" to be seaward of the 1939 line. The General Assembly also passed HB 159 SL 2018-73 last summer. That bill conveyed state owned land to the Town for this project. I have attached these two bills as well as the executed and recorded deed from the State to the Town for your consideration. z- Show us on with a line drawn and overlain on aerials, what your proposed average line of construction is and how your proposal falls in line with that average line of construction. The Town's Consultants have prepared 5 drawings depicting the Town's proposed average line construction for this case. I have attached these drawings for. your review and consideration. As you will note, the proposed project is landward of the existing structures. You will also note that the proposed project is in line with the proposed average line of construction. Increased oceanside light pollution can misorient hatchling sea turtles and nesting female sea turtles. To minimize these impacts, we recommend the applicant be cognizant of lighting. Therefore, the NCWRC recommends the following proactive conservation methods: • Floodlights should not be used • All exterior light fixtures on the seaward or shore -perpendicular sides of buildings, or on the landward side of buildings if the fixtures are visible from beach, should be fitted with shields and directed downward so that no light directly or indirectly illuminates the beach • Exterior lighting should be tamped with a long wavelength light source, such as amber or red light emitting diodes (LED), low pressure sodium, or true red neon. Light sources should emit light above five hundred sixty (560) nanometers (nm). • Pole lights should be shielded in such a way that light will not illuminate areas other than the specific property boundaries of the subject site and shall not directly or indirectly illuminate the beach or dune area on the seaward side of the pole. Natural forces of water and wind collide with tons of force, even on calm days. Man-made structures cannot be guaranteed to survive the force of a hurricane. Long-term erosion (or barrier island migration) may take from two to ten feet of the beach each year, and, sooner or later, will threaten oceanfront structures. These are the facts of life for oceanfront property owners. The Coastal Resources Commission (CRC) has adopted rules for building along the oceanfront. The rules are intended to avoid an unreasonable risk to life and property, and to limit public and private losses from storm and long-term erosion. These rules lessen but do not eliminate the element of risk in oceanfront development. As you consider building along the oceanfront, the CRC wants you to understand the rules and the risks. With this knowledge, you can make a more Informed decision about where and how to build in the coastal area. The Rules When you build along the oceanfront, coastal management rules require that the structure be sited to fit safely into the beach environment. Structures along the oceanfront, less than 5,000 square feet in size, must be behind the frontal dune, landward of the crest of the primary dune, and set back from the first line of stable natural vegetation a distance equal to 30 times the annual erosion rate (a minimum of 60 feel). The setback calculation increases as the size of the structure increases [15A NCAC 7H.0306(a)(2)1. For example: A structure between 5,000 and 10,000 square feet would require a setback from the first line of stable, natural vegetation to a distance equal to 60 times the annual erosion rate (a minimum of 120 feet). The graduated setback continues to increase through structure sizes greater than 100.000 square feet. The Reasons The beachfrom is an ever -changing landform. The beach and the dunes are'natural "shock absorbers,' taking the beating of the wind. and waves and protecting the inland areas. By incorporating building setbacks into the regulations, you have a good chance of enjoying the full life of the structure. At first, it seems very inviting to build your dream house as close to the beach as possible, but in five years you could find the dream has become a nightmare as high tides and storm tides threaten your investmer 1. The Exception The Coastal Resources Commission recognized that these rules, initially passed in June 1979, might prove a hardship for some property owners. Therefore, they established an exception for lots that cannot meet the setback requirement. The exception allows buildings in front of the current setback, if the following conditions apply. 1) the lot must have been platted as of June 1, 1979, and Is not capable of being enlarged by combining with adjoining land under the same ownership; 2) development must be constructed as far back on the property as possible and in no case less than 60 feet landward of the vegetation line; 3) no development can take place on the frontal dune; 4) special construction standards on piling depth and square footage must be met; and 5) all other CAMA, state and local regulations must be met. However, one issue that concerns us as owners of the Silver Gull Motel, is that, on the proposed drawing, it shows an encroachment into our driveway by a concrete median. This should be moved back to allow easy ingress and egress of the driveway. The other concern that we have is that the roof drain for the Silver Gull Motel is being blocked now by construction debris. I have concerns as to where the drainage is going when you finish. This drain line runs to the edge of our property on Salisbury Street, ocean front. Do you have any suggestions on how we can rectify this problem?
