This permit, issued on September 12, 2019 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Expanded Docking Facility 1) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be conside of this permit for which the permittee is responsible. This prohibition shall be applied gPe orn�ced throughout the entire existence of the permitted structure. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) This permit authorizes one additional formalized slip for a maximum of three (3) formalized boat slips. 6) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owners' riparian access corridor to the north. 7) Should the lot to the south be sold prior to the initiation of the expansion of the docking facility, the permittee shall obtain a written agreement from the new owner(s) waiving the 15-foot riparian corridor setback and submit it to the Division of Coastal Management prior to initiating construction of the expanded docking facility. 8) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. General 9) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 10) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 11) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 12) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. RECEIVED NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of General Permit 197800056 (Action ID No. SAW-2019-001573). The applicant is proposing to install a second I F x I I' boatlift. The project is located at 1704 Carolina Blvd., adjacent to Topsail Sound in Topsail Beach, Pender County. Areas of Environmental Concern (AFC's) impacted by the proposal are EW and PT. Waters at the site are classified as SA and are open to shell fishing. The area is not a Primary Nursery Area. I have reviewed this proposal for consistency with the Topsail Beach Land Use Plan and offer the following comments. The general area of the project is classified Developed, while the AECs impacted by the work are classified as Conservation. In general, the Topsail Beach Land Use Plan allows development in Conservation classified AECs which is consistent with the State's minimum use standards. The Topsail Beach Land Use Plan contains some policies, which exceed the State's minimum use standards. However, none of these more restrictive policies appear to be applicable to this project. There are no Coastal Wetlands on -site, or adjacent to the property. Residential properties border the land to the north, south and east and Banks Channel/Topsail Sound borders the property to the west. The existing pier and docking facility were authorized in August 2015 under CAMA General Permit No. 64799-D. The facility is located along the western portion of the property and extends approximately 100' into Banks Channel. The facility consists of a 6' x 40' access pier, 16' x 16' L- head shaped platform, 6' x 30' floating dock and 15' x *15' boatiift (located on north side of the existing floating dock). The existing docking facility is located just inshore of the adjacent docking facilities to the north and south, within Y4 of the width of the water body. The waters of Topsail Sound (adjacent to the project site) are classified as SA by the North Carolina Division of Water Resources. They ARE NOT designated as a Primary Nursery Area (PNA) by the North Carolina Division of Marine Fisheries, and they are OPEN to the harvest of shellfish. Based on visual observations made by DCM staff during the August 2018 site visit, there appears to be NO Submerged Aquatic Vegetation (SAV) in the surrounding area. Water depths in the vicinity of the existing facility range from -2' to -8', relative to normal low water (NLW). PROPOSED PROJECT: The applicant proposes to expand the existing docking facility by installing a new 11' x 11' boatlift According to the application package, a new boadift would be installed along the northern side of the existing elevated platform, between the applicant's pier and the neighboring docking facility. The proposed boatlift would be angled away from the existing platform and would provide dockage for a single vessel. The additional lift would create up to three (3) potential docking spaces, when combined with the existing structures (existing boatlift and floating dock).
