This permit, issued on September 12, 2019 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Expanded Docking Facility
1) This permit authorizes only the docks, piers, and other structures and uses located in or over the
water that are expressly and specifically set forth in the permit application. No other structure,
whether floating or stationary, shall become a permanent part of this docking facility without permit
modification. No non -water dependent uses of structures shall be conducted on, in or over Public
Trust waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be conside of this
permit for which the permittee is responsible. This prohibition shall be applied gPe orn�ced
throughout the entire existence of the permitted structure.

ADDITIONAL CONDITIONS
3) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
5) This permit authorizes one additional formalized slip for a maximum of three (3) formalized boat slips.
6) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure and the adjacent property owners' riparian access corridor to the north.
7) Should the lot to the south be sold prior to the initiation of the expansion of the docking facility, the
permittee shall obtain a written agreement from the new owner(s) waiving the 15-foot riparian corridor
setback and submit it to the Division of Coastal Management prior to initiating construction of the
expanded docking facility.
8) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
General
9) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
10) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
11) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
12) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required. RECEIVED

Consistency Determination:
This project is consistent and not in conflict with the Topsail Beach Land Use Plan
update.
The applicant is proposing to install a second I F x I I' boatlift. The project is located at
1704 Carolina Blvd., adjacent to Topsail Sound in Topsail Beach, Pender County.
Areas of Environmental Concern (AFC's) impacted by the proposal are EW and PT.
Waters at the site are classified as SA and are open to shell fishing. The area is not a
Primary Nursery Area.
I have reviewed this proposal for consistency with the Topsail Beach Land Use Plan and
offer the following comments.
The general area of the project is classified Developed, while the AECs impacted by the
work are classified as Conservation.
In general, the Topsail Beach Land Use Plan allows development in Conservation
classified AECs which is consistent with the State's minimum use standards. The
Topsail Beach Land Use Plan contains some policies, which exceed the State's minimum
use standards. However, none of these more restrictive policies appear to be applicable
to this project.
This project is consistent with the Topsail Beach Land Use Plan Update.

Through coordination with the North Carolina Division of Coastal Management we
have learned of your request to expand the existing docking facility located at 1704
Carolina Boulevard, adjacent to Banks Channel and Topsail Sound in Topsail Beach,
Pender County, North Carolina.
On January 1, 2017, we renewed general permit No. 197800056, (copy enclosed),
that authorizes the maintenance, repair, construction and installation of piers, docks,
boathouses and boat shelters, mooring piles, dolphins, jetties and breakwater structures
in navigable waters of the United States in the State of North Carolina pursuant to
Section 10 of the Rivers and Harbors Act of 1899.
Your work is authorized provided it is accomplished in strict accordance with your
submitted plans, the enclosed general conditions, and the following special conditions:
1. All work authorized by this permit must be performed in strict compliance with the
submitted plans received by this office on 14 August, 2019, which are a part of this
permit.
Please read the enclosed permit to prevent an unintentional violation of Federal law. ECEIVED

The total area of the existing and proposed structures was calculated as follows:
Shoreline length = +/-59 ft. x 8 sq. ft. = 472 sq. ft. allowable.
Proposed and Existing:
Platform = 16' xl6' = 256 sq. ft
Floating dock = 6' x 30' = 180 sq. ft. (in -line with pier)
Boatlifts x 2 = 346 sq. ft. (not included)
Total proposed = 121 sq. ft.
The construction would provide docking space for up to three (3) vessels at this location.
As proposed, the project would be CONSISTENT with the use standards set forth in NCAC
07H .0208(b) (6), including the Y4 width rule, the eight -square foot rule and the pier -width
rule. The proposed structures would be located entirely over open water. This office has
NO OBJECTION to the proposed work provided it is consistent with all other state and
federal permitting requirements.
It is recommended that any permit issued should include standard conditions for private
docking facilities.

9. PROJECT DESCRIPTION:
The project site is located at 1704 Carolina Boulevard, adjacent to Banks Channel and Topsail
Sound, in Topsail Beach, Pender County. To find the property from the Wilmington Regional Office,
take Highway 17 North from Wilmington approximately 20 miles and turn right on N.C. State
Highway 210. Travel approximately 2.8 miles to the intersection of NC 210 and NC 50. Turn right
onto NC 50/NC 210 and travel approximately 1.9 miles onto Topsail Island. Turn right onto S.
Topsail Dr. /NC 50 and travel approximately 7.75 miles to Drum Avenue and turn right Travel
approximately 0.10 miles along Drum Avenue and turn left onto Channel Boulevard. The subject
property will be located on the right-hand side of the road at house number 1704.
Existing man-made features on the property include a single-family residential dwelling and a
private docking facility. High ground vegetation consists of lawn grass and ornamental shrubs. The
high ground portion is elevated approximately 3'-5' above the normal high water (NHW) level, and
the shoreline (+/- 59 linear feet) is stabilized by bulkhead. There are no Coastal Wetlands on -site,
or adjacent to the property. Residential properties border the land to the north, south and east and
Banks Channel/Topsail Sound borders the property to the west.
The existing pier and docking facility were authorized in August 2015 under CAMA General Permit
No. 64799-D. The facility is located along the western portion of the property and extends
approximately 100' into Banks Channel. The facility consists of a 6' x 40' access pier, 16' x 16' L-
head shaped platform, 6' x 30' floating dock and 15' x *15' boatiift (located on north side of the
existing floating dock). The existing docking facility is located just inshore of the adjacent docking
facilities to the north and south, within Y4 of the width of the water body.
The waters of Topsail Sound (adjacent to the project site) are classified as SA by the North Carolina
Division of Water Resources. They ARE NOT designated as a Primary Nursery Area (PNA) by the
North Carolina Division of Marine Fisheries, and they are OPEN to the harvest of shellfish. Based on
visual observations made by DCM staff during the August 2018 site visit, there appears to be NO
Submerged Aquatic Vegetation (SAV) in the surrounding area. Water depths in the vicinity of the
existing facility range from -2' to -8', relative to normal low water (NLW).
PROPOSED PROJECT:
The applicant proposes to expand the existing docking facility by installing a new 11' x 11' boatlift
According to the application package, a new boadift would be installed along the northern side of
the existing elevated platform, between the applicant's pier and the neighboring docking facility.
The proposed boatlift would be angled away from the existing platform and would provide dockage
for a single vessel. The additional lift would create up to three (3) potential docking spaces, when
combined with the existing structures (existing boatlift and floating dock). The proposed boat lift
would encroach within the 15-foot riparian corridor setback of the northern property owner;
however, the applicant has obtained an "initialed" waiver allowing the encroachment

10. ANTICIPATED IMPACTS:
The proposed structure would incorporate approximately 121 sq. ft. of Estuarine Waters and Pubic
Trust Area. The boatlift would remain consistent with similar pier length requirements (established
pier -head line) and would be located outside of the federal channel setback Minor increases in
turbidity should be expected during construction. Water depths in the vicinity of the proposed
project range from -2.0' to -3.9' @ normal low water.

development activities at 1704 Carolina Boulevard, adjacent to Banks Channel and Topsail

and appears to be adequate for processing at this time. The projected deadline for making a
decision on your permit application is October 26, 2019. An additional 75-day review
period is provided by law when such time is necessary to complete the review. If you have
not been notified of a final action by the initial deadline stated above, you should consider
the review period extended. Under those circumstances, this letter will serve as your
notice of an extended review. However, an additional letter will be provided on or about
the 75th day.
If this agency does not render a permit decision within 70 days from August 12, 2019, you
may request a meeting with the Director of the Division of Coastal Management and permit
