Marinas/Docking Facilities
1) Unless specifically altered herein, this Minor Modification authorizes the expansion of the two (2)
outermost boat lifts within slips 1&7, addition of a fixed 16'x16' covered platform gazebo, and
relocation of an osprey pole, as expressly and specifically set forth in the attached letter and workplan
drawings. Any additional development activities may require a modification of this permit. The
permittee and/or his or her contractor shall meet with a representative of the Division prior to project
initiation.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2022

2) Unless specifically altered herein, this permit authorizes the osprey pole, all as expressly and specifically
set forth in the attached permit application and workplan drawings. The nesting platform of the osprey,
platform structure shall be maintained at an elevation above normal high water that does not pose a
hazard to navigation.
3) No lateral bracing (i.e. wire, timbers, etc.) shall be used to support the piling.
4) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
5) This Minor Modification shall be attached to the original Permit No. 71-19, which was issued on
9/23/19, as well as all subsequent modifications, refinements, and renewals, and copies of all documents
must be readily available on site when Division personnel inspect the project for compliance.
6) All conditions and stipulations of the active permit remain in force unless specifically altered herein.
NOTE: The U.S. Army Corps of Engineers assigned the proposed project COE Action Id. No. SAW-
2018-00339.

SUBJECT Permit Modification Request to State Permit No. 71.19, Finally Close LLC, 5908 Greenville Loop Road,
Wilmington, New Hanover County
William Corbett, representing Finally Close LLC, is requesting a Minor Modification to State Permit No. 71-19. This request was
submitted in a letter received by DCM on February 1911, 2020, and four (4) drawings received by DCM on February 20", 2020,
labeled "Pier and Dock Plan With Survey Rev 1 ", *Pier and Dock Plan- Existing Removed Rev. 2", Pier and Dock Profile", and
Pier and Dock Profile Rev. 2. The drawings that include "Rev. 2" in the title detail the changes requested by the applicant below.
This minor mod request was accepted as complete an March 9, 2020 with the delivery of the adjacent riparian property owner
notification delivery receipts.
CAMA Major Permit 71-19 was issued on September 23, 2019 to Finally Close LLC to expand an existng docking facility al 5908
Greenville Loop Rd in Wilmington, NC. A letter of refinement to the permit was issued on Febuary 13, 2020 authorizing a
change in elevation for a portion of the fixed pier. Major Permit 71-19 is due to expire December 31, 2022.
The applicant is requesting a minor modification to the permit to allow for an expansion of the two (2) outermost boat lifts within
slips 18 7. The applicant is requesting a change to accommodate a wider 12'6" boat lift in each of the outermost slips, from the
previously authorized 198' wide boat lifts. This would amount to a 22' wide outward expansion of the footprint of the outermost
slips (slip 187 only). The distance from the constructed features to the western adjacent riparian corridor line would reduce from
601"as authorized to 58'3", and reduce the distance from the constructed features to the eastern adjacent riparian corridor line
from 42'1" as authorized to 407 (see drawings tilled Pier and Dock Plan with Survey, Rev 1 8 Rev.2). Additionally, the
applicant is requesting to construct a fixed, covered platform gazebo (16' xl6') (See drawing Pier and Dock Plan With Survey
Rev 2, and drawing Pier and Dock Profile Rev.2). This feature was omitted from the original permit application as at the time it
conflicted with a City of Wilmington regulation that has since been amended and is now permittable. Lastly, the applicant is
requesting to move an existing osprey pole further to the northwest (still within their riparian access corridor) at the request of the
western riparian neighbor to allow for more buffer distance between the docking facility and potential nesting ospreys in the
future. The applicant has notified the adjacent riparian property owners with certified mail.
The proposed modifications appear to be consistent with NCAC 07H .0208(b)(6), which includes the specific use standards for
docking facilities. The applicant's property includes 375 LF of shoreline. The authorized docking facility accounts for 784 SF in
platform shading, and the proposed gazebo would add 256 SF in platform shading, for a total of 1040 SF of platform shading.
The 22' outward expansion of the two (2) outermost slips would result in 33 SF of additional incorporation of public trust area.
This office has no objection to the modification of State Permit No. 71-19, provided it is consistent with all other local, stale, and
federal regulations. Will Corbett has submitted a check (check No. 163) in the fee amount of $100.
By copy of this memo, DCM is requesting that the USACE, NC DWR, and the New Hanover County LPO provide any comments that
your agency may have on the proposed project to Gregg Bodnar of DCM's MHC office with in 14 days of receipt of this memo.

Minor Modification Request of Existing Major Permit 71-19
William C. Corbett, on behalf of Finally Close LLC, is requesting a minor modification to
state permit 71-19. This major permit was issued on September 23, 2019 to expand an
existing a docking facility at 5908 Greenville Loop Road in Wilmington. Major Permit 71-
19 is due to expire December 31, 2022. This minor modification request is to construct
a covered, fixed -platform gazebo measuring 16' x 16'. This feature was omitted from
the original permit application due to a conflicting City of Wilmington regulation at the
time of permitting that has been amended. This request for gazebo conforms to all
existing guidelines and restrictions pertinent to the previously approved major permit
71-19.
Additionally, at the suggestion of our marine contractor, we are requesting permission
to locate the outer pilings 22" outward on each end of the pier in order to facilitate
installation of standard -sized boat lifts. The resulting location would retain a distance of
58'3" from the riparian line bordering the Williams property to the west and 40'3" from
the Herring Pass Subdivision to the east.
Lastly, at the request of our neighbor, Mrs. Williams, we are requesting permission to
move the existing osprey pole on the western side of the pier further toward the
Williams property. She is concerned about any possible disturbance to nesting ospreys
and would like the pole relocated to reduce any such disturbance.

I hereby certify that I own property adjacent to Finally Close LLC's property located at 5908 Greenville
Loop Road on Hewlett's Creek, in Wilmington, N.C. The applicant has described to me, as shown
below, the development proposed at the above location.
I have no objection to this proposal.

DESCRIPTION AND/OR DRAWING OF PROPOSED DEVELOPMENT

We are proposing minor modifications to the pier and dock plans previously permitted by all applicable
agencies. Please see a description of the proposed modifications below and the attached schematics.
1. At the suggestion of the dock builder, the proposed locations of the outer pilings are being
expanded outward by 22 inches on each end of the dock to accommodate a standard sized
boat lift for the outer slips. This retains a distance of 58'3" from the riparian line with Mrs.
Williams' property (BK 969, PG 692 and BK 959, PG 158) and 40'3" from the riparian line with
the Herring Pass Subdivision (MB 47, PG 31).
2. Per new allowances by the City of Wilmington not in place at the time of original pier and dock
application, a 16' x 16' gazebo is to be placed at the documented location (see provided
schematic).
3. At the request of Mrs. Williams, we are applying for permission to move the existing osprey pole
in the direction of Mrs. Williams' property so as to hopefully avoid any future disturbance to
nesting ospreys. The exact location of the osprey pole is yet to be fully determined pending
discussion with and approval by the appropriate agencies.

Description of project area and activity: The proposal is to add a 16 feet by 16 feet gazebo to an existing docking facility, to widen
the two (2) outer boat lifts and to relocate an osprey Dole. The addition of the gazebo will add 256 square feet of coverage of
Hewletts Creek by the dockine facility.

Special Condition: In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must
implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly adhere to all requirements therein. The guidelines

Your work is authorized by the above referenced permit provided it is accomplished in strict accordance with the attached
RGP-56 General and Special Conditions, your permit modification application and Revision #2 drawings dated February 17,
2020. Any violation of the attached conditions or deviation from your submitted plans may subject the permittee to a stop
work order, a restoration order, a Class 1 administrative penalty, and/or appropriate legal action.
This verification will remain valid until the expiration date identified below unless the nationwide and/or regional general permit
authorization is modified, suspended or revoked. If, prior to the expiration date identified below, the nationwide and/or regional
general permit authorization is reissued and/or modified, this verification will remain valid until the expiration date identified below,
provided it complies with all requirements of the modified nationwide permit. If the nationwide and/or regional general permit
authorization expires or is suspended, revoked, or is modified, such that the activity would no longer comply with the terms and
conditions of the nationwide permit, activities which have commenced (i.e., are under construction) or are under contract to
commence in reliance upon the nationwide and/or regional general permit, will remain authorized provided the activity is completed
within twelve months of the date of the nationwide and/or regional general permit's expiration, modification or revocation, unless
discretionary authority has been exercised on a case -by -case basis to modify, suspend or revoke the authorization.
Activities subject to Section 404 (as indicated above) may also require an individual Section 401 Water Quality Certification. You
