This permit, issued on August 6, 2020 is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
ie subject to fines, imprisonment or civil action; or may cause the permit to oe nun ana voiu.
Lot 57 Docking Facility
1) Unless specifically altered herein, this Minor Modification authorizes a 3' x 26' section of dock
waterward of the previously permitted boardwalk on lot 57 and the addition of a two -pole boatlift
immediately waterward of the new 3' x 26' section, all as expressly and specifically set forth in the
attached letter and workplan drawings. Any additional development activities may require a
modification of this permit.

This permit action may be appealed by the pertnittee or
other qualified persons within twenty (20) days of the issuing
date.
This permit shall be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work shall cease when the permit expires on
December 31, 2022
In issuing this permit; the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
2) The waters adjacent to the permitted project are classified by the Marine Fisheries Commission as
"Conditionally Approved -Open". The construction and/or operation of the authorized facilities shall not
directly result in a permanent closure of these conditionally approved waters. Any such permanent
closure directly attributable to the authorized facility shall require that the permittee undertake remedial
actions to remedy the situation. Such actions may include, but are not limited to, a removal of any
unauthorized slips or mitigative measures to reduce or eliminate the cause(s) of the closure.
3) This permit authorizes a maximum of 1 formalized boat slip as indicated on the attached workplan
drawings.
Lot 41 Docking Facility
4) This permit authorizes only the docks, piers, floating platform, gazebo, and other structures and uses
located in or over the water that are expressly and specifically set forth in the permit application. No
other structure; whether floating or stationary, shall become a permanent part of this docking facility
without permit modification. No non -water dependent uses of structures shall be conducted on, in or
over Public Trust waters without permit modification.
5) The authorized covered platform portion shall not be enclosed. Any material used on the sides shall not
obstruct view and shall be permeable to air and water. Screen or wire on the sides along with benches
are permitted. Lattice is specifically excluded from being used under this authorization.
6) The roof of the covered platform portion shall not be designed for second story use.
7) This permit authorizes a maximum of 1 formalized boat slip.
8) Any portion of the permitted access pier and docking facilities built above Coastal Wetlands shall not
exceed six feet in width and shall be elevated a minimum of three feet above the wetland substrate as
measured from the bottom of the decking.

9) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
10) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout
the entire existence of the permitted structure.
11) The authorized structures and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the dimensions shown on the attached permit drawings.
12) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.

ADDITIONAL CONDITIONS
13) The authorized docking facility shall not exceed the quarter width of the water body.
14) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure and the adjacent property owner's area of riparian access.
15) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
16) All debris associated with this development shall be contained within the authorized project area and
removed to an appropriate upland refuse disposal site.
17) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
18) This Minor Modification shall be attached to the original Permit No. 20-19, which was issued on
3/29/19, as well as all subsequent modifications, refinements, and renewals, and copies of all documents
must be readily available on site when Division personnel inspect the project for compliance.
19) All conditions and stipulations of the active permit remain in force unless specifically altered herein.
NOTE: The N.C. Division of Water Resources has assigned the proposed project DWR Project No.
2018-1527v1.
NOTE: The U.S. Army Corps of Engineers assigned COE Action Id. No. SAW-2018-01501.

Mr. D Logan, acting as agent for WLI Investments, LLC has submitted a request to modify CAMA Major Permit
No. 20-19, which was issued on March 29, 2019, and later transferred on June 6, 2019: The permit is scheduled to
expire on December 31, 2022.
The permittee is requesting approval to install a 9' wide boardwalk (6' over land and 3' over water) along the
shoreline of Lot No. 57, and also install a 2-pole boatlift immediately adjacent to the existing bulkhead. According
to the modification request, the boatlift would extend approximately 15' into the entrance channel, which is
purported to be approximately 90' in width.
In addition to the development adjacent to lot no. 57, the permittee is also seeking approval to develop lot no. 41,
which is one of the lots along the eastern shoreline (i.e. located outside of the entrance canal and boat basin). At this
location, the permittee is requesting approval to install a 6' x 50' access pier, 12' x 16' gazebo and 6' x 20' floating
dock. As proposed, the pier would extend toward the east and terminate into a 12' x 16' gazebo. A 6' x 20' floating
dock would be installed just south of the gazebo and would ran parallel to the shoreline, in -line with the outer edge
of the gazebo. Based on the information provided, it appears the proposed dock design is similar in size and location
as previous pierstdocks along this section of shoreline. According to the information provided, the docking facility
would extend approximately 18' beyond the normal low water line, along the near shore edge of the existing channel
(which measures 40' in width). Water depths in the area of the proposed floating dock, according to the modification
request, range from -3' to -5', @ normal low water.
Based on the information provided, regarding the minor modification request (plans and documents), there does not
appear to be any new impacts to any wetlands, and the size/footprint of the development plan would remain
consistent with DCM's Rules concerning the Estuarine and Public Trust Waters.
At this time, this office has no objection(s) to this renewal request. The applicant has submitted a check (No. 6965)
in the amount of $100 to cover the processing fee.
By copy of this memo, DCM is requesting that the NCDWR and NCDEMLR and NCDMF provide any comments that your
agency may have on the proposed project to Curt Wychert of DCM's Morehead City office within 14 days of receipt of
this memo

adding 357 LF of upland boardwalk at the edge of the existing bulkhead on Lots 57, 58, 59, 66 and 67.
Additionally, the owner would like to add a single boat slip to Lot 57 and Lot 41, as indicated on the attached
drawings, respectively.

We have had an opportunity to review this modification request, and do not have any objections to any of the proposed
construction activities. We would like to reiterate, however, the need to avoid the creation of any permanent or
temoorary opportunities for boat dockage through the construction of the boardwalks along lots 58, 59, 66, and 67. As
is specified in the original permit and in the deed restrictions noted in the bottom left corner of page 9 of the
modification request, these lots are prohibited from maintaining any slips, and the creation of permanent or temporary
slips would necessitate an expanded closure to shellfish harvest impacting areas currently classified as Conditionally
Approved Open.

Hey Anne,
It relates to the separation distance between facilities/slips when we are doing slip counts and trying to measure our
buffer closures. The bottom little piece of lot S7 is far enough away from the marina that an individual slip there will not
be included with the 75 slips in the marina basin proper for counting or measuring purposes.

impact the shellfish closure, but here was our full comment:

I could not find the permit for this project. I've got the ones all around it, but not this one. I also could not find the
permit application. Perhaps I'm looking under the wrong applicant for the historical information. I have though reviewed
the current proposal.
NCWRC would not support a project that compromises or closes open shellfish waters. While the individual aspects of
the project may appear to fall within impact allowances, the cumulative impacts of this proposal and previous
developments may not be acceptable. Therefore, NCWRC would support the comments provided by NCDMF and
Shellfish Sanitation to minimize impacts to their resources regarding the piers, lifts, and slips. More detailed water
depths in the precise slip area may also be beneficial. If the expansion of the boardwalk would not create an increase in
the number of calculated slips, NCWRC would have minimal concerns with its construction.

The DWR would object to any project that degrades or closes open shellfish waters in accordance with the 15A NCAC
028.0201 Antidegradation Policy, 15A NCAC 02B .0221 Tidal Salt Water Quality Standards for Class SA Waters and 15A
NCAC 02B .0225 Water Quality Standards for Outstanding Resource Waters. This proposed modification appears to be
consistent with the aforementioned standards. However, continued requests to modify the permit to authorize
additional dockage could result in cumulative impacts that would result in a denial of future requests. Therefore, DWR
would support the comments provided by NC WRC, NCDMF and Shellfish Sanitation to minimize impacts to SA:ORW
water resources regarding piers, boat lifts, and boat slips. The original permit application drawing sheet 18 of 19
references both Normal High Water and Mean Low Water for Profile 7 which is located approximately 650 feet south of
the proposed modification on Lot 41. The proposed modification for Lot 41 references Normal Low Water and fails to
identify the entity responsible for determining the depths in this location.. The depths shown in the location of the
proposed modification for Lot 41 should be verified in the field for accuracy to ensure no impacts to SAV or shallow
bottom habitat will occur. I appreciate the opportunity to comment. Please feel free to call or email me if you have

0213.0201 Antidegradation Policy, 15A NCAC 02B .0221 Tidal Salt Water Quality Standards for Class SA Waters and 15A
NCAC 02B .0225 Water Quality Standards for Outstanding Resource Waters. This proposed modification appears to be
consistent with the aforementioned standards. However, continued requests to modify the permit to authorize
additional dockage could result in cumulative impacts that would result in a denial of future requests. Therefore, DWR
would support the comments provided by NC WRC, NCDMF and Shellfish Sanitation to minimize impacts to SA:ORW
water resources regarding piers, boat lifts, and boat slips. The original permit application drawing sheet 18 of 19
references both Normal High Water and Mean Low Water for Profile 7 which is located approximately 650 feet south of
the proposed modification on Lot 41. The proposed modification for Lot 41 references Normal Low Water and fails to
identify the entity responsible for determining the depths in this location.. The depths shown in the location of the
proposed modification for Lot 41 should be verified in the field for accuracy to ensure no impacts to SAV or shallow

Hi Curt.
The DMF Fisheries Resource Specialist reviewed the CAMA Minor Modification Request: WLI Investments, LLC #20-19.
DMF does not have any objections to the proposed modification of this permit. We do have concerns that the construction
of any additional slips or the use of temporary slips off the proposed boardwalk or piers along lots 58, 59, 66, and 67 would
cause an expanded closure to shellfish harvest impacting areas currently classified as Conditionally Approved Open.

I just wanted to round back on this topic. It seems as though there are no concerns from Shellfish sanitation about the
addition of these slips and boardwalk causing a shellfish closure, however, that doesn't mean that there still aren't
concerns or other comments on the proposed modifications. Should I be expecting more comments from any of your
agencies?
