Any violation of these terms may ie subject to fines, imprisonment or civil action; or may cause the permit to oe nun ana voiu. Lot 57 Docking Facility 1) Unless specifically altered herein, this Minor Modification authorizes a 3' x 26' section of dock waterward of the previously permitted boardwalk on lot 57 and the addition of a two -pole boatlift immediately waterward of the new 3' x 26' section, all as expressly and specifically set forth in the attached letter and workplan drawings. Any additional development activities may require a modification of this permit. (See attached sheets for Additional Conditions) This permit action may be appealed by the pertnittee or other qualified persons within twenty (20) days of the issuing date. This permit shall be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work shall cease when the permit expires on December 31, 2022 In issuing this permit; the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee t -_ % WLI Investments, LLC c/o Mr. D Logan Permit No. 20-19 Page 2 of 3 ADDITIONAL CONDITIONS 2) The waters adjacent to the permitted project are classified by the Marine Fisheries Commission as "Conditionally Approved -Open". The construction and/or operation of the authorized facilities shall not directly result in a permanent closure of these conditionally approved waters. Any such permanent closure directly attributable to the authorized facility shall require that the permittee undertake remedial actions to remedy the situation. Such actions may include, but are not limited to, a removal of any unauthorized slips or mitigative measures to reduce or eliminate the cause(s) of the closure. 3) This permit authorizes a maximum of 1 formalized boat slip as indicated on the attached workplan drawings. Lot 41 Docking Facility 4) This permit authorizes only the docks, piers, floating platform, gazebo, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure; whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 5) The authorized covered platform portion shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. Screen or wire on the sides along with benches are permitted. Lattice is specifically excluded from being used under this authorization. 6) The roof of the covered platform portion shall not be designed for second story use. 7) This permit authorizes a maximum of 1 formalized boat slip. 8) Any portion of the permitted access pier and docking facilities built above Coastal Wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet above the wetland substrate as measured from the bottom of the decking. General 9) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 10) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 11) The authorized structures and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. 12) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. WLI Investments, LLC c/o Mr. D Logan Permit No. 20-19 Page 3 of 3 ADDITIONAL CONDITIONS 13) The authorized docking facility shall not exceed the quarter width of the water body. 14) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's area of riparian access. 15) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 16) All debris associated with this development shall be contained within the authorized project area and removed to an appropriate upland refuse disposal site. 17) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 18) This Minor Modification shall be attached to the original Permit No. 20-19, which was issued on 3/29/19, as well as all subsequent modifications, refinements, and renewals, and copies of all documents must be readily available on site when Division personnel inspect the project for compliance. 19) All conditions and stipulations of the active permit remain in force unless specifically altered herein. NOTE: The N.C. Division of Water Resources has assigned the proposed project DWR Project No. 2018-1527v1. NOTE: The U.S. Army Corps of Engineers assigned COE Action Id. No. SAW-2018-01501. The permittee is requesting approval to install a 9' wide boardwalk (6' over land and 3' over water) along the shoreline of Lot No. 57, and also install a 2-pole boatlift immediately adjacent to the existing bulkhead. According to the modification request, the boatlift would extend approximately 15' into the entrance channel, which is purported to be approximately 90' in width. In addition to the development adjacent to lot no. 57, the permittee is also seeking approval to develop lot no. 41, which is one of the lots along the eastern shoreline (i.e. located outside of the entrance canal and boat basin). At this location, the permittee is requesting approval to install a 6' x 50' access pier, 12' x 16' gazebo and 6' x 20' floating dock. As proposed, the pier would extend toward the east and terminate into a 12' x 16' gazebo. A 6' x 20' floating dock would be installed just south of the gazebo and would ran parallel to the shoreline, in -line with the outer edge of the gazebo. Based on the information provided, it appears the proposed dock design is similar in size and location as previous pierstdocks along this section of shoreline. According to the information provided, the docking facility would extend approximately 18' beyond the normal low water line, along the near shore edge of the existing channel (which measures 40' in width). Water depths in the area of the proposed floating dock, according to the modification request, range from -3' to -5', @ normal low water. Based on the information provided, regarding the minor modification request (plans and documents), there does not appear to be any new impacts to any wetlands, and the size/footprint of the development plan would remain consistent with DCM's Rules concerning the Estuarine and Public Trust Waters. At this time, this office has no objection(s) to this renewal request. The applicant has submitted a check (No. 6965) in the amount of $100 to cover the processing fee. Therefore, NCWRC would support the comments provided by NCDMF and Shellfish Sanitation to minimize impacts to their resources regarding the piers, lifts, and slips. More detailed water depths in the precise slip area may also be beneficial. If the expansion of the boardwalk would not create an increase in the number of calculated slips, NCWRC would have minimal concerns with its construction. The DMF Fisheries Resource Specialist reviewed the CAMA Minor Modification Request: WLI Investments, LLC #20-19. DMF does not have any objections to the proposed modification of this permit. We do have concerns that the construction of any additional slips or the use of temporary slips off the proposed boardwalk or piers along lots 58, 59, 66, and 67 would cause an expanded closure to shellfish harvest impacting areas currently classified as Conditionally Approved Open. It seems as though there are no concerns from Shellfish sanitation about the addition of these slips and boardwalk causing a shellfish closure, however, that doesn't mean that there still aren't concerns or other comments on the proposed modifications.
