HomeMy WebLinkAbout59-19 Wanchese Marine Industrial ParkPermit Class NEW Permit Number 59-19 w s- STATE OF NORTH CAROLINA Department of Environmental Quality and Coastal Resources Commission Permit for X Major Development in an Area of Environmental Concern pursuant to NCGS 113A-118 Excavation and/or filling pursuant to NCGS 113-229 Issued to Wanchese Marine Industrial Park, PO Box 549, Wanchese, NC 27981 Authorizing development in Dare County at Wanchese Harbor and Mill Creek, lots 22 and 23 at the OBX Marina as requested in the permittee's application dated 5/13/19, incl. attached workplan drawings (3), Sheets 1 & 3 of 3 dated 4/26/19 and Sheet 2 of 3 dated "Revised 4/22/08". This permit, issued on July 11, 2019 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. OBX Marina 1) Prior to the occupancy of any new slips authorized under this permit, a marine pumpout sewage disposal facility shall be installed in an easily accessible location and maintained in operable condition for the life of the marina. 2) Prior to the occupancy of any slips authorized by this permit, the permittee shall meet on -site with a representative of the Division to ensure that the required pumpout facility is in place and operable. 3) The marina shall display a sign showing the location of the on -site pumpout facility, including other appropriate waste disposal information, at the entrance and exit from the main piers. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2022 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Wanchese Marine Industrial Park Permit No. 59-19 Page 2 of 3 s- ADDITIONAL CONDITIONS 4) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the marina. Any sewage discharge at the manna shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 5) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this marina without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 6) No attempt shall be made by the peen ittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 7) The authorized marina shall not exceed the distances offshore, as expressly and specifically set forth in the permit application and associated workplans. The distances offshore have been determined for the above referenced property via Permit No. 119-05, which was authorized by CRC variances on 7/18/05 and 3/1/19 and which expired on 12/31/12. 8) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 9) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structures in order to make it more visible during hours of darkness or inclement weather. 10) This permit authorizes the removal of 6 existing formalized boat slips and the addition of 9 new formalized boat slips, resulting in a total number of 52 formalized boat slips at the permitted marina. NOTE: It is strongly recommended that the permittee exercise all available precautions in the day-to-day operation of the facility to prevent facility waste from entering the adjacent waters. Such discharge, either directly or indirectly, to adjacent waters could contravene state water quality standards, thereby violating state law. Wanchese Marine Industrial Park Permit No. 59-19 Page 3 of 3 ADDITIONAL CONDITIONS General 11) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. The permittee shall notify NOAAINATIONAL OCEAN SERVICE Chief Source Data Unit N CS261, 1315 E West HWY-RM 7316, Silver Spring, MD 20910-3282 at least two weeks prior to beginning work and upon completion of work. 12) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 13) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The pernttee is not relieved of this requirement if he or she abandons the permitted activity without having it transferred to a third party. 14) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2019-00935). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2004-1517 V3. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 264-3901 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal water level. The property is located at 708 B Harbor Road, Wanchese, Dare County adjacent to Roanoke Sound. The development proposal involves the Public Trust Area (PTA) and Estuarine Waters (EW) Areas of Environmental Concern. I have reviewed the Rules of the Coastal Resources Commission (CRC) as they pertain to this project and my findings are as follows: 15A NCAC 07H .0208 USE STANDARDS (a) addresses General Use Standards, and subparagraph (1) requires that uses which are not water dependent shall not be permitted in coastal wetlands, estuarine waters, and public trust areas. Restaurants, residences, apartments, motels, hotels, trailer parks, private roads, factories, and parking lots are examples of uses that are not water dependent. Uses that are water dependent include: utility crossings, wind energy facilities, docks, wharves, boat ramps, dredging, bridges and bridge approaches, revetments, bulkheads, culverts, groins, navigational aids, mooring pilings, navigational channels, access channels and drainage ditches. This sub -paragraph lists these structures as water dependent. (a)(2)(A) requires that the location, design, and need for development, as well as the construction activities involved shall be consistent with the management objective of the Estuarine and Ocean System AEC (Rule .0203 of this subchapter) and shall be sited and designed to avoid significant adverse impacts upon the productivity and biologic integrity of coastal wetlands, shellfish beds, submerged aquatic vegetation as defined by the Marine Fisheries Commission, and spawning and nursery areas. Consistent: The development is designed to not interfere with Shellfish beds or submerged aquatic vegetation. (a)(2)(B) requires that the development shall comply with state and federal water and air quality Consistent: This development will not violate water and air quality. (a)(2)(C) requires that the development shall not cause irreversible damage to documented archaeological or historic resources as identified by the N.C. Department of Cultural resources. Consistent: There are no known archaeological or historic resources on the property. (a)(2)(D) requires that the development shall not increase siltation. Consistent: It does not appear that this development will measurably increase siltation. (a)(2)(E) requires that the development shall not create stagnant water bodies. Consistent: It does not appear that the development will create stagnant water bodies. (a)(2)(F) requires that the development shall be timed to avoid significant adverse impacts on life cycles of estuarine and ocean resources. Consistent: The development will be timed to have minimum adverse significant effects on life cycles or estuarine resources. Possible Inconsistency: The development may affect navigation; however, it was previously authorized through a variance. (b) Specific Use Standards (b)(5) Addresses Marinas (b)(5)(A) requires that Marinas shall be sited in non -wetland areas or in deep waters (areas not requiring dredging) and shall not disturb shellfish resources, submerged aquatic vegetation as defined by the MFC, or wetland habitats, except for dredging necessary for access to high -ground sites. Consistent: The Marina is not located in a wetland area. (b)(5)(H) requires that Marinas shall be designed so that the capability of the waters to be used for navigation or for other public trust rights in estuarine or public trust waters are not jeopardized while allowing the applicant access to deep waters; Possible Inconsistency: The proposed additional piers will cover more public trust waters than what was previously constructed. (b)(5)(0) requires that all marinas shall comply with all applicable standards for docks and piers, shoreline stabilization, dredging and dredged material disposal of this Rule; Possible Inconsistency: The proposed additional piers do not meet the Ya width rules, but were previously authorized through a CRC variance. (b)(6) Addresses Piers and Docking Facilities. (b)(6)(A) requires that piers shall not exceed six feet in width. Piers greater than six feet in width shall be permitted only if the greater width is necessary for safe use, to improve public access, or to support a water dependent use that cannot otherwise occur. Possible Inconsistency: The proposed finger piers are 6 foot in width, but the proposed floating pier is 8 foot in width. (b)(6)(F) requires that piers and docking facilities shall be single story. They may be roofed but shall not be designed to allow second story use. Consistent: The proposed piers are single story. RECEIVED JUL 01 2019 DCM-MHD CITY North Uarolma Department of Enva'omnental (Quality MEMORANDUM Division of Coastal Management Page 4 of 5 June 25,2019 (b)(6)(G) requires that pier and docking facility lengths shall be limited by: (i) not extending beyond the established pier or docking facility length along the same shoreline for similar use; (This restriction does not apply to piers 100 feet or less in length unless necessary to avoid unreasonable interference with navigation or other uses of the waters by the public); Consistent: The proposed finger piers appear to be in line with the existing piers on the other side of the original docking facility. (ii) not extending into the channel portion of the water body; and Consistent: The proposed piers will not extend into the channel portion of the waterbody. (iii) not extending more than one-fourth the width of a natural water body, or human -made canal or basin. Measurements to determine widths of the water body, canals or basins shall be made from the waterward edge of any coastal wetland vegetation that borders the water body. The one-fourth length limitation does not apply in areas where the U.S. Army Corps of Engineers, or a local government in consultation with the Corps of Engineers, has established an official pier head line. The one-fourth length limitation shall not apply when the proposed pier is located between longer piers or docking facilities within 200 feet of the applicant's property. However, the proposed pier or docking facility shall not be longer than the pier head line established by the adjacent piers or docking facilities, nor longer than one-third the width of the water body. Possible Inconsistency: The proposed finger piers will extend approximately 250ft which is more than W width of the 532 foot waterway. (b)(6)(I) requires that piers and docking facilities shall not interfere with the access to any riparian property and shall have a minimum setback of 15 feet between any part of the pier or docking facility and the adjacent property owner's areas of riparian access. The line of division of areas of riparian access shall be established by drawing a line along the channel or deep water in front of the properties, then drawing a line perpendicular to the line of the channel so that it intersects with the shore at the point the upland property line meets the water's edge. Consistent: The proposed piers are within the Seafood Industrial Parks property boundaries. DATE: June 18, 2019 Consistency Determination: The request is consistent with/not in conflict with the Dare County 2009 Land Use Plan certified by the CRC on February 24, 2011. Overview: The NC Seafood Industrial Park is located on approximately 54 acres adjacent to the Wanchese Harbor Basin, a manmade basin which adjoins Mill Landing Creek, and west of Broad Creek off the Roanoke Sound. The subject property includes leasehold Lots 22-24. The property has approximately 650 linear feet of shoreline along the harbor basin to the west. It is sparsely vegetated with small patches of lawn grasses. The property has an elevation of approximately 5 feet above Normal Water Level (NWL). It is located in the AE (8) and AE (10) Floodzones. Existing site improvements on Lots 22-24 consist of an office building, storage sheds and asphalt and gravel parking. Existing shoreline improvements consist of shoreline bulkhead; six (6) 15 foot long finger piers; two (2) 35 foot long finger piers; a 236 foot long pier with a 246 foot long platform that has five (5) 28.5 foot long finger piers and six (6) 24.5 foot long finger piers; two (2) piers that are 80.45 feet long, and; a 157.5 foot long pier. Forty-nine (49) boat slips are provided. Elimination of six (6) existing slips and installation of an 8 foot wide by 100 foot long floating pier with two (2) 6 foot wide by 24.5 foot long finger piers, two (2) 6 foot wide by 28.5 foot long finger piers, and twenty-seven (27) tie pilings are proposed. Improvements will result in the creation of nine (9) boat slips bringing the total number of boat slips to fifty-two (52). Submerged Aquatic Vegetation (SAV) was not observed in the project area. A review of historic and archaeological resources was not provided. Anticipated Impacts resulting from this project are expected to include: the shading of 1,436 sq. ft. of Public Trust Area/Estuarine Waters Areas of Environmental Concern (AEC). Basis for Determination: Proposed improvements are located in the waters of a manmade basin adjoining Mill Landing Creek. As indicated on Page 217 of the Dare County Land Use Plan, the "Conservation" designation applies to all CAMA Areas of Environmental Concern (AECs). As indicated on Page 217 for the "Conservation" designation, "...development should be limited to residential development and traditional accessory uses permitted in the CAMA AECs such as but not limited to piers, docks, and crab -shedders." Proiect Setting The property proposed for development is located at 708 B Harbor Road in Wanchese and is part of the North Carolina Seafood Industrial Park Authority, which consists of 46 acres adjacent to Broad Creek and the Roanoke Sound. The upland portion of the property contains an office building and storage sheds along with asphalt and gravel parking areas with small patches with indigenous yard grasses. The property to the north is a vacant lot owner by a private property owner and the property to the south is a commercial docking facility. Vegetation on the site includes, but is not limited to, indigenous yard grasses around the buildings. Soil types include Hobonny Muck (HoA) and Psamments (PsB). Also, the water classification for this site is Aquatic Life, Secondary Recreation, Salt Water (SC). Submerged Aquatic vegetation (SAV) was not found within the project area. The property has an elevation of approximately 5 feet above Normal Water Level (NWL), and the shoreline is stabilized with bulkheading. There are currently 49 slips with a 236 foot pier with a 246 foot platform coming off of it containing five 28.5 foot finger piers and six 24.5 foot finger piers. There are also three other piers associated with this lot two that are 80.45 feet long and the other is 157.5 feet long. There is also six 15 foot finger piers off of the bulkhead with two additional 35 foot finger piers. Development Proposal The applicant proposes to eliminate 6 existing slips and construct a 100 foot by 8-foot-wide floating pier with two 6 foot by 24.5-foot finger piers and two 6 foot by 28.5-foot finger piers and add an additional 27 tie pilings. The proposed development includes the addition of nine slips of varying sizes that will result in a total slip count of12 Y4 after the removal of six slips. The water depth at the terminus is approximately 15 feet w h conflicts with the width rule. The proposed development was previously authorized through CRC variance from Major permit number 119-05 that expired in 2015. Anticipated Impacts The proposed development will result in the shading of 1,436 square feet of Public Trust Area and Estuarine Waters of Environmental Concern. RECEIVED Submitted by: Cynthia Rountree MAY 3 0 2119 Date: May 24, 2019 DCM-MHG CITY OBX Marina Wanchese Marine Industrial Park Marina Expansion CAMA Major Permit #119.05 Major Modification April 3, 2019 Introduction and Background The proposed project involves the expansion of the OBX Marina (formerly Broad Creek Marina) located on lots 22 and 23 within the Wanchese Marine Industrial Park (WMIP) from an existing 49 slips to 52 slips as shown on the attached Site Plans. The project vicinity and project area (35.84430560 north and 75.6213555' west) is shown on the attached copy of the USGS Topographic Quadrangle-Wanchese. Permits for 32 slips were issued by CRC Variance in 2005. A copy of NC DCM's file review (Memorandum prepared by Gregg Bodnar) for this project is attached. A subsequent request for expansion of this marina was issued in (exactly as presented in this application —removal of six slips and addition of nine slips for a total of 52 slips) by CRC Variance on March 1, 2009. The variance was required because the slips exceed the quarter -width rule (15A NCAC 071­1.0208(b)(6)(J) (iii). This permit request is identical to the previously authorized work in CAMA Major Modification #119.05 issued by variance on March 1, 2009 (copy attached). Due to economic circumstances and restructuring of the OBX Marina (formerly Broad Creek Marina), the permit expired before the slip expansion was constructed. The owners of the marina now desire to re -apply for the slip expansion, exactly as previously authorized. Proposed Work Requiring CAMA Maior Modification (#119-05) Proposed activities associated with the development, which require modification of the CAMA Major Permit #119-05 include installation of 100 linear feet (If) of eight feet wide floating pier, nine 20 feet by 40 feet slips, and four six feet by 28.5 feet finger piers. The slips and piers will also include the installation of 27 mooring pilings and the removal of 6 existing slips for a total slip count of 52. All of the proposed activities are shown on the attached site plans. For clarity we have included three Site Plans that show the existing marina and slip configuration (Figure 1), previously authorized marina expansion (Figure 2) (as permitted by variance March 1, 2009) and the marina expansion requested with this application (Figure 3) which is identical to the previously authorized work. The floating pier and pilings will be installed by barge. No wetlands will be crossed or impacted during construction of the marina expansion. All materials and equipment will be stored on site.
