Shoreline Stabilization - Bulkhead 1) The bulkhead shall be constructed in accordance with the alignment depicted on the attached workplan drawings. 2) No open water shall be excavated or filled, even temporarily, outside of the approved bulkhead alignment. 3) The alignment of the authorized bulkhead shall be staked by the permittee and verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Signature of Permittee Glenn & ToAnn Walthall Permit No. 51-19 .01 Page 2 of 3 ADDITIONAL CONDITIONS 4) The bulkhead shall be constructed prior to any backfrlling activities. 5) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 6) The fill material shall be clean and free of any pollutants except in trace quantifies. 7) All backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. Sedimentation and Erosion Control 8) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfrlling activities. Docking Facility 9) This permit authorizes only the dock, pier, separated platforms, tie pilings and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 10) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 11) This permit authorizes a maximum of 5 formalized boat slips, (three located at the main pier and 1 at each of the separated platforms). 12) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. General 13) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 14) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the permitted activity without having it transferred to a third party. 15) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2019-00769). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2019-0551. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 264-3901 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal water level. NOTE: An application processing fee of $400 was received by DCM for this project. This fee also satisfied the Section 401 application processing fee requirements of the Division of Water Resources. DAVIS Di,, to, MAY 3 1 2019 MP SECTION MHD SUBJECT: Major Permit Application Recommendations submitted on behalf of: Glenn and Jo Ann Walthall The development site is located at 3922 Pineway Drive, Lot 27 in the Kitty Hawk Landing subdivision, Kitty Hawk, Dare County, and is adjacent a man-made canal off the Albemarle Sound. Existing structures onsite include a two-story single-family dwelling, driveway, and walkway that connects to an old pier/dock. The applicants are proposing the construction of a 185-Ift vinyl sheet pile bulkhead with associated backfill and upland grading, and a docking facility that will include a 13'x6' pier, 9'x16' upper platform, 70'x 4-5' (average 4.28') lower platform, 2-12'x12' boatlifts, 2 tie pilings in front of the main dock, and 2-6'x20' platforms (along the new bulkhead) each with 2 tie pilings. The existing walkway from the dwelling to the pier will be rebuilt, with approximate dimensions of 28'x4'. The development proposal involves the Estuarine Waters, Public Trust Areas, Estuarine Shoreline, and Public Trust Shoreline AECs. I have reviewed the Rules of the Coastal Resources Commission (CRC) as they pertain to this proposal, and my findings are as follows: 15A NCAC 07H .0206 ESTUARINE WATERS (d) Use Standards. Suitable land/water uses shall be those consistent with the management objectives in this Rule. Highest priority of use shall be allocated to the conservation of estuarine waters and their vital components. Second priority of estuarine waters use shall be given to those types of development activities that require water access and use which cannot function elsewhere such as simple access channels; structures to prevent erosion; navigation channels; boat docks, marinas, piers, wharfs, and mooring pilings. RECEIVED The request is consistent with this rule. MAY 3 1 2019 15A NCAC 07H .0207 PUBLIC TRUST AREAS MP T��� �� (c) Management Objective. To protect public rights for navigation and r i conserve and manage the public trust areas so as to safeguard and perpetuate their biological, economic and aesthetic value. (d) Use Standards. Acceptable uses shall be those consistent with the management objectives in Paragraph (c) of this Rule. In the absence of overriding public benefit, any use which jeopardizes the capability of the waters to be used by the public for navigation or other public trust rights which the public may be found to have in these areas shall not be allowed. The development of navigational channels or drainage ditches, the use of bulkheads to prevent erosion, and the building of piers, wharfs, or marinas are examples of uses that may be acceptable within public trust areas, provided that such uses shall not be detrimental to the public trust rights and the biological and physical functions of the estuary. Projects which would directly or indirectly block or impair existing navigation channels, increase shoreline erosion, deposit spoils below normal high water, cause adverse water circulation patterns, violate water quality standards, or cause degradation of shellfish waters are considered incompatible with the management policies of public trust areas. In every instance, the particular location, use, and design characteristics shall be in accord with the general use standards for coastal wetlands, estuarine waters, and public trust areas. The request is consistent with this rule. 15A NCAC 07H .0208 USE STANDARDS (b) Specific Use Standards (6) Piers and Docking Facilities. (A) Piers shall not exceed six feet in width. Piers greater than six feet in width shall be permitted only if the greater width is necessary for safe use, to improve public access, or to support a water dependent use that cannot otherwise occur; (B) The total square footage of shaded impact for docks and mooring facilities (excluding the pier) allowed shall be eight square feet per linear foot (Ift) of shoreline with a maximum of 2,000 square feet. In calculating the shaded impact, uncovered open water slips shall not be counted in the total. Projects requiring dimensions greater than those stated in this Rule shall be permitted only if the greater dimensions are necessary for safe use, to improve public access, or to support a water dependent use that cannot otherwise occur. Size restrictions shall not apply to marinas; Consistent: The proposed pier to access the main dock will be 6' wide. The shoreline is 177 Ift, with a potential allowance of 1,416 sf of platform. The total of platforms proposed is 684 sf. Major Permit Recommendations: Glenn and Jo Ann Walthall Division of Coastal Management Page 3 of 5 05/31/19 (C) Piers and docking facilities over coastal wetlands shall be no wider than six feet and shall be elevated at least three feet above any coastal wetland substrate as measured from the bottom of the decking; Consistent: There are no coastal wetlands located in the project site. (D) A boathouse shall not exceed 400 square feet except to accommodate a documented need for a larger boathouse and shall have sides extending no farther than one-half the height of the walls and covering only the top half of the walls. Measurements of square footage shall be taken of the greatest exterior dimensions. Boathouses shall not be allowed on lots with less than 75 linear feet of shoreline. Size restrictions do not apply to marinas; (E)The total area enclosed by an individual boat lift shall not exceed 400 square feet except to accommodate a documented need for a larger boat lift; (F) Piers and docking facilities shall be single story. They may be roofed but shall not be designed to allow second story use; Consistent: The proposal does not include a boathouse; 2 boat lifts are proposed with dimensions of 12'x12'; each individual boat lift will be 144 sf. No roofs are proposed for the docking facility. (G) Pier and docking facility length shall be limited by: (i) not extending beyond the established pier or docking facility length along the same shoreline for similar use; (This restriction does not apply to piers 100 feet or less in length unless necessary to avoid unreasonable interference with navigation or other uses of the waters by the public); (ii) not extending into the channel portion of the water body; and (iii) not extending more than one-fourth the width of a natural water body, or human -made canal or basin. Measurements to determine widths of the water body, canals or basins shall be made from the waterward edge of any coastal wetland vegetation that borders the water body. The one-fourth length limitation does not apply in areas where the U.S. Army Corps of Engineers, or a local government in consultation with the Corps of Engineers, has established an official pier head line. The one-fourth length limitation shall not apply when the proposed pier is located between longer piers or docking facilities within 200 feet of the applicant's property. However, the proposed pier or docking facility shall not be longer than the pier head line established by the adjacent piers or docking facilities, nor longer than one-third the width of the water body. (H) Piers or docking facilities longer than 400 feet shall be permitted only if the proposed length gives access to deeper water at a rate of at least 1 foot each 100-foot increment of length longer than 400 feet, or, if the additional length is necessary to span some obstruction to navigation. Measurements to determine lengths shall be made from the waterward edge of any coastal wetland vegetation that borders the water body; (1) Piers and docking facilities shall not interfere with the access to any riparian property and shall have a minimum setback of 15 feet between any part of thREGEIVED docking facility and the adjacent property owner's areas of riparian access.... M AY 3 1 2019 MP SECTION MHD r2 Major Permit Recommendations: Glenn and Jo Ann Walthall Division of Coastal Management Page 4 of 5 05/31/19 Consistent: The main docking facility proposed will extend a total distance of 28' into the adjacent waterbody that measures 234' to 320' wide. All portions of the structures proposed will conform to the 'A distance rule, and will be outside of the riparian setback. (7) Bulkheads (A) Bulkhead alignment, for the purpose of shoreline stabilization, shall approximate the location of normal'high water or normal water level; (B) Bulkheads shall be constructed landward of coastal wetlands in order to avoid significant adverse impacts to the resources; (C) Bulkhead backfill material shall be obtained from an upland source approved by the Division of Coastal Management pursuant to this Section, or if the bulkhead is a part of a permitted project involving excavation from a non -upland source, the material so obtained may be contained behind the bulkhead; (D) Bulkheads shall be permitted below normal high water or normal water level only when the following standards are met: (i)the property to be bulkheaded has an identifiable erosion problem, whether it results from natural causes or adjacent bulkheads, or it has unusual geographic or geologic features, e.g. steep grade bank, which will cause the applicant unreasonable hardship under the other provisions of this Rule; (ii) the bulkhead alignment extends no further below normal high water or normal water level than necessary to allow recovery of the area eroded in the year prior to the date of application, to align with adjacent bulkheads, or to mitigate the unreasonable hardship resulting from the unusual geographic or geologic features; (iii) the bulkhead alignment will not adversely impact public trust rights or the property of adjacent riparian owners; (iv) the need for a bulkhead below normal high water or normal water level is documented by the Division of Coastal Management; and (v) the property to be bulkheaded is in a non -oceanfront area. The 177-Ift shoreline of the development site is natural, with no erosion control structure(s) present. The property has experienced accelerated erosion due to natural effects of storms and possibly from adjacent bulkheads. Shoreline erosion averaging 4' has been noted within the past year, with a total of 10'+ over a 5-year period. The applicants are requesting authorization to reclaim a practical amount of shoreline so that they can match the alignment of the riparian properties and tie into their bulkheads. The maximum distance waterward of NWL is 12', with an average distance of 8-9'. The amount of backfill for the bulkhead will'be 1,450 sf, and the fill material will be clean sand. The request is consistent with the intent of this rule. All shoreline development shall be compatible with the dynamic nature of coastal shorelines as well as the values and the management objectives of the estuarine and ocean system. Other objectives are to conserve and manage the important natural features of the estuarine and ocean system so as to safeguard and perpetuate their biological, social, aesthetic, and economic values; to coordinate and establish a management system capable of conserving and utilizing these. shorelines so as to maximize their benefits to the estuarine and ocean system and the people of North Carolina. (d) Use Standards. Acceptable uses shall be those consistent with the management objectives in Paragraph (c) of this Rule. These uses shall be limited to those types of development activities that will not be detrimental to the public trust rights and the biological and physical functions of the estuarine and ocean system. Every effort shall be made by the permit applicant to avoid or minimize adverse impacts of development to estuarine and coastal systems through the planning and design of the development project. Development shall comply with the following standards: (1) All development projects, proposals, and designs shall preserve natural barriers to erosion, including peat marshland, resistant clay shorelines, and cypress - gum protective fringe areas adjacent to vulnerable shorelines. (2) All development projects, proposals, and designs shall limit the construction of impervious surfaces and areas not allowing natural drainage to only so much as is necessary to service the primary purpose or use for which the lot is to be developed. Impervious surfaces shall not exceed 30 percent of the AEC area of the lot, unless the applicant can demonstrate, through innovative design, that the protection provided by the design would be equal to or exceed the protection by the 30 percent limitation. Redevelopment of areas exceeding the 30 percent impervious surface limitation shall be permitted if impervious areas are not increased and the applicant designs the project to comply with the rule to the maximum extent feasible. Consistent: The only new development proposed landward of the bulkhead and docking facility, other than fill and upland grading, is to rebuild the wooden walkway from the residence to the pier. 15A NCAC 07K.0208(b), Single Family Residence Exemption, allows for the construction of a generally shore perpendicular access to the water, provided that the access shall be no wider than six feet. The dimensions of the walkway are estimated at 28'x4'. Based on my review of the applicable subsections of the North Carolina Administrative Code, the permit application and plans, the proposal requested by Glenn and Jo Ann Walthail meet the intent of the rules of the CRC. DATE: May 13, 2019 Consistency Determination: The request is consistent with/not in conflict with the Town of Kitty Hawk 2004 Core Land Use Plan (LUP) certified by the CRC on June 17, 2005. Overview: The .3 acre subject property has approximately 177 linear feet of natural shoreline along a manmade canal that connects to the Albemarle Sound. The canal measures 234 feet to 320 feet wide at the project site. Water depths in the canal range from -1 to -6 feet from Normal Water Level (NWL). The property elevation is 4 feet above NWL. The property is in the AE (EL8) Floodzone. Existing site improvements consist of a two-story single-family house, concrete driveway and wooden walkway. The site is vegetated with yard grasses and some trees and shrubs. Existing shoreline improvements consist of a dock and pier. The wooden walkway extends from the house to the pier. Shoreline erosion averaging 4 feet has been noted in the past year, with over 10 feet of erosion noted over the past 5 years. Installation of 185 linear feet of bulkhead, a 6 foot wide by 13 foot long pier with a 9 foot by 16 foot upper platform and a 70 foot by 4 to 5 foot lower platform, two (2) 12 foot by 12 foot boatlifts, six (6) tie pilings, and two (2) 6 foot by 20 foot platforms are proposed. The existing pier, dock and walkway will be removed. A 4 foot wide by 28 foot long walkway will be installed to replace the existing walkway. The bulkhead will be installed a maximum of 12 feet and an average of 8 to 9 feet waterward of NWL. The bulkhead will connect to the bulkheads on adjoining properties to the north and south. Backfill for the bulkhead will consist of clean sand. Anticipated Impacts resulting from this project are expected to include: the filling of 1,450 sq. ft. of Public Trust/Estuarine Waters Areas of Environmental Concern (AEC) and 3,037 sq. ft. of High Ground within the Public Trust/Estuarine Shoreline AEC, and; the shading of 1,050 sq. ft. of Public Trust Area/Estuarine Waters AEC. Basis for Determination: The project area is designated as "Lower Density Residential Areas' on the Town of Kitty Hawk Future Land Use Map (FLUM). Although processing of the application is nearing completion, additional time is needed for this office to complete the review and make a decision on your request. Therefore, it is necessary that the standard review time be extended. An additional 75 days is provided by G.S. 113A-122(c) which would make September 2, 2019 the new deadline for reaching a decision on your request. The residential parcel is a 12,998-sf tract, with an elevation of 4' above normal water level (NWL). The existing man-made structures are a two-story single- family dwelling, concrete driveway, and a walkway that connects to an old pier and dock. Existing vegetation on the project site include indigenous yard grasses, loblolly pines (Pinus taeda), Eastern red cedar (Juniperus virginiana), live oaks (Quercus virginiana), American holly (ilex opaca), and camellias. There are no coastal wetlands present onsite. The 177-Ift shoreline of the development site is natural, with no erosion control structure(s) present. Shoreline erosion averaging 4' has been noted within the past year, with a total of 10'+ over a 5-year period. The '+water depths in the project area range from -1 to -6 NWL. The substrate type encountered in the canals of Kitty Hawk Landing are predominantly an organic mud/muck. The riparian properties to the north and south are developed with single-family dwellings, bulkheads, piers, and boat slips. The Albemarle Sound is classified as Joint Waters by agreement with the Marine Fisheries Commission and Wildlife Resources Commission. The waters of the Albemarle Sound in this area are classified as SB and are closed to shellfish taking. The project area is not in a primary nursery area. There are no previous permits on file for this parcel. There is no record that the project site is in a National Registered Historic District. Development Proposal The Waithails are proposing to construct a vinyl sheet pile bulkhead totaling 185 [ft. They are requesting authorization to reclaim a practical amount of shoreline so that they can match the alignment of the riparian properties and tie into their bulkheads. The maximum distance waterward of NWL is 12', with an average distance of 8-9'. The amount of backfill for the bulkhead will be 1,450 sf, and the fill material will be clean sand. In addition to the backfill associated with the bulkhead construction, the applicants would like to grade a portion of their yard and tie into the proposed bulkhead height. The area of upland grading will total approximately 3,037 sf. In addition to the shoreline stabilization project, the Walthalis propose to construct the following structures for a docking facility: • the main dock will total 522 sf, and consist of a 13'x6' pier, 9'x16 upper platform, and 70'x 4-5' (average 4.28') lower platform; • 2-12'x12' boatlifts, which will be located on the north and south sides of the main dock; 2 tie pilings east of the main dock; and 2-6'x20' platforms, each with 2 tie pilings in front of the platforms. o Total slips after construction will be 5. �EGEtVE �cM,MHp OV Field Investigation Report: Glenn and Jo Ann Walthall Page 3 The existing wooden walkway from the dwelling to access the pier will be rebuilt after the bulkhead and land disturbing activities are complete, and the dimensions will be approximately 28'x4'. The main dock proposed will extend a total distance of 28' into the adjacent waterbody that measures 234' to 320' wide. All portions of the structures proposed will conform to the 1/4 distance rule, and will be outside of the riparian setback. The applicants have a 177-Ift shoreline, which allows for 1,416 sf of platform. The project as designed will have 684 sf of platform and is consistent with CRC rules. Anticipated Impacts The installation of the bulkhead and backfill will result in the filling of 1,450 sf of shallow bottom habit of the Estuarine Waters (EW) /Public Trust Areas (PTA) AECs. The filling and grading of the yard will result in high ground disturbance of approximately 3,037 sf of the Coastal Shoreline AEC. The docking facility will result in shading of 1,050 sf of open water habit in the EW/PTA AECs. The Site is waterfront, located on the Kitty Hawk Landing canal system that leads to the Albemarle Sound. Current site conditions include a two-story single-family residence with mature Live Oaks and Loblolly Pines and maintained grasses. There are no coastal wetlands or non -coastal Section 404 wetlands present onsite. Adjacent properties to the north and south consist of single-family residences with bulkheading and piers. Extensive erosion has occurred on the Walthall's property based on aerials imagery, anecdotal accounts and recent survey data. It is clear that there has been at least 10 ft of erosion over the last 5 years. Much of the erosion can be attributed to bulkheading on either side of the subject property. A 2ft high erosion escarpment is present along the Normal Water Level (NWL) which is retreating landward due to erosion. Recent survey data between 2018 and 2019 shows that there has been an average of 4 ft of erosion over the last year. The bulk of the recent erosion occurred in response to TS Michael. Until 2016, there had been trees and root systems along the shoreline that had helped keep the loose soils intact, but these trees had been undermined and collapsed. Proposed Work Mr. and Mrs. Walthall wish to construct a bulkhead on their properly, tying into their neighbors to the north and south. Due to extensive loss of shoreline the owner wishes to reclaim a reasonable amount of shoreline to match the alignment of the neighboring properties on either side. The total length of bulkhead proposed is 185 ft. Proposed fill area behind the proposed bulkhead is 1,450 SF below NWL. This proposed fill area will require approximately 240 cubic yards of fill to accommodate the preferred alignment and to match existing grade at the top of the escarpment. Included in this submission package are aerial photographs from 2013 and 2017. The areas where we are proposing the most shoreline reclamation (center portion of the property) would restore the shoreline conditions to what existed in 2013. Mr. Walthall also wishes to grade some of his yard to tie into the proposed bulkhead height and existing grade around the existing residence. Total proposed upland grading is 3,037 SF. The plan includes the limits of disturbance (LD) line. In addition to the proposed bulkhead and shoreline reclamation, the Walthalis proposes to construct a 522 SF Main Dock system extending from the center of the proposed bulkhead into the canal to replace the existing dilapidated pier. The new proposed pier associated with the Main Dock system would be a 13 FT by 6 FT pier with a 16 FT by 9 FT L-platform and a lower level platform measuring 70 LF and varying from 4 to 5 FT in width (totaling 300 SF). The pier will be at the elevation of the new bulkhead. In addition to this pier, a step-down platform is proposed to wrap around the above -mentioned pier. The lower platform will allow safe entry onto and off -of boats and paddle craft. This Main Dock system is depicted in the attached CAMA plan and detail sheet. 3 slips are proposed at the Main Dock, two of which will be 12 ft by 12 ft boat lifts and one side -to at the end of the platform. Two more platforms are proposed along the bulkhead, each measuring 20 LF by 6 FT and a boat slip at each. A total of 5 boat slips are proposed. All proposed work is shown on the attached Plan.
