Shoreline Stabilization - Bulkhead

ADDITIONAL CONDITIONS
The fill material shall be clean and free of any pollutants except in trace quantities.
All backfill material shall be obtained from a high ground source and confined behind the permitted
bulkhead.
All fill material to be placed below normal water level shall be confined behind the permitted bulkhead.
Sedimentation and Erosion Control
A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of
grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately
landward of the bulkhead cap immediately following completion of backfilling activities.
Docking Facility Expansion and Boathouse
This permit authorizes only the docking facility expansion and uses located in or over the water that are
expressly and specifically set forth in the permit application. No other structure, whether floating or
stationary, shall become a permanent part of this docking facility without permit modification. No non -
water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit
modification.
The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
This permit does not authorize any new formalized boat slips.
The boathouse shall not be completely enclosed or have side coverage more than one half the height of
the side, from the roof waterward. The footprint of the boathouse, including roof overhangs, shall not
exceed 40W.
The authorized boathouse shall be single story, and shall not be designed to allow for second story use.
No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
General
This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
The permittee shall maintain the authorized work in good condition and in conformance with the terms
" and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the
permitted activity without having it transferred to a third party.

ADDITIONAL CONDITIONS
The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
The U.S. Army Corps of Engineers authorized the project by way of Programmatic General .
Permit 198000291 (Action ID SAW-2019-00170).
TE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 19-0058.
Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 946-6481 prior to the commencement of any
such activity for this determination. The permittee is further advised that many land disturbing
activities are not authorized within 50 feet of the normal water level unless specifically exempted
by Environmental Management Commission's (EMC) Tar Pamlico buffer regulations in
place at the time of such development.
CE: An application processing fee of $400 was received by DCM for this project. This fee also
satisfied the Section 401 application processing fee requirements of the Division of Water
Resources.

There are some difficulties between the workplans, MP forms and bio report that makes it difficult to
determine the accurate square footage. In any case, it seems that the square footage is within the
allowable 2,000ft2 maximum for the property. Below is a list of issues and the resultant answers.
1. Boathouse square footage —The bio report and MP-4 form lists the boathouse as 1430
(420ft2), whereas the workplan dimensions list the boathouse as 13x30 (390ft2). Kelly Spivey will
determine which dimensions are correct, and if the 420ft2 is correct then will obtain
documentation to the need for a boathouse larger than 400ft2.
2. There is no scale on the oversized drawings and each structure does not have complete
dimensions. Below is a list of where the dimensions were verified...
a. Oversized workplan notes the existing T-head at 14x16 (224ft2)
b. Oversized workplan and the bio report notes the proposed L addition to the T head at
12x14 and 14x14 (48ft2 + 56ft2 = 104ft2)
c. The existing slip that is proposed to be covered by the boathouse has an existing pier
and platform
i. Dimensions of the existing pier and platform is located in the anticipated
impacts portion of the bio report. The bio report lists the pier, platform and
boathouse at 984ft2. Therefore, math puts the pier and platform at 564ft2.
(984ft2 — 420ft2 = 564ft2).
ii. Google Earth notes a separate finger pier to the existing slip. It is detailed on
the workplan. Kelly Spivey noted that the separate finger pier is existing and the
square footage is in the existing square footage detailed on the bio report.
3. Based on all the evidence the square footage is as follows...
a. Existing pier

The enclosed permit constitutes authorization under the Coastal Area Management Act,
and where applicable, the State Dredge and Fill Law, for you to proceed with your project
proposal. The original (buff -colored form) is retained by you and it must be available on site
when the project is inspected for compliance. Please sign both the original and the copy and
return the copy to this office in the enclosed envelope. Signing the permit and proceeding
means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant
to NCGS 113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with
NCGS Chapter 150B with the Office of Administrative Hearings, 6714 Mail Service Center,
Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days of this decision on your
permit. You should also be aware that another qualified party may submit an objection to the
issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise,
all work must be carried out in accordance with your application. Modifications, time extensions,
and future maintenance requires additional approval. Please read your permit carefully prior to
starting work and review all project plans, as approved. If you are having the work done by a
contractor, it would be to your benefit to be sure that he fully understands all permit
requirements.
From time to time, Department personnel will visit the project site. To facilitate this
review, we request that you complete and mail the enclosed Notice Card just prior to work
initiation. However, if questions arise concerning permit conditions, environmental safeguards,
or problem areas, you may contact Department personnel at any time for assistance. By
working in accordance with the permit, you will be helping to protect our vitally important coastal
resources.

Mr. Tyson has submitted a CAMA Major Permit request for the construction of a 14' wide x 30' long roof
over an existing uncovered boatlift, expand existing platform and replace 389 linear feet of bulkhead at his property
located off SR 1115 at 120 Dickinson Road in the long Point Landing Subdivision on Blounts Creek near the
community of Blounts Creek in Beaufort County, North Carolina.
Staff has reviewed the proposed project regarding rules found in Subchapter 7H concerning development in
Estuarine Water and Public Trust Areas. It is staff s recommendation that the proposed project appears consistent
with 15A NCAC 07H .0208 as described below.
This office feels the development is consistent with 15A NCAC 07H .0208(b)(6)(B) which states in part that
"The total square footage of shaded impact for docks and mooring facilities allowed shall be eight square feet per
linear foot of shoreline with a maximum of 2,000 square feet". The applicant has proposed a total of 1,016 square
feet of platform. The total platform allowed on this property with 389 linear feet of shoreline is 2,000 square feet.
This office feels the construction of the bulkhead is consistent with 15A NCAC 07H .I 105(a)(3) which states in
part" When replacing an existing bulkhead, the new alignment shall not be positioned so as not to exceed a
maximum distance of two feet waterward of the current bulkhead alignment".
Staff recommends the following conditions be included if the project is permitted.

Consistency Determination: The request is consistent with/not in conflict the Beaufort County Joint Land
Use Plan 2006 Update certified by the CRC on January 13, 2010, provided that the land development and
land use activities comply with the requirements of the Tar -Pamlico Buffer Rule, unless located in the
exempted or allowed areas (see policy 2.1.5), and that development meets the Beaufort County Flood
Damage Prevention Ordinance (see policy 2.2.3).
Overview: The .80-acre site is located at 120 Dickinson Rd, Chocowinity, off Blounts Creek in Beaufort
County. The site has 389 linear feet of shoreline. Existing site improvements include a single family
residence, bulkhead, platform, outbuildings, pier, platform and an uncovered boatlift. The site is
approximately 6' above NWL. The site is mostly vegetated with lawn grasses, pines and various hardwood
trees.
The applicant proposes to cover the existing uncovered boatlift with a 14' wide x 30' long roof and expand
the existing 224 ft2 platform an additional 104 ft2 by adding a 12' x 4' and 14' x 4' section on the right side
of the platform. The new boathouse will be located no further waterward than the existing pier.
Additionally, the applicant proposes to replace 389 linear feet of bulkhead 2' waterward of the existing
bulkhead.
AECs involved include: Coastal Shoreline and Public Trust. The project is located within in Tar -Pamlico
River Basin and is subject to the Tar -Pamlico Buffer Rule. Blounts Creek is classified as SB, NSW, is not a
Primary Nursery Area, and is closed to shellfishing. The site is in Special Flood Hazard Area AE (EL10)
according to the Beaufort County FIRM (Map # 3720660000J Panel 6600). A review of shellfish, Coastal
Wetlands, 404 Wetlands and archaeological/cultural resources in the area was not provided.

Anticipated impacts resulting from this project are. expected to include:. the replacement buIkhead,wili a
result in the filling ±778 ft2 of Creek bottom. The installation of the dead -men and tie back system will
result in the high ground disturbance of±7,800 ft2. The construction of the 14'x3O' roof will result in ±420
ft2 boathouse coverage. The total platform square footage of the pier, platform and boathouse will be 984
eft'. The maximum allowed square footage for this property is 2,000 ft2.
Basis for Determination:
The project is subject to the Beaufort County Joint Land Use Plan 2006 Update. The counties Future Land
Use Map (FLUM) classifies the site as Transition, Conservation I (Public Trust AEC and water protected by
Tar -Pam Buffer), and Conservation II (100-year flood plain)'.
Thelfollowing LUP policies may be applicable to this request:
2.1 Conservation I
2.1.3 Only development and land/water use activities that are consistent with the use standards for
coastal wetlands,. estuarine':' waters, and public trust areas (15A NCAC 07H .0208) are allowed in this
classification. Permitted extractive uses in the Aurora area will continue.
2.1.5 Unless in the exempted or allowed, land development and land use activities must comply with the
requirements of the Tar -Pamlico Buffer Rule (15A NCAC 02B .0259).
2.2 Conservation II
2.2.2 Only development that is consistent with the use standards for the estuarine shoreline AEC and the
public trust shoreline AEC (15A NCAC 07H 0209(d) is allowed.
2.2.3 Development in any flood hazard zone delineated on a. Beaufort County FIRM or in an area that.is
subject to storm inundation as illustrated on Beaufort County storm surge maps must meet the location
and construction requirements of the Beaufort County Flood Damage Prevention Ordinance.

erosion and sediment control regulations.
This Certification can be contested as provided in Articles 3 and 4 of General Statute 150B by filing a
written petition for an administrative hearing to the Office of Administrative Hearings (hereby known as
OAH). A petition form may be obtained from the OAH at http://www.ncoah.com/ or by calling the OAH
Clerk's Office at (919) 431-3000 for information.
Within sixty (60) calendar days of receipt of this notice, a petition must be filed with the OAH. A petition
is considered filed when the original and one (1) copy along with any applicable OAH filing fee is received

The project site is located off SR 1115 in the Long Point Landing Subdivision at 120 Dickinson Rd.
near the community of Blounts Creek in Beaufort County, North Carolina. The lot is approximately 0.8
acres (34,900 ft2) in size and has 389 linear feet of shoreline on Blounts Creek. Man-made features on the
lot include a single family residence, outbuildings, bulkhead, pier, platform, and uncovered boatlift. The lot
is approximately 6.0' in elevation above the Normal Water Level. The lot is mostly vegetated with lawn
grasses, pines and various hardwood trees.
Both the downstream and upstream properties are developed with single family dwellings with piers
and bulkheads. Blounts Creek Creek is classified as SB NSW by the Environmental Management
Commission at the project location. No SAV was observed in the area. Blounts Creek is classified as inland
fishing waters at the project location. The property is subject the Tar -Pamlico Riparian Buffer rules enforced
by the N.C. Division of Water Resources.
Project description
The applicant proposes to cover the existing uncovered boatlift with a 14' wide x 30' long roof and
expand the existing 224 ft2 platform an additional 104 ft2 by adding a 12' x 4' and 14' x 4' section on the
right side of the platform. The new boathouse will be located no further waterward than the existing pier.
Additionally, the applicant proposes to replace 389 linear feet of bulkhead 2' waterward of the existing
bulkhead.
Anticipated impacts
The construction of the replacement bulkhead will result in the filling ±778 ft2 of Creek bottom. The
installation of the dead -men and tie back system will result in the high ground disturbance of f7,800 ft2. The
construction of the 14'x30' roof will result in±420 ft2 boathouse coverage. The total platform square footage
of the pier, platform and boathouse will be 984 W. The maximum allowed square footage for this property is
2,000 ft2.

The NC Division of Coastal Management hereby acknowledges receipt of your application
for State approval for development of your property located off SR 1115 in the Long Point
Landing Subdivision at 120 Dickinson Rd near the community of Blounts Creek in Beaufort
County, North Carolina. It was received on 28 December 2018, and appears to be adequate
for processing at this time. The projected deadline for making a decision is 13 March 2018.
An additional 75-day review period is provided by law when such time is necessary to
complete the review. If you have not been notified of a final action by the initial deadline
stated above, you should consider the review period extended. Under those circumstances,
this letter will serve as your notice of an extended review. However, an additional letter will

NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development Enclosed you will find a "Notice of Permit Filing" postcard which
must be posted at the property of your proposed development You should post this notice
at a conspicuous point along your property where it can be observed from a public road.
Some examples would be: Nailing the notice card to a telephone pole or tree along the road
right-of-way fronting your property, or at a point along the road right-of-way where a private
road would lead one into your property. Failure to post this notice could result in an
incomplete application.

The Department of Environment and Natural Resources hereby gives public notice as
required by N.C.G.S. 113A-119(b) that an application for a development permit in an Area of
Environmental Concern as designated under the Coastal Area Management Act (CAMA) was
received on 28 December 2019. According to the said application submitted by Billy Tyson Sr.,
applicant proposes to construct a 14'x 30 boathouse, 20 x 8' platform and 389' x 2 x 4 bulkhead.
Located off SR 1115 in the Long Point Landing Subdivision at 120 Dickinson Rd near the
community of Blounts Creek in Beaufort County, North Carolina
A copy of the entire application may be examined or copied at the office of Jonathan R.
Howell, District Manager, Washington Regional Office, 943 Washington Square Mall,
Washington, NC, during normal business hours. Public comments received by 1 February 2019
will be considered. Later comments will be accepted and considered up to the time of permit
