Shoreline Stabilization - Bulkhead The bulkhead shall not extend waterward more than 2 feet from the existing bulkhead alignment at any point along its alignment at the time of construction. Signature of Permittee Tyson Sr. Permit No.13-19 Page 2 of 3 ADDITIONAL CONDITIONS The fill material shall be clean and free of any pollutants except in trace quantities. All backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. All fill material to be placed below normal water level shall be confined behind the permitted bulkhead. Sedimentation and Erosion Control A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. Docking Facility Expansion and Boathouse This permit authorizes only the docking facility expansion and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non - water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. This permit does not authorize any new formalized boat slips. The boathouse shall not be completely enclosed or have side coverage more than one half the height of the side, from the roof waterward. The footprint of the boathouse, including roof overhangs, shall not exceed 40W. The authorized boathouse shall be single story, and shall not be designed to allow for second story use. No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. General This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. The permittee shall maintain the authorized work in good condition and in conformance with the terms " and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the permitted activity without having it transferred to a third party. Tyson Sr. Permit No.13-19 Page 3 of 3 ADDITIONAL CONDITIONS The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. The U.S. Army Corps of Engineers authorized the project by way of Programmatic General . Permit 198000291 (Action ID SAW-2019-00170). TE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 19-0058. Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 946-6481 prior to the commencement of any such activity for this determination. The permittee is further advised that many land disturbing activities are not authorized within 50 feet of the normal water level unless specifically exempted by Environmental Management Commission's (EMC) Tar Pamlico buffer regulations in place at the time of such development. CE: An application processing fee of $400 was received by DCM for this project. This fee also satisfied the Section 401 application processing fee requirements of the Division of Water Resources. DAVIS Dtremr File Note: FROM: Gregg Bodnar, DCM Assistant Major Permit Coordinator SUBJECT: Billy Tyson Sr. MP application/workplan issues DATE: 1/23/19 There are some difficulties between the workplans, MP forms and bio report that makes it difficult to determine the accurate square footage. In any case, it seems that the square footage is within the allowable 2,000ft2 maximum for the property. Below is a list of issues and the resultant answers. 1. Boathouse square footage —The bio report and MP-4 form lists the boathouse as 1430 (420ft2), whereas the workplan dimensions list the boathouse as 13x30 (390ft2). Kelly Spivey will determine which dimensions are correct, and if the 420ft2 is correct then will obtain documentation to the need for a boathouse larger than 400ft2. 2. There is no scale on the oversized drawings and each structure does not have complete dimensions. Below is a list of where the dimensions were verified... a. Oversized workplan notes the existing T-head at 14x16 (224ft2) b. Oversized workplan and the bio report notes the proposed L addition to the T head at 12x14 and 14x14 (48ft2 + 56ft2 = 104ft2) c. The existing slip that is proposed to be covered by the boathouse has an existing pier and platform i. Dimensions of the existing pier and platform is located in the anticipated impacts portion of the bio report. The bio report lists the pier, platform and boathouse at 984ft2. Therefore, math puts the pier and platform at 564ft2. (984ft2 — 420ft2 = 564ft2). ii. Google Earth notes a separate finger pier to the existing slip. It is detailed on the workplan. Kelly Spivey noted that the separate finger pier is existing and the square footage is in the existing square footage detailed on the bio report. 3. Based on all the evidence the square footage is as follows... a. Existing pier 1. 6' pier is access ii. 14x16 T Head (224ft2) III. L Head Addition (48ft2 + 56ft2 = 104ft2) iv. Boathouse (420ft2) v. Staff has reviewed the proposed project regarding rules found in Subchapter 7H concerning development in Estuarine Water and Public Trust Areas. It is staff s recommendation that the proposed project appears consistent with 15A NCAC 07H .0208 as described below. This office feels the development is consistent with 15A NCAC 07H .0208(b)(6)(B) which states in part that "The total square footage of shaded impact for docks and mooring facilities allowed shall be eight square feet per linear foot of shoreline with a maximum of 2,000 square feet". The applicant has proposed a total of 1,016 square feet of platform. The total platform allowed on this property with 389 linear feet of shoreline is 2,000 square feet. This office feels the construction of the bulkhead is consistent with 15A NCAC 07H .I 105(a)(3) which states in part" When replacing an existing bulkhead, the new alignment shall not be positioned so as not to exceed a maximum distance of two feet waterward of the current bulkhead alignment". Staff recommends the following conditions be included if the project is permitted. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized _work 2. The new boathouse will be located no further waterward than the existing pier. Additionally, the applicant proposes to replace 389 linear feet of bulkhead 2' waterward of the existing bulkhead. AECs involved include: Coastal Shoreline and Public Trust. The project is located within in Tar -Pamlico River Basin and is subject to the Tar -Pamlico Buffer Rule. Blounts Creek is classified as SB, NSW, is not a Primary Nursery Area, and is closed to shellfishing.
