This permit, issued on Aueust 20, 2019 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Bulkhead
1) In accordance with the 07/04/19 email received from the permittee, the authorized bulkhead shall be
constructed no more than two (2) feet waterward of the existing alignment.
2) The alignment of the authorized bulkhead shall be staked by the permittee and verified by the
Division of Coastal Management within a maximum of 30 days prior to the start of construction.
Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather
conditions, shall require the alignment to be re -staked by the permittee within a maximum of 30 days
prior to the new expected start of construction.
3) No backfill material shall be placed within 30 feet of the normal high water line, except that which will
be used to backfill the area behind the permitted bulkhead.

This permit action may be appealed by the permittee or other Signed by the authority of the Secretary of DEQ and the Char
qualified persons within twenty (20) days of the issuing date. of the Coastal Resources Commission.

ADDITIONAL CONDITIONS
4) The temporary placement or double handling of fill materials within waters or vegetated wetlands is not
authorized.
5) The bulkhead shall be constructed prior to any backfilling activities.
6) The bulkhead shall be structurally tight so as to prevent seepage of backfrll materials through the structure.
7) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal'or vinyl sheet piles, or
other suitable materials approved by Division personnel.
8) All backfill material shall be clean and free of any pollutants except in trace quantities.
Sedimentation and Erosion Control
9) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
10) A ground cover sufficient to restrain erosion shall be provided -within 30 calendar days of completion of
any phase of grading on cut or filled. slopes. At a minimum, a silt fence shall be properly installed
immediately landward of the bulkhead cap immediately following completion of backfilling activities.
General
11) The perinittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
12) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
13) This permit does not authorize the interference with.any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
14) No filling of any vegetated wetlands'beyond two (2) feet waterward of the existing bulkhead is
authorized by this permit.
NOTE: The workplan drawing submitted with the permit application indicates that the property lines
extend below the mean high water line. The permittee is advised that the State of North Carolina
claims title to most lands falling waterward of the mean high water line.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.

NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of Nationwide
Permit 3 (Action ID No. SAW-2019-00948), which was issued on 8/20/19.
NOTE: The N.C. Division of Water Resources assigned the proposed project DWR Project No. 2019-
0731.
NOTE: An application processing fee of $400 was received by DCM for this project. This fee also
satisfied the Section 401 application processing fee requirements of the Division of Water
Resources.

It is the staff s recommendation that the applicant's proposal to install approximately 85 linear feet of
bulkhead with approximately 280 square feet of Coastal Wetland fill water ward of the existing
deteriorating bulkhead is CONSISTENT with the Rules of 15 NCAC 711.0205 (d) Use Standards for
Coastal Wetlands, Rules of 15 NCAC 711.0206 (d) Use Standards for Estuarine Waters, Rules of 15
NCAC 7H.0207 (d) Use Standards for Public Trust Areas and Rules of 15 NCAC 7H.0208 (b)(7) Use
Standards for Bulkheads. As proposed, this office has no objections to the proposed project and any
permit issued should include the standard permit conditions for bulkheads.
ILdetermined to be consistent with NCAC 07H .0206(d), it is recommended that any permit issued
should include the following conditions:
1. No attempt will be made by the permittee to prevent the full and free use by the public of all
navigable waters at or adjacent to the authorized work.
2. The authorized structure and associated activity must not cause an unacceptable
interference with navigation and shall not exceed the established pierhead line.
3. The permittee must install and maintain, at his expense, any signal lights and signals
prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized
facilities.
4. In order to protect water quality, runoff from the construction must not visibly increase the
amount of suspended sediments in adjacent waters.
5. This permit does not authorize the interference with any existing or proposed Federal
project, and, the permittee will not be entitled to compensation for damage to the
authorized structure or work, or injury which may be caused from existing or future
operations undertaken by the United States in the public interest
6. The permittee will maintain the authorized work in good condition and in conformance
with the terms and conditions of this permit The permittee is not relieved of this
requirement if he abandons the project without having the permit transferred to a third -
party.
This permit does not eliminate the need to obtain any additional state, federal or local
permits, approvals or authorization which may be required.

Date: June 18, 2019
The applicant is proposing to install anew bulkhead immediately waterward of an
existing, failing bulkhead. The project is located at 304 Empie Avenue, adjacent to
Topsail Sound in Topsail Beach, Pender County.
Areas of Environmental Concern (AEC's) impacted by the proposal are ES and CW.
Waters at the site are classified as SA and are not open to shell fishing. The area is not a
Primary Nursery Area.
I have reviewed this proposal for consistency with the Topsail Beach Land Use Plan and
offer the following comments.
The general area of the project is classified Developed.
In general, the Topsail Beach Land Use Plan allows development in Developed classified
AECs which is consistent with the State's minimum use standards. The Topsail Beach
Land Use Plan contains some policies, which exceed the State's minimum use standards.
However, none of these more restrictive policies appear to be applicable to this project.
This project appears to be consistent with the Topsail Beach Land Use Plan Update.

Approval of 401 Water Quality Certification with Additional Conditions
Dear Ms. Thomason,
You have our approval, in accordance with the attached conditions and those listed below to
permanently impact approximately 150 sq. feet (0.003 acres) of coastal wetlands area, and
approximately 470 sq. it. (0.011 acres) of open water area in order for the construction of a new
bulkhead 2 feet waterward of existing failing bulkhead adjacent Topsail Sound, as described in your
CAMA Major Development permit application received by the N.C. Division of Water Resources
(DWR) on May 31, 2019 and sequential information received by you your through the NC Division
of Coastal Management on July 5 and 26 2019. After reviewing your application, we have decided
that the additional impacts do require written concurrence and are covered by General Water
Quality Certification Number 4175 (GC4175).
This Certification allows you to use the Nationwide Permit 3 when issued by the U.S. Army Corps of
Engineers. In addition, you should obtain or otherwise comply with any other required federal,
state or local permits before you go ahead with your project including (but not limited to) Erosion
and Sediment Control, Non -discharge, and stormwater regulations. Also, this approval to proceed
with your proposed impacts or to conduct impacts to waters as depicted in your application shall
expire upon expiration of the 404 Permit. This Certification can also be found on line at:

3. A pre -construction meeting is recommended to be held with,th'e Division prior to the start
of the projectphasesso thatthe contractors and/or agents fully understand the. conditions
associated with this certification. [15A NCAC 02H .0507 (c) and 15A NCAC 02H .0502 (e)]
4. Turbidity Standard
The turbidity standard of 25 NTUs (Nephelometric Turbidity. Units) shall not be exceeded as
described in 15 A NCAC 213.0220. Appropriate' sediment and erosion control practices must be used
to meet this standard. Turbidity curtains shall be used as appropriate. Please notify this Office if
anyturbidity, issues arise at910.796.7215
5. All wetlands, streams, surface waters, and riparian bufferslocated within 50'feet of the
construction area on the project site shall be clearly marked (example- orange fabric fencing) prior
to any land d isturbing, activities and must be maintained on the property until the project phase is
completed. [15A NCAC 02H.0506'(b)(2) and (c)(2) and 15A NCAC 02H.0507,(c)]
6. Appropriate measures should be installed prior to any land clearing activities to protect
waters.and wetlands from .turbidity and/ or sedimentation.. These,measures should beroutinely
inspected, and properly maintained, and excavated materials should be contained outsidethe
wetland boundary. Excessive silt and sediment loads can have numerous detrimental effects on
aquatic resources including destruction;ofspawning habitat, suffocation of eggs, and,clogging of
gills of aquatic species. [15A NCAC 02H .0506 (b) (3), and (c)(3)]
7. This General Certification shall expire on the same day as the expiration date.of the
corresponding General Permit The conditions in effect on the date of issuance of the Certification
for a specific project shall remain in effect for the life of the project, regardless of the expiration of
this Certification.
8. The per' mittee shall require.its contractors and/or agents to comply with the terms of this
permit inthe construction and maintenance of this projectand shall provide each of its. contractors

and/or agents associated with the construction or maintenance of this project a copy of this
certification. A copy of this certification including all conditions shall be available at the project site
during the construction and maintenance of this project [15A NCAC 021-1.0507 (c) and 15A NCAC
02H .0506 (b)(2) and (c)(2)]
9. Continuing Compliance:
The applicant/permittee and their authorized agents shall conduct all activities in a manner
consistent with State water quality standards (including any requirements resulting from
compliance with 303(d) of the Clean Water Act), and any other appropriate requirements of State
and Federal law. If the Division determines that such standards or laws are not being met,
including failure to sustain a designated or achieved use, or that State or Federal law is being
violated, or that further conditions are necessary to assure compliance, than the Division may
reevaluate and modify this General Water Quality Certification. [15A NCAC 02H .0507(d)]
10. All mechanized equipment operated near surface waters or wetlands will be regularly
inspected and maintained to prevent contamination of waters and wetlands from fuels, lubricants,
hydraulic fluids or other potential toxic chemicals. In the event of a hydrocarbon or chemical spill,
the permittee/contractor shall immediately contact the Division of Water Quality, between the
hours of 8 am to 5 pm at the Wilmington Regional Office at 910.796.7215 and after hours and on
weekends call (800) 858-0368. Management of such spills shall comply with provisions of the
North Carolina Oil Pollution and Hazardous Substances Control Act. [15A NCAC 02H .0506 (b)(3)
and (c)(3), 15A NCAC 02B .0200 (3)(0, and GS 143 Article 21A].
11. Fueling, lubrication and general equipment maintenance should not take place within 50
feet of a waterbody or wetlands to prevent contamination by fuel and oils. [15A NCAC 02H .0506
(b)(3) and (c)(3) and 15A NCAC 02B .0200 (3)(1)].
12. This certification grants permission to the director, an authorized representative of the
Director, or DEQ staff, upon the presentation of proper credentials, to enter the property during
normal business hours 15A NCAC 02H.0502(e).
13. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or applicable
Buffer Rules, and any subsequent modifications, the applicant and/or authorized agent is required
to return a completed certificate of completion form to the NCDEQ DWR 401 and Buffers Unit North
Carolina Division of Water Resources, 1617 Mail Service Center, Raleigh, NC, 27699 within ten days
of project completion. The certification of completion is available at:

Violations of any condition herein set forth may result in revocation of this Certification and
may result in criminal and/or civil penalties. The authorization to proceed with your proposed

Any violation of the attached conditions or deviation from your submitted plans may subject the permittee to a stop work order,
a restoration order, a Class I administrative penalty, and/or appropriate legal action.
This verification will remain valid until the expiration date identified below unless the nationwide authorization is modified, suspended
or revoked. If, prior to the expiration date identified below, the nationwide permit authorization is reissued and/or modified, this
verification will remain valid until the expiration date identified below, provided it complies with all requirements of the modified
nationwide permit. If the nationwide permit authorization expires or is suspended, revoked, or is modified, such that the activity would
no longer comply with the terms and conditions of the nationwide permit, activities which have commenced (i.e., are under construction)
or are under contract to commence in reliance upon the nationwide permit, will remain authorized provided the activity is completed
within twelve months of the date of the nationwide permit's expiration, modification or revocation, unless discretionary authority has

This follows our discussion on this application earlier this week. As proposed, the application states the proposed new
bulkhead along southern property would average approximately 4 feet waterward of existing deteriorating bulkhead,
which would incorporate approximately 300 sq. ft. coastal wetlands. The application does not demonstrate the purpose
and need for this amount of this coastal wetlands impact, and as proposed appears to be inconsistent with our current
under rules: 15A NCAC 02B .0201 ANTIDEGRADATION POLICY (f) Activities regulated under Section 404 of the Clean
Water Act (33 U.S.C. 1344) which require a water quality certification as described in Section 401 of the Clean Water
Act (33 U.S.C. 1341) shall be evaluated according to the procedures outlined in 15A NCAC 2H .0500. Activities which
receive a water quality certification pursuant to these procedures shall not be considered to remove existing
uses. The evaluation of permits issued pursuant to G.S. 143-215.1 that involve the assimilation of wastewater or
stormwater by wetlands shall incorporate the criteria found in 15A NCAC 2H .0506 (c)(1)-(5) in determining the
potential impact of the proposed activity on the existing uses of the wetland per 15A NCAC 2H .0231.

Apparently my rookie skills were not enough. That being said, you have been great guiding me through this. Based on
your feedback, I am willing to revise my permit request so that the bulkhead extends 2 feet beyond where it is now on
the Banks Channel side and the southern Empie Avenue side rather than trying to have it on my property line as desired.

As you and I have previously discussed, you were in agreement to move the location of the new wall (bulkhead/seawall)
so that it extended no more than 2' from the edge of the existing bulkhead. However, based on comments received
from the US Army Corp of Engineers, they are requesting a revised drawing depicting what you and I discussed above.,
Could you please revised the site plan to show that the proposed bulkhead will not extend any further than 2' from the
existing wall, along the run of the shoreline, and return a copy of that drawing to me at your earliest convenience?

Apparently my rookie skills were not enough. That being said, you have been great guiding me through this. Based on
your feedback, I am willing to revise my permit request so that the bulkhead'extends 2 feet beyond where it is now on
the Banks Channel side and the southern Empie Avenue side rather than trying to have it on my property line as desired.

As you and I have previously discussed, you were in agreement to move the location of the new wall (bulkhead/seawall)
so that it extended no more than T from the edge of the existing bulkhead. However, based on comments received
from the US Army Corp of Engineers, they are requesting a revised drawing depicting what you and I discussed above.
Could you please revised the site plan to show that the proposed bulkhead will not extend any further than 2' from the
existing wall, along the run of the shoreline, and return a copy of that drawing to me at your earliest convenience?

Just wanted to follow up on this since Courtney is out of the office this week. Based on the revised plan, there appears
to be approximately 200 sq. ft. of Coastal Wetland impacts as a result of the bulkhead replacement. The impacts would
occur along the southern bulkhead alignment (running east to west) as well as a portion of the return along the SW
corner of the existing wall.

Apparently my rookie skills were not enough. That being said, you have been great guiding me through this. Based on
your feedback, I am willing to revise my permit request so that the bulkhead extends 2 feet beyond where it is now on
the Banks Channel side and the southern, Empie Avenue side rather than trying to have it on my property line as desired.

It is the staffs recommendation that the applicant's proposal to install approximately 85 linear feet of
bulkhead with approximately 280 square feet of Coastal Wetland fill water ward of the existing
deteriorating bulkhead is CONSISTENT with the Rules of 15 NCAC 71-1.0205 (d) Use Standards for
Coastal Wetlands, Rules of 15 NCAC 7H.0206 (d) Use Standards for Estuarine Waters, Rules of 15
NCAC 71-1.0207 (d) Use Standards for Public Trust Areas and Rules of 15 NCAC 71-1.0208 (b)(7) Use
Standards for Bulkheads. As proposed, this office has no objections to the proposed project and any
permit issued should include the standard permit conditions for bulkheads.
](determined to be consistent with NCAC 07H .0206(d), it is recommended that any permit issued
should include the following conditions:
1. No attempt will be made by the permittee to prevent the full and free use by the public of all
navigable waters at or adjacent to the authorized work.
2. The authorized structure and associated activity must not cause an unacceptable
interference with navigation and shall not exceed the established pierhead line.
3. The permittee must install and maintain, at his expense, any signal lights and signals
prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized
facilities.
4. In order to protect water quality, runoff from the construction must not visibly increase the
amount of suspended sediments in adjacent waters.
S. This permit does not authorize the interference with any existing or proposed Federal
project, and, the permittee will not be entitled to compensation for damage to the
authorized structure or work, or injury which may be caused from existing or future
operations undertaken by the United States in the public interest.
6. The permittee will maintain the authorized work in good condition and in conformance
with the terms and conditions of this permit. The permittee is not relieved of this
requirement if he abandons the project without having the permit transferred to a third -
party.
This permit does not eliminate the need to obtain any additional state, federal or local
permits, approvals or authorization which may be required.

9. PROJECT DESCRIPTION:
The project site is located at 304 Empie Avenue, adjacent to Banks Channel and Topsail Sound, in Topsail
Beach, Pender County. To get to the site from the Wilmington Regional Office, take US Hwy 17 N to NC
Hwy 210 (approximately 15 miles) and turn right. Continue approximately 2 miles along NC Hwy 210 and
turn right at the intersection of NC Hwy 210 and Rowland Ave. Travel approximately 1.9 miles along
Rowland Avenue and turn right onto South Shore Drive. Continue along S. Shore Drive (which turns into
N. Anderson Blvd.) for approximately 5.85 miles and then turn right onto Empie Avenue. The subject
property will be located at the end of the road, along the right-hand side at house number 304.
The subject property is developed (residential) and has approximately 162 linear feet of shoreline bordering
Banks Channel. Elevations at the property range from 3' to 5' above the normal high water (NHW) line.
The size of the tract is approximately 12,201 sq. ft., or 0.28 acres. Lawn grasses and ornamental landscaping
make up the high ground vegetation, and Smooth Marsh Cordgrass (Spartina alterniflora) accounts for the
adjacent wetland vegetation. Just waterward of the existing bulkhead, the applicant maintains a private
docking facility which consists of a 6' x 70' access pier and 9' x 27' "T-head" shaped platform, two-4' x
12' floating docks and one boatlift (located along southern side of docking facility). A stand of Smooth
Marsh cordgrass extends from the seaward edge of the existing bulkhead, approximately 8'-10' in a
westerly direction. Currently, the normal high water line approximates the seaward side of the existing
bulkhead.
The Topsail Beach Land Use Plans classifies the adjacent waters as Conservation. The waters of Banks
Channel and Topsail Sound are classified SA and SA-ORW by the Division of Water Resources. The
waters immediately adjacent to the property ARE NOT designated as a Primary Nursery Area (PNA) by
the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish.
PROPOSED PROJECT:
The applicant proposes to install a new bulkhead immediately waterward of an existing, failing bulkhead.
The existing bulkhead is comprised of timber and was installed approximately 25+ years ago. The existing
tie -backs that support the wall have deteriorated and separated, in part due to Hurricane Florence. Excessive
rainfall (during Hurricane Florence) caused the upland portion of the property to erode from the area
immediately adjacent to the existing bulkhead. The applicant proposes to replace the existing bulkhead
(approximately 162 linear feet) by constructing a new vinyl wall immediately waterward of the existing
wall, at an average of 1-2' offshore (along the banks channel side) and an average of 4' along the southern
property line (bordering Empie Ave). Because of the new bulkhead construction, approximately 470 sq. ft.
of open water (public trust) fill and approximately 300 sq. ft. of Coastal Wetlands would occur. The area
of Coastal Wetland impacts is isolated and limited to the southern portion of the property, along the western
face of the wall, as well as the southern facing wall. In this location, the existing bulkhead makes an
approximate 90 degree turn, with Coastal Wetlands being located along the side property line (along Empie
Ave)

According to the site plan, a narrow stand of marsh would be impacted along the southern property line
(Empie Ave. side) as the applicant seeks to fill this area to regain a portion of property that has purportedly
been lost due to years of erosion. As proposed, the fill footprint would span approximately 8' from the
southern corner of the wall, toward the south, and would taper back toward the highground (east), ultimately
tying into the existing wall, approximately 77', as measured from the western corner of the existing wall.
High ground disturbance associated with the applicant's proposal would include grading and filling of
approximately 1,530 sq. ft. (dead -men and anchoring).
10. ANTICIPATED EUPACTS:
The proposed bulkhead would fill approximately 300 sq. ft. of Coastal Wetlands (primarily Smooth Marsh
Cordgrass), and approximately 470 sq. ft. of Estuarine Waters and Pubic Trust Area. The proposed bulkhead
would extend approximately 1'-2' beyond the existing wall along the western property boundary (shoreline)
and approximately 8' maximum ( average of 4' at greatest distance) along the southern property boundary.
Minor increases in turbidity should be expected during construction.

NARRATIVE
During Hurricane Florence in September of 2018, the bulkhead adjacent to Banks Channel in
front of 304 Empie Avenue was damaged beyond repair. The bulkhead had last been replaced
in excess of twenty years ago. The existing timber bulkhead cannot be repaired effectively so
two contractors recommended we construct a new bulkhead in front of the existing one. In
preparation of building the new bulkhead, we had the property surveyed to insure that it was
built within the confines of the property lines. The new bulkhead will be built directly in front
of the old one facing Banks Channel. As the survey shows that the Empie Avenue facing
property line is 97 inches (8 ft., 1 inch) south of the existing bulkhead, the new bulkhead will be
built 8 ft south of the existing location and will continue east (inland) along a path one inch
inside the property line for 77 feet and 8 inches and will include 85 feet along the western
shoreline for a total of approximately 162 linear feet of bulkhead. This area is part of the
property but not encompassed by the existing bulkhead. The area to be included contains
approximately 300 square feet of coastal wetlands that is a part of the property. Construction
will be typical timber construction with a galvanized steel rod attached to a buried deadman in
appropriate intervals. The damaged existing bulkhead will remain and be covered with dirt.

The Division of Coastal Management hereby acknowledges receipt of your application requesting State approval for
development of the subject property located at 304 Empie Avenue, in Topsail Beach, Pender County. It was
received as complete on May 20, 2019 and appears to be adequate for processing at this time. The projected deadline
for making a decision is August 3.2019. An additional 75-day review period is provided by law when such time is
necessary to complete the review. If you have not been notified of a final action by the initial deadline stated above,
you should consider the review period extended. Under those circumstances, this letter will serve as your notice of
an extended review. However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from May 20, 2019, you may request a meeting with
the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a
meeting will be held within five working days from the receipt of your written request and shall include the property
owner, developer, and project designer/consultant.
NCGS I I3A-119(b) requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from
a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property; or at a point along the road right-of-way where a private road would lead one into your
property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the appropriate
State or Federal agency. Please contact me if you have any questions and notify me in writing if you wish to receive
a copy of my field report and/or comments from reviewing agencies.
