This permit, issued on December 6, 2019 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may

Boat Ramp & Fixed Pier Extension
1) The boat ramp shall either be poured at an upland location and pushed into place once hardened, or
poured entirely within a watertight containment structure. Live concrete shall not be allowed to
contact waters of the State or waters that will enter waters of the State.
2) Unless specifically altered herein, this permit authorizes one concrete boat ramp, as indicated on the
attached workplan drawings.
3) In accordance with commitments made by the permittee, the boat ramp shall be poured entirely
within a watertight containment structure. Live concrete shall not be allowed to contact waters of the
State or waters that will enter waters of the State.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2022
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
4) Placement of fill materials below normal high water level shall be limited to the concrete ramp structure,
rip rap, and vinyl sheet pile walls.
5) Excavation and ground disturbing activities, associated with the placement of the boat ramp, rip rap and
sheet pile walls, above and below the normal high water line shall be limited to that absolutely necessary
to establish adequate ramp slope and provide a ramp no greater in size that specified in the attached
permit application and workplan drawings.
6) Any portion of the permitted access pier built over Coastal Wetlands shall not exceed six (6) feet in
width and shall be elevated a minimum of three (3) feet over the wetland substrate as measured from the
bottom of the decking.
7) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors should be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
Sedimentation and Erosion Control
8) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
9) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property.
NOTE: An Erosion and Sedimentation Control Plan may be required for this project. This plan should be
filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this
plan to the Department of Energy, Mineral, and Land Resources, Land Quality Section, 127
Cardinal Drive Extension, Wilmington, NC 28405.
Stormwater Manaaement
NOTE: A Stormwater Permit may be required for this project. This plan should be filed at least thirty
(30) days prior to the beginning of any land disturbing activity. Submit this plan to the
Department of Energy, Mineral, and Land Resources, Land Quality Section, 127 Cardinal Drive
Extension, Wilmington, NC 28405.
General
10) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
11) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.

12) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of Nationwide
Permit No. 3 (SAW Action Id. No. 2019-01709) which was issued on 12/6/19.
NOTE: The N.C. Division of Water Resources assigned the project DWR Project No. DWR-2019-1155.
NOTE: An application processing fee of $400 was received by DCM for this project. This fee alsc
satisfied the Section 401 application processing fee requirements of the Division of Water
Resources.

RECOMMENDATIONS FOR TANGLEWOOD POA BOAT RAMP REPLACEMENT 8/19/2019
The proposed boat ramp replacement will be within the existing footprint of the Tanglewood boat ramp.
No work or expansion is proposed to the existing docking facility. The only new structures proposed are
the 60 ft2 of pier located on high ground connecting to the existing pier adjacent to the boat ramp where
the existing concrete would be removed and the 159 ft2 of rip rap placed at the waterward end of the boat
ramp.
As proposed, the project appears to be CONSISTENT with the Specific Use Standards for Estuarine
Waters and Public Trust Areas, as set forth in 15A NCAC 07H .0208 (b), and also with the Use Standards
for Coastal Shorelines, as set forth in 15A NCAC 07H .0209 (d). This office has no objection to the
proposed work, provided that it is consistent with all other local, state, and federal permitting
requirements. In the absence of any concerns from the commenting agencies, it is recommended that a
permit be issued subject to the standard boat ramp development.

This project is consistent with the 2007 Brunswick County Land Use Plan Update.
The applicant proposes to replace the existing boat ramp and associated structures of the
Tanglewood Property Owner's Association private community docking facility. The
project is located at 3185 Waterview Drive SW, Adjacent to the AIWW, near Supply in
Brunswick County.
Areas of Environmental Concern (AEC's) impacted by the proposal are ES, EW, PTS,
CW and PTA.
Waters at the project site are classified as SA, HQW and are open to the harvesting of
shellfish. The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the Brunswick County Land Use Plan
and offer the following comments.
The general area of the project is classified as Residential.
In general, Brunswick County allows development in Residential classified AECs which
is consistent with the State's minimum use standards. The Brunswick County Land Use
Plan contains some policies, which exceed the State's minimum use standards. However,
none of these standards appear to be applicable to this proposal.
This project is consistent and not in conflict with the 2007 Brunswick County Land Use
Plan.

Dear Mr. Isenhour,
You have our approval, in accordance with the attached conditions and those listed below, to
impact an additional 159 square feet of open waters replace an existing boat ramp and docking
facilities at a private residential docking facility as described in the application received by the
N.C. Division of Water Resources (DWR) on August 28, 2019. After reviewing your application,
we have decided that the impacts are covered by General Water Quality Certification Number
4175 (GC4175).
In addition, you should obtain or otherwise comply with any other required federal, state or local
permits before you go ahead with your project including (but not limited to) Erosion and Sediment
Control, Non -discharge, and stormwater regulations. Also, this approval to proceed with your
proposed impacts or to conduct impacts to waters as depicted in your application shall expire upon
expiration of the 404 Permit. This Certification can also be found on line at:

This approval is for the purpose and design that you described in your application. If you change
your project, you must notify us and you may be required to send us a new application. If the
property is sold, the new owner must be given a copy of this Certification and approval letter and
is thereby responsible for complying with all conditions. If total fills for this project (now or in
the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may
be required as described in 15A NCAC 21-1.0506 (h). This approval requires you to follow the
conditions listed in the attached certification and any additional conditions listed below.
The Additional Conditions of the Certification are:
1. This approval is for the purpose and design described in your application. The plans and
specifications for this project are incorporated by reference as part of the Certification. If

you change your project, you must notify the Division and you may be required to submit
a new application package with the appropriate fee. If the property is sold, the new owner
must be given a copy of this approval letter and General Certification and is responsible
for complying with all conditions. Any new owner must notify the Division and request
the Certification be issued in their name {I 5A NCAC 02H .0501 and .0502).
2. Any final construction plans for this project must include or reference the application and
plans approved by the Division under this authorization letter and certification. The
applicant will also be required to evaluate all acquired permits to assure that they are
consistent and all relative impacts are accounted for and shown on the construction plans.
[15A NCAC 02H .0502 (b) and 15A NCAC 02H .0506 (4)] The applicant shall require his
contractors (and/or agents) to comply with all of the terms of this Certification and shall
provide each of its contractors (and/or agents) a copy of this Certification.
3. Turbidity Standard
The turbidity standard of 25 NTUs (Nephelometric Turbidity Units) shall not be exceeded
as described in 15 A NCAC 2B .0220. Appropriate sediment and erosion control practices
must be used to meet this standard. Turbidity curtains shall be used as appropriate. Please
notify this Office if any turbidity issues arise at 910.796.7215
4. This General Certification shall expire on the same day as the expiration date of the
corresponding General Permit. The conditions in effect on the date of issuance of the
Certification for a specific project shall remain in effect for the life of the project, regardless
of the expiration of this Certification.
5. The permittee shall require its contractors and/or agents to comply with the terms of this
permit in the construction and maintenance of this project and shall provide each of its .
contractors and/or agents associated with the construction or maintenance of this project a
copy of this certification. A copy of this certification including all conditions shall be
available at the project site during the construction and maintenance of this project. (15A
NCAC 02H .0507 (c) and 15A NCAC 02H .0506 (b)(2) and (c)(2)]
6. Continuing Compliance:
The applicant/permittee and their authorized agents shall conduct all activities in a manner
consistent with State water quality standards (including any requirements resulting from
compliance with 303(d) of the Clean Water Act), and any other appropriate requirements
of State and Federal law. If the Division determines that such standards or laws are not
being met, including failure to sustain a designated or achieved use, or that State or Federal
law is being violated, or that further conditions are necessary to assure compliance, than

the Division may reevaluate and modify this General Water Quality Certification. [15A
NCAC 02H .0507(d)]
All mechanized equipment operated near surface waters or wetlands will be regularly
inspected and maintained to prevent contamination of waters and wetlands from fuels,
lubricants, hydraulic fluids or other potential toxic chemicals. In the event of a
hydrocarbon or chemical spill, the permittee/contractor shall immediately contact the
Division of Water Quality, between the hours of 8 am to 5 pm at the Wilmington Regional
Office at 910.796.7215 and after hours and on weekends call (800) 858-0368.
Management of such spills shall comply with provisions of the North Carolina Oil
Pollution and Hazardous Substances Control Act. [15A NCAC 02H .0506 (b)(3) and
(c)(3), 15A NCAC 02B .0200 (3)(f), and GS 143 Article 21A].
8. Fueling, lubrication and general equipment maintenance should not take place within 50
feet of a waterbody or wetlands to prevent contamination by fuel and oils. [15A NCAC
02H .0506 (b)(3) and (c)(3) and 15A NCAC 02B .0200 (3)(f)].
9. This certification grants permission to the director, an authorized representative of the
Director, or DEQ staff, upon the presentation of proper credentials, to enter the property
during normal business hours 15A NCAC 02H.0502(e).
10. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or
applicable Buffer Rules, and any subsequent modifications, the applicant and/or
authorized agent is required to return a completed certificate of completion form to the
NCDEQ DWR 401 and Buffers Unit North Carolina Division of Water Resources, 1617
Mail Service Center, Raleigh, NC, 27699 within ten days of project completion. The
certification of completion is available at:

Violations of any condition herein set forth may result in revocation of this Certification and
may result in criminal and/or civil penalties. The authorization to proceed with your proposed
impacts or to conduct impacts to waters as depicted in your application and as authorized by this
Certification shall expire upon expiration of the 404 or CAMA Permit.
This approval and its conditions are final and binding unless contested.
This Certification can be contested as provided in Articles 3 and 4 of General Statute 150B by
filing a written petition for an administrative hearing to the Office of Administrative Hearings
(hereby known as OAH). A petition form may be obtained from the OAH at
http://www.ncoali.com/ or by calling the OAH Clerk's Office at (919) 431-3000 for
information. Within sixty (60) calendar days of receipt of this notice, a petition must be filed with

a new application package with the appropriate fee. If the property is sold, the new owner
must be given a copy of this approval letter and General Certification and is responsible
for complying with all conditions. Any new owner must notify the Division and request
the Certification be issued in their name {I 5A NCAC 02H .0501 and .0502}.
2. Any final construction plans for this project must include or reference the application and
plans approved by the Division under this authorization letter and certification. The
applicant will also be required to evaluate all acquired permits to assure that they are
consistent and all relative impacts are accounted for and shown on the construction plans.
[15A NCAC 021-1.0502 (b) and 15A NCAC 02H .0506 (4)] The applicant shall require his
contractors (and/or agents) to comply with all of the terms of this Certification and shall
provide each of its contractors (and/or agents) a copy of this Certification.
3. Turbidity Standard
The turbidity standard of 25 NTUg (Nephelometric Turbidity Units) shall not be exceeded
as described in 15 A NCAC 2B .0220. Appropriate sediment and erosion control practices
must be used to meet this standard. Turbidity curtains shall be used as appropriate. Please
notify this Office if any turbidity issues arise at 910.796.7215
4. This General Certification shall expire on the same day as the expiration date of the
corresponding General Permit. The conditions in effect on the date of issuance of the
Certification for a specific project shall remain in effect for the life of the project, regardless
of the expiration of this Certification.
The permittee shall require its contractors and/or agents to comply with the terms of this
permit in the construction and maintenance of this project and shall provide each of its
contractors and/or agents associated with the construction or maintenance of this project a
copy of this certification. A copy of this certification including all conditions shall be
available at the project site during the construction and maintenance of this project. [15A
NCAC 02H .0507 (c) and 15A NCAC 02H .0506 (b)(2) and (c)(2)]
6. Continuing Compliance:
The applicant/permittee and their authorized agents shall conduct all activities in a manner
consistent with State water quality standards (including any requirements resulting from
compliance with 303(d) of the Clean Water Act), and any other appropriate requirements
of State and Federal law. If the Division determines that such standards or laws are not
being met, including failure to sustain a designated or achieved use, or that State or Federal
law is being violated, or that further conditions are necessary to assure compliance, than

the Division may reevaluate and modify this General Water Quality Certification. [15A
NCAC 02H .0507(d)]
7. All mechanized equipment operated near surface waters or wetlands will be regularly
inspected and maintained to prevent contamination of waters and wetlands from fuels,
lubricants, hydraulic fluids or other potential toxic chemicals. In the event of a
hydrocarbon or chemical spill, the permittee/contractor shall immediately contact the
Division of Water Quality, between the hours of 8 am to 5 pm at the Wilmington Regional
Office at 910.796.7215 and after hours and on weekends call (800) 858-0368.
Management of such spills shall comply with provisions of the North Carolina Oil
Pollution and Hazardous Substances Control Act. [15A NCAC 02H .0506 (b)(3) and
(c)(3), 15A NCAC 02B .0200 (3)(f), and GS 143 Article 21A].
8. Fueling, lubrication and general equipment maintenance should not take place within 50
feet of a waterbody or wetlands to prevent contamination by fuel and oils. [15A NCAC
02H .0506 (b)(3) and (c)(3) and 15A NCAC 02B .0200 (3)(f)].
9. This certification grants permission to the director, an authorized representative of the
Director, or DEQ staff, upon the presentation of proper credentials, to enter the property
during normal business hours 15A NCAC 02H.0502(e).
10. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or
applicable Buffer Rules, and any subsequent modifications, the applicant and/or
authorized agent is required to return a completed certificate of completion form to the
NCDEQ DWR 401 and Buffers Unit North Carolina Division of Water Resources, 1617
Mail Service Center, Raleigh, NC, 27699 within ten days of project completion. The
certification of completion is available at:

Violations of any condition herein set forth may result in revocation of this Certification and
may result in criminal and/or civil penalties. The authorization to proceed with your proposed
impacts or to conduct impacts to waters as depicted in your application and as authorized by this
Certification shall expire upon expiration of the 404 or CAMA Permit.
This approval and its conditions are final and binding unless contested.
This Certification can be contested as provided in Articles 3 and 4 of General Statute 150B by
filing a written petition for an administrative hearing to the Office of Administrative Hearings
(hereby known as OAH). A petition form may be obtained from the OAH at
http://www.ncoah.com/ or by calling the OAH Clerk's Office at (919) 431-3000 for
information. Within sixty (60) calendar days of receipt of this notice, a petition must be filed with
the OAH. A petition is considered filed when the original and one (1) copy along with any

9. PROJECT DESCRIPTION
The applicant's property is located at 3185 Waterview Drive SW in Supply, Brunswick County along the
AIWW. To locate the project site from the Wilmington Regional Office (WiRO), travel southwest from
Wilmington to Supply on US 74 W (Martin Luther King Jr Pkwy) & US 17 S for approximately 35 miles
until you reach Mt Pisgah Road SW and take a left to head towards Holden Beach. Travel about 4 miles
down Mt Pisgah Road SW until you reach Oxpen Road SW on the right, just after NC 130 comes into Mt
Pisgah Road SW. Go down Oxpen Road SW for about one and three quarters of a mile until you reach
Boones Neck Road SW. Take a right onto Boones Neck Road SW and continue about a mile and you
will reach W Tanglewood Drive SW on your left. Go left onto W Tanglewood Drive SW and you are now
in the Tanglewood Community. Travel almost half a mile to the end of W Tanglewood Drive SW and you
have reached Waterview Drive SW. Turn left onto Waterview Drive SW and travel to the end of the road
and you have reached the project site of the Tanglewood Community Boat Ramp & Docking Facility
located on your right. The project site is bordered by residential properties to the north and west, a tidal
creek to the east, and the AIWW to the south.
The project site is comprised of one parcel totaling approximately 0.41 acres in size and the elevation is
approximately 5.2' above normal high water (NHW) as reported by the applicant. There is approximately
340' of shoreline along the AIWW and tidal creek surrounding the property. The east shoreline adjacent
to the tidal creek has been stabilized with rip rap. Coastal Wetland vegetation is present waterward of
the existing rip rap along the shoreline around the entire parcel and consists primarily of Smooth Cord
Grass (Spartina alterniflora). Currently the high ground of the project site is vegetated primarily with lawn
grasses and mature oak trees and supports the community boat ramp and docking facility by a gravel
driveway. There is also a gazebo located to the west of the boat ramp on the high ground of the property
totaling approximately 215 ftz that leads to the community docking facility. An existing private community
docking facility extends from the natural shoreline and the gazebo out into the AIWW and includes a pier,
two fixed platforms, and a finger pierthat leads to the floating dock that supports 2 boat slips. The existing
docking facility extends into the western adjacent 15' riparian corridor setback and beyond the riparian
corridor line as reported by the applicant. An existing boat ramp with associated structures including two
stabilizing wooden bulkheads, an adjacent fixed pier, and a single mooring piling is located in the center
of the property and provides access to the AIWW. The applicant states that the waterbody measures
approximately 504' wide in this location of the AIWW with a water depth of -3.5' at mean low water (MLW)
at the waterward end of the existing boat ramp.
The Brunswick County Land Use Plan classifies the area in the vicinity of the project area as Residential
(R-6000). The waters in the project area are classified as SAIHQW by the N.C. Division of Water
Resources (DWR). The waters are not designated as a Primary Nursery Area (PNA) by the N.C. Division
of Marine Fisheries (DMF), and they are open to the harvest of shellfish.
10. PROPOSED PROJECT
The applicant is proposing to replace the existing boat ramp and associated structures of the Tanglewood
POA private residential community docking facility along the AIWW. Before demolition of the existing
boat ramp and wooden bulkheads, the applicant states a turbidity curtain would be installed to prevent
materials from accidentally leaving the project site. The existing boat ramp and wooden bulkheads would
be removed using an excavator and disposed of at the landfill. The 91 ft2 section of concrete connected
to the boat ramp leading to the existing adjacent wooden pier would be removed and not replaced due
to not serving as a functioning section of the boat ramp (See Sheet Cl). Excavated materials would be
temporarily stockpiled out of the 30' Coastal Shoreline Buffer in the parking area of the gravel driveway
using erosion and sediment control practices including silt fencing. After they have dewatered, the spoils
would be trucked to the landfill for disposal.

Once removed, the applicant proposes to replace the boat ramp in the same footprint with dimensions
approximately 109' in length by 20' in width (See Sheet C2). Before the new boat ramp can be
constructed, two new vinyl bulkheads are proposed to stabilize the sides of the boat ramp. The proposed
vinyl bulkheads would each measure approximately 91.5' in length and 2' in width and terminate at the
waterward end of the boat ramp. After the proposed vinyl bulkheads have been pile driven into the
substrate and constructed, a temporary sheet pile coffer dam is proposed around the limits of disturbance
for the boat ramp replacement. Once the temporary sheet pile coffer dam has been constructed around
the limits of disturbance for the proposed replacement of the boat ramp, the applicant proposes to
construct a new boat ramp using a concrete truck to pour the concrete in place. The concrete would be
poured within the control joints of the temporary coffer dam and vinyl bulkheads to construct the new boat
ramp in the same location. After the concrete has dried and the boat ramp has been constructed, the
applicant proposes to remove the temporary coffer dam and turbidity curtain and add rip rap 1' thick at
the waterward end of the boat ramp approximately 21'/4' in length and 7'/2 in width to prevent boat
propeller washing from launching and loading vessels. Where the 91 ft2 section of concrete would be
removed from the high ground, the applicant proposes to replace this section of the boat ramp with a
fixed wooden pier connecting to the existing wooden pier adjacent to the boat ramp. The proposed pier
would measure approximately 20' in length and 3' in width totaling approximately 60 ft2.
11. ANTICIPATED IMPACTS
The proposed boat ramp replacement and associated structures would disturb a total area of
approximately 2,765 ft2. A total of approximately 1,142 ft2would be disturbed within the high ground
portion of the property in the 75' Estuarine Shoreline Area of Environmental Concern (AEC). The
proposed boat ramp would result in approximately 960 ft2 of disturbance on high ground within this AEC.
The proposed vinyl bulkheads would result with a high ground disturbance of approximately 122 Wand
the proposed pier addition would result in approximately 60 ft2 of disturbance to this AEC. A total of
approximately 1,623 ft2 would be disturbed over open water within the Estuarine Waters & Public Trust
Areas AECs. Approximately 1220 ft2 of open water within this AEC would be disturbed by the
replacement of the proposed boat ramp. The proposed vinyl bulkheads would result in an open water
disturbance of approximately 244 ft2 and the proposed rip rap would result in approximately 159 ft2 of
disturbance to this AEC. The boat ramp and associated structures would not encroach into either of the
15' riparian corridor setbacks. As proposed, there would not be a potential for bottom disturbances such
as accidental dredging or displacement of the substrate by prop -washing from vessel propellers to utilize
the boat ramp at periods of low tide due to adding rip rap 1' thick at the end of the boat ramp. Minor
increases in turbidity should be expected during construction. There appears to be no Submerged
Aquatic Vegetation (SAV) nor shellfish beds in the project area. This area is a not a Primary Nursery
Area (PNA) and is open to the harvest of shellfish by the Division of Marine Fisheries (DMF).

The Tanglewood Subdivision is a residential area in the unincorporated
district of Brunswick County along the ICWW close to Holden Beach.
The subdivision was created with a community boat ramp in
approximately 1970. There are existing lakes, roadways, pier, floating
dock, gazebo, and concrete ramp.
This project proposes to replace the existing wooden bulkhead concrete
ramp with new PVC sheetpile bulkhead and new concrete.

dock, and gazebo.

ramp. #57 Stone will be placed off the end of the concrete to prevent boat propeller
wash when loading/unloading vessels. No canal will be dredged at the ramp.
4. Environmental Impacts
The project will disturb only 0.06 acres of land along the ICWW which will comply with
the NCDENR requirements of the Sediment Erosion Control rules. The only area to be
disturbed will be the amount necessary to completely remove the existing ramp. There
will be no impervious areas constructed within 50' of the mean high water line.
5. Erosion Control Considerations: The following erosion control measures are
used on this project:
Temporary Gravel Construction Entrance/Exit
To prevent sediment from leaving the site, temporary gravel construction entrance
should be installed where Road enters the site. For dimensions and specifications,
see construction details.
2. Floating Boom
A floating boom turbidity curtain will be installed around the work area to prevent
disturbed materials from floating away from the work area.
6. Construction Schedule:
1. Obtain plan approval and other applicable permits.
2. Hold pre -construction meeting at least one week prior to beginning construction.

The existing Tanglewood neighborhood boat ramp is in severe deterioration of the driving
surface, wood bulkheading, and rutting out of the material at the bottom of the ramp as well. The
POA wishes to repair the ramp by installing new vinyl sheetpile and new concrete surface to get
the ramp back to its full service of providing water recreational access to the ICWW.
We believe this repair will be of little environmental impact by keeping the same footprint of the
existing ramp. No other ramp or dock work is proposed at this time. The proposed work will be
conducted after Labor Day (September 2, 2019).
Enclosed are two sets of 11"x17" construction plans, application, and $400 application fee.

rate with the cost of measurement thereof, if any, being paid by Seller.
10. EVIDENCE OF TITLE: Seller agrees to use his best efforts to deliver to Buyer as soon as reasonably possible
after the Effective Date of this contract, copies of all title information in possession of or available to Seller,
including but not limited to: title insurance policies, attorney's opinions on title, surveys, covenants, deeds, notes
and deeds of trust and easements relating to the Property. Seller authorizes (1) any attorney presently or previously
representing Seller to release and disclose any title insurance policy in such attorney's file to Buyer and both Buyer's
and Settees agents and attorneys; and (2) the Property's title insurer or its agent to release and disclose all materials

11. LABOR AND MATERIAL: Seller shall furnish at Closing an affidavit and indemnification agreement in form
satisfactory to Buyer showing that all labor and materials, if any, furnished to the Property within 120 days prior to
the date of Closing have been paid for and agreeing to indemnify Buyer against all loss from any cause or claim
arising there from.

13. PROPERTY INSPECTION, APPRAISAL, INVESTIGATION (Choose ONLY ONE of the following
Alternatives);

(a) Property Inspection: Unless otherwise stated heroin, Buyer shall have the option of inspecting, or obtaining at
Buyer's expense inspections, to determine the condition of the Property. Unless otherwise stated herein, it is a
condition of this contract that: (i) the built-in appliances, electrical system, plumbing system, heating and cooling
systems, roof coverings (including flashing and gutters), doors and windows, exterior surfaces, structural
components (including foundations, columns, chimneys, floors,. walls, ceilings and roofs), porches and decks,
fireplaces and flues, crawl space and attic ventilation systems (if airy), water and sewer systems (public and private),
shall be performing the function for which intended and shall not be in need of immediate repair; (it) there shall be
no unusual drainage conditions or evidence of excessive moisture adversely affecting the structure(s); and (lii) there
shall be no friable asbestos or existing environmental contamination. Any inspections shall be completed and written
notice of necessary repairs shall be given to Seller on or before . Seller shall
provide written notice to Buyer of Seller's response within days of Buyer's notice. Buyer is advised to
have any inspections made prior to incurring expenses for Closing and in sufficient time to permit any required
repairs to be completed by Closing.
(b) Wood -Destroying Insects: Unless otherwise stated herein, Buyer shall have the option of obtaining, at Buyer's
expense, a report from a licensed pest control operator on a standard form in accordance with the regulations of the
North Carolina Structural Pest Control Committee, stating that as to all structures, except
there was no visible evidence of wood -destroying insects and containing no indication of visible damage there from.
The report must be obtained in sufficient time so as to permit treatment, if any, and repairs if any, to be completed
prior to Closing. All treatment required shall be paid for by Seller and completed prior to Closing, unless otherwise
agreed upon in writing by the parties. The Buyer is advised that the inspection report described in this paragraph
may not always reveal either structural damage or damage caused by agents or organisms other than wood -
destroying insects. If new construction, Seller shall provide a standard warranty of termite soil treatment.
(e) Repairs: Pursuant to any inspections in (a) and/or (b) above, if any repairs are necessary, Seller shall have the
option of completing them or refusing to complete them. If Seller elects not to complete the repairs, then Buyer shall
have the option of accepting the Property in its present condition or terminating this contract, in which case all
earnest monies shall be refunded. Unless otherwise stated herein, any items not covered by (a)(i), (a)(H), (a)(iii) and
(b) above are excluded from repair negotiations under this contract.
(d) Radon Inspection: Buyer shall have the option, at Buyer's expense, to have the Property tested for radon on or
before the date for completion of inspections as set forth in paragraph 13 (a) above. The test result shall be deemed
satisfactory to Buyer if it indicates a radon level of less than 4.0 pico curies per liter of air (as of January 1,1"7,
EPA guidelines reflect an "acceptable" level as anything less than 4.0 pico curies per liter of air). If the test
result exceeds the above -mentioned level, Seller shall have the option of: a) remediating to bring radon level within
the satisfactory range; or b) refusing to remediate. Upon the completion of remediation, Buyer may have a radon test
performed at Seller's expense, and if the test result indicates a radon level less than 4.0 pico curies per liter of air, it
shall be deemed satisfactory to the Buyer. If Seller elects not to remediate, or if remediation is attempted but fails to

bring the radon level within the satisfactory range, Buyer shall have the option of: a) accepting the Property with its
then current radon level; or
b) terminating the contract, in which case all earnest monies shall be refunded.
(a) Cost Of Repair Conthageney: Notwithstanding the above and as an additional remedy of Buyer, if a reasonable
estimate obtained by Buyer of the total cost of repairs required by (a) and (b) and/or remediation required by (d)
above equals or exceeds $ then Buyer shall have the option to terminate this contract
pursuant to the Cost of Repair Can agency no later than seven days following the inspection date and all earnest
monies shall be refunded to Buyer.

contract is not subject to a financing contingency requiting an appraisal, Buyer shall arrange to have the appraisal

19. ASSIGNMENTS: This contract may not be assigned without the written consent of all parties, but if assigned

20. PARTIES: This contract shall be binding upon and shall inure to the benefit of the parties, i.e., Buyer and Seller
and their heirs, successors and assigns. As used hereto, words in the singular include the plural and the masculine
includes the feminine and neuter genders, as appropriate.
ZI. SURVIVAL: If any provision herein contained which by its nature and effect is required to be observed, kept or
performed after the Closing, it shall survive the Closing and remain binding upon and for the benefit of the parties
hereto until fully observed, kept or performed.
22. ENTIRE AGREEMENT: This contract contains the entire agreement of the parties and there are no
representations, inducements or other provisions other than those expressed herein. All changes, additions or

Channel to the Atlantic Ocean, adjacent to the Atlantic Ocean, Wrightsville Beach, New Hanover
County.

Brunswick County, adjacent to the Atlantic Intracoastal Waterway. The application was accepted as complete on
August 19, 2019 and appears to be adequate for processing at this time. The projected deadline for making a
decision is November 2, 2019. An additional 75-day review period is provided by law when such time is necessary
to complete the review. If you have not been notified of a final action by the initial deadline stated above, you
should consider the review period extended. Under those circumstances, this letter will serve as your notice of an
extended review. However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from August 19, 2019, you may request a meeting
with the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such
a meeting will be held within five working days from the receipt of your written request and shall include the
property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will fend a "Notice of Permit Filing" postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from
a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property; or at a point along the road right-of-way where a private road would lead one into your
property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the appropriate
State or Federal agency. Please contact me if you have any questions and notify me in writing if you wish to receive
a copy of my field report and/or comments from reviewing agencies.

• Please relabel Normal High Water to Mean High Water (MHW) to be consistent with C2.
• Continue the waterward coastal wetland delineation (marsh line) across the entire parcel
and add the landward limits of coastal wetlands to the plans. Please show marsh grass on
the plans and label the lines.
• We need to see the entire docking facility on the plans. Please show the existing footprint
of the docking facility and label the structures as existing.

• We need to see the Riparian Corridor for the parcel on both plans. Please include the
Riparian Lines with the 15' Riparian Setbacks.
• What is the width of this waterbody? Please include the width of the waterbody on both
plans.
• What is the need/purpose of replacing the section of the concrete boat ramp with concrete
that is not used for unloading/loading vessels? I've highlighted this section pink on both
plans.
• Work Note for the Site Contract #4 explains that no work shall occur below the mean high
water line. Please remove this note.
• General Note #6 explains that the Atlantic Intracoastal Waterway Right of Way and 80'
Setback lines are plotted and there is only the Right of Way shown, however this line is
labeled incorrectly and says 80' Setback From Dredged Channel. Please correct the line
to say Atlantic Intracoastal Right of Way and include the 80' Federal Channel Setback line.
• Structural Note #3 explain that the proposed bulkhead length is approximately 310 feet in
length? I measure approximately 147 feet in length.
• Structural Note #12 explains that backfill for bulkhead shall be clean? Where is backfill
proposed or needed for these structures? I'm a little confused by this and the backfill listed
on the MP-2. There shouldn't be much, if any, backfill needed for these bulkheads.
• Structural Note # 15 explains that anchors will be used for the proposed bulkheads? There
shouldn't be any anchors or backfill for these proposed bulkheads.

proposed rip rap on C2 at the end of the boat ramp.

• What is the width of this waterbody? Please include the width of the waterbody on both
plans.
• Cross Section A is included, but there is not a line labeled as "A" going across the boat
ramp. Where is this cross section from? Leave this cross section, but also add Cross
Section B to the plans showing the slope of the boat ramp from beginning to end of the
project.
• What is the need/purpose of replacing the section of the concrete boat ramp with concrete
that is not used for unloading/loading vessels? I've highlighted this section pink on both
plans.
• Is a coffer dam proposed for the proposed concrete boat ramp replacement below or
waterward of the proposed bulkheads? If a sheet pile coffer dam is proposed to replace the
boat ramp below MHW and waterward of the ends of the proposed bulkheads, then we will
need to see that on the plans too. A description of this construction should be included in
the narrative and MP-1, as well as the dimensions included on the MP-2.

• Where will spoil material and old concrete boat ramp be located during and after removal? Is there
a temporary spoil disposal area? What is the final destination of this excavated fill?
• Is actual clean dirt/fill proposed for these bulkhead replacements? I'm a little confused with the
backfill notes on the plans and the backfill listed on the MP-2. Are you referring to the concrete
boat ramp as backfill?
• "Concrete Poured in Place" should be labeled as Proposed and concrete cannot be poured below
MHW unless a coffer dam is proposed. Is a coffer dam out of temporary sheet pile proposed below
the waterward ends of the proposed bulkheads for this method of replacing the boat ramp? If a
coffer dam is needed for this method, please include the structure on the plans and on the MP-2.
• What is the need/purpose of replacing the section of the concrete boat ramp with concrete
that is not used for unloading/loading vessels? I've highlighted this section pink on both
plans. This section does not function as a boat ramp and could be replaced with wood.
• Have the adjacent riparian property owners (ARPOs) been notified of the proposed
development? I didn't receive any notifications or certified letters to the ARPOs with your
application. I would recommend notifying the ARPOs with the new plans once these
deficiencies have been corrected.
• I highly recommend a preliminary meeting on site to discuss these deficiencies of your application.
