Boat Rama/ Groin/ Shoreline Stabilization 1) Unless specifically altered herein, this Minor Modification authorizes the use of concrete rubble from the boat ramp removal to be placed along the vinyl sheet pile wall and existing rip rap area, all as expressly and specifically set forth in the attached letter and workplan drawings. Any additional development activities may require a modification of this permit. (See attached sheet for additional conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2022 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. USACE / FEDERAL CONDITIONS 6) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein. This major permit was issued on December 6, 2019 to replace the existing boat ramp in the same footprint, add riprap at the end of the boat ramp, and to extend the landward end of the wooden fixed access pier for the boat ramp. Major Permit No. 94.19 expires on December 31, 2022. This Minor Modification request proposes to use the concrete material from the old boat ramp (that will be removed), for the purpose of adding to the existing riprap revetment and the surrounding area outside of the proposed vinyl sheelpile wing walls (see Sheet Cl). All proposed concrete riprap would not be located within Coastal Wetlands. The applicant also proposes to construct two vinyl sheetpile bulkheads, also known as wing walls or break walls, each extending down the side of the new boat ramp (see Sheet C2). According to the applicant, the proposed "Navy style break wall will be placed on each side of boat ramp to provide additional support from waves from passing boats." The appncant also proposes to replace the entire wooden fixed access pier for the boat ramp, instead of only extending the landward end that was approved under Major Permit No. 94-19. All proposed modifications would be located within the applicant's riparian corridor and would not encroach into the 15' riparian corridor setbacks or the U.S. Army Corps of Engineers Right -of -Way. This request was completed with plans, narrative, agent authorization form, adjacent riparian property owner notifications, and a modification fee (Check # 3560) of $100 received by this office on February 26, 2020. The proposed modification appears to be consistent with 15A NCAC 07H .0208 (b) (6 & 7)..1105, and .1305, which includes the Specific Use Standards for Piers & Docking Facilities, Bulkheads, Riprap Revetments, and Boat Ramps in Estuarine Waters and Public Trust Areas AECs. This office has no objection to the modification of State Permit No. 94-19, provided it is consistent with all other local, state, and federal regulations. By copy of this memo, DCM is requesting that the USACE, the NC DWR, the NC DMF, and the Brunswick County LPO to provide any comments that your agency may have on the proposed project to Tyler McGuire of DCM's Wilmington office within 14 days of receipt of this memo. In the process of acquiring a suitable contractor to do the work it was determined that there were a few changes that needed to be made to the existing plan/drawings to complete the project. It was decided that the changes needed to be summarized in a minor permit against the Major permit. The changes are as follows: 1 Concrete from the existing boat ramp will be used on site to shore up existing Rip Rap already in place. 2 A Navy style break wall will be installed on each side of boat ramp to provide additional support from waves from passing boats. 3 A new Catwalk will be installed at the same time on the west side of the boat ramp replacing the existing deteriorating catwalk. However, this new drawing seems to show a few differences from the major permit application that aren't described in this narrative. First, along the proposed sheetpile wall on the eastern side, there appears to be riprap proposed which isn't mentioned in the report or narrative. Second, the area of demolished riprap placement on the western catwalk was not in the original major permit application. Lastly, when compared to the original major permit, "toe of slope" line was also the marsh line.
