Permit #10.19

This letter is in response to correspondence received on August 9, 2019, from your agent Hal Goodman, of
Construction Engineering Services, Inc., requesting a refinement on your behalf to the recent Minor
Modification that was issued for Major Permit #10-19. In the correspondence, Mr. Goodman requested that
the alignment of the permitted bulkhead be refined such that the wall will extend straight across the shoreline
from the authorized retaining wall versus an angled wall, tying into the authorized return wall. This request
also clarifies that the refined alignment will be above the current Normal Water Level, and provide better
protection from future erosion.
Major Permit #10-19 was originally issued to the Tale of the Whale Restaurant on February 12, 2019, for a
pier extension and wet slips, and was modified on August 9, 2019 for shoreline stabilization. The project is
located at 7575 S. Virginia Dare Trail, in the Town of Nags Head, Dare County.
Your modification request as described and/or depicted in the submittal dated August 9, 2019, is hereby
authorized as a refinement to CAMA Major permit #10-19. All existing conditions remain in effect, including
the expiration date of December 31, 2022. This letter is provided to you as a record of the authorization, and
should be included with the Permit file.
Please be advised that you may need to obtain a building permit from the Town of Nags Head. If you have

Good afternoon Jonathan,
I met onsite with Dan Bibey and his contractor on August 2nd regarding the pending modification to
MP 10-19 for shoreline stabilization that included a retaining wall, bulkhead and return. At that time
there was a discussion that the angled bulkhead alignment that was originally submitted by
Construction Engineering Services was not the best design. This information had been relayed to me
by Hal Goodman prior to the site visit. I mentioned the potential refinement request, and Gregg
Bodnar had stated that they should request the refinement after the minor mod was issued, or they
would have to start the process over.
So, as soon as the minor mod was authorized and sent out, I received a letter and refined
drawing. The adjacent property owner to the left (next to the project), has signed the drawing noting
that he has no objection to the change.
Please find attached a refinement letter drafted for your review/changes/approval, as well as the
correspondence received from Construction Engineering. Don't hesitate to contact me or Hal
Goodman if you have any questions or need further documentation.
