as authorized by the State of North Carolina, Department of Environment,
and Natural Resources and the Coastal Resources Commission for development
in an area of environment concern pursuant to Section 113A-118 of the
General Statutes, "Coastal Area Management"
Issued to Town of Sunset Beach, authorizing development in the Estuarine Shoreline (ES) at 206 Sunset Boulev�
North, east of the intersection of Sunset Blvd. and Shoreline Drive, adjacent to Mary's Creek and AIWW, in Sun:
Beach, Brunswick County. This permit, issued on September 19, 2013, is subject to compliance with the application a
site drawings (where consistent with the permit), all applicable regulations and special conditions and notes set fo
below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or may cause t
permit to be null and void.
This permit authorizes: construction of a multi -use town park consisting of a pervious concrete walking trail, wooden
slatted boardwalk walking trails, an observation deck (not to exceed 200 sq ft), three educational kiosks, a restroom
building, a gazebo, and a pervious concrete parking area.
(1) All proposed development and associated construction must be done in accordance with the permitted work p
drawings(s) dated received on September 5, 2013.
(2) All construction must conform to the N.C. Building Code requirements and all other local, State and Fed&
regulations, applicable local ordinances and FEMA Flood Regulations.
(3) Any change or changes in the plans for development, construction, or land use activities will require a
evaluation and modification of this permit.
(4) A copy of this permit shall be posted or available on site. Contact this office at (910) 796-7215 for a fir

This permit action may be appealed by the permittee or other qualified persons
within twenty (20) days of the issuing date. From the date of an appeal, any
work conducted under this permit must cease until the appeal is resolved. This
permit must be on the project site and accessible to the permit officer when the
project is inspected for compliance. Any maintenance work or project
modification not covered under this permit, require further written permit
approval. All work must cease when this permit expires on:
December 31, 2016

(5) Pursuant to 15A NCAC, Subchapter 7J.0406(b), this permit may not be assigned, transferred, sold or otherwise
disposed of to a third -party.
(6) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective
sedimentation and erosion control measures. Disturbed areas shall be vegetatatively stabilized (planted and
mulched) within 14 days of construction completion.
(7) All other disturbed areas shall be vegetatatively stabilized (planted and mulched) within 14 days of construction
completion.
(8) The amount of impervious surface shall not exceed 300,10 of the lot area within 75 feet of normal high water
(Estuarine Shoreline Area of Environmental Concern), in this case, 9,093 square feet is authorized.
(9) Unless specifically allowed in 15A NCAC 07H. 0209(d)(10), and shown on the permitted plan drawing, all
development/construction shall be located a distance of 30 feet landward of normal high water.

construction of a multi -use town park. The construction proposed within the park consists of 12,776 sq ft of pervious
concrete walking trails, 2,311 sq ft of slatted boardwalk walking trails, an observation deck (not to exceed 200 sq ft), three
educational kiosks, a restroom building (20'x20'), a 1500 sq ft gazebo and a pervious concrete parking area (12,282 sq ft).
Please note that the walking trails constructed within the 30' Coastal Shoreline Setback will be constructed as wooden
slatted walkways, which is allowable within the 30' Setback. There are no proposed pervious concrete trails within the
30' setback.

FOR DEVELOPERS IN OCEAN HAZARD AND ESTUARINE HAZARD AREAS:
I acknowledge that the land owner is aware that the proposed development is planned for an area which may be
susceptible to erosion and/or flooding. I acknowledge that the local permit officer has explained to me the particular
hazard problems associated with this lot. This explanation was accompanied by recommendations concerning stabilization
and floodproofing techniques.
PERMISSION TO ENTER ON LAND:
I furthermore certify that I am authorized to grant and do in fact grant permission to the local permit officer and his agents
to enter on the aforementioned lands in connection with evaluating information related to this permit application.
This application includes: general information (this form), a site drawing as described on the back of this application, the
ownership statement, the AEC hazard notice where necessary, a check for $100.00 made payable to the locality, and any
information as may be provided orally by the applicant. The details of the application as described by these sources are

Dear Ms. Parker:
On February 18, 2014, the Division excluded the subject project above from the requirement to obtain a
stormwater management permit based on three criteria: 1) the disturbed acreage was less than 1 acre;
2) no CAMA Major permit was required; and, 3) the proposed built -upon area was less than 10,000
square feet. On August 6, 2014, staff of the Wilmington Regional Office of the Division of Energy,
Mineral and Land Resources inspected the subject project and determined that the disturbed acreage
limits exceeded the 0.94 acres which was originally proposed for this project and that the materials
observed on site for the "boardwalk" construction within the 50' surface water buffer appear to be of a
type that could not be considered a completely pervious surface.
The disturbed area limits were measured as being approximately 3 acres, which will require the
submission and approval of a Sedimentation Erosion Control plan, therefore, the "not subject"
determination for this project previously provided by the Division on February 18, 2014, is hereby
withdrawn. The North Carolina Administrative Code requires any project that is part of a larger common
plan of development, or that proposes more than 10,000 square feet of new built -upon area, or that
must receive Sedimentation and Erosion Control Plan approval, or that must receive a CAMA Major
permit, to apply for and receive a Stormwater Management Permit from the Division of Energy,
Mineral and Land Resources. Any construction on the subject site, prior to receipt of the required
Coastal Stormwater permit, will constitute a violation of 15A NCAC 2H.1000 and may result in
appropriate enforcement action by this Office.
Therefore, please submit a Stormwater Permit Application Package including 2 sets of plans,
completed application form, fee, and supporting documentation, or a written response regarding the
status of this project and the expected submittal date, to this Office no later than September 20, 2014.
Failure to respond to this request may result in the initiation of enforcement action, and construction
may experience a subsequent delay. Please reference the Project Number above on all
