Issued by WiRO SH 13-01 Town of Shallotte Permit Number CAMA MINOR DEVELOPMENT PERMIT as authorized by the State of North Carolina, Department of Environment, and Natural Resources and the Coastal Resources Commission for development in an area of environment concern pursuant to Section 113A-118 of the General Statutes, "Coastal Area Management' Issued to Samantha Hughes, Quincy's Creek LLC., authorizing development in the Estuarine Shoreline (AEC) at 1800 Village Pc Road, in Shallotte, adjacent to the Shallotte River in Brunswick County, as requested in the permittee's application, dated Februz 6, 2013. This permit, issued on February 21, 2013 is subject to compliance with the application and site drawing (where consistE with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. This permit authorizes: The construction of an approximately 537 sq. ft. addition to an existing restuarant. (1) All proposed development and associated construction must be done in accordance with the revised work plat drawings(s) dated received on 02/06/2013. (2) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal regulations, applicc local ordinances and FEMA Flood Regulations. (3) Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and modificatio this permit. (4) A copy of this permit shall be posted or available on site. Contact this office at 910-796-7215 for a final inspection at completio work. (Additional Permit Conditions on Page 2) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. From the date of an appeal, any work conducted under this permit must cease until the appeal is resolved. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. Any maintenance work or project modification not covered under this permit, require further written permit approval. (6) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective sedimentation and erosion control measures. Prior to any land -disturbing activities, a barrier line of filter cloth must be installed between the land disturbing activity and the adjacent marsh or water areas, until such time as the area has been properly stabilized with a vegetative cover. (7) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective sedimentation and erosion control measures. Al! other disturbed areas shall be vegetatively stabilized (planted and mulched) within 14 days of construction completion. Shallotte, NC 28470 Re: Remodeling plan review Dear Mr. Milliken, On December 11, 2012 The Brunswick County Health Services Department received your remodeling plans of the kitchen at Inlet View Bar & Grill (ID # 07010010878). The plans were reviewed by this Department during an on -site visit with you at the establishment on December 17, 2012. Please be advised that the floor plans as proposed for the planned building extension to allow the relocation of the walk-in cooler/freezer and the construction of the new dishwashing room are approved as proposed and you may begin that part of the project after first obtaining all required mechanical, Wash Rinse HI electrical, plumbing, and building permits from Building Inspections. In addition, we also discussed your plan for relocating the existing ice machine presently in the kitchen to instead be outside in an enclosed area at the top of your existing service ramp. That request is approved so long as additional construction is completed that will completely enclose the ice machine so that the ice is protected at all times. Of course, adequate screening at the top of the enclosure will be necessary to allow venting of the heat that the ice machine will generate. The mesh of that screening should be at least as small as size 16 so as to adequately restrict the entry of all pest into the enclosure. The ice machine and/or the door way leading into the new enclosure will have to be lockable and remain locked when left unattended. The ice machine will also have to be properly plumbed to an approved drain with at least a 2 inch air gap. Other items discussed were the proposed relocation of the existing equipment on the cook line beneath the hood system and the installation of a new 6 foot hood over the area where the existing ice machine is presently located so that you will have added space for installation of a new convection oven. Also, a cooler and table that is presently blocking the exit way at the east end of the cook line will have to be moved to the opposite end near the area where the present walk-in cooler is located. Should that equipment not be relocated so that entry into the cook line area is accessible at both ends, the installation of another handwash sink shall then be required at the east end of the cook line that will be accessible to employees working at that end of the cookline. A handwash sink shall be added near the proposed entrance of the new dishwashing room. The existing dishwashing room and the area where the existing walk-in cooler/freezer is located will be remodeled and used for storage and other means. Last, one section of the wait station shall be remodeled as well to use for relocating your computers. All floors, walls, and ceilings shall be durable, smooth, and easily cleanable. All equipment shall be NFS approved meeting ANSI standards and shall be new or in like -new conditions having no rust, corrosion, damage, or alterations and each piece of equipment shall include its identifying information (Manufacturer, Serial #, etc...). Please note as we discussed on site the details of these proposed change being somewhat different from that shown on your present hand drawn plans, you must submit revised scaled floor plans showing the final layout of all proposed changes, notes on the intended use for each room and all equipment, plus an updated equipment list prior to starting to work on their construction. Understand that any and all newly constructed areas or equipment that are to be installed may not be put to use nor operated until it is first permitted, inspected and approved by the Building Inspections (and Fire Marshall as needed) AND only after you have received final inspection by and written approval from the Brunswick County Health Services Department. Last, you have also requested to change your menu to include sushi products that will be prepped at the restaurant. Please be advised that this will require you to submit a revised copy of your complete menu to be reviewed for approval by this Department. You must include detailed information on the source for all sushi items, documentation of parasite destruction, what method you will use to prepare and hold the sushi rice, proposed consumer advisory, etc.... The North Carolina Food Code (Adopted 7-1- 2012, Effective date 9-1-2012) requires the following regarding parasite destruction: 3-402.11 Parasite Destruction. (A) Except as specified in ¶ (B) of this section, before service or sale in READY -TO -EAT form, raw, raw -marinated, partially cooked, or marinated -partially cooked FISH shall be: (1) Frozen and stored at a temperature of -200C (-4°F) or below for a minimum of 168 hours (7 days) in a freezer; (2) Frozen at -350C (-31 OF) or below until solid and stored at -350C (-31 OF) or below for a minimum of 15 hours; or (3) Frozen at -350C (-31 OF) or below until solid and stored at -200C (-4°F) or below for a minimum of 24 hours. (B) Paragraph (A) of this section does not apply to: (1) MOLLUSCAN SHELLFISH; RECEIVED DCM WILMINGTON, NC , ,, .I " -1 rifiS1) (2) Tuna of the species Thunnus alalunga, Thunnus albacares (Yellowfin tuna), Thunnus atlanticus, Thunnus maccoyii (Bluefin tuna, Southern), Thunnus obesus (Bigeye tuna), or Thunnus thynnus (Bluefin tuna, Northern); or (3) Aquacultured FISH, such as salmon, that: (a) If raised in open water, are raised in net -pens, or (b) Are raised in land -based operations such as ponds or tanks, and (c) Are fed formulated feed, such as pellets, that contains no live parasites infective to the aquacultured FISH. (4) FISH eggs that have been removed from the skein and rinsed. 3-402.12 Records, Creation and Retention. (A) Except as specified in ¶ 3-402.11(B) and ¶ (B) of this section, if raw, raw -marinated, partially cooked, or marinated -partially cooked FISH are served or sold in READY -TO - EAT form, the PERSON IN CHARGE shall record the freezing temperature and time to which the FISH are subjected and shall retain the records of the FOOD ESTABLISHMENT for 90 calendar days beyond the time of service or sale of the FISH. (B) If the FISH are frozen by a supplier, a written agreement or statement from the supplier stipulating that the FISH supplied are frozen to a temperature and for a time specified under § 3-402.11 may substitute for the records specified under ¶ (A) of this section. (C) If raw, raw -marinated, partially cooked, or marinated -partially cooked FISH are served or sold in READY -TO -EAT form, and the FISH are raised and fed as specified in Subparagraph 3-402.11(13)(3), a written agreement or statement from the supplier or aquaculturist stipulating that the FISH were raised and fed as specified in Subparagraph 3-402.11(13)(3) shall be obtained by the PERSON IN CHARGE and retained in the records of the FOOD ESTABLISHMENT for 90 calendar days beyond the time of service or sale of the FISH. If you should decide to prepare your sushi rice using vinegar to preserve the product, then understand that a variance will be required from the State Variance Committee as is required by the following section of the NC Food Code: 3-502.11 Variance Requirement. A FOOD ESTABLISHMENT shall obtain a VARIANCE from the REGULATORY AUTHORITY as specified in § 8-103.10 and under § 8-103.11 before: (C) Using FOOD ADDITIVES or adding components such as vinegar: (1) As a method of FOOD preservation rather than as a method of flavor enhancement, or (2) To render a FOOD so that it is not POTENTIALLY HAZARDOUS (TIME/TEMPERATURE CONTROL OF SAFETY FOOD). The proposed addition to the existing restaurant is 537 sf. The proposed addition to the existing structure will consist of an expansion to the existing kitchen area and open deck on the floor above. The entire addition will be located on pilings with the bottom of the lowest horizontal structural member to be placed above the 100-year water surface elevations, including the required Town required flood zone freeboard elevation. No change is proposed to the existing parking; thus precluding the need for any fill material to be added to the site. The property within the area of the proposed building addition is currently located in the floodway. Per the Brunswick County Flood Insurance Study (FIS) and Federal Insurance Rate Map (FIRM) # 3720109600J, both dated June 2, 2006, Shallotte River is currently defined as a Special Flood Hazard Area (SFHA), based upon a re -delineated detailed study, with base flood elevations established and a regulatory floodway shown. Per 44 CFR Ch. 1 paragraph 60.3, when a regulatory floodway has been designated, the community shall "prohibit encroachments, including fill, new construction, substantial improvements, and other development within the adopted regulatory floodway unless it has been demonstrated through hydrologic and hydraulic analyses performed in accordance with standard engineering practice that the proposed encroachment would not result in any increase in flood levels within the community during the occurrence of the base flood discharge." This language is echoed in the Town of Shallotte Flood Damage Prevention Ordinance Article 5, Section F (1). Since the proposed development associated with the minor proposed building addition to Inlet View Bar & Grill will require construction within the effective floodway, one of the following options must be chosen: A Conditional Letter of Map Revision (CLOMAR) request for the affected Flood Insurance Rate Map (FIRM) panels, followed by a Letter of Map Revision (LOMR) request at the completion of construction. This series of requests will formally update the FEMA FIRM panels to show the effects of the proposed crossings and require approval by both the Town of Shallotte and FEMA. Due to the nature of the proposed development and its location in the floodway, a no -rise certification is being submitted to the Town of Shallotte. Per the structural building plans developed by this consultant, the only above -grade obstructions to flow during the 100-year event are the new pilings supporting the proposed minor building addition. The bottom of the lowest horizontal structural member of the proposed building addition is to be placed above the 100-year water surface elevation, including the Town required freeboard elevation. No change is proposed to the existing site grades. This analysis of the flood impacts of the proposed building addition assumes that the Site Plan and survey provided by East Coast Engineering & Surveying, P.C. is correct.
