This permit, issued on April 22, 2019 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Elevated Boat Ramp Replacement 1) Unless specifically altered herein, this permit authorizes the replacement of the previously authorized elevated boat ramp. The replacement elevated boat ramp shall be constructed in accordance with the alignment depicted on the attached workplan. 2) The elevated boat ramp shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's areas of riparian access. 3) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2022 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature ofPermittee Sanderling Property Owners Association Permit No. 24-19 Page 2 of 3 ADDITIONAL CONDITIONS 4) If the crossing of wetlands with mechanized construction equipment is necessary, temporary construction mats shall be utilized for the areas to be crossed. The temporary mats shall be removed immediately upon completion of construction. 5) This permit does not authorize any fill or excavation. 6) Use of the elevated boat ramp as temporary dockage is not authorized under this permit. NOTE: It is strongly recommended that the permittee exercise all available precautions in the day-to-day operation of the facility to prevent injury or damage to associated structures, property and the adjacent habitat. Mooring Buoys 7) This permit authorizes only the 4 mooring buoys and uses located in or over the water that are expressly and specifically set forth in this permit. No other structure, whether floating or stationary, shall become a permanent part of this mooring without permit modification. No non -water dependent or commercial uses of structures shall be conducted on, in or over public trust waters without permit modification. 8) Freestanding moorings shall be marked or colored in compliance with U.S. Coast Guard and NC Wildlife Resources Commission requirements and the required marking maintained for the life of the moorings. 9) Freestanding moorings must bear the owner's name, state vessel registration numbers and/or U.S. Customs Documentation numbers. Required identification must be legible for the life of the mooring(s). 10) The type of material used to anchor the mooring buoys must be non-polluting and of sufficient weight and design to safely anchor the buoy and vessel. 11) The mooring and attached vessel shall not interfere with the access of any riparian owner nor shall it block riparian access by blocking channels, deep water, etc. which allows riparian access. 12) Freestanding moorings shall not be transferable or assignable. Upon transfer of riparian property ownership, the moorings shall be removed by the original permittee unless a new permit is issued to the new riparian owner. 13) If freestanding moorings are to be replaced, the moorings shall comply with those guidelines of the Division in place at that time. 14) This permit authorizes a maximum of 4 formalized boat slips. Sanderling Property Owners Association Permit No. 24-19 Page 3 of 3 ADDITIONAL CONDITIONS General 15) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the moorings or elevated ramp. Any sewage discharged at the mooring shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 16) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 17) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third parry without the written approval of the Division of Coastal Management. 18) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the permitted activity without having it transferred to a third party. 19) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2019-00301). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2019-0203. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 264-3901 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal water level. March 6, 2019 Sanderling Property Owners Association Major Permit Recommendations The applicant proposes to replace an existing elevated wooden boat ramp, remove 7 existing mooring piles and install 4 mooring buoys. The site of the proposed development is located at 1578 Duck Road (NC-12), within the Town of Duck, Dare County, adjacent to the Currituck Sound. The development proposal involves the Public Trust Area (PTA), Estuarine Waters (EW), and Estuarine Shoreline (ES) Areas of Environmental Concern (AEC's). I have reviewed the Rules of the Coastal Resources Commission (CRC) as they pertain to this project and my findings are as follows: 15A NCAC 07H.0206 Use Standards Paragraph (a) addresses General Use Standards, and sub -paragraph (1) precludes uses that are not water dependent within the EW and PTA and lists uses that may be considered water dependent. Consistent: The proposed development is consistent with the intent of this rule. Paragraph (a)(2)(A) states that the location, design, and need for development, as well as the construction activities involved shall be consistent with the management objective of the Estuarine and Ocean System AEC and shall be sited and designed to avoid significant adverse impacts upon the productivity and biologic integrity of coastal wetlands, shellfish beds, submerged aquatic vegetation as defined by the Marine Fisheries Commission, and spawning and nursery areas. Paragraph (a)(2)(13) states that development shall comply with state and federal water and air quality standards. Consistent: The proposed development is consistent with the intent of this rule. Paragraph (a)(2)(C) states that development shall not cause irreversible damage to documented archaeological or historic resources as identified by the N.C. Department of Cultural Resources. Consistent: The proposed development is consistent with the intent of this rule. Paragraph (a)(2)(D) states that development shall not increase siltation. Consistent: The proposed development is consistent with the intent of this rule. Paragraph (a)(2)(E) states that development shall not create stagnant water bodies. Consistent: The proposed development is consistent with the intent of this rule. Paragraph (a)(2)(F) states that development shall be timed to avoid significant adverse impacts on life cycles of estuarine and ocean resources. Consistent: The proposed development is consistent with the intent of this rule. Paragraph (a)(2)(G) states that development shall not jeopardize the use of the waters for navigation or for other public trust rights in public trust areas including estuarine waters. Consistent: The proposed development is consistent with the intent of this rule. Paragraph (b) addresses Specific Use Standards. Of these, subparagraph (10) Freestanding Moorings, pertains to this project, and those subparagraphs not listed are not applicable to this project. Paragraph (10) Freestanding Moorings Subparagraph (10)(A) defines a "freestanding mooring" as any means to attach a ship, boat, vessel, floating structure or other water craft to a stationary underwater device, mooring buoy, buoyed anchor, or piling (as long as the piling is not associated with an existing or proposed pier, dock, or boathouse). Subparagraph (10)(13) states that Freestanding moorings shall be permitted only: (i) to riparian property owners within their riparian corridors Consistent: The proposed development is consistent with the intent of this rule. Subparagraph (10)(C) states that all mooring fields shall provide an area for access to any mooring(s) and other land -based operations that shall include wastewater pumpout, trash disposal and vehicle parking. Consistent: The proposed development is consistent with the intent of this rule. Gregg Bodnar, Assistant Major Permits Coordinator Sanderling Property Owners Association Major Permit Recommendations March 6, 2019 Page 3 Subparagraph (10)(D) states that to protect water quality of shellfishing areas, mooring fields shall not be located within areas where shellfish harvesting for human consumption is a significant existing use or adjacent to such areas R shellfish harvest closure is anticipated to result from the location of the mooring field. Consistent: The proposed development is not located within a shellfish harvesting area. Subparagraph (10)(E) states that moorings shall not be located without written consent from the leaseholders or owners of submerged lands that have been leased from the state or deeded by the state Consistent: The proposed development is consistent with the intent of this rule. Subparagraph (10)(F) states that moorings shall be located and constructed so as to avoid adverse impacts on navigation throughout all federally maintained channels. This includes mooring sites (permanent or temporary), speed or traffic reductions, or any other device, either physical or regulatory, which may cause a federally maintained channel to be restricted. Consistent: The proposed development is consistent with the intent of this rule. Subparagraph (10)(G) states that open water moorings shall not be enclosed within breakwaters that preclude circulation and degrade water quality in violation of EMC standards. Consistent: The proposed development is consistent with the intent of this rule. Subparagraph (10)(H) states that moorings and the associated land -based operation design shall comply with all applicable EMC requirements for management of stormwater runoff. Consistent: The proposed development is consistent with the intent of this rule. Subparagraph (10)(1) states that Mooring fields shall have posted in view of patrons a notice prohibiting the discharge of any waste from boat toilets or any other discharge and listing the availability of local pump -out services and waste disposal. Not applicable: The proposed development is for seasonal mooring only. Subparagraph (10)(K) states that freestanding mooring buoys and piles shall be evaluated based upon the arc of the swing including the length of the vessel to be moored. Moorings and the attached vessel shall not interfere with the access of any riparian owner nor shall it block riparian access to channels or deep water, which allows riparian access. Freestanding moorings shall not interfere with the ability of any riparian owner to place a pier for access. Consistent: The proposed development is consistent with the intent of this rule. Subparagraph (10)(L) states that freestanding moorings shall not be established in submerged cable/pipe crossing areas or in a manner that interferes with the operations of an access through any bEIVED Consistent: The proposed development is consistent with the intent of this rule. MAR 18 2019 DCM-MHD CITY Gregg Bodnar, Assistant Major Permits Coordinator Sanderling Property Owners Association Major Permit Recommendations March 6, 2019 Page 4 Subparagraph (10)(M) states that freestanding moorings shall be marked or colored in compliance with U.S. Coast Guard and the WRC requirements and the required marking maintained for the life of the mooring(s). Consistent: Subject to permit conditions. Subparagraph (10)(N) states that the type of material used to create a mooring must be free of pollutants and of a design and type of material so as to not present a hazard to navigation or public safety. Consistent: The proposed development is consistent with the intent of this rule. 15A NCAC 07H.0209 Coastal Shorelines (c) Management Objective. The management objective is to ensure that shoreline development is compatible with the dynamic nature of coastal shorelines as well as the values and the management objectives of the estuarine and ocean system. Other objectives are to conserve and manage the important natural features of the estuarine and ocean system so as to safeguard and perpetuate their biological, social, aesthetic, and economic values; to coordinate and establish a management system capable of conserving and utilizing these shorelines so as to maximize their benefits to the estuarine and ocean system and the people of North Carolina. Consistent: The proposed development is consistent with the intent of this rule. (d) Use Standards. Acceptable uses shall be those consistent with the management objectives in Paragraph (c) of this Rule. These uses shall be limited to those types of development activities that will not be detrimental to the public trust rights and the biological and physical functions of the estuarine and ocean system. Every effort shall be made by the permit applicant to avoid, mitigate or reduce adverse impacts of development to estuarine and coastal systems through the planning and design of the development project. In every instance, the particular location, use, and design characteristics shall comply with the general use and specific use standards for coastal shorelines, and where applicable, the general use and specific use standards for coastal wetlands, estuarine waters, and public trust areas described in Rule .0208 of this Section. Development shall be compatible with the following standards: (1) All development projects, proposals, and designs shall preserve and not weaken or eliminate natural barriers to erosion including peat marshland, resistant clay shorelines, and cypress -gum protective fringe areas adjacent to vulnerable shorelines. , Consistent: The proposed development is consistent with the intent of this rule. (2) All development projects, proposals, and designs shall limit the construction of impervious surfaces and areas not allowing natural drainage to only so much as is necessary to adequately service the major purpose or use for which the lot is to be developed. Impervious surfaces shall not exceed 30 percent of the AEC area of the lot, unless the applicant can effectively demonstrate, through innovative design, that the protection provided by the design would be equal to or exceed the protection by the 30 percent limitation. Redevelopment of areas exceeding the 30 percent impervious surface limitation may be permitted if impervious areas are not increased and the applicant designs the project to comply with the intent of the rule to the maximum extent feasible. 41 Gregg Bodnar, Assistant Major Permits Coordinator Sanderling Property Owners Association Major Permit Recommendations March 6, 2019 Page 5 Consistent: The proposed development is consistent with the intent of this rule. (3) All development projects, proposals, and designs shall comply with the following mandatory standards of the North Carolina Sedimentation Pollution Control Act of 1973: (A) All development projects, proposals, and designs shall provide for a buffer zone along the margin of the estuarine water which is sufficient to confine visible siltation within 25 percent of the buffer zone nearest the land disturbing development. Consistent: The proposed development is consistent with the intent of this rule. (B) No development project proposal or design shall permit an angle for graded slopes or fill which is greater than an angle which can be retained by vegetative cover or other erosion -control devices or structures. Consistent: The proposed development is consistent with the intent of this rule. (C) All development projects, proposals, and designs which involve uncovering more than one acre of land shall plant a ground cover sufficient to restrain erosion within 30 working days of completion of the grading; provided that this shall not apply to clearing land for the purpose of forming a reservoir later to be inundated. Consistent: The proposed development is consistent with the intent of this rule. (4) Development shall not have a significant adverse impact on estuarine and ocean resources. At that point the POA reached out to us to dig deeper. We ran the title and are convinced Turnpike deeded the Boat Ramp property to Sanderling POA in Book 618/805 by warranty deed. After that warranty deed to the Sanderling POA, however, a correction deed (quitclaim deed) was put on record from Sanderling Partners to Turnpike in Book 782/i8o to fix a missing signature in a prior deed that dealt with the underlying boat ramp property. In order to fix this once and for all and stop any further confusion in the chain I would propose Turnpike quitclaim to Sanderling POA the property labeled as Tract z on the 782/18o deed. PROJECT SUMMARY: The applicant, proposes to replace an existing elevated wooden boat ramp, remove 7 existing mooring piles and install 4 mooring buoys. Project Setting The site of the proposed development is located at 1578, Duck Road (NC-12), within the Town of buck, Dare County, adjacent to the'Currituck Sound. The property is t148,500 ft2 (±-3.41 acres) in size with elevations that range from t0.5' above normal water level (NWL) along the western shoreline to t5' above. NWL in.the, highground area located to the east. The shoreline is t1000' in length with the western portion of the property along the. Currituck. Sound being predominantly coastal wetlands (t66,000 ft2) consisting of black needlerush (Juncus roemerianus), giant cordgrass (Spardna cynosuroides) and sawgrass (Cladium jamaicense). The coastal wetlands transition.to USACE 404-wetlands before turning to highground area on the eastern side of the property. Man-made features in the highground include a clubhouse with an'outdoor pool and spa, tennis courts'tocated to the south of the clubhouse and a paved parking'lot located to the north of the clubhouse. The property has two piers with platforms that extend from the highground through thewetlands into the'Currituck Sound: The first; pier is located at the clubhouse,pool area and measures t134'x6' (t50' over wetlands) with.a: t24'x20' platform. The second pier is located on the north side of the parking °area and measures t2210'x6' (t55' over°wetlands, t48' over highground) with a 32'x16' platform, There are`7 mooring piles adjacent to this pier, (4 on north side, 3 on south side). On'the north side of the second piers an existing t1 f8'xl4' elevated wooden boat ramp that extends from the highground area into the Currituck Sound with elevations above the substrate that range from t1.5"to t2'.; Coastal wetlands are growing adjacent to the ramp, but the area under the ramp is void of vegetation and the substrate is sandy. The.adjacent property to the north is mostly wetlands with a community docking facility for the Palmers Island Club subdivision. The adjacent property #o the south is similarly developed with a clubhouse, spa and pier for the Sanderting Hotel The waters of the CurrituckZound are classified as SC by the Environmental Management Commission and are not open to shellfish taking. Water depths within the,, project area range from t1' below NWL along the wetland edge to a2.5' below NWL. The bottom substrate is made up of fine sands and there is t3.8 miles of open water to the west of the site. A Submerged 'Aquatic Vegetation (SAV) survey was conducted within the project area that found no rooted SAV near the end of the wooden boat ramp; however, t28' beyond the end of the ramp SAV consisting of eel grass (Zostera marina) was found to be growing in water depths ?2.5 below NWL. Prior CAMA permitting activity on this site includes: - LAMA Major Permit #275-84, issued on 12/20/1984;authorizing the existing second pier described above and the existing wooden elevated boat ramp. - CAMA General Permit #5323A, issued 3/23/1989 authorizing the .existing first pier described above extending from the pool, area. Aiderling Property Owners "Association Field Investigation Report Page 3 Development Proposal The"applicant is proposing a complete replacement of the existing *118'x14' elevated wooden boat" ramp'with a new elevated wooden boat ramp within the existing "footprint at the same elevations'and dimensions. This ramp has been maintained over its life (t34 years) as was required by MP#275.84, but its condition has deteriorated 'to a point that it can no longer be safely used. In addition to the ramp replacement, the applicant proposes to remove 7 existing mooring piles (four with a 12' arc -of -swing, three with a 1.0' arc -of -swing) that are located at the adjacent pier to the south and then'install 4 mooring buoys utilizing screw jack anchors ±24' waterward of the end of the boat ramp. The proposed buoy'.s will be 20' apart with a 20' arc -of -swing and:will be anchored in the non-SAV area at a water depth of z2.5' below NWL. Anticipated Impacts . The replacement of the existing elevated wooden boat ramp :within'the same footprint will not create additional long-term. impacts. The existing ramp shades ±564 ft2 of shallow water bottom,;f836 ft2.of non -vegetated area between NWL and highground area and ±252ft2 of highground. . It is anticipated there will be temporary impacts, such as water turbidity, associated with the removal and rebuilding of the wooden boat ramp. Neither pier has slips. The applicant is requesting the demolition of the existing elevated boat ramp in order to replace it with a new elevated boat ramp in the same location and same dimensions. The existing elevated boat ramp was constructed in 1985 and is now'due for a complete replacement, including pilings and decking. + A site visit on August 30,, 2018 revealed the approximate location of wetlands and Submerged Aquatic Vegetation (SAV) as depicted on the attached plat. This delineation was performed by Environmental Professionals, Inc. The SAV survey was conducted by raking the substrate and identification of species found. The applicant also proposes the installation of four mooring buoys utilizing screw jack anchors and a mooring ball. The location is depicted on the plat. The mooring buoys will be located in an area devoid of SAVs and at a water depth of+/- 2.5 feet. The existing mooring poles will be removed. An initial screening of the submittal package has been conducted as per 15A NCAC 07J.0204. This revealed certain deficiencies, which must be corrected before the application package can be accepted as complete. To assist you in expediting the permitting process as much as possible, I am notifying you of these deficiencies immediately so that they can be quickly corrected to facilitate my detailed review. Because the deficiencies are easily correctable, I am not returning the entire original application package. Please make the needed changes, and submit the appropriate documentation. With the retained copy of the application, I can commence the detailed review. Please understand that the subsequent detailed review may reveal additional areas where further information or documentation is required to demonstrate compliance with the rules directly applicable to the proposed development. If this occurs, you will be notified of such issues separately. Our initial screening has identified the following deficiencies: 1. Not all questions on the application have been answered or indicated as "not applicable." These piles are also arranged in a straight line, not offset as shown. - There are 5 mooring poles shown on the north side of the existing pier; however, currently there are only 4, the one closest to the platform is gone. - All slips/moorings should be identified and numbered. - Arc -of -swing should be shown for all moorings - 30' CAMA Buffer - 75' AEC Line - Label the coastal wetlands as such - There are two dashed lines within the existing wooden boat ramp, identify what these lines are for. ■ A Cross -Section Drawing must be submitted that: - Depicts the longitudinal view of the boat ramp, specifically showing elevations above the wetland/water bottom substrate and NWL. - References elevations to zero at NWL. The Plat must show the entire tract of land to be developed. - The inset project overview picture is not clear, and the property lines are not visible. - The inset project overview picture does not scale to the indicated 1"=100' scale. - Label the adjacent property owners on this as well. 3. Regarding the submitted narrative: • The property has two piers with platforms - include this as existing structures on the property. • Indicate that the pier & platform extending from the pool does not have slips associated with it. ■ The narrative indicates that the ramp was built in 1983; however, the permit for it was not issued until 12/20/1984. Please correct the date in the narrative and elsewhere in the application. ■ Describe in more detail the method used for the SAV survey and results. Please provide this in the amount of $400 if the slip/mooring total count is greater than 10 OR $250 if the slip/mooring total count is 10 or less. 6. If the goal is to stay below a total of 10 slips/moorings, I would suggest removing some of the existing mooring piles if they are not utilized. 7. Included is a copy MP#275-84.Of note is condition 2, which states that the structure shall be properly maintained. I would include this information in the narrative as well as submitting the permit as part of the narrative. To expedite our response to your permitting request, we will commence the detailed review of your application for a permit pending the receipt of the additional information requested above. However, the statutorily provided 75/150 days allowed for review cannot commence until such time as we have received a complete application package. Once your application has been accepted as complete, you will receive a separate notification letter. If it is not possible to render a permit decision within 70 days of the date when your application is received complete, you may request a meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a meeting will be held within five working days from the receipt of your written request and shall include the property owner, developer, and project designer/consultant.
