Pl-P4 all dated 5/16/18. This permit, issued on August 14, 2019 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Docking Facility Expansion 1) This permit authorizes only the docks, platform expansion, boatlifts, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2022 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Page 2 of 2 ADDITIONAL CONDITIONS 3) This permit authorizes an additional 3 formalized boat slips for a maximum of 5 formalized boat slips. 4) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. USACE Conditions 5) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at littp://www.fws.gov/iic-es/maminal/maiiatee auidelines.odf. General 6) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third parry without the written approval of the Division of Coastal Management. 7) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the permitted activity without having it transferred to a third party. 8) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 197800056 (Action ID SAW-2019-01486) issued 8/13/19. NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2019-0836. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 808-2808 prior to the commencement of any such activity for this determination. The permittee is fiirther advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: An application processing fee of $250 was received by DCM for this project. The original (buff -colored form) is retained by you and it must be available on site when the project is inspected for compliance. Please sign both the original and the copy and return the copy to this office in the enclosed envelope. Signing the permit and proceeding means you have waived your right of appeal described below. If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days of this decision on your permit. You should also be aware that another qualified party may submit an objection to the issuance of this permit within twenty (20) days. The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried out in accordance with your application. Modifications, time extensions, and future maintenance requires additional approval. Please read your permit carefully prior to starting work and review all project plans, as approved. If you are having the work done by a contractor, it would be to your benefit to be sure that he fully understands all permit requirements. From time to time, Department personnel will visit the project site. To facilitate this review, we request that you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning permit conditions, environmental safeguards, . or problem areas, you may contact Department personnel at any time for assistance. The applicant proposes to expand an existing docking facility to 5 slips. The property is located at 234 Pondview Drive in Hubert, Onslow County. Areas of Environmental Concern (AEC's) impacted by the proposal are Estuarine Waters Coastal Wetlands and Public Trust Areas. Waters at the project site are classified as SA- ORW and are open to the harvesting of shellfish. The area is a not Primary Nursery Area. I have reviewed this proposal for consistency with the Onslow County Land Use Plan Update and offer the following comments. The general area of the project is classified as Conservation and Community Growth Area. In general, Onslow County allows development in Conservation classified AECs which is consistent with the State's minimum use standards. The Onslow County Land Use Plan contains some policies, which exceed the State's minimum use standards. However, none of these more restrictive policies appear to be applicable to this project. NARRATIVE DESCRIPTION: The William Rogers project is located at V4JPond View Dr. in Hubert adjacent to Bogue Sound and the AIWW. The property is 189.4ac of mostly undeveloped woodland and has 2300' of shoreline. Along the shoreline is a —1000' fringe of Coastal Wetlands predominantly consisting of Smooth Cordgrass (Spartina alterniflora). An earthen peninsula of historic fill extends through the marsh to an existing two slip dock. One of which is a boat house. The Division of Water Resources classifies this area as SA-ORW waters. This is not a Primary Nursery Area. This portion of Bogue Sound is open to harvesting shellfish. There are no SAV's or significant shellfish populations in the area to be disturbed. This area is classified in the Onslow County LUP as Community Growth Area. 10. PROJECT DESCRIPTION: Mr. William Rogers is proposing to add three additional slips and platform area to an existing dock. This will be done by expanding an existing 8'X24'19 platform. The addition would be 8'X15' for a final platform of 8'X39'(312ft2). Three 3'X15' finger piers would also be added. Adjacent to the finger piers would be three 13'X13' boatlifts. Water depths in the area of the slips range from-2.5NLW to -5NLW. There would be a total of 5 slips associated with this docking facility. 11. ANTICIPATED IMPACTS: The proposed docking project would usurp an additional 762ft2 of Public Trust Area and shade 255ftz. Any turbidity resulting from driving of Mooring piles would be temporary.
