Richter, 211 Stratford Rd., Goldsboro, NC 27534 Authorizing development in Carteret County at adi. to Back Sound, at 126 South Ferry Dock Rd., in Harkers Island as requested in the permittee's application dated 5/10/19 (MP- 1) and 6/12/19 (MP-2, MP-5), including attached workplan drawing (1), dated 10/4/19. This permit, issued on October 30, 2019 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Wetland Fill and Culvert 1) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities associated with the development of the above referenced property, including the culvert and approximately 423 ft of section 404 wetland fill, all as expressly and specifically set forth in the attached permit application and workplan drawings. 2) No vegetated wetlands shall be excavated or filled, even temporarily, outside of the approved culvert and fill alignment. 3) The alignment of the authorized fill shall be staked by the permittee and verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other Signed by the authority of the Secretary of DEQ and the Chair qualified persons within twenty (20) days of the issuing date. of the Coastal Resources Commission. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2022 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Richter Permit No. 86-19 Page 2 of 3 ADDITIONAL CONDITIONS 4) The fill material shall be clean and free of any pollutants except in trace quantities. 5) All backfill material shall be obtained from a high ground source. 6) No additional fill, materials or debris shall be stored, even temporarily, within wetlands or within 30 feet of the normal high water line. 7) If the crossing of wetlands with mechanized construction equipment is necessary, temporary construction mats shall be utilized for the areas to be crossed. The temporary mats shall be removed immediately upon completion of construction. Shoreline Stabilization - Bulkhead 8) The bulkhead shall be constructed in accordance with the alignment depicted on the attached workplan drawings. 9) No vegetated wetlands shall be excavated or filled, even temporarily, outside of the approved bulkhead alignment. 10) The alignment of the authorized bulkhead shall be staked by the permittee and verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. 11.) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel. 12) No backfill material is to be placed within 30 feet of the normal high water line. Sedimentation and Erosion Control 13) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. 14) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of any phase, of grading on cut or filled slopes. For the bulkhead, at minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities General 15) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 16) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 1VIicGa'el P. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2013-00757). NOTE: The N.C. Division of Water Resources authorized the project by way of General Water Quality Certification 4175 and assigned the project D WR Project No. 2019-1073. NOTE: Future development of the permittee's property may require a modification of this permit. Greg, The following is a draft of my response to what I understand as the current questions. Greg, I say this is a draft, because if there is any other item I should respond to, or further clarifications of these items, please let me know. I will list the questions, with my response following. 1) What will be the grade of the drainage pipe? - The invert of the pipe will lie along the existing grade so as not to change any waterflow patterns. 2) What is the weight of the vehicles that will be traveling over the area? Weight will be consistent with those associated with a residential driveway. Accordingly the pipe will be installed in accordance with the NCDOT drainage users manual for a private residence. 3) What is the depth of the coverage material over the pipe. Per the NCDOT manual the " Minimum fill height for All types of pipe is 12 inches as measured from the top of the pipe to the top of soil". "Minimum cover requirements are the same for all pipe material types unless used for Commercial Driveways." Pipe will be install accordingly. The maximum cover for PVC or HDPE pipe is 20 feet. The actual depth will be quite a bit less so the maximum depth does not come into consideration. 4) The size of the pipe was questioned. After review, the pipe can be upsized to 15" 5) Pipe material? The pipe used will be of pipe material approved for use for a private residence or residential subdivision driveway culvert. HDPE pipe will come in longer sections than concrete pipe, making a minimal number of joints.. 6) Pipe Bedding? To eliminate any possibility of settling a 12" thick bed of #57 stone will be installed prior to pipe installation. 7) Pricing? I put together the pricing based upon my experience, briefly - Civil Engineering degree from NCSU, 37 years in various roles working for a NC unlimited unclassified ENR top 400 contractor specializing in bridge, utilities, and building work. -last 5 years as President. Over the years have put f 04 together and or reviewed pricing on projects easily exceeding I bill dollars., Currently retired, and hold a NC Unlimited Building Contractor's license. Greg, I will be glad to respond to any other questions that may be out there, or delete one of these items, i.e. number 7 if you feel it is not important. Sorry about that, but congrats to Courtney! I still have questions regarding the cost estimate, the size of the crossing (15X40) and installation method of the pipe itself (the pipe would need to be installed in such a way that the flow and circulation of the wetland would not be impaired). They need to show how the culvert would be stable, and would not be crushed/buried by the fill over time. A rip rap base for the culvert to lay upon prior to backfill would be a way to stabilize. The cost estimate seems pretty generic as I have no idea what kind of bridge was considered for the purpose of backing a trailer with small boats down to the water. There was no cost/square foot and no mention of materials. A simple beam bridge/girder bridge with piers or other small crossing would likely not be very expensive and would avoid filling the wetland and potential hydrologic impacts on the adjacent property. Where/who/what company did the numbers come from? While the applicant has managed to reduce the amount of fill, I am still not convinced that a bridge is not a feasible alternative to the fill. NCDMF has concerns with the project as currently proposed due to the potential for wetland fill activities such as this to negatively impact fisheries habitat by degradation of water quality. While wetlands such as this are not used as a direct fish habitat, the ecological functions they provide are no less important. Wetlands, especially in the riparian corridor, enhance water quality by fixing nutrients in the soil and removing sediment and pollutants. Additionally, wetlands improve shoreline resiliency during storm events by retaining water and slowing runoff. These ecosystem services enhance water quality conditions for juvenile and adult fish. Accordingly the pipe will be installed in accordance with the NCDOT drainage users manual for a private residence. 3. What is the depth of the coverage material over the pipe. Per the NCDOT manual the " Minimum fill height for All types of pipe is 12 inches as measured from the top of the pipe to the top of soil". "Minimum cover requirements are the same for all pipe material types unless used for Commercial Driveways." Pipe will be install accordingly. The maximum cover for PVC or HDPE pipe is 20 feet. The actual depth will be quite a bit less so the maximum depth does not come into consideration. 4. The size of the pipe was questioned. After review, the pipe can be upsized to 15" 5. Pipe material? The pipe used will be of pipe material approved for use for a private residence or residential subdivision driveway culvert. HDPE pipe will come in longer sections than concrete pipe, making a minimal number of joints.. 6. Pipe Bedding? To eliminate any possibility of settling a 12" thick bed of #57 stone will be installed prior to,pipe installation. 7. Pricing? Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit application with regard to impacts on fish and wildlife resources. The project site is located at 126 S. Ferry Dock Road, Harkers Island, NC. Our comments are provided in accordance with provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.). The applicant proposes to fill 609 ft2 of Section 404 wetlands to level the yard to better access the shoreline. Coastal wetlands in the would not be directly impacted but are adjacent to the fill. A 103' retaining wall will be constructed to prevent material from being deposited on neighboring property. A 1' by 28' culvert would be installed to allow hydrologic connectivity. Back Sound in this location is classified SA ORW by the Environmental Management Commission and is open to shellfish harvesting. The NCWRC has reviewed the permit application and has concern with the wetland fill, including direct and indirect impacts. Wetlands provide important habitat opportunities for numerous wildlife species as well as serve as an important filtration system for stormwater runoff. In addition to the loss of habitat function, the fill of wetlands or installation of inadequately sized culverts can lead to culvert failure or the backing up of flood waters. Due to these reasons and importance of wetlands, the NCWRC does not support the fill of wetlands without a purpose and need that demonstrates avoidance and minimization of wetland impacts. We understand that for some water dependent structures, access, utilities setback, or construction, wetland impacts may be necessary and can be allowed after demonstration of avoidance and minimization. Those parameters do not appear to be demonstrated within this permit application. Greg, I say this is a draft, because if there is any other item I should respond to, or further clarifications of these items, please let me know. I will list the questions, with my response following. 1. What will be the grade of the drainage pipe? - The invert of the pipe will lie along the existing grade so as not to change any waterflow patterns. 2. What is the weight of the vehicles that will be traveling over the area? Weight will be consistent with those associated with a residential driveway. Accordingly the pipe will be installed in accordance with the NCDOT drainage users manual for a private residence. 3. What is the depth of the coverage material over the pipe. Per the NCDOT manual the " Minimum fill height for All types of pipe is 12 inches as measured from the top of the pipe to the top of soil". "Minimum cover requirements are the same for all pipe material types unless used for Commercial Driveways." Pipe will be install accordingly. The maximum cover for PVC or HDPE pipe is 20 feet. The actual depth will be quite a bit less so the maximum depth does not come into consideration. 4. The size of the pipe was questioned. After review, the pipe can be upsized to 15" S. Pipe material? The pipe used will be of pipe material approved for use for a private residence or residential subdivision driveway culvert. HDPE pipe will come in longer sections than concrete pipe, making a minimal number of joints.. 6. Pipe Bedding? To eliminate any possibility of settling a 12" thick bed of #57 stone will be installed prior to pipe installation. 7. Pricing? I put together the pricing based upon my experience, briefly - Civil Engineering degree from NCSU, 37 years in various roles working for a NC unlimited unclassified ENR top 400 contractor specializing in bridge, utilities, and building work. -last 5 years as President. Over the years have put together and or reviewed pricing on projects easily exceeding 1 bill dollars., Currently retired, and hold a NC Unlimited Building Contractor's license. Excessive silt and sediment loads can have numerous detrimental effects on aquatic resources including destruction of spawning habitat, suffocation of eggs, and clogging of gills of aquatic species. An alternate to the fill would be retaining/sea walls, fill, and a vehicular bridge which is cost prohibitive. I am in the area the rest of today and tomorrow, and will be glad to meet with you and/or the local official to discuss. This was to avoid impact to the coastal wetland area and keep the flow path on the west property line intact. The applicant will also need to provide a cross-section showing the culvert. A 10" PVC pipe is likely not sturdy enough to withstand compaction over years of driving across with a truck and trailer. The pipe will need to be upsized in diameter and of a sturdy material, or install multiple sturdy pipes in order to maintain flow from the adjacent wetland. Additionally, a 15-foot wide crossing is excessive when most driveways are no larger than 10-12 feet. The applicant will need to reduce the width of the crossing -this goes to the avoidance and minimization point. NARRATIVE DESCRIPTION: The Michael Richter project is located at 126 S. Ferry Dock Rd. on Harkers Island adjacent Back Sound. This property is 18,099ft2in its entirety and has an existing single family home. The shoreline is 70' in length and consists of a white sand estuarine beach. Situated between the house and beach is a depression area that contains Coastal and ACOE jurisdictional wetlands as marked by Tom Charles. An existing 6' wide bridge crosses this depression providing access to the shoreline. All existing high ground development was permitted by Carteret County Local Permitting. Water depths offshore of the beach are —2' at NLW. Patches of SAV exist in this area. The Division of Water Resources classifies this area of Back Sound as SA-ORW waters. This is not a Primary Nursery Area. This portion of Back Sound is open to harvesting shellfish. The parcel is classified in the Carteret Co. LUP as Limited Transition. 10. PROJECT DESCRIPTION: Michael Richter is proposing to create an earthen access to the shoreline by placing 609ftz(15'X40') of fill material in ACOE jurisdictional wetlands. The fill would be —2' deep. A silt fence would be placed along the North boundary of the fill area until area is stabilized. A 103' bulkhead would be placed along the south boundary of the fill area to prevent fill material from being deposited on neighboring property. A 1'X28' culvert would be placed beneath fill area to provide drainage. On high ground, 2,000ftz would be graded for landscaping. 11. ANTICIPATED IMPACTS: This project would result in the filling of 609ft2 of ACOE jurisdictional wetlands. The finished grade in the fill area would be at the same level or higher than adjacent natural grade. This could alter the local drainage patterns and could result in water level changes. Earthen fill and sediment deposition from this fill project could impact adjacent coastal wetlands without proper sedimentation barriers. There could be impacts to the adjacent coastal wetland substrate during the mechanized filling and grading process.
