and Natural Resources and the Coastal Resources Commission for development
in an area of environment concern pursuant to Section 113A-118 of the
General Statutes, "Coastal Area Management"
Issued to McMullan Ventures, LLC, authorizing development in the Estuarine Shoreline (AEC), located at 4924
Main Street, adjacent to the Shallotte River. in Shallotte, in Brunswick County, as requested in the permittee's
application, dated received August 5. 2009 and complete on September 11, 2009. This permit, issued on
April 1. 2015. is subject to compliance with the application and site drawing (where consistent with the
permit), all applicable regulations and special conditions and notes set forth below. Any violation of these
terms may subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and
void.
This permit authorizes the addition of an open, uncovered, elevated, slatted, drip thru, wooden deck
(approximately 1,225 sq. ft.) to an existing building.
(1) All proposed development and associated construction must be done in accordance with the permitted
work plat drawings(s) dated received on September 9, 2009 and received September 11, 2009.
(2) No increase in the amount of existing impervious surface area within 75 feet of (normal high water)
(Estuarine Shoreline Area of Environmental Concern) is authorized.
(3) The proposed development qualifies for the Urban Waterfront requirements and use standards of
15A NCAC 07H .0209(g).
(4) All construction must conform to the N.C. Building Code requirements and all other local, State and
Federal regulations, applicable local ordinances and FEMA Flood Regulations.
(5) Any change or changes in the plans for development, construction, or land use activities will require a
re-evaluation and modification of this permit.
(6) A copy of this permit shall be posted or available on site. Contact this office at (910) 796-7215 for a
final inspection at completion of work.

officer when the project is inspected for compliance.

this permit, require further written permit approval,

In issuing this permit it is agreed that this project is consistent with
the local Land Use Plan and all applicable ordinances.

(7) This permit does not authorize development within any wetlands or open water areas.
(8) Unless specifically allowed in 15A NCAC 07H. 0209(d)(10), and shown on the permitted plan drawing,
all developmentJconstruction shall be located a distance of 30 feet landward of Normal High Water.
(9) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by
effective sedimentation and erosion control measures. Prior to any land -disturbing activities, a barrier line of
filter cloth must be installed between the land disturbing activity and the adjacent marsh or water areas, until
such time as the area has been properly stabilized with a vegetative cover.
(10) Prior to any development, silt fence shall be properly installed between all planned land disturbance and the
adjacent marsh and open water areas; the silt fence shall be properly maintained throughout the construction
period. Silt fence shall be installed such that it is properly toed -in to the soil.
(11) All other disturbed areas shall be vegetatively stabilized (planted and mulched) within 14 days of construction
completion.

I acknowledge that the land owner is aware that the proposed development is planned for an area which may be
susceptible to erosion and/or flooding. I acknowledge that the local permit officer has explained to me the particular
hazard problems associated with this lot. This explanation was accompanied by recommendations concerning stabilizatic
and floodproofing techniques.

Due to economic conditions, the applicant, McMullan Ventures, LLC, has not yet
begun the permitted work. However, it is the intent of the applicant to complete the work
within the next 2 year. There has been no change to the plans or ownership of the

This letter is in reference to your request to extend Permit No. 2009-02, which was originally issued on September 11
2009. As you may be aware Session Law 2009-406, entitled "An Act to Extend Certain Government Approvals Affectir
the Development of Real Property Within the State", was enacted by the General Assembly and signed into law It
Governor Perdue on August 5, 2009. The purpose of this Act was to prevent of the abandonment of approved projec
and activities due to the unfavorable economic conditions by adding additional time to certain permits. This Act wi
extended an additional year under Session Law 2010-177, signed into law by Governor Perdue on August 2, 2011
Therefore, in accordance with this Act, you are hereby informed that the current expiration date for Permit No. 2009-C
is now officially extended until April 16, 2015.
You should attach this letter to the original of Permit No. 2009-02, as well as all subsequent modifications and renewal
and copies of all documents shall be readily available on site when a Local Permit Officer monitors the project fc
compliance. Should you need additional time to complete your development after the extended expiration date, plea!
contact me to request a permit renewal (15A NCAC 07J.0404). You are also advised that this action does not eliminal
the need to obtain any additional state or federal permits, approvals or authorizations that may be required. Should yc

LAMA permit to construct a resi-
dential dwelling off Pender Ave., ad-
jacent to Stump Sound, and on Au-
gust'13, 2009 Thomas Hilker ap-
plied for a CAMA permit to add ad-
ditional square footage to existing
deck at 2805 S. Shore Dr., adjacent
to the Atlantic Ocean. Both pro-
jects are located in Surf City, Pender
Counttyy. On August 5, 2009 McMul-
lan Ventures, LLC applied for a
CAMA permit to construct a deck at
4924 Main St., adjacent to the Shal-
lotte River, in Shallotte,`erunswick
County: The application may be in-
spected at the address below. Pub-
lic comments received by, Septem-
ber 1, 2009 will be considered.
Later comments' will be accepted
and considered up to the time of
permit decision. Project modifica-
tions may occur based on further
review and comments. Notice of,
the permit decision in this matter
will be provided .upon written re-
quest.
