(1) All proposed development and associated construction must be done in accordance with the permitted work plat drawings(s) dated received on September 9, 2009 and received September 11, 2009. (2) No increase in the amount of existing impervious surface area within 75 feet of (normal high water) (Estuarine Shoreline Area of Environmental Concern) is authorized. (3) The proposed development qualifies for the Urban Waterfront requirements and use standards of 15A NCAC 07H .0209(g). (4) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal regulations, applicable local ordinances and FEMA Flood Regulations. (5) Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and modification of this permit. (6) A copy of this permit shall be posted or available on site. As you may be aware Session Law 2009-406, entitled "An Act to Extend Certain Government Approvals Affectir the Development of Real Property Within the State", was enacted by the General Assembly and signed into law It Governor Perdue on August 5, 2009. The purpose of this Act was to prevent of the abandonment of approved projec and activities due to the unfavorable economic conditions by adding additional time to certain permits. This Act wi extended an additional year under Session Law 2010-177, signed into law by Governor Perdue on August 2, 2011 Therefore, in accordance with this Act, you are hereby informed that the current expiration date for Permit No. 2009-C is now officially extended until April 16, 2015. You should attach this letter to the original of Permit No. 2009-02, as well as all subsequent modifications and renewal and copies of all documents shall be readily available on site when a Local Permit Officer monitors the project fc compliance.
