in an area of environment concern pursuant to Section 113A-118 of the
General Statutes, "Coastal Area Management"

attached Settlement Agreement, authorizing development in the Ocean Hazard (AEC) at 518 N. Fort Fisher Blvd in Kure Beach,
New Hanover County, as requested in the permittee's application, dated March 10, 2021 and drawings (2), dated revised on March
9, 2021 and received on March 12, 2021. This permit, issued on March 16, 2021, is subject to compliance with the application and
site drawings (where consistent with the permit), all applicable regulations and special conditions and notes set forth below. Any
violation of these terms may subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void.
This permit authorizes: The construction of a pool with associated concrete decking and fence, new wooden decking and a new
beach accessway.
(1) All proposed development and associated construction must be done in accordance with the permitted work plat drawing
dated received on March 12, 2021. As provided in 15A NCAC 07J .0403, the CAMA Minor Permit issued in conformanc
with this Settlement Agreement shall expire on December 31 of the third year following the year the permit was issued.
(2) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal regulation:
applicable local ordinances and FEMA Flood Regulations.
(3) Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation an
modification of this permit.
(4) A copy of this permit shall be posted or available on site. Contact this office at (910) 796-7215 for a final inspection
completion of work.

This permit must be on the project site and accessible to the permit officer when
the project is inspected for compliance. Any maintenance work or project
modification not covered under this permit, require further written permit
approval. All work must cease when this permit expires on:
December 31, 2024
In issuing this permit it is agreed that this project is consistent with the local Land
Use Plan and all applicable ordinances. This permit may not be transferred to
another party without the written approval of the Division of Coastal
Management.

(5) Any structure constructed within the ocean hazard area shall comply with the NC Building Code, including the
Coastal and Flood Plain Construction Standards of the N. C. Building Code, and the Local Flood Damage
Prevention Ordinance as required by the National Flood Insurance Program. If any provisions of the building code
or a flood damage prevention ordinance are inconsistent with any of the following AEC standards, the more
restrictive provision shall control.
(6) The oceanfront setback measured from the First Line of Stable Natural Vegetation ("FLSNV") staked by the Town's
LPO on March 8, 2021 and depicted on the March 9, 2021 survey is valid for sixty days. If construction has not
begun within sixty days after March 10, 2021, or there is a major shoreline change, when Petitioners are ready to
begin construction, they shall arrange a meeting with the Town's LPO at the Site to determine the 60 ft. setback
from the FLSNV.
(7) If the permit expires without construction of a pool, Petitioners must submit a new application and the evaluation of
the proposed development shall be based on the existing site conditions and the Commission's existing regulations
at that time.
(8) All pilings shall have a tip penetration greater than eight feet below the lowest ground elevation under the structure.
(9) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective
sedimentation and erosion control measures. Disturbed areas shall be vegetatatively stabilized (planted and
mulched) within 14 days of construction completion.
(10) Any structure authorized by this permit shall be relocated or dismantled when it becomes imminently threatened by
changes in shoreline configuration. The structure(s) shall be relocated or dismantled within two years of the time
when it becomes imminently threatened, and in any case upon its collapse or subsidence. However, if natural
shoreline recovery or beach renourishment takes place within two years of the time the structure becomes
imminently threatened, so that the structure is no longer imminently threatened, then it need not be relocated or
dismantled at that time. This condition shall not affect the permit holder's right to seek authorization of temporary
protective measures allowed under CRC rules.
(11) Pursuant to 15A NCAC, Subchapter 7J.0406(b), this permit may not be assigned, transferred, sold or otherwise
disposed of to a third -party.
(12) Dune disturbances will be allowed only to the extent necessary for development and if the dune's protective value is
not weakened or reduced. Disturbed dune areas will be immediately stabilized. Dune disturbances and land
disturbing activity shall be restricted to the applicant's property and no work is authorized outside of the lateral
bounds of the applicant's property
(13) Pursuant to 15A NCAC Subchapter 7H .0308(c) the accessway over the dunes must not exceed six feet in width
and shall provide only pedestrian access to the ocean beach. The accessway must be constructed so as to make
negligible alterations to the frontal dunes. That portion of the accessway crossing the frontal dune must be
constructed on raised posts or pilings of five feet or less in depth, so that wherever possible only the posts or pilings
touch the frontal dunes without any alteration to the dunes. In no case shall the dune be altered so as to
significantly diminish its capacity as a protective barrier against flooding and erosion.
(14) Any future maintenance or repair, or modification to the proposed development will require additional written permit
approval based on existing site conditions and requlations.

This notice is intended to make you, the applicant, aware of the
special risks and conditions associated with development in this
area, which is subject to natural hazards such as storms, erosion
and currents. The rules of the Coastal Resources Commission
require that you receive an AEC Hazard Notice and acknowledge
that notice in writing before a permit for development can be
issued.
The Commission's rules on building standards, oceanfront
setbacks and dune alterations are designed to minimize, but not
eliminate, property loss from hazards. By granting permits, the
Coastal Resources Commission does not guarantee the safety of
the development and assumes no liability for future damage to the
development. Permits issued in the Ocean Hazard Area of
Environmental Concern include the condition that structures be
relocated or dismantled if they become imminently threatened by
changes in shoreline configuration. The structure(s) must be
relocated or dismantled within two (2) years of becoming
imminently threatened, and in any case upon its collapse or
subsidence.
The best available information, as accepted by the Coastal
Resources Commission, indicates that the annual long-term
average ocea erosion rate for the area where your property is
located is feet per year.
The rate was established by careful analysis of aerial photographs
of the coastline taken over the past 50 years.
Studies also indicate that the shoreline could move as much as
feet landward in a major storm.

Preferred oceanfront protection measures are beach nourishment
and relocation of threatened structures. Hard erosion control
structures such as bulkheads, seawalls, revetments, groins, jetties

SPECIAL NOTE: This hazard notice is required

erosion. Permits issued for development in this area expire
December 31 of the third year following the year in which
permit was issued. Shortly before work begins on the project
the Local Permit Officer must be contacted to determine

SETTLEMENT AGREEMENT
Petitioners James P. Kastberg, Individually and as Trustee of the James P.
Kastberg Revocable Living Trust Dated 12.13.2007 and Joanne M. Kastberg,
Individually and as Trustee of the Joanne M. Kastberg Revocable Living Trust
Dated 12.13.2007 ("Petitioners") and Respondent North Carolina Department of
Environmental Quality, Division of Coastal Management ("DCM") (collectively "the
Parties") hereby enter into this Settlement Agreement ("Agreement") in order to
resolve matters in controversy between them.
This matter arose out of the denial of Petitioners' application for minor permit
to construct a swimming pool at 518 Fort Fisher Boulevard North by the Town of Kure
Beach's Local Permit Officer ("LPO") pursuant to the Coastal Area Management Act of
1974 ("LAMA") and the implementing rules adopted by the North Carolina Coastal
Resources Commission ("Commission"). Petitioners challenged the decision to deny the
permit application and filed a Petition for a Contested Case Hearing in the Office of
Administrative Hearings, No. 20 EHR 03105 (the "Petition")
AGREEMENT
NOW THEREFORE, in consideration of the mutual promises described in this Agreement,
the Parties agree as follows:
The Parties agree that they will use their best efforts to effectuate this Settlement.
In order to reach this outcome, the following actions must occur:
a. Petitioners shall submit a completed application for proposed development
consistent with the pool and deck design shown on the survey by Port City Land
Surveying PLLC revised March 9, 2021 (attached) to the DCM including the items
listed in 15A NCAC 07J .0204(b). Petitioners are required to show that they have
provided the adjacent riparian property owners with actual notice of the proposed
development and to complete the AEC Hazard Notice. Respondent agrees to waive
the $100 fee for a minor permit application.
b. The Commission "has delegated to the Director [of the Division of Coastal
Management] the authority to enter into settlements of appeals concerning CAMA
permits ... prior to the time the administrative law judge opens the hearing on the
permit appeal." 15A NCAC 07J .0312. Respondent agrees that as long as the
application is consistent with the March 9, 2021 survey and is not inconsistent with
any of the Commission's rules other than the Commission's current interpretation
of 15A NCAC 07H .0306(a) and .0309, the Director will use his best efforts to
expeditiously review and issue the requested CAMA Minor Permit as contemplated
by this Agreement to resolve the disputed issues in this case. If Petitioners include
a form signed by the adjacent riparian property owners stating they have no
objection to the proposed development, Respondent will expedite its review and
issue the CAMA Minor Permit within five days. If Petitioners do not submit a
signed adjacent riparian property owner form showing no objection to the proposed
development, DCM's review of the completed application may take approximately

two weeks from the date that the completed application is received. A review period
of 25 days is provided by law and DCM may, under exceptional circumstances,
extend the review period for an additional 25-day period if such time is necessary
to complete the review of the proposed project, but regardless DCM will issue the
CAMA Minor Permit upon completion of review.
c. Following issuance of the CAMA Minor Permit, Petitioners will submit an
application for a building permit to the Town for the proposed development. The
Parties agree that the Town's Building Inspector has reviewed the attached March
9, 2021 survey and has indicated in a written memo dated March 9, 2021 that the
proposed development does not encroach on the Town's easement. The Town's
building inspector has also reviewed the proposed development and determined that
it complies with the Town's requirements. Once the CAMA Minor Permit is issued,
the Parties understand that Petitioners will submit an application to the Town for
the proposed development and the Town will be able to expeditiously review,
process, and issue the requested building permit as long as it is consistent with the
March 9, 2021 survey.
d. If this Settlement Agreement is not signed before close of business on March 10,
2021, Petitioners may either submit a dismissal without prejudice or proceed to
hearing on Respondent's Motion for Summary Judgment. If a dismissal without
prejudice is filed, this will allow time for Petitioners to submit their permit
applications and for DCM and the Town to review and process the requests for
permits. Once the CAMA Minor Permit and the Town's building permit have been
issued, Petitioners will dismiss their Petition filed in 20 EHR 03105 with prejudice.
e. If for some reason not anticipated by the Parties, DCM and the Town are unable to
issue the requested permits within 60 days of the date the a completed application
for a CAMA minor permit is received, the Agreement shall be null and void and
Petitioners may refile their Petition to the extent allowed by the North Carolina
Rules of Civil Procedure.
f. The Parties agree that Petitioners will dismiss the Petition with prejudice once
DCM issues the CAMA Minor Permit and the Town issues its building permit
authorizing construction of a pool as depicted in the attached survey by Port City
Surveying PLLC revised March 9, 2021.
g. As provided in 15A NCAC 07J .0403, the CAMA Minor Permit issued in
conformance with this Settlement Agreement shall expire on December 31 of the
third year following the year the permit was issued. Furthermore, the oceanfront
setback measured from the First Line of Stable Natural Vegetation ("FLSNV")
staked by the Town's LPO on March 8, 2021 and depicted on the March 9, 2021
survey is valid for sixty days. If construction has not begun within sixty days after
March 10, 2021, or there is a major shoreline change, when Petitioners are ready to
begin construction, they shall arrange a meeting with the Town's LPO at the Site
to determine the sixty foot setback from the FLSNV. If the permit expires without

construction of a pool, Petitioners must submit a new application and the evaluation
of the proposed development shall be based on the existing site conditions and the
Commission's existing regulations at that time. Any future maintenance or repair,
or modification to the proposed development will require additional written permit
approval based on existing site conditions and regulations.
h. In issuing the CAMA minor permit, the Parties agree the proposed development is
consistent with the CAMA land use plan and all applicable Town ordinances. Once
the CAMA minor permit is issued, it cannot be transferred to any other party
without the written approval of Respondent the Division of Coastal Management.
2. The Parties agree that this Agreement pertains to a disputed claim and is the result
of compromise. As such, it does not constitute and shall not be deemed an admission of liability
by any of the Parties. The terms of this agreement and offers made in settlement are protected by
Rule 408 of the North Carolina Rules of Evidence.
3. The Parties agree that the Petitioners may file this Agreement in the New Hanover
Registry to document the basis for issuing the CAMA Minor Permit contemplated by this
Agreement as a resolution of this disputed claim. However, the Parties agree that this Settlement
Agreement does not authorize any future permit and any future permit applications for proposed
development. Any future development will be evaluated based on existing site conditions and
regulations.
4. The Parties agree that this Agreement contains the entire agreement and
understanding between the Parties concerning the subject matter of this Agreement. Each Party
agrees that they have read this entire document and understand the Agreement. Each Party
acknowledges that this Agreement is being signed freely by each of the Parties without fraud,
duress, or undue influence. Each of the terms of this Agreement are contractual, not a mere recital,
and are the result of negotiations among the Parties.
5. The Parties agree that each had ample opportunity to review the Agreement and
consult with an attorney of their choice during the negotiation and drafting of this Agreement. The

Parties agree that any rule of construction of contracts resolving any ambiguities against the
drafting party shall not apply to this Agreement.
6. This Agreement is made and entered into in the State of North Carolina and it shall
in all respects be interpreted, enforced, and governed under the laws of this State.
7. The Parties, without further consideration, shall execute and deliver such other
documents and take such other action as may be necessary to effectively consummate the subject
matter of this Agreement.
8. The Parties agree that they release, discharge, and promise not to sue each other,
and in the case of DCM and DEQ, its respective decision makers, and employees, on account of
any claim or cause of action in law or in equity related to the CAMA Minor Permit.
9. All Parties agree that they each shall bear their own fees and costs.
10. This Agreement may be executed in counterparts with the same force and effect as
if executed in one complete document. Electronic or digital signatures are acceptable.

12. This Agreement may be modified only by a writing signed by all the Parties and
the Town.
