This permit, issued on 05/06/15, is subject to compliance with the application and site drawing (where consistent with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. This permit authorizes: the installation of a drainage pipe to convey excess storm water from the existing storm water pond to the existing bulkhead. (1) All proposed development and associated construction must be done in accordance with the permitted work plat drawings(s) dated received on 05/05/15. (2) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal regulations, applicable local ordinances and FEMA Flood Regulations. (3) Any change or changes in the plans for development, construction, or land use activities will require a re- evaluation and modification of this permit. (4) A copy of this permit shall be posted or available on site. Contact this office at 910-796-7215 for a final inspection at completion of work. (Additional Permit Conditions on Page 2) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. Any maintenance work or project modification not covered under this permit, require further written permit approval. All work must cease when this permit expires on: DECEMBER 31, 2018 In issuing this permit it is agreed that this project is consistent with the local Land Use Plan and all applicable ordinances. (6) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective sedimentation and erosion control measures. Prior to any land -disturbing activities, a barrier line of filter cloth must be installed between the land disturbing activity and the adjacent marsh or water areas, until such time as the area has been properly stabilized with a vegetative cover. (7) Any proposal for grading within the 30' buffer from the Normal High Water must be contoured to prevent additional stormwater runoff to the adjacent marsh. This area shall be immediately vegetatively stabilized, and must remain in a vegetated state. (8) All other disturbed areas shall be vegetatively stabilized (planted and mulched) within 14 days of construction completion. (9) In order to protect water quality, runoff from the construction must not visibly increase the amount of suspended sediments in adjacent waters. (10) The proposed development shall not result in any fill or scouring of the adjacent coastal wetlands. On subsequent review, I have discovered that additional information is needed to complete the review process. Accordingly, I am requesting that you submit the following additional information to this office: 1. Please provide clarification on the proposed location of the discharge pipe. It appears, based on the submitted drawing, that the proposed pipe will discharge storm water directly into coastal wetlands. This proposed discharge has the potential to alter the wetlands and substrate. This type of development could be found to be inconsistent with the Rules of the CRC found in 07H.0205(e)(1) the Use Standards for Coastal Wetlands and with the Rules found in 07H.0207(d) the Use Standards for Public Trust Areas. This proposed discharge may also trigger the need for additional State and Federal authorization. It is therefore recommended that the proposed discharge pipe be moved to avoid impacts to the adjacent Coastal Wetlands. In accordance with the Department of Environment and Natural Resources regulations, we note that a certain time has passed while the application has remained in our office. Upon resubmission of a complete application, a local decision will be made in 3 days, provided this period is not extended as provided by law. The proposed construction consists of underground piping for discharge from existing ponds during extreme stormwater level conditions that would otherwise adversely affect nearby roadways and structures. This piping is routed through common areas of Starboard by the Sea for ultimate discharge into the Spring Branch area, adjacent to the Atlantic Intracoastal Waterway. It is important to note that these drainage systems are not intended to maintain certain elevations within the ponds, or to pass routine flow. Elevations were set to allow for discharge only during significant storm events that would cause adverse flooding over roadways and/or onto residential structures.
