and Natural Resources and the Coastal Resources Commission for development
in an area of environment concern pursuant to Section 113A-118 of the
General Statutes, "Coastal Area Management"
Issued to the Town of Ocean Isle Beach, authorizing development in the Estuarine Shoreline (AEC) located within ai
easement between 28 and 30 Scotland Street, in the Town of Ocean Isle Beach, Brunswick County, as requested in thi
permittee's application, dated 08/05/13. This permit, issued on 08/20/13, is subject to compliance with the applicatiol
and site drawing (where consistent with the permit), all applicable regulations and special conditions and notes set fortl
below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or may cause thi
permit to be null and void.
This permit authorizes: the installation of a catch basin and drainage pipe to convey storm water from the road to the existing
bulkhead.
(1) All proposed development and associated construction must be done in accordance with the permitted work plz
drawings(s) dated received on 08/05/13.
(2) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal regulation;
applicable local ordinances and FEMA Flood Regulations.
(3) Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation an
modification of this permit.
(4) A copy of this permit shall be posted or available on site. Contact this office at 910-796-7215 for a final inspection

This permit action may be appealed by the permittee or other qualified persons
within twenty (20) days of the issuing date. From the date of an appeal, any
work conducted under this permit must cease until the appeal is resolved. This
permit must be on the project site and accessible to the permit officer when the
project is inspected for compliance. Any maintenance work or project
modification not covered under this permit, require further written permit
approval. All work must cease when this permit expires on:

In issuing this permit it is agreed that this project is consistent with the local Land
Use Plan and all applicable ordinances. This permit may not be transferred to

(5) Unless specifically allowed in 15A NCAC 07H. 0209(d)(10), and shown on the permitted plan drawing, all
development/construction shall be located a distance of 30 feet landward of Normal High Water.
(6) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective
sedimentation and erosion control measures. Prior to any land -disturbing activities, a barrier line of filter cloth must
be installed between the land disturbing activity and the adjacent marsh or water areas, until such time as the area
has been properly stabilized with a vegetative cover.
(7) Any proposal for grading within the 30' buffer from the Normal High Water must be contoured to prevent additional
stormwater runoff to the adjacent marsh. This area shall be immediately vegetatively stabilized, and must remain in
a vegetated state.
(8) All other disturbed areas shall be vegetatively stabilized (planted and mulched) within 14 days of construction
completion.
(9) In order to protect water quality, runoff from the construction must not visibly increase the amount of suspended
sediments in adjacent waters.

CAMA MINOR PERMIT NOTICE
Pursuant to NCGS 113A-119(b), the North Carolina Division of Coastal Management, al
agency authorized to issue CAMA permits in areas of environmental concern, hereby gives NOTICE
that on August 6, 2013, the Town of Ocean Isle Beach proposed to install a catch basin and drainag,
pipe near 30 Scotland St., adjacent to a canal off of the AIWW, in Ocean Isle Beach, Brunswic,
County. Public comments received by August 27, 2013 will be considered. Later comments will bE
accepted and considered up to the time of permit decision. Project modifications may occur based or
further review and comments. Notice of the permit decision in this matter will be provided upor

THIS EASEMENT, made and entered into this 4th day of June, 2013, by and between
Michael John Miller and Mary Smith Miller, hereinafter called "Grantor", and the Town of
Ocean Isle Beach, a municipal corporation, hereinafter called "Grantee";
WITNESSETH:
THAT WHEREAS, Grantor owns a certain tract of land conveyed to Grantor by deed
recorded in Book 3244 at Page 0071 of the Brunswick County Registry, more particularly
described as Lot 48, Canal 11, Section A & B, of Ocean Isle Beach according to Map Book 11 at
Page 25 of the Brunswick County Registry; and
WHEREAS, it will benefit both Grantor and Grantee for Grantor to convey to Grantee a
perpetual easement across a portion of the lands of Grantor in order for Grantee to be able to
install, repair and maintain pipes for stormwater outfall;
NOW, THEREFORE, Grantor, for valuable consideration, the receipt of which is hereby
acknowledged, does hereby give, grant and convey unto Grantee and its successors and assigns,
a non-exclusive perpetual right and easement to excavate, lay, place, install and maintain pipes
for stormwater outfall under, across and upon the lands hereinafter described, together with the
right to run said pipe through Grantee's bulkhead and the right to go upon said land whenever
the same is reasonably necessary or convenient for the purpose of inspecting, maintaining ,
repairing and replacing said pipe, together with the right to remove pampas grass and stabilize
said area with filter cloth, fill material and grass, said property being described as follows:
Begin at a point on the southwestern corner of Lot 48, Canal 11, as it intersects with
Scotland Street, thence with and along the southern property line of said lot, in an eastern
direction to the southeastern corner of Lot 48, or to the bulkhead, whichever is further,
thence with and along the eastern property line of Lot 48 for a distance of seven feet,

said property is free and clear of encumbrances and that Grantor will warrant and defend the
same against the lawful claims of all persons.
