This permit, issued on October 30, 2019 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may to rules, imprisonment or civil action; or may cause me permit to be null and void. Bulkhead 1) The bulkhead shall be constructed in accordance with the alignment depicted on the attached workplan drawings. 2)- The alignment of the authorized bulkhead shall be staked by the permittee and verified by the Division of Coastal Management within a maximum of 30 days prior to the start of construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the alignment to be re -staked by the permittee within a maximum of 30 days prior to the new expected start of construction. 3) No backfill material shall be placed within 30 feet of the normal high water line, except that which will be used to backfill the area behind the permitted bulkhead. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other Signed by the authority of the Secretary of DEQ and the Cha qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2022 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. of the Coastal Resources Commission. Signature of Permittee Robert Reif Permit No. 84-19 Page 2 of 2 ADDITIONAL CONDITIONS 3) The temporary placement or double handling of fill materials within waters or vegetated wetlands is not authorized. 4) The bulkhead shall be constructed prior to any backfilling activities. 5) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 6) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel. 7) All backfill material shall be clean and free of any pollutants except in trace quantities. Sedimentation and Erosion Control 8) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 9) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. General 10) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 11) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 12) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers assigned Action ID No. SAW-2019-01813. The N.C. Division of Water Resources assigned DWR Project No. 2019-1235. It is recommended that any permit issued should include the following conditions: 1. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work 2. The authorized structure and associated activity must not cause an unacceptable interference with navigation and shall not exceed the established pierhead line. 3. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities. 4. In order to protect water quality, runoff from the construction must not visibly increase the amount of suspended sediments in adjacent waters. 0 S. This permit does not authorize the interference with any existing or proposed Federal project, and, the permittee will not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 6. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the project without having the permit transferred to a third - party. This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorization which may be required. PROJECT DESCRIPTION: The project site is located at 709 Hughes Road, adjacent to Mill Creek and the AIW W, in Hampstead, Pender County. To find the project site, travel north (from Wilmington) on US Highway 17 to Washington Acres Road, in Hampstead. Turn right onto Washington Acres Road and travel approximately 1.5 miles before turning left on Hughes Road. Continue traveling on Hughes Road approximately 0.25 miles and the project site will be located on the right hand side of the road at house number 709. The subject property is developed (residential) and has approximately 90 linear feet of shoreline bordering a man-made basin bordering Mill Creek. Elevations at the property range from 3' to 18' above the normal high water (NHW) line. The size of the tract is approximately 19,602 sq. ft., or 0.45 acres. Mature oaks, lawn grasses and ornamental landscaping make up the high ground vegetation, and Smooth Marsh Cordgrass (Spartino alternitlora) accounts for the adjacent wetland vegetation. Coastal Wetlands bordering the eastern shoreline are confined to the northern half of the property. The area surrounding the project site is developed. Washington Acres Subdivision borders the property to the west, north and south and a man-made basin borders the property to the east. The basin is bordered along the northern side by Coastal Wetlands, which is vegetated primarily with Smooth March Cordgrass (Spartina alterniflora) and Black Neelderush Ouncus romarianus). The Pender County Land Use Plan classifies the adjacent waters as Conservation. The waters of the AIWW and Mill Creek are classified SA and SA-ORW by the Division of Water Resources. The waters immediately adjacent to the property ARE NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. PROPOSED PROJECT: The applicant proposes to install approximately 76 linear feet of new bulkhead immediately waterward of an existing, failing bulkhead. The existing bulkhead is comprised of a vertical broken concrete structure that was installed approximately 20-25 years ago. The existing tie -backs that support the wall have deteriorated/separated, which has caused catastrophic failure to the wall's vertical sheets. In addition, excessive rains during Hurricane Florence exacerbated the wall's failure, causing separation of high ground behind the wall. The applicant wishes to resolve the walls failure by constructing a new vinyl wall immediately waterward or the existing wall, at an average of 1'-2' offshore (application package states a maximum of 4' waterward only because the wall is leaning at an angle). As a result of the new bulkhead construction, approximately 67 sq. ft. of Coastal Wetlands would be impacted (filled), as would approximately 67 sq. ft. of open water area. High ground disturbance associated with the applicant's proposal would include grading and filling approximately 900 sq. ft. (dead -men and anchoring).
