This permit, issued on October 30, 2019 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation

Shellfish Lease Boundary Markers
1) This permit authorizes only the activities associated with the installation and use of the four pilings
associated with marking the boundary of the shellfish lease, as referenced in the attached workplan
drawings. No other structure, whether floating or stationary, shall become a permanent part of this
shellfish lease without permit modification. No non -water dependent uses of structures shall be
conducted on, in or over Public Trust waters without permit modification.
2) The location of the four pilings shall be located at the following GPS coordinates:

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2022
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
NOTE: The operation and gears associated with the oyster lease have been authorized by the North
Carolina Division of Marine Fisheries oyster lease program and have been assigned permit
numbers 1966753 and 1966761.
General
3) The pilings shall be marked in accordance with state or federal marking requirements for shellfish
leases. At a minimum the pilings shall be marked with permanent reflectors to make them more visible
during hours of darkness or inclement weather.
4) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
5) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the
permitted activity without having it transferred to a third party.
6) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: This permit does not convey any rights, either in real estate or material.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Nationwide Permit 48
(Action ID SAW-2019-01936).
NOTE: The N.C. Division of Water Resources assigned the project DWR Project No. 2019-1238.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 808-2808 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal water level.
NOTE: An application processing fee of $250 was received by DCM for this project.

This letter is in reference to the application submitted for a Coastal Area Management Act Major
Permit to undertake development activities to place corner marking poles for a shellfish lease, in
Carteret County.
Although processing of the application is nearing completion, additional time is needed for this
office to complete the review and make a decision on your request. Therefore, it is necessary that
the standard review time be extended. An additional 75 days is provided by G.S. 113A-122(c)
which would make January 11, 2020 the new deadline for reaching a decision on your request.
However, we expect to take action prior to that time and will do so as soon as possible. In the

Consistency Determination: The request is consistent with/not in conflict with Carteret County Land Use
Plan certified by the CRC on December 20, 2010.
Overview: The applicant wishes to install four 6' pilings to mark the corners of a shellfish lease in the
Newport River east of Mill Point Lane, Carteret County, NC. The lease site is 6.57 acres, is rectangular in
shape and is positioned in a NE/SW alignment. The proposed piling locations are:

AECs onsite include Estuarine Waters and Public Trust Areas. The surface water classifications are SA
(Market Shellfishing, Salt Water) and HOW (High Quality Water). The site is not designated as a Primary
Nursery Area, does not have any PNA, and is open to the harvest of shellfish. A review of historic/cultural
resources was not provided.
Anticipated impacts
The proposed pilings would fill 2.3 ft2of open water

Basis for Determination:
The project site is subject to the 2005 Carteret County Land Use Plan Update. The Future Land Use Map
(FLUM) designates the site as Conservation (Areas of Environmental Concern). Uses allowed in Areas of
Environmental Concern are those consistent with the State's minimum use standards and state and
federal regulations.

Carteret County's policies for development in estuarine and public trust waters are as follow:
1. Carteret County will only allow development activities in estuarine and public trust waters
that are associated with water -dependent uses, consistent with state and federal standards,

SUBJECT: CAMA Dredge/Fill Peanut Application for William Rayner, Carteret County, North Carolina.
Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit
application with regard to impacts on fish and wildlife resources. The project site is located within the
Newport River, east of Mill Point Lane near Morehead City, NC. Our comments are provided in accordance
with provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-128), as amended;
Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and Wildlife Coordination Act (48
Stat. 401, as amended, 16 U.S.C. 661 et seq.).
The applicant proposes to install four 6" pilings to mark the comers of a 6.57-acre shellfish lease. The
applicant's narrative states the pilings would be marked as required by NCDMF. The Newport River at this
location is classified SA HQW by the Environmental Management Commission and is open to shellfish
harvesting.
The NC WRC has reviewed the permit application and does not believe the pilings would cause significant
adverse impacts to wildlife resources. However, we do have concerns regarding the creation of navigation
hazards for various recreational, fishing, and hunting user groups. It was not stated in the application if the
piles would have reflective material on them to increase their visibility at night and during inclement weather.
This safety measure should be required The height of the pilings above normal water level also was not
noted. Adequate height should be required to insure the piles can be seen in the horizon as well as stay above
the water line during higher water events. The applicant did state the pilings would be marked per NCDMF
requirements, but NCWRC is unfamiliar with those requirements at this time. In addition to the concern with
the pilings creating a navigation hazard, the type of shellfish lease was not disclosed. If the lease includes gear
for water column production, the entire 6.57-acre lease area may increase navigation hazards and may need to
have appropriate signage.

Dear Mr. Rayner:
The Division of Water Resources (DWR) has received a copy of your CAMA Major application
request dated received by this office on September 18, 2019. DWR issues approval in the
form of a Water Quality Certification (WQC) in conjunction with the CAMA Major Permit and
General Permit(s) 198000291 and/or the Nationwide Permit #48 issued by the US Army
Corps of Engineers (USACE). This Certification allows you to use the CAMA Major Permit
when the Division of Coastal Management issues it.
In accordance with the attached General Certification #4175 (GC 4175), the impacts
described in your application do not require written authorization to utilize GC 4175.
However, you are required to follow the conditions listed in the attached certification. You
should get or otherwise comply with any other federal, state and local requirements before
you go ahead with your project including (but not limited to) erosion and sediment control
regulations.
This Certification can be contested as provided in Articles 3 and 4 of General Statute 150B
by filing a written petition for an administrative hearing to the Office of Administrative
Hearings (hereby known as OAH). A petition form may be obtained from the OAH at
http://www.ncoah.com/ or by calling the OAH Clerk's Office at (919) 431-3000 for
information.
Within sixty (60) calendar days of receipt of this notice, a petition must be filed with the
OAH. A petition is considered filed when the original and one (1) copy along with any
applicable OAH filing fee is received in the OAH during normal office hours (Monday through

Carolina. The lease site is 6.57 acres, is rectangular in shape and is positioned in a NE/SW
alignment.
Newport River is classified as SA;HQ W by the Environmental Management Commission and is
open to shellfishing. There are no SAV in the footprint of the pilings.

The request is to mark each corner of shellfish lease #1966753 /1966761 recently approved by
the North Carolina Division of Marine fisheries dated February 22 2019. The tease is located in
the Newport River, locate on a map west of Country Club Road and Blair Point, Morehead City,
NC. Specifically, the request is to mark the four corners of the lease with 6 inch diameter wood
pilings. The pilings will be properly marked as required by the NC Division of Marine Fisheries
Shellfish Leasing Program and will extend greater than 4' above the high-water line. The four
wood pilings will be located at the following GPS (Degrees Decimal Minutes) coordinates.

The NC Division of Coastal Management hereby acknowledges receipt of your application
for State approval fordevelopmentofyourpropertylocated Newport River in Carteret
County near city of Morehead, North Carolina. It was received on 14 August 2019, and
appears to be adequate for processing at this time. The projected deadline for making a
decision is 28 October 2019. An additional 75-day review period is provided by law when
such time is necessary to complete the review. If you have not been notified of a final action
by the initial deadline stated above, you should consider the review period extended. Under
those circumstances, this letter will serve as your notice of an extended review. However,
an additional letter will be provided on or about the 75th day. Jonathan Howell, District
Manager for the Division of Coastal Management is responsible for processing your permit
and he can be reached at 252-948-3851 or via email at Jonathan. Howellfa7ncdenr.gov if you
have any questions.
If this agency does not render a permit decision within 70 days from 14 August 2019, you
may request a meeting with the Director of the Division of Coastal Management and permit
staff to discuss the status of your project. Such a meeting will be held within five working
days from the receipt of your written request and shall include the property owner,
developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which
must be posted at the property of your proposed development. You should post this notice
at a conspicuous point along your property where it can be observed from a public road.
Some examples would be: Nailing the notice card to a telephone pole or tree along the road
right-of-way fronting your property, or at a point along the road right-of-way where a private
road would lead one into your property. Failure to post this notice could result in an
incomplete application.
