and Natural Resources and the Coastal Resources Commission for development
in an area of environment concern pursuant to Section 113A-118 of the
General Statutes, "Coastal Area Management"
Issued to the Town of Oak Island, c/o Gene Kudgus, authorizing development in the Estuarine Shoreline (AEC) at the
end of SW 6th Street, in Oak Island, as requested in the permittee's application, dated 1/9/09. This permit, issued on
February 18, 2009, is subject to compliance with the application and site drawing (where consistent with the permit), all
applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void.
This permit authorizes: the construction of a gravel parking area in the existing road right-of-way.
(1) All proposed development and associated construction must be done in accordance with the permitted work plat
drawings(s) dated received on January 9, 2009,
(2) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal regulations,
applicable local ordinances and FEMA Flood Regulations.
(3) Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and
modification of this permit.
(4) A copy of this permit shall be posted or available on site. Contact this office at (910) 796-7424 for a final inspection at
completion of work.

This permit action may be appealed by the permittee or other qualified persons
within twenty (20) days of the issuing date. From the date of an appeal, any
work conducted under this permit must cease until the appeal is resolved. This
permit must be on the project site and accessible to the permit officer when the
project is inspected for compliance. Any maintenance work or project
modification not covered under this permit, require further written permit
approval. All work must cease when this permit expires on:

(5) The amount of impervious surface shall not exceed 30% of the lot area within 75 feet of normal high water (NHW)
(Estuarine Shoreline Area of Environmental Concern), in this case, 25.7% square feet is authorized.
(6) Unless specifically allowed in 15A NCAC 07H. 0209(d)(10), and shown on the permitted plan drawing, all
development/construction shall be located a distance of 30 feet landward of NHW. No portion of the parking lot shall
encroach into the 30 ft. buffer.
(7) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective
sedimentation and erosion control measures. Prior to any land -disturbing activities, a barrier line of filter cloth must
be installed between the land disturbing activity and the adjacent marsh or water areas, until such time as the area
has been properly stabilized with a vegetative cover.
(8) All other disturbed areas shall be vegetatively stabilized (planted and mulched) within 14 days of construction
completion.
(9) Pursuant to 15A NCAC, Subchapter 7J.0406(b), this permit may not be assigned, transferred, sold or otherwise
disposed of to a third -party.
NOTE: This permit does NOT authorize the proposed dock and ramp shown on plans. These structures do
not constitute minor development and shall be authorized under a CAMA General Permit.

This letter is in response to your correspondence received by the Division of Coastal Management on February
10, 2009, regarding your concerns about the proposal by the Town of Oak Island to construct a public pier facility the ei
of SW 6t' Street, in Oak Island, Brunswick County. The project consists of a fixed elevated, wooden access ramp with
30' in length by 6' in width pier leading to 24' in length by 6' in width fixed platform with two 4' in length by 4' in widt
triangular extensions between the pier and platform. A gravel parking area was proposed under a CAMA minor permit
application. The proposed project has been determined to comply with the Rules of the Coastal Resources Commission
(NCAC 7H.0207 & 07H.0209) and as such, a permit has been issued to authorize the development. I have enclosed a
copy of the permit, as well as the relevant statutes.
If you wish to contest our decision to issue this permit, you may file a request for a Third Party Hearing. The
request for a hearing will be considered by the Chairman of the Coastal Resources Commission. The hearing request
must be filed with the Director, Division of Coastal Management, in writing and must be received within twenty (20) da;

I acknowledge that the land owner is aware that the proposed development is planned for an area which may be
susceptible to erosion and/or flooding. I acknowledge that the local permit officer has explained to me the particular

Dear Heather,
Thanks for calling regarding the proposed pier for the handicapped at the end of 6th Street, Oak Island.
We feel that any construction there will have a negative effect on our already diminished property value. Our lot is
quite narrow and part of the value was the road access and unobstructed view. Our access to the lot is from the
undeveloped end of 6th Street and the most desirable location for the driveway has not yet been determined. Our
neighbor on the other side of the street has had to install a fence to insure privacy for his property.
We also question whether we would have a more difficult time getting approval from CAMA for a pier for our
property. If denied that would further devalue the lot.
It is our understanding that there is already a public access pier at the end of 5th Street and the city is proceeding to
purchase the ocean pier on the island. Wouldn't it make more sense the provide for the handicapped there? If there
are only parking spaces for the handicapped on 6th Street, is the city going to tow cars there that do not have
handicapped signs?
As tax payers, it concerns us that our tax dollars are being spent to devalue our property. If accomodations funds
are used, couldn't that money be better spend on projects that in this economy are more essential?
Please use this note as our "written" protest to the proposed project.

CORRECTED ORDINANCE AMENDMENT
That Section 22-6 of the Oak Island Code of Ordinances is amended to add the following:
Regulation of Parking, Vehicular and Pedestrian Traffic for Street -end of
SW 61h Street
(a) SW 61h Street is a public street that ends immediately north of the northern
boundary of the mean high water mark of Davis Canal. Regulating on -street
parking, vehicular and pedestrian traffic in this area will promote the general
health, safety and welfare of the public.
(b) In accordance with the authority granted under NCGS § 160A-300, NCGS § 160A-
301 and Section 22-6 of the Town's Code of Ordinances, the Town hereby
adopts this ordinance to implement the installation of the improvements depicted
on the attached exhibit "A" to regulate on -street, vehicular and pedestrian
traffic in this area. Said installation shall be conducted in such a manner as to not
interfere with the public's right of ingress and egress from SW 6`h Street.
(c) Any vehicle parking in a marked on -street parking space shall be entirely within
the lines or markings of the marked parking space.
(d) It shall be the responsibility of the Police Department and Public Works
Department to enforce this ordinance.
