Pamlico River. at 140 Summer Haven Lane, near Washington as requested in the permittee's application dated 2/12/19 (MP- 1,2) and 3/22/19 (MP-4), including attached workplan drawings (3), all dated 2/12/19. This permit, issued on June 18, 2019 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Shoreline Stabilization - Bulkhead 1) The bulkhead shall not extend waterward more than 2 feet from the existing bulkhead at any point along its alignment at the time of construction. 2) No open water shall be excavated or filled, even temporarily, outside of the approved bulkhead alignment. 3) The alignment of the authorized bulkhead shall be staked by the permittee and verified by a representative of the Division of Coastal Management within a maximum of 30 day rior to the start of construction. Oestreich Permit No. 45-19 Page 2 of 3 ADDITIONAL CONDITIONS 4) The bulkhead shall be constructed prior to any backfilling activities. 5) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 6) The fill material shall be clean and free of any pollutants except in trace quantities. 7) All backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. Sedimentation and Erosion Control 8) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. Docking Facility 9) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 10) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hou* darkness or inclement weather. IVeo 11) This permit authorizes a maximum of 2 formalized boat slips. J(/N 2 4 2019 12) The boathouse shall not be completely enclosed or have side coverage more than Ald ' t of the side, from the roof waterward. The footprint of the boathouse shall not exceed the dimension s n the authorized workplans. 13) The authorized boathouse shall be single story, and shall not be designed to allow for second story use. 14) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 15) Should the Lot to the west be sold prior to the initiation of construction of the docking facility, the permittee shall obtain a written agreement from the new owner(s) waiving the 15 foot riparian corridor setback and submit it to the Division of Coastal Management prior to initiating construction of the docking facility. Oestreich Permit No. 45-19 Page 3 of 3 - ADDITIONAL CONDITIONS General 16) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 17) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the permitted activity without having it transferred to a third parry. 18) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2019-00787). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2019-0604. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 946-6481 prior to the commencement of any such activity for this determination. The permittee is further advised that many land disturbing activities are not authorized within 50 feet of the normal water level unless specifically exempted by Environmental Management Commission's (EMC) Tar Pamlico River buffer regulations in place at the time of such development. NOTE: An application processing fee of $400 was received by DCM for this project. This fee also satisfied the Section 401 application processing fee requirements of the Division of Water Resources. Oestreich 140 Summer Haven Lane, Washington Beaufort County Mr. Oestreich has submitted a CAMA Major Permit request for the construction of a 4' wide x 10' long platform expansion, extending existing boathouse roof 7.0' and the replace of 921inear feet of bulkhead at his property located off SR 1319 at 140 Summer Haven Lane on the Pamlico River near the City of Washington in Beaufort County, North Carolina. Staff has reviewed the proposed project regarding rules found in Subchapter 7H concerning development in Estuarine Water and Public Trust Areas. It is staff s recommendation that the proposed project appears consistent with 15A NCAC 07H .0208 as described below. This office feels the development is consistent with 15A NCAC 07H .0208(b)(6)(B) which states in part that "The total square footage of shaded impact for docks and mooring facilities allowed shall be eight square feet per linear foot of shoreline with a maximum of 2,000 square feet". The applicant has proposed a total of 736 square feet of platform. The total platform allowed on this property with 92 linear feet of shoreline is 736 square feet. This office also feels the development is consistent with 15A NCAC 07H .0208(b)(6)(D) which states in part that "A boathouse shall not exceed 400 square feet except to accommodate a documented need for a larger boathouse". The applicant has demonstrated the need for a larger boathouse in his narrative submitted with the application. This office feels the construction of the bulkhead is consistent with 15A NCAC 07H .1105(a)(3) which states in part" When replacing an existing bulkhead, the new alignment shall not be positioned so as not to exceed a maximum distance of two feet waterward of the current bulkhead alignment". Staff recommends the following conditions be included if the project is permitted. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 2. This permit authorizes only the structures and uses located in or over the water that are expressly and specifically set forth in the permit application. The proposed project involves the construction of a bulkhead and the expansion of a boathouse and wooden platform. Staff review of the plans and specifications has determined that the project, as proposed, consists of activities that will not pose surface water quality threats from stormwater runoff. The Director has determined that projects that are reviewed and approved by the Division as not posing water quality threats from stormwater runoff should not be subject to the stormwater management permitting requirements of 15A NCAC 21-1.1000. For this reason, we are informing you by way of this letter that the current project will not require a State Stormwater management permit. The stormwater rules require the Division to permit the common plan of development, therefore, any future development on the property, regardless of whether a SEC plan or CAMA Major permit is also required, will require a Stormwater Management Permit application and permit issuance from the Division of Energy, Mineral, and Land Resources prior to any construction. Any construction on the subject site, prior to receipt of the required permit, will constitute a violation of 15A NCAC 2H.1000 and may result in appropriate enforcement actions by this Office. Please keep in mind that this determination does not affect your legal obligation to obtain other permits and approvals, which may be required by Federal, State, or local government agencies, rule or law. DWR issues approval in the form of a Water Quality Certification (WQC) in conjunction with the CAMA Major Permit and General Permit(s)198000291 issued by the US Army Corps of Engineers (USACE). This Certification allows you to use the CAMA Major Permit when the Division of Coastal Management issues it. In accordance with the attached General Certification #4175 (GC 4175), the impacts described in your application do not require written authorization to utilize GC 4175. Overview: The .37-acre site is located at 140 Summer Haven Lane near the City of Washington in Beaufort County. The site has 92 linear feet of shoreline on the Pamlico River. Existing site improvements include a single family residence, bulkhead, platform, boathouse and an uncovered PWC lift. The water depth at the waterward end of the pier is 4.0' below NWL. The site is mostly vegetated with lawn grasses, ornamental shrubs, and various hardwood trees. The applicant proposesto The applicant proposes to add 4' x 10'to the existing platform. This will increase the size of the platform to a total of 16' x 16'. The applicant also proposes to lengthen the existing 16' x 23' boathouse 7.0', for a total length of 30'. The boathouse will not be relocated, will be no closer to the riparian line on the upstream (west) side and will not extend farther waterward than the existing docking facility. It should be noted that the boathouse is located within the 15' setback of the riparian line and the property owner on the west side has waived the 15' setback for this current proposal. Additionally, the applicant proposes to replace 75 linear feet of bulkhead 2' waterward of the existing bulkhead and 17' of bulkhead (return wall on the east side) in the same footprint. AECs involved include: Coastal Shoreline and Estuarine Water. The project is located within in Tar -Pamlico River Basin and is subject to the Tar -Pamlico Buffer Rule. The Pamlico River is classified as SB, NSW, is not a Primary Nursery Area, and is closed to shellfishing. The installation of the dead -men and tie back system will result in the high ground disturbance of±1,500 ftZ. The 112 ft2 expansion of the boathouse will result in a total of 480 ftZ of boathouse coverage at the property. The expansion of the platform will result in an additional40 ft2of platform for a total of 256 ft2 of platform. The total square footage of the platform and boathouse is 736 ft2, which is the maximum allowed for this property with 92 linear feet of shoreline. Basis for Determination: The project is subject to the Beaufort County Joint Land Use Plan 2006 Update. The counties Future Land Use Map (FLUM) classifies the site as Transition, Conservation I (Coastal Shoreline AEC and water protected by Tar -Pam Buffer), and Conservation II (100-year flood plain). The following LUP policies may be applicable to this request: 2.1 Conservation I 2.1.3 Only development and land/water use activities that are consistent with the use standards for coastal wetlands, estuarine waters, and public trust areas (15A NCAC 07H .0208) are allowed in this classification. PROJECT SUMMARY: The applicant proposes to expand an existing boathouse and platform. Additionally, the applicant proposes to replace 92 linear feet of bulkhead. James W. Oestreich 140 Summer Haven Lane, Washington Beaufort County Protect settin¢ The project site is located off SR 1319 at 140 Summer Haven Lane near the City of Washington in Beaufort County, North Carolina. The lot is approximately 0.37 acres (16,500 ft2) in size and has 92 linear feet of shoreline on the Pamlico River. Man-made features on the lot include a single family residence, bulkhead, pier, platform, boathouse and an uncovered PWC lift. The water depth at the waterward end of the pier is 4.0' below Normal Water Level (NWL). The lot is approximately 13.0' in elevation above the NWL. The lot is mostly vegetated with lawn grasses, ornamental shrubs, and various hardwood trees. Both the downstream and upstream properties are developed with single family dwellings with bulkheaded shorelines. The Pamlico River is classified as SB NSW waters by the Environmental Management Commission at the project location. There are no Coastal Wetlands on -site. Pamlico River is classified as coastal fishing waters at the project location. The property is subject the Tar -Pamlico Riparian Buffer rules enforced by the N.C. Division of Water Resources. No Submerged Aquatic Vegetation was observed during the site visit. Protect description The applicant proposes to add 4' x 10'to the existing platform. This will increase the size of the platform to a total of 16' x 16'. The applicant also proposes to lengthen the existing 16' x 23' boathouse 7.0', fora total length of 30'. The boathouse will not be relocated, wil I be no closer to the riparian line on the upstream (west) side and will not extend farther waterward than the existing docking facility. Additionally, the applicant proposes to replace 75 linear feet of bulkhead 2' waterward of the existing bulkhead and 17' of bulkhead (return wall on the east side) in the same footprint. Anticipated impacts The construction of the replacement bulkhead will result in the filing f 150 ft2 of River bottom. The installation of the dead -men and tie back system will result in the high ground disturbance off 1,500 ft2. The 112 ft2 expansion of the boathouse will result in a total of 480ft2 of boathouse coverage at the property. It should be noted that the boathouse is located within the 15' setback of the riparian line and the property owner on the west side has waived the 15' setback for this current proposal. The expansion of the platform will result in an additional 40 ft2 of platform for a total of 256 ft2 of platform at the property. The total combined square footage of both the platform and boathouse is 736 ft2, which is the maximum allowed for this property with 92 linear feet of shoreline. Existing bulkhead is approximately 75 feet in length with an "L" shaped portion on the property line pointing inward measuring approximately 17 feet in length, for a total of 92 feet overall. Replacement bulkhead measuring 75 feet to be located approximately 2 feet in front of the existing structure. The "L" shaped portion will have to be dug out and replaced as it is beside a neighbor's existing concrete wall. Also requesting to extend the roofline of existing boathouse with like material from 23 feet in length to 30 feet with the width of the roofline remaining the same. The boathouse was originally built for an 18 foot boat and since that time I have purchased a boat that the existing roofline will not adequately cover.
