Dockin¢ Facility Expansion I) This permit authorizes only the fixed piers and boat lifts, and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility expansion without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2022 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Robert Oaks ADDITIONAL CONDITIONS Permit No. 95-19 Page 2 of 2 3) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 4) . This permit authorizes an additional 3 formalized boat slips for a maximum of 4 formalized boat slips. 5) In order to satisfy concerns of the resource agencies, physical stops shall be placed on boat lift No. 2 at a minimum height of 24" above the bottom substrate to prevent the boat lift from disturbing the bottom substrate. The physical stops shall remain in place for the life. of the permitted docking facility. 6) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. General 7) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 8) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the permitted activity without having it transferred to a third party. 9) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 197800056 (Action ID SAW-2007-01765). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2019-1508. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 808-2808 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. Proiect Summary: The proposed project is for the construction of three stepdown fixed platforms and the addition of three new slips with boatlifts for a total of 4 slips within Bogue Sound. A CAMA major permit (85-07) was issued for a 1-slip docking facility for a maximum of 510 feet from the edge of marsh and 540 feet from NHW. Narrative Description: The Robert Oaks project is located at 125 Camp Morehead Drive along Hwy 24 Morehead City, Carteret County. The site is found by following highway 24 into the Morehead City town limits. Turn right onto Camp Morehead Drive (approximately 4.4 miles east of the Gales Creek Bridge) and follow for approximately 1300 feet. The property will be immediately on the left. The residential property is .855 acres (37,243.8 so in its entirety and an average of 4' above nhw. Bogue Sound runs along the south side of the property. The upland vegetation mainly consists of lawn grasses, shrubs, and a few trees. There is a 55' x 205' section of jurisdictional wetlands/ coastal wetlands, which consists mostly of (Spartina altemiflora) and (Spartina patens) along the 125' of shoreline on Bogue Sound. The waters of Bogue Sound have approximately 2.5'to 3' lunar tidal amplitude. The Division of Water Resources classifies this area as HQW/SA Waters. This area of Bogue Sound is not designated as a Primary Nursery Area and is open to the taking of shellfish. The Morehead City Land Use Plan classifies this area as Medium Density Residential with Conservation within the AECs. According to Google Earth spacial data, the ICW W is located approximately 688' waterward (south) of the most southern proposed platform and the most southern proposed slips (1 &2). Water depths within this project location are-2.7'nlw/mlw to - 3.25' nlw/mlw. The bottom substrate is sand and no SAV (approximately 75' landward of the existing platform) were observed within the proposed slip areas and floating platform areas. Bogue Sound is approximately 1.5 miles wide at this location. There are SAV within this location approximately 440' from NHW. No SAV were observed beyond this point. 10) Proposed Development: The applicant was issued a CAMA major permit on 6/19/07 for a 2-slip docking facility however the previous applicant only installed one slip. The current proposal is for the addition of three new slips (total of 4 slips) with lifts and 3 stepdown platforms to a maximum distance of 515' from the edge of marsh and 545' from NHW. No SAV was observed within the proposed slip areas. The applicant is proposing to add a 5' x 20' stepdown platform addition at the most southern portion of the existing t-head platform. They are also proposing a new slip (#2) along the east side of the existing platform with a 13' x 13' boatlift. An 8' x 24' fixed stepdown platform would be also added along the backside(northeast) of the existing platform (parallel with the existing pier access). A 6' x 8' jet ski lift (slip # 4) would be located north of this area. The final 6' x 20' fixed stepdown platform and 13' x 13' boatlift (slip # 3), would be located along the west side of the existing pier access and approximately 15' landward of existing slip # 1. The closest section of the proposed platforms and boatlifts are approximately 50' waterward of the edge of SAV habitat. The most waterward portion of the proposed docking facility would not exceed a maximum of 545' from NHW and 515' from the edge of coastal wetlands. All parts of the Field Investigation Report Robert Oaks 125 Camp Morehead Drive Page 3 of 3 docking facility would be landward of the ICWW channel (approximately 688' landward) and a minimum of 34' from the western riparian corridor and 38' from the eastern riparian corridor. Riparian corridors were determined through previous major permit 85-07. There would be a total of four slips (1 existing slip with boatlift, 2 new slips with boatlifts and one jet ski lift. The boat size would be limited to a maximum of 23' and of open runabout design. The water depths within the slip areas are -2.7' nlw to 3.25' nlw/mlw depending on location, with connecting water depths of -3.25' plus nlw/mlw. The water depths beyond 400' fall an additional 2.25' from 400' to 500'. 11. Anticipated hnpacts: The proposed platform additions and boatlifts would shade 412 ft2 and incorporate 2475 ft2 of shallow bottom habitat. The development would increase the number of slips from one to four. The increase in suspended sediment and turbidity levels from the piling placement would be temporary, occur while the piling placement is taking place and should be minimal given the bottom composition. The proposed docking facility should not be a hindrance to navigation due to the fact all portions would be located landward 688' from the ICW. The propose docking facility would also meet the minimum 15' setback from the riparian access lines and not exceed a maximum distance of 515' waterward of the edge of marsh or 545' from NHW. The applicant is proposing to add three new slips as well as three new stepdown fixed platforms to the existing 1-slip docking facility. There would be a total of four slips (1 existing and three proposed) along this parcel. The proposed additions to the existing docking facility would not extend more than 515' waterward of the edge of marsh and no farther than a maximum of 545' from NHW and would remain within pier head length within this area. All portions of the development would be landward approximately 697' of the ICW channel setback. The proposed fixed stepdown platforms and slip areas with boatlifts would also be located approximately 20' to 25' waterward of any SAV depending on location. The development conforms to the guidelines set forth under 15A NCAC 07H .0208. Overview: The project is located at 125 Camp Morehead Drive adjacent to Bogue Sound in Morehead City, Carteret County. Existing development includes a single family residence, driveway and a 1-slip docking facility. The applicant was issued a CAMA major permit on 6/19/07 for a 2-slip docking facility however the previous applicant only installed one slip. The current proposal is for the addition of three new slips (total of 4 slips) with lifts and 3 stepdown platforms to a maximum distance of 515' from the edge of marsh and 545' from NHW. The project property is .855 acres (37,243.8 sf) in its entirety and is an average of 4' above NHW. The upland vegetation mainly consists of lawn grasses, shrubs, and a few trees. There is a 55' x 205'section of jurisdictional wetlands/ coastal wetlands, which consists mostly of (Spartina alterniflora) and (Spartina patens) along the 125' of shoreline on Bogue Sound. The waters of Bogue Sound have approximately 2.5 'to 3' lunar tidal amplitude. According to Google Earth spacial data, the ICWW is located approximately 688' waterward (south) of the most southern proposed platform and the most southern proposed slips ( 1 &2). Water depths within this project location are-2.7'nlw/mlw to -3.25' nlw/mlw. Areas of Environmental Concern (AEC) in the project area include Estuarine Waters (EW), Coastal Wetlands (CW) and Public Trust Areas (PTA). Bogue Sound has a water classification of SA/HQW. The area is not a Primary Nursery Area, and is open to taking of shellfish. Water depths within this project location are shallow (less than -2' NLW). The bottom substrate is sand with no SAV. The increase in suspended sediment and turbidity levels from the piling placement would be temporary, occuring while the piling placement is taking place and should be minimal given the bottom composition. The proposed docking facility should not be a hindrance to navigation due to the fact all portions would be located landward 688' from the ICW. The propose docking facility would also meet the minimum 15' setback from the riparian access lines and not exceed a maximum distance of 515' waterward of the edge of marsh or 545' from NHW. Basis for Determination: The project site is in the Town of Morehead City and is subject to the 2007 Town of Morehead City Core Land Use Plan Update. The Future Land Use Map (FLUM) designates the site as "Medium Density Residential" and "Conservation/Open Space" (due to the sites location in Coastal Wetlands, Estuarine Waters and Public Trust Area AECs). The following LUP policies may be applicable to this request: 4.2.6 Areas of Environmental Concern Policy 1, pg. 94: The Town of Morehead City supports state and federal law regarding land use and development in AECs. The project is located at 125 Camp Morehead Drive in Morehead City. The applicant is proposing to expand on an existing docking facility by adding additional fixed dock platform, two additional boatlifts and a personal water craft lift at the terminus of an access pier within Bogue Sound. The waters within the project area are classified as SA, high quality waters (HQW) and are open to the harvest of shellfish. The waters within the project area have also had evidence of submerged aquatic vegetation (SAV) within the proposed development area. The NC Marine Fisheries Commission defines SAV as submerged lands that have been vegetated by one or more of the species identified in Sub -item (4)(i)(i) of this Rule within the past 10 annual growing seasons (15A NCAC 031.0101(4)(d)(i)(i)). The NCDMF has evidence of the land underneath the lift labeled as "2" in sheet 3 of 5 on the application packet has had documented SAV growth within the last 10 years. SAV is a vital component to the estuarine system and is prime nursery area for many fisheries species, such as gag grouper, Flounder, red drum, black sea bass, weakfish and Atlantic croaker. SAV supports high diversity of foraging fish and invertebrates, and provides valuable ecosystem services as a primary producer and enhancer of water quality. For these reasons, protection of SAV habitat is crucial within the coastal waters of North Carolina. Formalized slips in shallow water can allow vessels to repeatedly contact the bottom, resulting in; aquatic vegetation or shellfish bed loss, anoxia in the sediment which can kill benthic invertebrates and reduction of shallow bottom habitat during low tide. In addition, vessels moving to and from these shallow water docks can cause propeller disturbance impacts to shallow nursery habitat.
