placement of ABC rocks at the end of the swale near the ICWW.
(1) All proposed development and associated construction must be done in accordance with the permitted work pl,

(2) All construction must conform to the N.C. Building Code requirements and all other local, State and Feder,
regulations, applicable local ordinances and FEMA Flood Regulations.
(3) Any change or changes in the plans for development, construction, or land use activities will require a rE
evaluation and modification of this permit.
(4) A copy of this permit shall be posted or available on site. Contact this office at (910) 796-7215 for a fin,
inspection at completion of work.

This permit must be on the project site and accessible to the permit officer when
the project is inspected for compliance. Any maintenance work or project
modification not covered under this permit, require further written permit
approval. All work must cease when this permit expires on:

Use Plan and all applicable ordinances. This permit may not be transferred to
another party without the written approval of the Division of Coastal

development/construction shall be located a distance of 30 feet landward of normal high water.
(7) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by
effective sedimentation and erosion control measures. Prior to any land -disturbing activities, a barrier line
of filter cloth must be installed between the land disturbing activity and the adjacent marsh or water areas,
until such time as the area has been properly stabilized with a vegetative cover.
(8) All other disturbed areas shall be vegetatatively stabilized (planted and mulched) within 14 days of
construction completion.

Dear Mr. Covington:
On March 18, 2009, the Wilmington Regional Office of the Division of Water Quality received a request to
exclude the subject proposed redevelopment project from Stormwater Management Permit requirements.
Staff review of the plans and supporting documents has determined that the project proposes activities that
are excluded from State Stormwater permitting requirements as set forth in Section 2.(d)(3) of Session Law
2008-211, effective October 1, 2008, and the stormwater rules under Title 15A NCAC 2H.1000, as
amended.
Therefore, the director of the Division of Water Quality is hereby providing confirmation that the subject
project is excluded from State Stormwater permitting requirements under the following conditions: 1) The
project must be constructed as shown on the plans submitted to this Office; 2) The proposed built -upon
area of 22,350 square feet does not exceed the existing built -upon area of 22,731 square feet; and 3) The
proposed stormwater control, sheet flow into a small low area behind the bulkhead, provides equal
protection of surface waters as the existing stormwater control, which is sheet flow into a larger low grassed
area behind the new bulkhead. (Note that the new bulkhead is located landward of the existing bulkhead.)
Under Section .1003 (b) of the stormwater rules, the entire common plan of development must be
permitted. Therefore, any future development or changes to the proposed development, including, but not
limited to, the relocation of built -upon area and the construction of additional built -upon area, will require
approval or a Stormwater Management permit application and permit issuance from the Division of Water
Quality prior to any construction. Any construction on the site prior to receipt of the required approval or
permit will constitute a violation of Title 15A NCAC 2H.1000 and Session Law 2008-211, and may result in
the initiation of appropriate enforcement action.
Please keep in mind that this determination does not affect your legal obligation to obtain any and all other
permits and approvals, which may be required by Federal, State, or local government agencies, statute,
rule or law. If you have any question, or need additional information concerning this matter, please contact

Dear Tara,
This response is not necessarily an objection as it is a need for clarification. Is the pipe you are
proposing to put in the park entrance going to receive the run off from the North side of Trails End Rd.?
There is no mention of the existing drain on the opposite side being opened or how the flow of run off
from the south side will be managed until it reaches my driveways.
