HomeMy WebLinkAbout41-19 MM NCWRCPermit Class MODIFICATION/MAJOR STATE OF NORTH CAROLINA Department of Environmental Quality and Coastal Resources Commission Permit for X Major Development in an Area of Environmental Concern pursuant to NCGS 113A-118 X Excavation and/or filling pursuant to NCGS 113-229 Permit Number 41-19 Issued to North Carolina Wildlife Resources Commission, 1720 Mail Service Center, Raleigh, NC 27699 Authorizing development in Carteret County adi to Salters Creek, at 200 Wildlife Ramp Rd. in Sealevel , as requested in the permittee's application dated 9/14/21, including attached workplan drawings (8), Sheets CD 1.0, 2.0, 2.1, 2.2, 2.3, 3.0, 3.1 dated 9/1/21 and Sheet CD 1.1 dated 9/9/21. This permit, issued on January 13, 2022 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Excavation Expansion 1) In order to protect juvenile shrimp and finfislt populations, no excavation or filling shall be permitted between April I and September 30 of any year without the prior approval of the Division of Coastal Management, in consultation with appropriate resource agencies. 2) No excavation shall take place outside of the area indicated on the workplan drawings. 3) Excavation shall not exceed -4 feet below the normal low water level. In no case shall the depth of excavation exceed the depth of connecting waters. (See attached sheets for additional conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2025 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. North Carolina Wildlife Resources Commission Permit No. 41-19 Page 2 of 2 ADDITIONAL CONDITIONS 4) All mechanized equipment will be regularly inspected and maintained to prevent contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of a spill of petroleum products or any other hazardous waste, the permittee shall immediately report it to the National Response Center at (800) 424-8802 and provisions of the North Carolina Oil Pollution and Hazardous Substances Control Act will be followed. 5) In order to protect waters adjacent to the designated dredge material disposal site, the permittee shall .provide the Division of Marine Fisheries — Shellfish Sanitation and Recreational Water Quality Section the dredge plan and the location of the dredge material disposal site prior to any dredging activity, so a swimming advisory or shellfish closure determination can be made, and documentation of this coordination provided to the Division of Coastal Management. General 6) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 7) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 8) All debris associated with the removal or construction of the permitted development shall be contained within the authorized project area and removed to an appropriate upland location. 9) This Major Modification shall be attached to Permit No. 41-19, which was issued to the permittee on 6/6/19, as well as all subsequent modifications, refinements, and renewals, and copies of all documents shall be readily available on site when a Division representative inspects the project for compliance. 10) All conditions and stipulations of the active permit remain in force, under this Major Modification, unless specifically altered herein. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers assigned the proposed project COE Action Id. No. SAW- 2010-01959. NOTE: The Division of Water Resources assigned the proposed project DWR Project No. 2019-0434 Q. NOTE: An application processing fee of $250 was received by DCM for this project. Although processing of the application is nearing completion, additional time is needed for this office to complete the review and make a decision on your request. Therefore, it is necessary that the standard review time be extended. An additional 75 days is provided by G.S. 113A-122(c) which would make March 14, 2022 the new deadline for reaching a decision on your request. However, we expect to take action prior to that time and will do so as soon as possible. The North Carolina Wildlife Resource Commission (WRC) is proposing a modification to Permit 41-19 for dredging the Salters Creek Boat Access area. The WRC is proposing to maintenance excavate a 30' by 1,796' access channel to serve the existing boat ramp currently permitted under Major Permit 41-19. Water depths in the channel would be altered from -2' at normal low water (NLW) to 4' at NLW. Periodic maintenance excavation would be required to maintain the proposed depths in order to ensure safe public access to the ramp. As noted in the Field Report, this area is designated as a Special Secondary Nursery Area (SNA). Areas designated as SNA are estuarine waters where the later stages of juvenile development occur. Fish species that are found in these areas are typically a mixture of adults, sub -adults, and juveniles that have migrated from upstream nursery area. As such, these habitats are often utilized as a developmental transition area. Shallow habitats, such as those found in the proposed project area, provide vulnerable juvenile species with habitat for refuge and forage, while meeting the necessary water quality parameters for using the habitat (i.e. temperature, flow, salinity, clarity, etc.). The resuspension of sediments associated with dredging can create an increase in turbidity, potentially impacting the vulnerable life stages such as juveniles. Increased turbidity can result in clogged gill surfaces and mortality, and dredging noise can lead to area avoidance or injury/mortality. Taking the above into consideration, DMF would recommend that any permit issued include a moratorium of 1 April through 30 September for all in -water work associated with the permit. Additionally, permit issuance should be conditioned on the requirement that any follow-up maintenance excavation also adhere to the moratorium in order to avoid the less biologically productive warmer months. Management of such spills shall comply with provisions of the North Carolina Oil Pollution and Hazardous Substances Control Act. If such activities should take place during periods of high biological activity (e.g. anadromous species), biological monitoring may be required at the request of other state and federal agencies and coordinated with these dredging activities. 9. The Permittee shall adhere; specially to 15A NCAC 02B .0220 Tidal Salt Water Quality for Class SC Waters (3)(g) pH: shall be normal for waters in the area, which generally shall range between 6.8 and 8.5 except that swamp waters may have a pH as low as 4.3 if it is the result of natural conditions; (1) Turbidity: the turbidity in the receiving water shall not exceed 25 NTU; if turbidity exceeds this level due to natural background conditions, the existing turbidity level shall not be increased. [15A NCAC 02B .0220] 10. The effluent water from the dredge spoil should not (if at all practicable) be released into open shellfish waters. The release of the effluent of dredge spoil from a closed shellfish area into open shellfish water will cause a (temporary) closure of that water which in turn is a degradation of waters and a violation of tidal salt water quality standards for Class SA Waters. Shellfish Sanitation (252.726.6827) and the Division of Water Resources (910.796.7215) must be notified if this is to occur. Salters Creek connects to Nelson Bay which opens up into Core Sound. The project will serve an existing boat ramp under the Hwy. 70 bridge. This property is 2.1 ac in its entirety and has 1,125' of shoreline. Existing on the property is a parking lot, boat ramp and bulkhead. A fringe of high and low marsh exists along the unstabilized portions of the shoreline. No Coastal Wetlands exist in the ramp or bulkhead area or shoreline. No SAV was observed during the site visit. Substrate in this area is sand and silt. The channel leading to the boat ramp has been previously excavated but DCM staff could not locate a permit on file for such excavation as it may have been historically excavated by the extensive use of commercial fishing vessels. Water depths around the boat ramp are -2' to -5' at NLW. The Division of Water Resources classifies this area of Core Sound as SA waters. This is not a Primary Nursery Area but is a productive Special Secondary. This portion of Salters Creek is closed to harvesting shellfish. The parcel is classified in the Carteret Co. LUP as Rural/Conservation. 10. PROJECT DESCRIPTION: NCWRC is proposing to excavate an existing navigation channel that serves an existing boat ramp. The proposed channel would be 1,796' long and 30' wide. Water depths in the channel would go from -2.75' at NLW to 4' at NLW. A total of 1,607 cubic yards would be excavated. Increasing the channel length would facilitate an increase overall depth which should lessen future maintenance dredges and therefore lessen habitat impacts. The North Carolina Wildlife Resources Commission (WRC) is requesting a modification to Permit #41-19. A recent survey performed along the existing channel indicates a required modification to the previously permitted dredge area is necessary. The revised dredge area adds approximately 150 linear feet (if) of additional dredge area (+/- 10%) to the previously permitted area. The revised dredge area will be roughly 30' wide with a depth of four (-4') feet (NAVD88) and follow the existing chaimel. Total excavation will be approximately 1,607 cubic yards (CY) and cover approximately 53,855 square feet. Dredged material will be moved offsite to an approved disposal area. Spoil Disposal 5) The spoil disposal area shall be inspected and approved by a representative of the Division of Coastal Management prior to the commencement of any dredging activities. 6) No spoil material shall be placed within 30 feet of the normal high water line. 7) All excavated materials shall be confined above normal high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. 8) The permittee and/or his contractor shall take all necessary precautions to ensure that the spoil material is properly contained during transport to the disposal site, and that all the proper coordination has taken place with the local or state governments to ensure that any damage to public streets caused by transport of the spoil material has been addressed. 9) In order to protect waters adjacent to the designated dredge spoil disposal site, the pemrittee shall provide the Division of Marine Fisheries — Shellfish Sanitation Section the dredge plan and the location of the spoil disposal site prior to any dredging activity, so a swimming advisory or shellfish closure determination can be made, and documentation of this coordination provided to the Division of Coastal Management. Maintenance Clause 10) The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of any maintenance excavation work authorized by this permit, and such notification shall include: A. The number of the original permit. B. A statement that no dimensional changes are proposed. C. A copy of the original permit plans with cross -hatching indicating the area to be maintained, the area to be used for spoil disposal, and the estimated amount of material to be removed. The location, design and holding capacity of the spoil disposal site shall be approved by a representative of the Division prior to the initiation of any maintenance dredging activities. D. The date of map revision and the permittee's signature shown anew on the original plan. USACE Conditions 11) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein.
