This permit, issued on January 13, 2022 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Excavation Expansion
1) In order to protect juvenile shrimp and finfislt populations, no excavation or filling shall be permitted
between April I and September 30 of any year without the prior approval of the Division of Coastal
Management, in consultation with appropriate resource agencies.
2) No excavation shall take place outside of the area indicated on the workplan drawings.
3) Excavation shall not exceed -4 feet below the normal low water level. In no case shall the depth of
excavation exceed the depth of connecting waters.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2025
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
4) All mechanized equipment will be regularly inspected and maintained to prevent contamination of
waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of a
spill of petroleum products or any other hazardous waste, the permittee shall immediately report it to the
National Response Center at [phone] and provisions of the North Carolina Oil Pollution and
Hazardous Substances Control Act will be followed.
5) In order to protect waters adjacent to the designated dredge material disposal site, the permittee shall
.provide the Division of Marine Fisheries — Shellfish Sanitation and Recreational Water Quality Section
the dredge plan and the location of the dredge material disposal site prior to any dredging activity, so a
swimming advisory or shellfish closure determination can be made, and documentation of this
coordination provided to the Division of Coastal Management.
General
6) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
7) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
8) All debris associated with the removal or construction of the permitted development shall be contained
within the authorized project area and removed to an appropriate upland location.
9) This Major Modification shall be attached to Permit No. 41-19, which was issued to the permittee on
6/6/19, as well as all subsequent modifications, refinements, and renewals, and copies of all documents
shall be readily available on site when a Division representative inspects the project for compliance.
10) All conditions and stipulations of the active permit remain in force, under this Major Modification,
unless specifically altered herein.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers assigned the proposed project COE Action Id. No. SAW-
2010-01959.
NOTE: The Division of Water Resources assigned the proposed project DWR Project No. 2019-0434 Q.

Management Act Major Permit to undertake development activities to expand an existing dredge
footprint adjacent to the existing Salters Creek BAA, in Carteret County.
Although processing of the application is nearing completion, additional time is needed for this
office to complete the review and make a decision on your request. Therefore, it is necessary that
the standard review time be extended. An additional 75 days is provided by G.S. 113A-122(c)
which would make March 14, 2022 the new deadline for reaching a decision on your request.
However, we expect to take action prior to that time and will do so as soon as possible. In the

A North Carolina Division of Marine Fisheries (DMF) Fisheries Resource Specialist has
reviewed the permit application for proposed actions that may impact fish and/or fish habitats.
The North Carolina Wildlife Resource Commission (WRC) is proposing a modification to
Permit 41-19 for dredging the Salters Creek Boat Access area. The WRC is proposing to
maintenance excavate a 30' by 1,796' access channel to serve the existing boat ramp currently
permitted under Major Permit 41-19. Water depths in the channel would be altered from -2' at
normal low water (NLW) to 4' at NLW. Periodic maintenance excavation would be required to
maintain the proposed depths in order to ensure safe public access to the ramp.
As noted in the Field Report, this area is designated as a Special Secondary Nursery Area (SNA).
Areas designated as SNA are estuarine waters where the later stages of juvenile development
occur. Fish species that are found in these areas are typically a mixture of adults, sub -adults, and
juveniles that have migrated from upstream nursery area. As such, these habitats are often
utilized as a developmental transition area.
Shallow habitats, such as those found in the proposed project area, provide vulnerable juvenile
species with habitat for refuge and forage, while meeting the necessary water quality parameters
for using the habitat (i.e. temperature, flow, salinity, clarity, etc.). The resuspension of sediments
associated with dredging can create an increase in turbidity, potentially impacting the vulnerable
life stages such as juveniles. Increased turbidity can result in clogged gill surfaces and mortality,
and dredging noise can lead to area avoidance or injury/mortality. Taking the above into
consideration, DMF would recommend that any permit issued include a moratorium of 1 April
through 30 September for all in -water work associated with the permit. Additionally, permit
issuance should be conditioned on the requirement that any follow-up maintenance excavation
also adhere to the moratorium in order to avoid the less biologically productive warmer months.

Consistency Determination: The request is consistent with/not in conflict with Carteret County Land Use
Plan certified by the CRC on December 20, 2010.
Overview: The NC WRC is proposing maintenance dredging to an channel to serve an existing NC WRC
boat ramp. The ramp is located a 200 Wildlife Rd, Sealevel, Carteret County; adjacent to Core Sound which
opens up into Core Sound. This property is 2.1 ac in its entirety and has 1,125' of shoreline. Existing onsite
development includes a parking lot, boat ramp and bulkhead.
The applicant is proposing modifications to Major Permit 41-19. The proposed channel would be 1,796'
long and 30' wide. Water depths in the channel would go from -2.75' at NLW to -4' at NLW. A total of
1,607 cubic yards would be excavated. Excavation would be bucketto barge and spoils would be offloaded
at the existing ramp before being transferred to an approved high ground location.
AECs onsite include Estuarine Waters and Public Trust Areas. The waters in this area of Core Sound are
classified as SA waters. The area is not a Primary Nursery Area but is a productive Special Secondary, and
is closed to harvesting shellfish.
Anticipated impacts
Excavation will result in the disturbance of 53,880ft' of shallow bottom habitat. Temporary turbidity
impacts can be expected during the removal of the 2,847 cubic yards of material. Final bottom
soundings would be -4' NLW. This project would improve and make public access safer to Public Trust
Waters. Periodic maintenance excavation would be required to maintain the proposed water depths.

Basis for Determination:
The project site is subject to the 2005 Carteret County Land Use Plan Update. The Future Land Use Map
(FLUM) designates the site as Rural (land) and Conservation (Areas of Environmental Concern). Uses
allowed in Areas of Environmental Concern are those consistent with the State's minimum use standards
and state and federal regulations.
The following LUP policies may be applicable to this request:

Carteret County's policies for development in estuarine and public trust waters are as follow:
1. Carteret County will only allow development activities in estuarine and public trust waters
that are associated with water -dependent uses, consistent with state and federal standards,

Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the
permit application with regard to impacts on fish and wildlife resources. The project site is
located waterward the Slaters Creek Boating Access Area (BAA) within Core Sound near Sea
Level, NC. Our comments are provided in accordance with provisions of the Coastal Area
Management Act (G.S. 113A-100 through 113A-128), as amended, Sections 401 and 404 of the
Clean Water Act, as amended, the Endangered Species Act of 1973, as amended (16 U.S.C. 1531
et seq.), the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et
seq.), the Magnuson -Stevens. Fishery Conservation and Management Act (FCMA), as amended
(16 U.S.C. 1801 et seq.), and the Migratory Bird Treaty Act (16 U.S.C. 703-712 et seq.).
The applicant proposes to excavate an existing navigation channel to serve the Salters Creek
BAA. The excavation proposal increases the footprint of the navigation channel by extending the
length 150' to establish a 30' by 1,796' channel with a final water depth of -4' NLW.
Approximately 1,607 CY of material will be removed via bucket to barge and offloaded at the
BAA prior to being transported to an approved high ground disposal area. The Core Sound in
this location is classified SA by the Environmental Management Commission and is designated a
Special Secondary Nursery Area by the NC Division of Marine Fisheries.
The NCWRC has reviewed the project proposal and is familiar with the project area. We
provided comments (Dunn 25 April 2019) for the original project review and do not believe the

Pursuant to the CAMA-Corps Programmatic Permit process, the North Carolina Division of Coastal Management
(NCDCM) has forwarded to our office a copy of the CAMA permit request for the subject project. The attached notice
requests federal agency comments on this project by January 12, 2021.
The applicant proposes to perform work within waters (Salter Creek) adjacent to Nelson Bay and Core Sound, associated
with proposed maintenance dredging expansion of the access channel to the existing NC WRC Boating Access Area at
200 Wildlife Road, in Sea Level, Carteret County, North Carolina. Coordinates in Decimal Degrees are: 34.892094 N -

You have our approval for the impacts listed below for the purpose described in your modification request
dated October 15, 2021 and received by the Division of Water Resources (Division) on November 2, 2021.
The modification proposes to expand the maintenance dredging foot print by 0.1 ac. The addition will add
approximately 150 linear feet to the channel with a deviation in the channel alignment. The proposed project
area is located in Salters Creek which is classified as SC waters by the DWR. After reviewing your
application, we have decided that the impacts are covered by General Water Quality Certification Number
4175 (GC 4175).
This Certification allows you to use the General Permit No. 198000291 when issued by the US Army Corps
of Engineers and the CAMA Major Permit when issued by the Division of Coastal Management. In
addition, you should obtain or otherwise comply with any other required federal, state or local permits
before you go ahead with your project including (but not limited to) Erosion and Sediment Control, Non -
discharge, Water Supply Watershed, and stormwater regulations. Also, this approval to proceed with
your proposed impacts or to conduct impacts to waters as depicted in your application shall expire
upon expiration of the 404 or CAMA Permit.

2. This approval is for the purpose and design described in your application. The plans and
specifications for this project are incorporated by reference as part of the Certification. If you change your
project, you must notify the Division and you may be required to submit a new application package with

3. The applicant shall require his contractors (and/or agents) to comply with all of the terms of
this Certification, and shall provide each of its contractors (and/or agents) a copy of this Certification.
4. This General Certification shall expire on the same day as the expiration date of the corresponding
General Permit. The conditions in effect on the date of issuance of the Certification for a specific project
shall remain in effect for the life of the project, regardless of the expiration of this Certification.
5. The applicant/permitee and their authorized agents shall conduct all activities in a manner
consistent with State water quality standards (including any requirements resulting from compliance with
303(d) of the Clean Water Act), and any other appropriate requirements of State and Federal law. If the
Division determines that such standards or laws are not being met, including failure to sustain a designated
or achieved use, or that State or Federal law is being violated, or that further conditions are necessary to
assure compliance, than the Division may reevaluate and modify this General Water Quality Certification.
6. All mechanized equipment operated near or in surface waters will be regularly inspected and
maintained to prevent contamination of waters from fuels, lubricants, hydraulic fluids or other potential
toxic chemicals. In the event of a hydrocarbon or chemical spill, the permitee/contractor shall immediately
contact the Division of Water Resources, between the hours of 8 am to 5 pm at the Wilmington Regional
Office at 910.796.7215 and after hours and on weekends call [phone]. Management of such spills
shall comply with provisions of the North Carolina Oil Pollution and Hazardous Substances Control Act.

Upon completion of all work approved within the 401 Water Quality Certification or applicable Buffer
Rules, and any subsequent modifications, the applicant and/or authorized agent is required to return the

Violations of any condition herein set forth may result in revocation of this Certification and may
result in criminal and/or civil penalties. The authorization to proceed with your proposed impacts or to
conduct impacts to waters as depicted in your application and as authorized by this Certification shall expire

8. Moratoriums
You will comply with any moratoriums per the NC Division of Marine Fisheries and the NC
Wildlife Resources Commission. Dredging moratoriums shall be observed as required by the NC
Division of Marine Fisheries, NC Wildlife Resources, US Fish and Wildlife and National Marine
Fisheries. If such activities should take place during periods of high biological activity (e.g. anadromous
species), biological monitoring may be required at the request of other state and federal agencies and
coordinated with these dredging activities.
9. The Permittee shall adhere; specially to 15A NCAC 02B .0220 Tidal Salt Water Quality for Class
SC Waters (3)(g) pH: shall be normal for waters in the area, which generally shall range between 6.8 and
8.5 except that swamp waters may have a pH as low as 4.3 if it is the result of natural conditions; (1)
Turbidity: the turbidity in the receiving water shall not exceed 25 NTU; if turbidity exceeds this level due
to natural background conditions, the existing turbidity level shall not be increased. [15A NCAC 02B
.0220]
10. The effluent water from the dredge spoil should not (if at all practicable) be released into open
shellfish waters. The release of the effluent of dredge spoil from a closed shellfish area into open
shellfish water will cause a (temporary) closure of that water which in turn is a degradation of waters and
a violation of tidal salt water quality standards for Class SA Waters. Shellfish Sanitation (252.726.6827)
and the Division of Water Resources (910.796.7215) must be notified if this is to occur. [15A NCAC
02B .0221]
This approval and its conditions are final and binding unless contested. This Certification can be contested
as provided in Articles 3 and 4 of General Statute 150B by filing a written petition for an administrative

Reference the application of the North Carolina Wildlife Resources Commission, c/o Mr.
Michael Leggett, to perform maintenance excavation of an access channel in Salters Creek, to
provide increased access to the existing boat ramp located at 200 Wildlife Road, in Sea Level,
Carteret County, North Carolina.
Specifically, the project consists of excavation of the existing navigation channel
approximately 1, 625 ft long by 30ft wide, to a depth of -4Ft NLW. A total of 2,847 cubic yards
of material would be removed from a 48, 750 square foot area of shallow bottom habitat. The
excavation method is bucket to barge, spoils will be offloaded at the ramp and transported to a
high ground location.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report. We recommend that the following conditions be
included in the modification to the State authorization:
1. In order to further protect the endangered West Indian Manatee, Trichechus
manatus, the applicant must implement the U.S. Fish and Wildlife Service's Manatee
Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at

9. NARRATIVE DESCRIPTION: The NCWRC project is located at 200 Wildlife Rd. in
Sea level adjacent Salters Creek. Salters Creek connects to Nelson Bay which opens up
into Core Sound. The project will serve an existing boat ramp under the Hwy. 70 bridge.
This property is 2.1 ac in its entirety and has 1,125' of shoreline. Existing on the property
is a parking lot, boat ramp and bulkhead. A fringe of high and low marsh exists along the
unstabilized portions of the shoreline. No Coastal Wetlands exist in the ramp or bulkhead
area or shoreline. No SAV was observed during the site visit. Substrate in this area is
sand and silt. The channel leading to the boat ramp has been previously excavated but
DCM staff could not locate a permit on file for such excavation as it may have been
historically excavated by the extensive use of commercial fishing vessels. Water depths
around the boat ramp are -2' to -5' at NLW.
The Division of Water Resources classifies this area of Core Sound as SA waters. This is
not a Primary Nursery Area but is a productive Special Secondary. This portion of Salters
Creek is closed to harvesting shellfish. The parcel is classified in the Carteret Co. LUP as
Rural/Conservation.
10. PROJECT DESCRIPTION: NCWRC is proposing to excavate an existing navigation
channel that serves an existing boat ramp. The proposed channel would be 1,796' long and
30' wide. Water depths in the channel would go from -2.75' at NLW to 4' at NLW. A
total of 1,607 cubic yards would be excavated. Excavation would be bucket to barge and
spoils would be offloaded at the existing ramp before being transferred to an approved high
ground location.
11. ANTICIPATED IMPACTS: Excavation will result in the disturbance of 53,880ft2 of
shallow, bQttoom habitat. Temporary turbidity impacts can be expected during the removal
of the cubic yards of material. Final bottom soundings would be 4' NLW. This
project would improve and make public access safer to Public Trust Waters. Periodic
maintenance excavation would be required to maintain the proposed water depths.

On June 61, 2019, CAMA Major Permit # 41-19 was issued to NCWRC for a proposed dredge at
The Salters Creek BAA located near Sea Level, NC. The existing boat ramp at Salters Creek
BAA provides boating access to Salters Creek and the surrounding areas. The existing channel
from the existing ramp to Nelsons Bay has steadily seen its depth decrease, making boat
navigation hazardous for the public.
NCWRC and Carteret County have received numerous complaints from boaters utilizing the
existing channel in regard to shoaling in the channel, particularly the area South of the HWY 70
bridge. Increasing the channel length would facilitate an increase overall depth which should
lessen future maintenance dredges and therefore lessen habitat impacts.
The North Carolina Wildlife Resources Commission (WRC) is requesting a modification to
Permit #41-19. A recent survey performed along the existing channel indicates a required
modification to the previously permitted dredge area is necessary. The revised dredge area adds
approximately 150 linear feet (if) of additional dredge area (+/- 10%) to the previously permitted
area. The revised dredge area will be roughly 30' wide with a depth of four (-4') feet (NAVD88)
and follow the existing chaimel. Total excavation will be approximately 1,607 cubic yards (CY)
and cover approximately 53,855 square feet. Dredged material will be moved offsite to an
approved disposal area.
The project proponent herby certifies that all information contained herein is true, accurate, and
complete to the best of my knowledge. The project proponent hereby requests that the certifying
authority review and take action on this CWQ 401 certification request within the applicable
reasonable period of time.

Auffiorizing development in Carteret County at adi. Salters Creek. at 200 Wildlife Ramp
Rd., in Sealevel , as requested in the pennittee's application dated 2/1/19,
including attached workplan drawings (4), all dated 2/1/19.
This permit, issued on . June 6, 2019 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
or mese terms may be subject to Ines, imprisonment or civil action; or may cause the permit to be null and void.
Excavation
1) In order to protect juvenile shrimp and finfish populations, no excavation or filling shall be permitted
between April I and September 30 of any year without the prior approval of the Division of Coastal
Management, in consultation with the appropriate resource agencies.
2) No excavation shall take place outside of the area indicated on the workplan drawings.
3) Excavation shall not exceed -4 feet below the normal low water level. In no case shall the depth of
excavation exceed the depth of connecting waters.

This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered

your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
4) The temporary placement or double handling of excavated or fill materials within waters or vegetated
wetlands is not authorized.
Spoil Disposal
5) The spoil disposal area shall be inspected and approved by a representative of the Division of Coastal
Management prior to the commencement of any dredging activities.
6) No spoil material shall be placed within 30 feet of the normal high water line.
7) All excavated materials shall be confined above normal high water and landward of regularly or
irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of
solids into any marsh or surrounding waters.
8) The permittee and/or his contractor shall take all necessary precautions to ensure that the spoil material
is properly contained during transport to the disposal site, and that all the proper coordination has taken
place with the local or state governments to ensure that any damage to public streets caused by transport
of the spoil material has been addressed.
9) In order to protect waters adjacent to the designated dredge spoil disposal site, the pemrittee shall
provide the Division of Marine Fisheries — Shellfish Sanitation Section the dredge plan and the location
of the spoil disposal site prior to any dredging activity, so a swimming advisory or shellfish closure
determination can be made, and documentation of this coordination provided to the Division of Coastal
Management.
Maintenance Clause
10) The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of
any maintenance excavation work authorized by this permit, and such notification shall include:
A. The number of the original permit.
B. A statement that no dimensional changes are proposed.
C. A copy of the original permit plans with cross -hatching indicating the area to be maintained, the
area to be used for spoil disposal, and the estimated amount of material to be removed. The
location, design and holding capacity of the spoil disposal site shall be approved by a
representative of the Division prior to the initiation of any maintenance dredging activities.
D. The date of map revision and the permittee's signature shown anew on the original plan.
USACE Conditions
11) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must
implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein.

General
12) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
13) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action ID SAW-2010-01959) issued 6/6/19.
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 2019-0434.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at [phone] prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal water level.
NOTE: An application processing fee of $475 was received by DCM for this project. This fee also
satisfied the Section 401 application processing fee requirements of the Division of Water
Resources.
