This permit, issued on June 6, 2019 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Water Control System 1) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities associated with the installation of the agricultural drainage system, including the culverts, tide gates, concrete pad, and flashboard riser brackets, all as expressly and specifically set forth in the attached permit application and workplan drawings. 2) No vegetated wetlands shall be excavated or filled, even temporarily, outside of the approved culvert alignment. 3) This permit does not authorize any fill or excavation waterward of the approved culvert alignment beyond what is necessary to install the agricultural drainage system. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires farther Division approval. All work must cease when the permit expires on December 31, 2022 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee North Carolina Wildlife Resources Commission Permit No. 39-19 Page 2 of 2 r ADDITIONAL CONDITIONS 4) The fill material shall be clean and free of any pollutants except in trace quantities. 5) The concrete base shall either be poured at an upland location and pushed into place once hardened, or poured entirely within a watertight containment structure. Live concrete shall not be allowed to contact waters of the State or waters that will enter waters of the State. 6) In order to satisfy concerns of the resource agencies and in accordance with commitments made by the permittee, the coffer dam shall be in place for the entirety of the installation of the agricultural drainage system. Sedimentation and Erosion Control 7) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of grading on cut or filled slopes to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. At a minimum, a silt fence shall be properly installed between any disturbed areas and adjacent wetlands or watercourses immediately following completion of backfilling activities. General 8) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 9) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the permitted activity without having it transferred to a third party. 10) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2019-00675). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2017-0907 V2, issued 5/15/19. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 946-6481 prior to the commencement of any such activity for this determination. The North Carolina Wildlife Resources Division proposes to replace an existing 30' x 48" culvert on a canal adjacent to the Little Alligator River on the Texas Plantation game land in Tyrell County. In addition to the culvert replacement a riser water control structure (either stop logs or a hinged flap gate) is to be installed to aid in management of the property. Although the downstream receiving water is a designated in -land PNA and anadromous fish spawning area neither of these resources should be adversely impacted by the proposed project. Due to the distance of the receiving waters from the project no moratorium will be requested but measures should be taken to reduce excess turbidity reaching the downstream waters. DATE: May 6, 2019 Consistency Determination: The request is consistent with/not in conflict with the Tyrrell County/Town of Columbia Land Use Plan certified by the CRC on March 25. 2010. Overview: The project area is located on a 1,519 acre tract that is managed as a waterfowl impoundment by the NC Wildlife Resources Commission. The public can hunt on the tract under a game lands license. The tract consists primarily of freshwater forested/scrub wetlands (946 acres), former agricultural fields managed as shallow water wetlands (228 acres) and estuarine and marine wetlands (30 acres). The tract has approximately 30,054 linear feet of combined, unimproved shoreline along the Little Alligator River to the south and connecting manmade canals. The project area is located along a manmade canal approximately 1,000 feet north of the canal's connection to the Little Alligator River. The project area is in an AE floodzone. Existing site improvements at the project area include the manmade canal that connects to the Little Alligator River, an interior manmade canal, two (2) intersecting levees, and a 48 inch wide by 30 foot long culvert. The culvert is located at the terminus of the manmade canal that connects to the river. It connects this canal to the interior manmade canal. The culvert is topped by a levee. A roadway runs parallel to and east of the manmade canal that connects to the river. As indicated in aerial photos, vehicles also drive on top of the levees. Installation of a 48 inch wide by 37 foot long culvertwith a riser water control structure is proposed. The culvert will replace the existing culvert in the same alignment. The water control structure will be either stop logs or hinged flap gates and will be installed on the upstream side of the culvert. The waters of the Little Alligator River in this area are classified as SC;SW and as Inland Waters, Primary Nursery Area and Anadromous Fish Spawning Area and are closed to shellfishing. A review of potential historic resources or archaeological sites was not provided. Anticipated Impacts resulting from this project are expected to include: the disturbance of 750 square feet of Highground primarily within the Public Trust Shoreline AEC. No wetland impacts are anticipated. Basis for Determination: The Tyrrell County/Town of Columbia Land Future Land Use Plan Map identifies the project site as 'Rural' and "Conservation". The "Conservation" designation also includes land and water areas which are environmentally sensitive, including areas of environmental concern, as indicated on Page 133. Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit application with regard to impacts on fish and wildlife resources. The project site is located at 2674 Fort Landing Road in Columbia, NC. Our comments are provided in accordance with provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.). The applicant proposes to replace an existing culvert and construct a water control structure for an existing impoundment that is connected to the Little Alligator River by a manmade canal. The 30' by 48" culvert will have a riser water control structure installed on the upstream side. Water will be allowed to gravity flow off the property late February to early May with the boards removed mid -July to August. The current management of the property is for game lands, specifically a waterfowl impoundment managed by a series of flash board risers and two permanent pump stations. Previous private ownership also included waterfowl impoundment and agriculture management that utilized pumps on the western most canal, jointly used by adjacent landowners. Recent site modifications by the NC Wildlife Resources Commission have been implemented to continue the traditional use of the facility but move the primary drainage to the current project area so as to avoid user conflict and update old pump equipment. The Little Alligator River in this area is classified SC Sw by the Environmental Management Commission and is designated a primary nursery area (PNA) by the NC WRC and anadromous fish spawning area (AFSA) by the NCWRC and NC Division of Marine Fisheries (NCDMF). Staff have reviewed the permit application and do not object to the culvert replacement and water control structure installation to allow continued use of an existing facility. Give a brief description of purpose, use, and daily operations of the project when complete. The North Carolina Wildlife Resources Commission began a Waterfowl Habitat Enhancement project in 2017. Partof this project included cleaning out a man-made ditch and replacing a culvert that had failed. The ditch was plugged with an earthen dam by previous landowners prior to State acquisition preventing water from entering or leaving the system. The removal of the earthen dam and replacing the collapsed culvert now allows water to freely move into and off of the property. It has been determined that replacing the new culvert with a water control structure will prevent inundation during high tide and wind driven events and reduce salt water intrusion inland. The stoplogs in the water control structure can be manually inserted in preparation of abnormally high tide or wind driven tide events to prevent water flowing inland. Stoplogs with hinged flap gates could be inserted most of the year that would prevent water from flowing inland when the river side of the water control structure is higher than the inland side while also naturally releasing water through gravity flow during periods when inland water levels exceed the rivers water level. c. Describe the proposed construction methodology, types of construction equipment to be used during construction, the number of each type of equipment and where it is to be stored. Two cofferdams will likely be installed, one on each side of the existing culvert, and the water pumped out to facilitate water control structure installation. The existing soil roadbed and the culvert will be removed with an excavator. Water control structure upright will likely receive a concrete base at the site and lowered to the elevations described in drawings attached as required for part 6-b. After the water control structure is installed, the pipe will becovered using material removed while removing culvert. This is a short-term project and equipment could be stored on adjacent roads or on inland uplands. d. List all development activities you propose. Replace an existing culvert with a flash board riser water control structure. Some of the stoplogs used may incorporate hinged flapgates that will allow water to drain from the system while preventing storm surge innodation and salt water intrusion. e. PROJECT SUMMARY: The applicant proposes to replace an existing culvert and construct a water control structure on an existing waterfowl impoundment adjacent Little Alligator River, Columbia, Tyrrell County. NCWRC- Texas Plantation Tyrrell County PROJECT SETTING The North Carolina Wildlife Resources Commission (NCWRC) has submitted a Major CAMA/Dredge and Fill request to replace an existing culvert and construct a water control structure in a manmade canal connecting 237 acres of waterfowl impoundments to the Little Alligator River. The 1,519-acre project site is located at 2674 Fort Landing Road (SR #1209) in Columbia, Tyrrell County off SR 1200. The property is currently Game lands and waterfowl impoundments that are managed by series of flash board risers and two permanent pump stations. Prior to the project site being acquired by the NCWRC the area was used for private hunting and agriculture and was drained using pumps on the western most canal. The connection through this canal has been closed off using an earthen berm, and water has been re -directed using a series of water control structures and pumps. This interior canal work was previously permitted by the United States Army Corps of Engineers Nationwide Permit 46 (ID SAW-2017-01369) and is currently completed. The North Carolina Division of Coastal Management authorized a replacement culvert on the eastern canal and maintenance excavation in the manmade canal with General Permit 68953-B. This excavation and culvert replacement were completed. The shoreline is currently wooded wetlands and not stabilized. The culvert and water control structure are approximately 1,000ft from the Little Alligator River. At the mouth of the canal there is an existing hunting cabin over the Little Alligator River. The property to the West and East of the project site are undeveloped and consists of wooded wetlands. The Little Alligator River at the project site is classified as SC; SW by the Environmental Management Commission and as Inland Waters, Primary Nursery Area, and Anadromous Fish Spawning Area by the North Carolina Wildlife Resources Commission. PROJECT DESCRIPTION The applicant proposes to replace an existing 30' long x 48" wide culvert with a 37' long x 48" wide culvert in the same alignment. The applicant is proposing to install a riser water control structure (either stop logs or hinged flap gates can be used) on the upstream side of the culvert to manage water levels during high water wind events. The stop logs will be position to allow water to gravity flow off the property late February to early May and the boards will be removed mid -July to August. The project will be in the alignment of an existing roadbed and all spoil material from construction will be kept on the existing road bed and will be returned to pre -project conditions. ANTICIPATED IMPACTS The project will result in localized turbidity due the removal of the existing culvert and installation of the new culvert. The elevated turbidity levels will be contained between two coffer dams. There will be temporary high ground disturbance during construction. Kevin Hart- 1 April 2019 RECEIVED Washington Regional Office APR 2 4 2019 DCM-MHD CITY Project Narrative: Texas Plantation Game Land Culvert Replacement with a Water Control Structure The North Carolina Wildlife Resources Commission began a Waterfowl Habitat Enhancement project in 2017 in cooperation with Ducks Unlimited Inc. to enhance three existing waterfowl impoundments and create four new waterfowl impoundment units in agricultural fields on Texas Plantation Game Land. The goal for the project is to provide seasonal shallow water wetland habitat for waterfowl, wading birds, and shorebirds and to provide public waterfowl hunting opportunities. The Texas Plantation Game Land is a recently acquired site that once served a similar function for a private hunting club. The habitat enhancement project was divided into two phases. Phase 1 was completed in 2018 and involved repairing an earthen dike to an existing impoundment and replacing one water control structure (WCS) and installing an additional WCS within the unit. In a second existing impoundment, an obsolete WCS was removed and a new WCS installed. Two new impoundments were constructed in agricultural fields and within the new impoundments, WCSs were installed to allow for water levels to be managed. A new centralized pump station was installed to allow water to be pumped into or out of these four impoundments. A ditch on the southern portion of the farm had been plugged to prevent water draining from the farm prior to NCWRC acquisition. This ditch was excavated to a depth equal to the receiving waters of the Little Alligator River, the earthen plug removed, and a collapsed culvert replaced. The removal of the earthen plug and replaced collapsed culvert now allows water to freely move on and off the property. Prior to the property's acquisition by the NCWRC, the majority of the site's water drained through a community shared canal and pump station on the western end of the property. To change direction of the flow, an earthen dam was installed in the southern perimeter canal. The plugging of this canal forces water out through the reopened ditch on the southern tip of the farm; thereby receiving flows from 92% of the game land area that was previously drained through the shared canal and pump station on the western edge of the property. The work completed in Phase 1 was conducted under the appropriate USACE and NCDWR permits. Only the work completed in the ditch on the southern tip of the property, including ditch clean out and culvert replacement, was within NCDCM's jurisdiction. A general permit was issued for this work. Phase 2 is currently in progress. This involves re -topping an existing impoundment and constructing two additional units in agricultural fields. The new waterfowl impoundments will have the associated WCS's to allow for water level management. A second centralized pump station will be installed to allow water to be pumped into or out of the three Phase 2 impoundments. VkECENEC RECEIVED FEB 14 Zp APR 24 2019 )CMWNRO DCM-MHD CITY It has been determined the newly installed culvert from Phase 1 at the end of the southern ditch has allowed the impoundment system to be affected by high tide and wind driven events. To remove the effect of high water inundation and salt water intrusion from these highwater events, the NCWRC proposes a WCS be installed at the location of the new culvert. Stoplogs in the WCS could be manually inserted prior to high water events to prevent water flows into the impoundment system. Stoplogs with hinged flap gates could be inserted to serve as tide gates. This would allow water to flow from the property but prevent water from entering the system during highwater events. The WCS would not restrict water flows coming into the impoundment system or alter aquatic habitat opportunities any more than the previous earthen dam that was removed one year ago. Water management on and off the property would be conducted as it has been to facilitate impoundment function. Shorebird use increases in late February through early May as they are resting, feeding, and staging for the migration north. Late winter waterfowl use peaks in January and February as they too are preparing for the migration north. During these months, water levels within the impoundments are slowly drawn down exposing new forage areas for shorebirds and waterfowl. During this drawdown period, the stoplogs will be positioned to allow water to gravity flow off the property. Fall shorebird migration begins in mid -July and runs through early October. However, some studies suggest that many shorebirds take a different route in the fall of the year that seems to hop over much of eastern NC. Blue -winged teal followed by green -winged teal are typically some of the earliest waterfowl migrants arriving in the region in September. Some of the heaviest waterfowl migrations south occur in mid -November. During this fall migration period, water levels in the impoundment units will be raised creating mudflats for shorebirds and shallow water areas for wading birds and waterfowl with average water depths 6" to 8". The boards in the proposed WCS would be removed to facilitate pumping through the ditch on the southern portion of the farm during this period. As previously mentioned, this property has been managed as a waterfowl impoundment for over 25 years. The proposed WCS in the southern ditch does not change or restrict flows and aquatic habitat opportunities any more than the previous earthen dam and collapsed culvert. However, the WCS would address impacts the system is receiving from high water inundation and salt water intrusion the newly installed culvert has introduced. The stoplogs in the water control structure can be manually inserted in preparation of abnormally high tide or wind driven tide events to prevent water flowing inland. Stoplogs with hinged flap gates could be inserted most of the year that would prevent water from flowing inland when the water level on the river side of the water control structure is higher than the inland side while also naturally releasing water through gravity flow during periods when inland water levels exceed the rivers' water level, essentially functioning as tide gates. The Division of Coastal Management (DCM) considers this to be in an "Area of Environmental Concern" under their regulations. Therefore, it is provided protection under state law. For this reason, the NCWRC will apply for a permit from DCM to perform the described work. Part of the permit process is notifying adjacent riparian landowners of the proposed work.
