Authorizing development in Dare County at Roanoke Sound approx. 1.5 nautical miles NE of
Northwest Point on Roanoke Island, as requested in the permittee's application dated 8/27/19, including
attached workplan drawings (3) Figures 2-3 dated 8/27/19 and Figure 4 dated 8/9/19.
This permit, issued on November 4, 2019 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
rf these terms may be subject to fines,
or civil action; or may cause the permit to cc min ana vota.
Artificial Reef AR-197
1) Unless specifically altered herein, this permit authorizes placement of additional material at artificial
reef AR-197, all as expressly and specifically set forth in the attached permit application, project
narrative, and workplan drawings. No other structure, whether submerged, floating or stationary,
shall become a permanent part of this artificial reef without permit modification. No non -water
dependent uses of structures shall be conducted on, in or over public trust waters without permit
modification.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2022
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONSS
Reef Structure
2) In accordance with commitments made by the permittee, reef construction within the site shall be
accomplished by the placement of approximately 2,000 tons of No. 4 granite as depicted in the attached
workplan drawings. All materials shall be free from loose dirt or pollutants except in trace quantities.
3) No material shall exceed the minimum vertical clearance as depicted in the attached workplans. The
pemritte shall be responsible for relocating or removing any material that violates the authorized
clearances.
4) No material shall be placed at any time in any waters outside of the alignment of the reef site boundaries
as indicated on the attached workplan drawings.
5) The permittee shall be required to repair, maintain and/or remove any components of the reef that are
displaced from the reef site boundaries as depicted in attached workplan(s). The permittee shall be
responsible for removing all portions of the reef should the site be terminated or displaced beyond
repair.
6) This permit does not authorize the placement of material within any rocky outcroppings/hard bottoms.
USACE Conditions
7) The U.S. Army Corps of Engineers (USACE) has assigned the proposed project SAW Action Id. No.
2018-00160. The USACE approved of this project under Regional General Permit 198500194 and
Programmatic General Permit 1980002911, dated received in Morehead City on 10/23/19. The
permittee shall abide by all conditions and stipulations set forth in the federal authorization. Any
violation of the permit approved by USACE shall be considered a violation of this CAMA permit.
General
8) In accordance with commitments made by the permittee, AR-197 site shall be marked with signage as
determined by the USCG private aids to navigation.
9) All precautions should be taken by the permittee to ensure the free and full use by the public of all
navigable waters at or adjacent to the authorized work. Use of the permitted activity shall not interfere
with the public's right to free navigation on all navigable waters of the United States.
10) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon
due notice from the Corp. of Engineers, to remove, relocate or alter the work or obstructions caused
thereby, without expense to the United States or the state of North Carolina. No claim shall be made
against the United States or the state of North Carolina on account of any such removal or alteration.
11) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.

12) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The N.C. Division of Water Resources has authorized the proposed project under General Water
Quality Certification No. 4175 (DWR Project No. 19-1211), which was issued on 10/11/19.
NOTE: Future development at the permitted Artificial Reef site may require a modification of this
permit. Contact a representative of the Division at (252) 264-3901 prior to the commencement of
any such activity for this determination.
NOTE: An application processing fee of $475 was received by DCM for this project. This fee also satisfied
the Section 401 application processing fee requirements of the Division of Water Resources.

measures 750 feet by 300 feet (5.26 acres or 229,126 square feet). A 100-foot buffer has been
established to ensure no material is placed outside the permitted reef boundary. One barge load

'NCDMF AR-197 Major Permit Recommendations
The NC Division of Marine Fisheries (NCDMF) proposes to enhance Artificial Reef 197 (AR-
197) through the placement of up to2,000 Sons of #4 size granite rock.
AR-197 is located at 350 57.110' N, -75a 42.337' W or f 1.5 nautical miles NE of Northwest
Point on Roanoke Island, within the Roanoke Sound, Dare County. The reef is 38.79 acres in
size and was originally permitted by the USACE in 1987. At that time, the reef was constructed
usingtires, which remain on the site. The limits of AR-197are currently marked with four 13"
spar buoys: MLW depth is 10 feet and navigational clearance is listed as 6 feet. A sidescan
survey of the site showed no existing shellfish resource or submerged aquatic vegetation in the
sandy substrate.
The development: proposal involves the Public Trust Area (PTA) and Estuarine Waters (EW)
Areas of Environmental Concern (AFC's).
The rules of the Coastal Resource Commission mention "artificial reefs" in 07H.0208(b)(12)
Submerged Lands Mining (A)(ii),.Natural reefs, coral outcrops, artificial reefs... shall be avoided.
While there are no development standards for artificial reefs, they are recognized as beneficial
fish habitat. The project will enhance the existing reef area.
It is recommended the project be approved with a condition that water depths of the reef be
maintained as proposed and that the granite material be free of any pollutants.

Consistency Determination: The request is consistent with/not in conflict with the Dare
County 2009 Land Use Plan certified by the CRC on February
24, 2011.
Overview: The 5.26 acre project site is located in the southeast corner of Artificial Reef-197 (AR-
197) a 38.79 acre artificial reef in the Roanoke Sound, 1.5 nautical miles NE of Northwest Point
on Roanoke Island. The reef was permitted in 1987 by the US Army Corps of Engineers
(USACE). Existing enhancements at AR-197 consist of tires located in the southwest corner of
the reef. The reef boundary is marked by four (4) 13 inch spar buoys.
Specific to the 5.26 acre project site, water depths are approximately 10 feet below Mean Low
Water (MLW). The bottom consists of sandy substrate. No existing shellfish resources or
submerged aquatic vegetation are located in the project site.
Placement of up to 2,000 tons of #4 size granite rock within 5.26 acres of AR-197 is proposed.
Rock will be located within a 300 foot by 750 foot area. A 100 foot perimeter buffer will be
established around the area to ensure no material is placed outside the reef boundary. Rock will
be transported by barge to the reef and sprayed off the deck onto the water bottom. It will be
placed in scattered mounds measuring up to 2 feet in height. Vertical clearance of 8 feet will be
provided for navigation.
The Roanoke Sound in this area is classified as SA and HQW and is closed to shellfishing. A
review of significant historic or archaeological resources was not provided.

Anticipated Impacts resulting from this project are expected to include: the filling of 5.26 acres of
Public Trust Area/Estuarine Waters Area of Environmental Concern (AEC).
Basis for Determination:
The project site is in the Roanoke Sound. As indicated on Page 217 of the Dare County Land
Use Plan (LUP) the "Conservation" designation applies to all CAMA Areas of Environmental
Concern (AECs). As indicated on Page 217, the purpose of the Conservation classification is to
provide for the effective long-term management and protection of significant, limited, or
irreplaceable areas. A glossary of terms used in the policy statements is provided on Page 139.

Reference the application of the NC Division of Marine Fisheries to construct a new artificial
reef by placing two decommissioned, cleaned, and prepared vessels (100' — 200' class) and up to
8,000 tons of recycled precast concrete over 9.3 acres of the proposed 163-acre reef site, located
approximately 7.5 miles SE of Oregon Inlet and 2.5 miles offshore of Pea Island, in the Atlantic
Ocean, Dare County, North Carolina.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. All work authorized by this permit must be performed in strict compliance with the attached
plans, the NMFS Sea Turtle and Smalltooth Sawfish Construction Conditions, Dated March 23,
2006, NCDMF Guidelines and Specifications for Acceptable Reef Materials, ASMFC/GSMFC
Guidelines for Marine Artificial Reef Materials, Environmental Protection Agency's National
Guidance: Best Management Practices (BMPs) for Preparing Vessels Intended to Create
Artificial Reefs, NOAA/NMFS National Artificial Reef Plan and artificial reef guidance and
conditions set forth in the Corps' Regional General Permit 198500194 and Programmatic
General Permit 1980002911 which are a part of this permit. Any modification to these plans
must be approved by the US Army Corps of Engineers (USACE) prior to implementation.
2. The Permittee will comply with the NMFS Biological Opinion (BO) SER-2019-00225, SER-
2019-19783 issued on October 18, 2019 which contains mandatory terms and conditions to
implement the Reasonable and Prudent Measures (RPM) that are associated with "incidental
take' that is also specified in the BO's. Your authorization under this USACE permit is
conditional upon your compliance with all of the mandatory terns and conditions associated
with incidental takes of the attached Opinions, which terms and conditions are incorporated by
reference in this permit. Failure to comply with the terms and conditions associated with
incidental take of the BO, where a take of the listed species occurs, would constitute an
unauthorized take, and it would also constitute non- compliance with your USACE permit. The
USFWS and NMFS are the appropriate authorities to determine compliance with the terns and
conditions of their BOs, and with the ESA.

NCDMF Special Conditions
1. Any deployment of reef materials during North Atl'e PIX"J" on (November
15 through April 15 of any year) must comply with:
a. Maximum speed for all vessels involved in placing the reef material is 10 knots.
b. When practicable, deployments will be conducted during daylight hours when lighting,
weather, and sea conditions allow for visual monitoring of the project area.
c. Deployment activities will cease immediately if sea turtles or marine mammals are sighted
within 50 feet of the construction area and will not recommence until the protected species
observer reports that the ESA listed species has left the area under its own volition. NCDMF and
its designees are also required to participate in the Right Whale Early Warning System to protect
North Atlantic right whales. If a right whale or any other species of whale is reported within the
area, then the contractor will be required to follow the enclosed NMFS's Southeast Region
Vessel Strike Avoidance Measures and Reporting for Mariners (revised February 2008)
(Appendix B), except where specific measures below are in conflict, in which case the measures
in this Opinion govern (e.g., a speed restriction to a maximum of 10 knots (kt) at all times in
right whale calving areas [i.e., federally -protected areas off the southeastern U.S. coast
designated and implemented for the protection of right whales and their calves during their
calving/migration season] for vessels 65 feet in length or greater). By law, vessels shall maintain
a 500-yd buffer between the vessel and any North Atlantic right whale [as required by federal
regulation 50 CFR 224.103 (c)].
2. If a listed species is seen within established exclusionary zones, all appropriate precautions shall
be implemented to ensure its protection. These precautions shall include cessation of operation
of any moving equipment closer than 50 feet of a listed species. Activities may not resume until
the protected species has departed the project area of its own volition.
3. Reef structures shall be sited and installed in accordance with the permitted boundaries and site
clearances.
4. Reef structures shall not be placed on natural hard -bottom habitat.
5. Materials should be of sufficient size and relative density to not move from the reef site post -
deployment and be clean and free from asphalt, creosote, petroleum, other hydrocarbons and
toxic residues, loose free floating material or other deleterious substances.
6. The use of explosives to deploy materials is not authorized.
7. Reef materials shall be selected to ensure that ESA -listed species do not become entrapped in reef
structures, or entangled in debris (e.g., abandoned fishing tackle, nets, and lines) that may
accumulate on artificial reefs:
a. Materials used for artificial reef building shall conform to the recommendations in the National
Artificial Reef Plan (as Amended): Guidelines for Marine Artificial Reef Materials, Second
Edition (Atlantic and Gulf States Marine Fisheries Commissions 2004). Except that derelict
automobiles shall not be used and derelict vessels and military surplus shall have openings on all
exposed sides adequate to prevent entrapment of ESA -listed species. Openings will be sufficient
of sufficient size and quantity to allow for several points of egress for sea turtle species that may
enter the stricture.
b. Military surplus and vessel strictures such as ladders, rails, booms, antennas, etc. will be
removed to reduce the potential accumulation of abandoned fishing tackle and lines. Clean steel,
concrete bridge, or large building demolition materials such as slabs or pilings may be used
provided that all steel reinforcement rods do not protrude more than 3 inches.
S. During regularly scheduled reef assessments, staff will make reasonable attempts to clean reef
materials of debris, without compromising the safety of the crew and divers. For example,
precluding conditions might involve low visibility or high current, which may present diver
safety issues and increase the potential of divers being entangled or snagged. The Permittee will
send confirmation of cleanup to NMFS's Southeast Regional Office
(takereport.nmfsser@noaa.gov), including dates of cleanup efforts and results of the clean-up.
9. The Permittee shall follow NMFS's Sea Turtle and Smalltooth Sawfish Construction Conditions
to further reduce interaction risk and require all construction workers to watch for sturgeon and
sea turtles. Operation of any mechanical construction equipment will cease immediately if a
protected species is seen within a 50-foot radius of the equipment. Activities will not resume
until the protected species has departed the project area of its own volition.
10. In order to fiuther protect the endangered West Indian Manatee, Trichechus manatus, the
Permittee must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly
adhere to all requirements therein. The guidelines can be found at https://www.fws.eov/nc-
es/mammal/manatee guidelines.pdf.
11. All material placed to construct reefs (specifically designed reef modules) will be selected and
placed so as to avoid the movement of reef materials due to sea conditions or currents. The
Permittee will be responsible for any materials which are moved by sea conditions or which
break loose from reefs, and the Permittee will be responsible for any damage caused by such
materials.
12. All materials used for construction of reefs shall be consistent with the National Artificial Reef
Plan and will be clean and free of petroleum and other hydrocarbons (oil, grease, asphalt and
creosote), toxic residues (mercury, cadmium and lead) and loose, free floating material and other
deleterious substances and/or in compliance with criteria established by the U.S. Environmental
Protection Agency (EPA).
13. The use of tires, Fish Aggregating Devices (FADS), post -use sanitary sewer materials,
automobiles and other civilian vehicles, white goods (refrigerators; washers, etc.) boat molds,
floatables, loose organic material and general demolition debris, other than clean concrete units
to form reefs, are not authorized.
14. The placement of material within any jurisdictional wetland, submerged aquatic vegetation bed,
coral reefs, oyster reefs, mussel beds, scallop beds, clam beds or live bottoms ( REM

the growth of sponges, sea fans, soft coral and other sessile macro invertebrates generally
associated with rock outcrops) is not authorized.

General Conditions
The permittee understands and agrees that, if future operations by the United States require the
removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall
cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will
be required, upon due notice from the U.S. Army Corps of Engineers, to remove, relocate, or
alter the structural work or obstructions caused thereby, without expense to the United States. No
claim shall be made against the United States on account of any such removal, relocation, or
alteration. The permittee shall notify NOAA/NATIONAL OCEAN SERVICE Chief Source Data
Unit N CS261, 1315 E West HWY- RM 7316, Silver Spring, MD 20910- 3282 at least two
weeks prior to beginning work and upon completion of work.
4. Except as specified in the plans attached to this permit, no excavation, fill or mechanized land -
clearing activities shall take place at any time in the construction or maintenance of this project,
in such a manner as to impair normal flows and circulation patterns within waters or wetlands
or to reduce the reach of waters or wetlands.
5. Except as authorized by this permit or any USACE approved modification to this permit, no
excavation, fill or mechanized land -clearing activities shall take place at any time in the
construction or maintenance of this project, within waters or wetlands. This permit does not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
Unless otherwise authorized by this permit, all fill material placed in waters or wetlands shall be
generated from an upland source and will be clean and free of any pollutants except in trace
quantities. Metal products, organic materials (including debris from land clearing activities), or
unsightly debris will not be used.
7. The authorized structure and associated activity must not interfere with the public's right to free
navigation on all navigable waters of the United States. No attempt will be made by the
permittee to prevent the full and free use by the public of all navigable waters at or adjacent to
the authorized work for reason other than safety.
8. The permittee shall advise the Corps in writing at least two weeks prior to beginning the work
authorized by this permit and again upon completion of the work authorized by this permit.
9. The permittee shall require its contractors and/or agents to comply with the terms and conditions
of this permit in the construction and maintenance of this project, and shall provide each of its
contractors and/or agents associated with the construction or maintenance of this project with a
copy of this permit. A copy of this permit, including all conditions, shall be available at the
project site during construction and maintenance of this project. RECEIVED

10. Violations of these conditions or violations of Section 404 of the Clean Water Act or Section 10 of
the Rivers and Harbors Act must be reported in writing to the Wilmington District U.S. Army Corps
of Engineers within 24 hours of the permittee's discovery of the violation.
11. The permittee shall employ all sedimentation and erosion control measures necessary to prevent an
increase in sedimentation or turbidity within waters and wetlands outside the permit area. This shall
include, but is not limited to, the immediate installation of silt fencing or similar appropriate devices
around all areas subject to soil disturbance or the movement of earthen fill, and the immediate
stabilization of all disturbed areas. Additionally, the project must remain in full compliance with all
aspects of the Sedimentation Pollution Control Act of 1973 (North Carolina General Statutes
Chapter 113A Article 4).
12. The activity will be conducted in such a manner as to prevent a significant increase in turbidity
outside the area of construction or construction -related discharge. Increases such that the turbidity in
the waterbody is 50 NTU's or less in all rivers not designated as trout waters by the North Carolina
Division of Environmental Management (NCDEM), 25 NTU's or less in all saltwater classes and in
all lakes and reservoirs, and 10 NTU's or less in trout waters, are not considered significant.

PROJECT SUMMARY: The NC Division of Marine Fisheries (NCDMF) proposes to
enhance Artificial Reef-197 (AR-197) through the placement of up to 2,000 tons of #4
size granite rock.
Project Setting
AR-197 is located at 350 57.110' N, -75° 42.337' W or t1.5 nautical miles NE of Northwest
Point on Roanoke Island, within the Roanoke Sound, Dare County. The reef is 38.79 acres in
size and was originally permitted by the USACE in 1987. At that time, the reef was constructed
using tires, which remain on the site. The limits of AR-197 are currently marked with four 13"
spar buoys. MLW depth is 10 feet and navigational clearance is listed as 6 feet. A sidescan
survey of the site showed no existing shellfish resource or submerged aquatic vegetation in the
sandy substrate.

Development Proposal
The NCDMF proposes to add up to 2.000 tons of #4 size granite rock to AR-197. This
development is planned to occur within a 5.26-acre portion of the 38.79-acre site.
The granite rock will be loaded onto a self-propelled barge at a stockpile site located at the
Wanchese industrial park and then transported to the reef. The barge is equipped with a water
monitor which will be used to spray the rock off the deck onto the water bottom. It is expected
that the granite rock will be washed at the quarry to reduce the likelihood of turbidity.
The area of water bottom that the rock will be placed measures t750 feet x 300 feet. The rock
will be placed in scattered mounds measuring up to 2 feet tall, leaving 8 feet of vertical
clearance for navigation. A 100-foot buffer has been established around the development area
to insure no material is placed outside of the reef boundary.
Anticipated Impacts
The project as proposed will result in the filling of t229,126 ft' (5.26 acres) of water bottom
within the Public Trust Area and Estuarine Waters AEC's. Temporary water turbidity will occur
during rock placement.

NCDMF Artificial Reefs
The North Carolina Division of Marine Fisheries (NCDMF) Artificial Reef Program has
been formally operating since the 1970's and manages 68 artificial reefs and oyster sanctuaries.
Twenty-five (25) of these sites are located in estuarine waters, and the remaining 43 are in ocean
waters. In 2016, the NCDMF released an artificial reef guide which outlines each of the artificial
reefs and oyster sanctuaries. This document provides material information, latitude longitude
information, and a figure of the material on the reef site. A pdf version of the hardcopy reef

state, and federal agencies.
Boundaries for each reef site were defined in a boundary packet which detailed the
coordinates of each reef, material locations, reef boundaries, and acreages of reefs and materials.
This packet was accepted by Division of Coastal Management on July 10, 2017 and USACE on
October 25, 2017. Letters acknowledging the acceptance of this reef packet are shown in
attachments 1, 2 and 3.
Project Background RECEIVED
The site is located about 1.5 nautical miles NE of Northwest Point on Roanoke Island as
shown in Figure 1. It was originally permitted by US Army Corps of Engineers in 1987
(SAWC077-N-028-0082). NCDMF does not have a record of a CAMA permit for the reef site, $ EP 1 1 "' 9
likely because construction was authorized prior to the implementation of current pernittingDCM-MHD
practices. The reef is 38.79 acres in size and was originally constructed using tires. The tires CITY
remain on the reef site and can be seen in Figures 2 and 3. AR-197 is currently marked with four
13" diameter spar buoys emblazoned with an orange diamond and the word "REEF". ML W
depth is 10 feet and navigational clearance is listed as 6 feet. A sidescan survey of the site
showed no existing shellfish resource or submerged aquatic vegetation (Figure 3).
Artificial reef materials are selected on four primary considerations: Function,
compatibility, durability, and stability. Accepted materials include concrete, vessels, and natural
materials and were chosen based on the above criteria, using guidance from internal program
studies, The ASMFC/GSMFC Guidelines for Marine Artificial Reef Materials (Second Ed.,
2004), The Environmental Protection Agency's (EPA) National Guidance: Best Management
Practices (BMPs) for Preparing Vessels Intended to Create Artificial Reefs, and the
NOAA/NMFS National Artificial Reef Plan. Concrete structures include recycled pre -fabricated
materials, crushed concrete, and pre -designed concrete reef material. These concrete structures
must be free of protruding rebar and any open bottomed structure must have an opening in the

to escape. Vessels consist of preferably large steel hulled vessels for longevity. Examples of
natural material include calcium carbonate shells, limestone marl, granite and basalt. All
materials must be cleaned and prepared in accordance with United States Corps of Engineers
General (Regional) Permits (4GP198500194 or #GPI9000291), applicable NC Division of
Coastal Management permits, Division of Water Resources permits, and conform to site -specific
navigational clearance requirements published by the United States Coast Guard and NOAA
Office of Coast Survey. This includes the removal of all pollutants and tangle hazards such as
railings, antennas, etc., from vessels.
Proposed Enhancements
Through a Sport Fish Restoration grant, the NCDMF Artificial Reef program plans to
purchase up to 2000 tons of #4 size granite rock (3/4"-2" average size) for use at AR-197. This
rock is typically washed at the quarry, reducing the likelihood of excessive turbidity during the
deployment process.
This development is planned to occur in a 5.26-acre portion of the 38.79-acre site. This
material will be loaded onto a self-propelled barge at a stockpile location nearby at the Wanchese
industrial park. The barge is equipped with a water monitor which will be used to spray rock off
the deck. This deployment strategy has been used successfully by NCDMF for many years in
cultch planting efforts and produces low -profile mounds of material. For this project, we plan to
modify the cultch planting style of deployment and create slightly taller mounts, up to 2 feet off
the bottom. A profile view can be seen in Figure 4.
Deployments will follow protected species avoidance measures as outlined in the
ongoing USACE consultation with NMFS-PRD as well as USFWS Guidelines for Avoiding
Impacts to the West Indian Manatee.

State approval to enhance Artificial Reef-197 located 1.5 Nautical Miles NE of Northwest Point
on Roanoke Island within Roanoke Sound in Dare County. It was received complete on September
10, 2019 and appears to be adequate for processing at this time. The projected deadline for making
a decision is November 24, 2019. An additional 75-day review period is provided by law when
such time is necessary to complete the review. If you have not been notified of a final action by
the initial deadline stated above, you should consider the review period extended. Under those
circumstances, this letter will serve as your notice of an extended review. However, an additional
letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from September 10, 2019, you may
request a meeting with the Director of the Division of Coastal Management and permit staff to
discuss the status of your project. Such a meeting will be held within five working days from the
receipt of your written request and shall include the property owner, developer, and project
designer/consultant.
NCGS I I3A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted
at the property of your proposed development. You should post this notice at a conspicuous point
along your property where it can be observed from a public road. Some examples would be:
Nailing the notice card to a telephone pole or tree along the road right-of-way fronting your
property, or at a point along the road right-of-way where a private road would lead one into your
property. Failure to post this notice could result in an incomplete application.
