This permit, issued on March 5, 2020 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to lines, imprisonment or ctvu action; or may cause me permit to be nmt ana vota.
1) Unless specifically altered herein, this Minor Modification authorizes realignment of the docking
facility, covered platform and osprey pole, all as expressly and specifically set forth in the attached
letter and workplan drawings. Any additional development activities may require a modification of
this permit.
2) The authorized covered platform shall not be enclosed. Any material used on the sides shall not
obstruct view and shall be permeable to air and water. Screen or wire on the sides along with benches
are permitted. Lattice is specifically excluded from being used under this authorization.
3) The roof of the covered platform shall not be designed for second story use.
(See attached sheet for additional conditions)
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2022
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

Comity; request for Minor Modification/Letter of Refinement
At our previous pre -construction meeting, we discussed a number of design changes that the owner would
like to incorporate into the permitted development. These included the following:
1) The alignment of the eastermuost portion of the pier has been shifted two feet to the west to
provide additional clearance from the eastern riparian line.
2) The Boat House has been shifted landward along the pier to the point where a uniform depth of
-5.2-ft (NWL) begins.
3) A partially roofed swim platform is to be incorporated at the end of the pier, extending no farther
than the pennitted length of the pier.
4) An osprey -nesting pole is to be installed between the kayak launch platform and the Boat House.
New drawings are enclosed to reflect these proposed changes. These drawings include:
Sheet I — Proposed Pier/Walkways, Boatlift, Boat House & Swim & Kayak Launch Platform provides an
overview reflecting the position of the changes.
Sheet 2 — Boat House Construction Details, which reflects a reduction in the number of supporting piles
from 6 on each side, to 5 on each side, and an increase in pier height to +5-ft above NWL.
Sheet 3 — Swim Platform Construction Details, which reflects a swim platform, with an approximate 8-ft
unroofed, step-down section at +241 NWL, and an approximate 1641 roofed section at +541
NWL. The total area of the proposed Swim Platform is 385 sq-ft, and the area of the roofed
portion of the platform is 304 sq-ft to the drip line.
Sheet 4 — Roofed Swim Platform Construction Details (Enlarged) reflects the roofed portion of the Swim
Platform.
Sheet 5 — Bulkhead Construction Details reflects the bulkhead to be constructed to a height +6-ft above
NWL.

Minor Modification to Major Permit
1. Ted Sampson has requested a Minor Modification to Major Permit #64-19,
which was issued on August 7, 2019 and expires on December 31, 2019. The
original major permit authorized bulkhead construction and a docking facility.
2. Ted Sampson has requested to modify Major Permit #64-19 to shift the
authorized pier 2 feet to the west, shift the boathouse landward, add a partially
roofed platform to the end of the pier and add an osprey pole.

3. I conducted a site visit on December 10, 2019 to review the Minor
Modification request pursuant to the provisions of reference (a) and have
determined that the request meets the requirements contained in 15A NCAC
07H .0208 USE STANDARDS. Specifically, the request to reconfigure the pier and
add an osprey pole will comply with 071-1.0208 (b) (6) (B).
4. The required fee of $100, paid by Check #7885, was received by the Elizabeth
City District Office on December 20.2019.
5. It is recommended that the Minor Modification request be granted, provided
all the Permit Conditions of the original permit issued on August 7. 2019 remain in
effect.
6. Notification attempts have been initiated with only one returned green card
and the second is waiting confirmation of delivery to be provided upon receipt.

Shoreline Stabilization - Bulkhead
1) The bulkhead shall be constructed in accordance with the alignment depicted on the attached workplan
drawings.
2) No vegetated wetlands shall be excavated or filled, even temporarily.
3) No open water shall be excavated or filled, even temporarily, outside the approved bulkhead alignment.

4) The alignment of the authorized bulkhead shall be staked by the permittee and verified by a
representative of the Division of Coastal Management within a maximum of 30 days prior to the start of
construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse
weather conditions, shall require the alignment to be re -staked by permittee and verified by DCM within
a maximum of 30 days prior to the new expected start of construction.
5) The bulkhead shall be constructed prior to any backfilling activities.
6) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the
structure.
7) The fill material shall be clean and free of any pollutants except in trace quantities.
8) All backfill material shall be obtained from a high ground source and confined behind the permitted
bulkhead.
Sedimentation and Erosion Control
9) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of
grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately
landward of the bulkhead cap immediately following completion of backfilling activities.
Docking Facility
10) This permit authorizes only the docks, piers, and other structures and uses located in or over the water
that are expressly and specifically set forth in the permit application. No other structure, whether
floating or stationary, shall become a permanent part of this docking facility without permit
modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust
waters without permit modification.
11) Any portion of the permitted access pier and docking facilities built over Coastal Wetlands shall not
exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as
measured from the bottom of the decking.
12) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
13) This permit authorizes a maximum of 1 formalized boat slip.
14) The boathouse shall not be completely enclosed or have side coverage more than one half the height of
the side, from the roof waterward. The footprint of the boathouse shall not exceed the dimensions on the
authorized workplans.

15) The authorized boathouse shall be single story, and shall not he designed to allow for second story use.
16) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
17) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure and the adjacent property owner's areas of riparian access.
General
18) In order to reduce the potential for negative effects on the spawning migration of anadromous fish, no
in -water work shall be permitted between February 15 and June 30 of any year without the prior
approval of the Division of Coastal Management, in consultation with appropriate resource agencies.
19) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
20) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the
permitted activity without having it transferred to a third party.
21) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action ID SAW-2019-01213) issued 8/2/19.
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 2019-6881 issued 8/6/19.
NOTE: Future development of the permittee's property may require a modification of this permit.

such activity for this determination. The permittee is further advised that many non -water

unclaimed. I have checked again with the Chowan County online records for this property, and find Mr.
Shalaby still listed as the owner, with the same address in Carson, CA. If this notification is returned
unclaimed, I will provide you with the returned letter.
Also enclosed are copies of the Certified Mail Receipts and Green Cards for the riparian owners. I will
later provide the copies received from the Post Office after delivery has been accomplished/attempted.

Permit was subsequently issued. This project has now entered the construction stage, and the owners have
requested a mmnber of minor modifications on the development to be constructed.
The North Carolina Division of Coastal Management is evaluating the proposed modifications and
requires re -notification of riparian property owners of requested modifications to the existing Permit.
Chowan County records still reflect you as the property owner to the west of MOD, LLC's, Lot 47, Farms
at Riversound (PIN 784500692478) in Chowan County, located at 620 Flagship Court, adjacent to your
Lot 48, at 621 Flagship Drive.
The proposed development modifications can be summarized as follows:
1) The alignment of the easternmost portion of the pier has been shifted two feet to the west
to provide additional clearance from the eastern riparian line.
2) The Boat House has been shifted landward along the pier to the point where a uniform
depth of -5.2-ft (NWL) begins.
3) A partially roofed swim platform is to be incorporated at the end of the pier, extending no
farther than the permitted length of the pier.
4) An osprey -nesting pole is to be installed between the kayak launch platform and the Boat
House.
These proposed modifications are reflected on a new site drawing, enclosed.
As an adjacent riparian neighbor to the development location, the CAMA Permit process provides you
with the opportunity to advise the NC Division of Coastal Management of whether you have any
comments relating to the proposed work. Landowners have 30 days from the date of notification in which
to conmrent. Such comments will be considered by the State in reaching a final decision on the
application for Permit modification.
