ADDITIONAL CONDITIONS
3) The bridge will have a minimum vertical navigational clearance of 4 feet above the NWL at the lowest
part of the bridge. The bridge shall provide a minimum horizontal navigational clearance of 6 feet.
4) No fill material shall be placed at any time in any vegetated wetlands or surrounding waters outside of
the alignment of the fill area indicated on the workplan drawing(s).
5) If the crossing of wetlands with mechanized construction equipment is necessary, temporary
construction mats shall be utilized for the areas to be crossed. The temporary mats shall be removed
immediately upon completion of construction.
Sedimentation and Erosion Control
6) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses or properties.
7) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of
USACE Conditions
8) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must
implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein.

9) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
10) The permittee shall maintain the authorized work in good condition and in conformance with the terns
and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the
permitted activity without having it transferred to a third party.
11) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action ID SAW-2019-00951) issued 11/25/19.
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water

The proposed driveway and bridge will provide permanent access to the existing mobile home. The property owners have
used an adjacent property owners bridge to access the mobile home but ownership has changed and this is no longer an
option. The proposed brdige will privide permanent access over an existing ditch.

of equipment and where it is to be stored.
The pier and bridge pilings will be installed hydraulically with a pump. The remaining construction will be done by hand using
conventional framing techniques. A pickup truck will be used to transport material over the bridge as it is being constructed.
Any equipment being used will be stored onsite when not in use.

SUBJECT: Recommendations for Major Permit Application submitted on behalf of:
Tim and Deborah McCollister
The applicants' request is for the construction of a 24'x12' wooden, elevated bridge over a man-made
canal and a gravel access/driveway to access an existing mobile home. The construction of the
driveway will fill approximately 535 sf of US Army Corps of Engineer 404 wetland vegetation. The fill
material proposed for the driveway will be 4", #57 stone, and will be laid over geotextile fabric. The
project is located at Parcel #014909000 at 0 NC 12 Hwy, Lot 2, Block A of C H Fulcher Tract
subdivision, in Frisco, Dare County. The 48,000± sf lot is next to their single-family residence at 52138
NC 12 Hwy, Frisco. The man-made canal connects to the Pamlico Sound.
The development proposal involves the Estuarine Shoreline (ES) and Public Trust Shoreline (PTS)
AECs, as well as the Estuarine Waters (EW) and Public Trust Area (PTA) AECs.
1 have reviewed the Rules of the Coastal Resources (CRC) as they pertain to this proposal, and my
findings are as follows:

(c) Management Objective. To conserve and manage the important features of estuarine waters so as
to safeguard and perpetuate their biological, social, aesthetic, and economic values; to coordinate and
establish a management system capable of conserving and utilizing estuarine waters so as to maximize
their benefits to man and the estuarine and ocean system.
(d) Use Standards. Suitable land/water uses shall be those consistent with the management
objectives in this Rule. Highest priority of use shall be allocated to the conservation of estuarine waters
and their vital components. Second priority of estuarine waters use shall be given to those types of
development activities that require water access and use which cannot function elsewhere such as
simple access channels; structures to prevent erosion; navigation channels; boat docks, marinas, piers,
wharfs, and mooring pilings. In every instance, the particular location, use, and design characteristics
shall be in accord with the general use standards for coastal wetlands, estuarine waters, and public
trust areas described in Rule .0208 of this Section.
Consistent: The project meets the use standards and is consistent with the intent of this rule.

15A NCAC 071-1.0208 USE STANDARDS
(a) General Use Standards
(1) Uses which are not water dependent shall not be permitted in coastal wetlands, estuarine
waters, and public trust areas. Restaurants, residences, apartments, motels, hotels, trailer parks,
private roads, factories, and parking lots are examples of uses that are not water dependent. Uses that
are water dependent include: utility crossings, wind energy facilities, docks, wharves, boat ramps,
dredging, bridges and bridge approaches, revetments, bulkheads, culverts, groins, navigational aids,
mooring pilings, navigational channels, access channels and drainage ditches;
Consistent: The proposed vehicular bridge is water dependent.
(2) Before being granted a permit, the CRC or local permitting authority shall find that the applicant
has complied with the following standards:
(A) The location, design, and need for development, as well as the construction activities
involved shall be consistent with the management objective of the Estuarine and Ocean
System AEC (Rule .0203 of this subchapter) and shall be sited and designed to avoid
significant adverse impacts upon the productivity and biologic integrity of coastal wetlands,
shellfish beds, submerged aquatic vegetation (SAV) as defined by the Marine Fisheries
Commission, and spawning and nursery areas;
(B) Development shall comply with state and federal water and air quality
(C) Development shall not cause irreversible damage to documented archaeological or historic
resources as identified by the N.C. Department of Cultural resources;
(D) Development shall not increase siltation;
(E) Development shall not create stagnant water bodies;
(F) Development shall be timed to avoid significant adverse impacts on life cycles of estuarine
and ocean resources; and
(G) Development shall not jeopardize the use of the waters for navigation or for other public
trust rights in public trust areas including estuarine waters.
Consistent: The location and design of the bridge approach and driveway are sited to avoid
coastal wetlands; 535 sf of 404 wetlands is proposed to be filled during the construction. There
were no SAVs in the adjacent canal. The bridge is proposed to be 4' above NWL for navigation
clearance.
(3) When the proposed development is in conflict with the general or specific use standards set
forth in this Rule, the CRC may approve the development if the applicant can demonstrate that the
activity associated with the proposed project will have public benefits as identified in the findings and
goals of the Coastal Area Management Act, that the public benefits outweigh the long range adverse
effects of the project, that there is no reasonable alternate site available for the project, and that all
reasonable means and measures to mitigate adverse impacts of the project have been incorporated
into the project design and shall be implemented at the applicant's expense....
Consistent: The proposed development is not in conflict with the General Use Standards.

(a) Description. The Coastal Shorelines category includes estuarine shorelines and public trust
shorelines.

(c) Management Objective. All shoreline development shall be compatible with the dynamic nature of
coastal shorelines as well as the values and the management objectives of the estuarine and ocean
system. Other objectives are to conserve and manage the important natural features of the estuarine
and ocean system so as to safeguard and perpetuate their biological, social, aesthetic, and economic
values; to coordinate and establish a management system capable of conserving and utilizing these
shorelines so as to maximize their benefits to the estuarine and ocean system and the people of North
Carolina.
(d) Use Standards. Acceptable uses shall be those consistent with the management objectives in
Paragraph (c) of this Rule. These uses shall be limited to those types of development activities that will
not be detrimental to the public trust rights and the biological and physical functions of the estuarine
and ocean system. Every effort shall be made by the permit applicant to avoid or minimize adverse
impacts of development to estuarine and coastal systems through the planning and design of the
development project. Development shall comply with the following standards:
(1) All development projects, proposals, and designs shall preserve natural barriers to erosion,
including peat marshland, resistant clay shorelines, and cypress -gum protective fringe areas adjacent
to vulnerable shorelines.
(2) All development projects, proposals, and designs shall limit the construction of impervious
surfaces and areas not allowing natural drainage to only so much as is necessary to service the
primary purpose or use for which the lot is to be developed. Impervious surfaces shall not exceed 30
percent of the AEC area of the lot, unless the applicant can demonstrate, through innovative design,
that the protection provided by the design would be equal to or exceed the protection by the 30 percent
limitation. Redevelopment of areas exceeding the 30 percent impervious surface limitation shall be
permitted if impervious areas are not increased and the applicant designs the project to comply with the
rule to the maximum extent feasible.
(3) All development projects, proposals, and designs shall comply with the following mandatory
standards of the North Carolina Sedimentation Pollution Control Act of 1973:
(A) All development projects, proposals, and designs shall provide for a buffer zone along the
margin of the estuarine water that is sufficient to confine visible siltation within 25 percent of
the buffer zone nearest the land disturbing development.
(B) No development project proposal or design shall propose an angle for graded slopes or fill
that is greater than an angle that can be retained by vegetative cover or other erosion
control devices or structures.
(C) All development projects, proposals, and designs that involve uncovering more than one
acre of land shall plant a ground cover sufficient to restrain erosion within 30 working days
of completion of the grading; unless the project involves clearing land for the purpose of
forming a reservoir later to be inundated.
(4) Development shall not have a significant adverse impact on estuarine and ocean resources.
Significant adverse impacts include development that would directly or indirectly impair water quality
increase shoreline erosion, alter coastal wetlands or Submerged Aquatic Vegetation (SAV), deposit
spoils waterward of normal water level or normal high water, or cause degradation of shellfish beds.
(5) Development shall not interfere with existing public rights of access to, or use of, navigable
waters or public resources.
(6) No public facility shall be permitted if such a facility is likely to require public expenditures for
maintenance and continued use, unless it can be shown that the public purpose served by the facility
outweighs the required public expenditures for construction, maintenance, and con f � a�sI'V®

(7) Development shall not cause irreversible damage to valuable, historic architectural or
archaeological resources as documented by the local historic commission or the North Carolina
Department of Natural and Cultural Resources.
(8) Established common-law and statutory public rights of access to the public trust lands and
waters in estuarine areas shall not be eliminated or restricted. Development shall not encroach upon
public accessways nor shall it limit the use of the accessways.
Consistent: The proposed development meets the use standards and is consistent with the
intent of this rule.
(9) Within the AECs for shorelines contiguous to waters classified as ORW by the EMC, no CAMA
permit shall be approved for any project that would be inconsistent with rules adopted by the CRC,
EMC or MFC for estuarine waters, public trust areas, or coastal wetlands. For development activities
not covered by specific use standards, no permit shall be issued if the activity would, based on site -
specific information, degrade the water quality or outstanding resource values.

development shall be located 'a distance of 30 feet landward of the normal water level or normal high
water level, with the exception of the following:

(C) Post- or pile -supported fences;
(D) Elevated, slatted, wooden boardwalks exclusively for pedestrian use and six feet in width or

(E) Crab Shedders, if uncovered with elevated trays and no associated impervious surfaces
except those necessary to protect the pump;
(F) Decks/Observation Decks limited to slatted, wooden, elevated and unroofed decks that shall
not singularly or collectively exceed 200 square feet;
(G) Grading, excavation and landscaping with no wetland fill except when required by a
permitted shoreline stabilization project. Projects shall not increase stormwater runoff to
adjacent estuarine and public trust waters;
Consistent: The vehicular bridge and bridge approaches are considered water dependent (per
07H.0208(a)(1). The project will not increase stormwater runoff to the adjacent waterbody.
Based on my review of the applicable subsections of the North Carolina Administrative Code, the
permit application, and plans submitted by Tim and Deborah McCollister, I recommend a Major Permit
be issued to the applicants based on their current proposal, and subject to the standard permit
conditions.

Recommendations for Major Permit Application submitted on behalf of:
Tim and Deborah McCollister
The applicants' request is for the construction of a 24'xl2' wooden, elevated bridge over a man-made
canal and a gravel access/driveway to access an existing mobile home. The construction of the
driveway will fill approximately 535 sf of US Army Corps of Engineer 404 wetland vegetation. The fill
material proposed for the driveway will be 4", #57 stone, and will be laid over geotextile fabric. The
project is located at Parcel #014909000 at 0 NC 12 Hwy, Lot 2, Block A of C H Fulcher Tract
subdivision, in Frisco, Dare County. The 48,000± Elf lot is next to their single-family residence at 52138
NC 12 Hwy,. Frisco. The man-made canal connects to the Pamlico Sound.
The development proposal involves the Estuarine Shoreline (ES) and Public Trust Shoreline (PTS)
AECs, as well as the Estuarine Waters (EW) and Public Trust Area (PTA) AECs.
I have reviewed the Rules of the Coastal Resources (CRC) as they pertain to this proposal, and my
findings are as follows:

(c) Management Objective. To conserve and manage the important features of estuarine waters so as
to safeguard and perpetuate their biological, social, aesthetic, and economic values; to coordinate and
establish a management system capable of conserving and utilizing estuarine waters so as to maximize
their benefits to man and the estuarine and ocean system.
(d) Use Standards. Suitable land/water uses shall be those consistent with the management
objectives in this Rule. Highest priority of use shall be allocated to the conservation of estuarine waters
and their vital components. Second priority of estuarine waters use shall be given to those types of
development activities that require water access and use which cannot function elsewhere such as
simple access channels; structures to prevent erosion; navigation channels; boat docks, marinas, piers,
wharfs, and mooring pilings: In every instance, the particular location, use, and design characteristics
shall be in accord with the general use standards for coastal wetlands, estuarine waters, and public
trust areas described in Rule .0208 of this Section.
Consistent: The project meets the use standards and is consistent with the intent of this rule.

(a) General Use Standards
(1) Uses which are not water dependent shall not be permitted in coastal wetlands, estuarine
waters, and public trust areas. Restaurants, residences, apartments, motels, hotels, trailer parks,
private roads, -factories, and parking lots are examples of uses that are not water dependent. Uses that
are -water dependent include: utility crossings, wind energy facilities, docks, wharves, boat ramps,
dredging, bridges and bridge approaches, revetments, bulkheads, culverts, groins, navigational aids,
mooring pilings, navigational channels, access channels and drainage ditches;
Consistent: The proposed vehicular bridge is water dependent.
(2) Before being granted a permit, the CRC or local permitting authority shall find that the applicant
has complied with the following standards:
(A) The location, design, and need for development, as well as the construction activities
involved shall be consistent with the management objective of the Estuarine and Ocean
System AEC (Rule .0203 of this subchapter) and shall be sited and designed to avoid
significant adverse impacts upon the productivity and biologic integrity of coastal wetlands,
shellfish beds, submerged aquatic vegetation (SAV) as defined by the Marine Fisheries
Commission, and spawning and nursery areas;
(B) Development shall comply with state and federal water and air quality
(C) Development shall not cause irreversible damage to documented archaeological or historic
resources as identified by the N.C. Department of Cultural resources;
(D) Development shall not increase siltation;
(E) Development shall not create stagnant water bodies;
(F) Development shall be timed to avoid significant adverse impacts on life cycles of estuarine
and ocean resources; and
(G) Development shall not jeopardize the use of the waters for navigation or for other public
trust rights in public trust areas including estuarine waters.
Consistent: The location and design of the bridge approach and driveway are sited to avoid
coastal wetlands; 635 sf of 404 wetlands is proposed to be filled during the construction. There
were no SAVs in the adjacent canal. The bridge is proposed to be 4' above NWL for navigation
clearance.
(3) When the proposed development is in conflict with the general or specific use standards set
forth in this Rule, the CRC may approve the development if the applicant can demonstrate that the
activity associated with the proposed project will have public benefits as identified in the findings and
goals of the Coastal Area Management Act, that the public benefits outweigh the long range adverse
effects of the project, that there is no reasonable alternate site available for the project, and that all
reasonable means and measures to mitigate adverse impacts of the project have been incorporated
into the project design and shall be implemented at the applicant's expense....
Consistent: The proposed development is not in conflict with the General Use Standards.

(a) Description. The Coastal Shorelines category includes estuarine shorelines and public trust
shorelines.

(c) Management Objective. All shoreline development shall be compatible with the dynamic nature of
coastal shorelines as well as the values and the management objectives of the estuarine and ocean
system. Other objectives are to conserve and manage the important natural features of the estuarine
and ocean system so as to safeguard and perpetuate their biological, social, aesthetic, and economic
values; to coordinate and establish a management system capable of conserving and utilizing these
shorelines so as to maximize their benefits to the estuarine and ocean system and the people of North
Carolina.
(d) Use Standards. Acceptable uses shall be those consistent with the management objectives in
Paragraph`(c) of this Rule. These uses shall be limited to those types of development activities that will
not be detrimental to the public trust rights and the biological and physical functions of the estuarine
and ocean system. Every effort shall be made by the permit applicant to avoid or minimize adverse
impacts of development to estuarine and coastal systems through the planning and design of the
development project. Development shall comply with the following standards:
(1) All development projects, proposals, and designs shall preserve natural barriers to erosion,
including peat marshland, resistant clay shorelines, and cypress -gum protective fringe areas adjacent
to vulnerable shorelines.
(2) All development projects, proposals, and designs shall limit the construction of impervious
surfaces and areas not allowing natural drainage to only so much as is necessary to service the
primary purpose or use for which the lot is to be developed. Impervious surfaces shall not exceed 30
percent of the AEC area of the lot, unless the applicant can demonstrate, through innovative design,
that the protection provided by the design would be equal to or exceed the protection by the 30 percent
limitation. Redevelopment of areas exceeding the 30 percent impervious surface limitation shall be
permitted if impervious areas are not increased and the applicant designs the project to comply with the
rule to the maximum extent feasible.
(3) All development projects, proposals, and designs shall comply with the following mandatory
standards of the North Carolina Sedimentation Pollution Control Act of 1973:
(A) All development projects, proposals, and designs shall provide for a buffer zone along the
margin of the estuarine water that is sufficient to confine visible siltation within 25 percent of
the buffer zone nearest the land disturbing development.
(B) No development project proposal or design shall propose an angle for graded slopes or fill
that is greater than an angle that can be retained by vegetative cover or other erosion
control devices or structures.
(C) All development projects, proposals, and designs that involve uncovering more than one
acre of land shall plant a ground cover sufficient to restrain erosion within 30 working days
of completion of the grading; unless the project involves clearing land for the purpose of
forming a reservoir later to be inundated.
(4) Development shall not have a significant adverse impact on estuarine and ocean resources.
Significant adverse impacts include development that would directly or indirectly impair water quality
increase shoreline erosion, alter coastal wetlands or Submerged Aquatic Vegetation (SAV), deposit
spoils waterward of normal water level or normal high water, or cause degradation of shellfish beds.
(5) Development shall not interfere with existing public rights of access to; or use of, navigable
waters or public resources.
(6) No public facility shall be permitted if such a facility is likely to require public expenditures for
maintenance and continued use, unless it can be shown that the public purpose served by the facility
outweighs the, required public expenditures for construction, maintenance, and con' FIVE®

(7) Development shall not cause irreversible damage to valuable, historic architectural or
archaeological resources as documented by the local historic commission or the North Carolina
Department of Natural and Cultural Resources.
(8) Established common-law and statutory public rights of access to the public trust lands and
waters in estuarine areas shall not be eliminated or restricted. Development shall not encroach upon
public accessways nor shall it limit the use of the accessways.
Consistent: The proposed development meets the use standards and is consistent with the
intent of this rule.

Partially Inconsistent: Although the vehicular bridge and bridge approaches are considered
water dependent (per 07H.0208(a)(1), the proposed gravel access/driveway proposed in the 30'
buffer is not one of the Exceptions listed in 07H.0209(10). The applicants are proposing to use
fill material that is comprised of 4", #67 stone, laid over geotextile fabric that is permeable and
comprised of non -biodegradable material, which is one of the exemptions to "built -upon area"
for stormwater programs. However, since this material is being used for a driveway, it will most
likely become impervious with regular use, and would not be consistent with our buffer rules.
Based on my review of the applicable subsections of the North Carolina Administrative Code, the
permit application, and plans submitted by Tim and Deborah McCollister, I recommend a Major Permit
for the vehicular bridge and abutment(s) be issued to the applicants based on their current proposal,
and subject to the standard permit conditions. However, it is staffs opinion that the proposed driveway
located in the 30' buffer should be revised to reduce the impacts to this area and be rpj}�, ���®

On September 27, 2019, the Washington Regional Office of the Division of Energy, Mineral,
and Land Resources received a copy of your CAMA Major application for the subject project. The
proposal involves the construction of an elevated wooden bridge and gravel driveway to an existing
home site located in Frisco, NC. Staff review of the plans and specifications has determined that the
project, as proposed, consists of activities that will not pose surface water quality threats from
stormwater runoff. The Director has determined that projects that are reviewed and approved by
the Division as not posing water quality threats from stormwater runoff should not be subject to
the stormwater management permitting requirements of 15A NCAC 21-1.1000. For this reason, we
are informing you by way of this letter that the current project will not require a State Stormwater
management permit.
The stormwater rules require the Division to permit the common plan of development,

24 foot long wooden bridge over a man-made canal that connects to the Pamlico
Sound and a 10 foot to 12 foot wide by 150 foot long gravel access/driveway with
parking area; on the north side of NC 12 at Parcel #014909000; in Frisco, Dare
County.

Consistency Determination: The request is consistent with/not in conflict with the Dare
County 2009 Land Use Plan certified by the CRC on February
24, 2011.
Overview: The 1.10 acre subject property has approximately 98 linear feet of shoreline along the
Pamlico Sound and 142 linear feet of shoreline along a man-made canal that connects to the
sound. The man-made canal divides the upper 2/3fds of the property to the north with access to
the sound from the lower 1131 that fronts onto NC 12. The canal is approximately 13 feet wide at
this location. Site elevations range from 3 feet to 6 feet above Normal Water Level (NWL).
Coastal Wetlands and Section 404 Wetlands are located on the site along with upland areas, with
an area of Section 404 Wetlands located adjacent to the manmade canal. The property is located
in the VE (8) and VE (9) Floodzones.
Existing site improvements consist of a mobile home and associated septic system located north
of the canal. Aerial images indicate that access to the mobile home has been provided through
the developed property under separate ownership to the east, which has a vehicular access
bridge over the canal.
Installation of a 12 foot wide by 24 foot long wooden bridge over the canal and a 10 foot to. 12 foot
wide by 150 foot long gravel access/driveway with parking area is proposed. The bridge will be
elevated to provide 4 feet of vertical navigation clearance. Silt fencing will be installed during
construction to' prevent runoff into adjacent Section 404 wetlands. Temporary matting will be
used to cross wetlands during construction.

The waters of the Pamlico Sound in this area are classified as SA waters and High Quality Waters,
Coastal Waters, and are open to shellfish taking. There were no Submerged Aquatic Vegetation._
(SAV) found at the project site. There are no known archaeological sites on the property.
Anticipated Impacts resulting from this project are expected to include: the filling of 465 sq. ft. of
Section 404 Wetlands within the Public Trust/Estuarine Shoreline Areas of Environmental
Concern (AEC), 1,248 sq. ft. of High Ground within the Public Trust/Estuarine Shoreline AEC, 70
sq. ft. of Section 404 Wetlands outside of an AEC, and 1,962 sq. ft. of Upland outside of an AEC,
and; the shading of 288 sq. ft. of Public Trust Area/Estuarine Waters AEC.
Basis for Determination:
The Dare County Land Classification Map identifies the subject property as "Transition Corridor".
As indicated on Page 217, the "Conservation" designation applies to all CAMA Areas of
Environmental Concern (AECs).
As indicated for "Conservation" areas on Page 217, "...development should be limited to
residential development and traditional accessory uses permitted in the CAMA AECs such as but
not limited to piers, docks, and crab -shedders... Authorized development should include
provisions and conditions that minimize impacts to any natural, cultural, historic, and scenic
values of the areas authorized for development".

2. Water Quality Certification
The proposed project must comply with all the conditions of the General Water Quality

maintenance should not take place within 50 feet of a waterbody or wetlands to prevent

description of the noncompliance, and its causes; the period of noncompliance, including
exact dates and times, if the noncompliance has not been corrected, the anticipated time
compliance is expected to continue; and steps taken or planned to reduce, eliminate, and
prevent reoccurrence of the noncompliance. The Division may waive the written submission
requirement on a case -by -case basis.

Dear Mr. Howell:
Reference the application of Mr. Tim McCollister to fill 535 square feet of jurisdictional
wetlands to construct a 24ft long by 12ft wide pile supported wooden bridge over an existing canal
on Lot 2 of the CH Fulcher Tract, in Frisco, Dare County, North Carolina.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. All work authorized by this permit must be performed in strict compliance with the
attached plans, which are a part of this permit. Any modification to these plans must be approved
by the US Army Corps of Engineers (USAGE) prior to implementation.
2. The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized, or
if, in the opinion of the Secretary of the Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation of the navigable waters, the
permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove,
relocate, or alter the structural work or obstructions caused thereby, without expense to the
United States. No claim shall be made against the United States on account of any such removal,
relocation, or alteration. The permittee shall notify NOAAINATIONAL OCEAN SERVICE
Chief Source Data Unit N CS261, 1315 E West HWY- RM 7316, Silver Spring, MD 20910-
3282 at least two weeks prior to beginning work and upon completion of work.
3. Except as specified in the plans attached to this permit, no excavation, fill or
mechanized land -clearing activities shall take place at any time in the construction or
maintenance of this project, in such a manner as to impair normal flows and circulation patterns
within waters or wetlands or to reduce the reach of waters or wetlands.
4. Except as authorized by this permit or any USACE approved modification to this
permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in
the construction or maintenance of this project, within waters or wetlands. This permit does not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
5. Unless otherwise authorized by this pernit,.all fill material placed in waters or wetlands
shall be generated from an upland source and will be clean and free of any pollutants except in
trace quantities. Metal products, organic materials (including debris from land clearing
activities), or unsightly debris will not be used.
6. The authorized structure and associated activity Hurst not interfere with the public's
right to free navigation on all navigable waters of the United States. No attempt will be made by
the pennittee to prevent the full and free use by the public of all navigable waters at or adjacent
to the authorized work for reason other than safety.
7. The permittee shall advise the Corps in writing at least two weeks prior to beginning the
work authorized by this permit and again upon completion of the work authorized by this permit.
8. The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall provide
each of its contractors and/or agents associated with the construction or maintenance of this
project with a copy of this permit. A copy of this permit, including all conditions, shall be
available at the project site during constriction and maintenance of this project.
9. The permittee shall employ all sedimentation and erosion control measures necessary to
prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit
area. This shall include, but is not limited to, the immediate installation of silt fencing or similar
appropriate devices around all areas subject to soil disturbance or the movement of earthen fill,
and the immediate stabilization of all disturbed areas. Additionally, the project must remain in
full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North
Carolina General Statutes Chapter 113A Article 4).
10. The activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or constriction -related discharge. Increases such that
the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by
the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all
saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not
considered significant.
11. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation.
12. In order to protect the endangered West Indian manatee (Trichechus manatus) the Permittee
shall implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly adhere to all
requirements therein. The guidelines can be found at http://www.fws.gov/nc-
es/mammal/manatee_guidelines.pdf.

8, PROJECT SUMMARY: Construct a wooden elevated bridge over a man-made canal
and a gravel access driveway.
Project Setting
Tim and Deborah McCollister's project is located on Parcel #014909000 at 0 NC 12 Hwy,
Lot 2, Block A of C H Fulcher Tract subdivision, in Frisco, Dare County. The 48,000± sf lot
is next to their single-family residence at 52138 NC 12 Hwy, Frisco, and is adjacent to a
man-made canal that connects to the Pamlico Sound. Man-made features onsite include a
mobile home and septic system. The shoreline length is 240 linear feet (98' is on the
Pamlico Sound and 142' is along the canal). The elevation of the tract ranges from 3' to 6'
above normal water level (NWL). There was no notable erosion escarpment in the project
area, and no known archeological sites on the property.
Coastal wetland vegetation onsite consists of Black Needlerush (Juncus roemerianus), Salt
meadow Cordgrass (Spartina patens), and Big Cordgrass (Spartina cynosuroides). High
ground is overgrown with the following non -coastal vegetation: Live Oak (Quercus
virginiana), Eastern Red Cedar (Juniperus virginiana), Wax Myrtle (Morella cerifera),
Chinese Privet (Ligustrum sinense Lour), Adam's Needle Yucca (Yucca filamentosa), and
indigenous grasses.
The adjacent riparian property to the north is developed with a single-family residence,
storage shed, walkway over wetlands to the adjacent sound, and a wooden vehicular bridge
that is elevated 4' above NWL in the center. The adjacent riparian property to the south is
an undeveloped, vacant lot.
The Pamlico Sound is classified as Coastal Waters, and is in the Pasquotank River Basin.
The Environmental Management Commission's water classifications for this tributary are SA
and High Quality Waters (HQW). The area is closed to shellfishing. The water depths in
the adjacent man-made canal range from -1' to -1.5' NWL at the project site. There were no
submerged aquatic vegetation (SAVs) found at the project site.
Development Proposal
In order to access the existing mobile home, the applicants are proposing to construct a
24'x12' wooden, elevated bridge over a man-made canal. The height of the bridge is
proposed at 4' for navigation clearance underneath, and will shade 288 sf of open water.
The project also includes the construction of a gravel access/driveway. The driveway in the
75' Coastal Shoreline Area of Environmental Concern (AEC) will be approximately 150' in
length, and transition from 10' to 12' in width as it enters the 30' Public Trust Shoreline AEC,
totaling 1,713 sf of high ground disturbance. Further upland disturbance proposed outside
of the CAMA AEC for the proposed driveway and parking will be approximately 2,032 sf.
Included in the development of the driveway is filling of approximately 535 sf of USACOE
404 wetland vegetation (465 sf within the CAMA AEC and 70 sf outside of t qPC)

In accordance with N.C.G.S. 143-214.7(b2), "for purposes of implementing stormwater
programs, built -upon area means impervious surface and partially impervious surface to the
extent that the partially impervious surface does not allow water to infiltrate through the
surface and into the subsoil". One of the five exemptions to "built -upon area" is a surface of
#57 stone, as designated by the American Society for Testing and Materials, laid at least
four inches thick over a geotextile fabric. The fill material proposed for the applicants'
driveway will be 4", #57 stone, and will be laid over geotextile fabric that is permeable and
comprised of non -biodegradable material.
Silt fencing will be installed around disturbed area(s) to prevent runoff into the adjacent
wetlands. Temporary matting is proposed to be used to cross wetlands during construction.
The pilings for the bridge will be hydraulically installed with a pump. All other construction
will be completed by conventional framing methods.
Anticipated Impacts
The construction of the elevated bridge will shade 288 sf of Open Water habitat in the
Estuarine Waters, Public Trust Areas AECs.
404 wetland fill proposed during the construction of the access/driveway will total
approximately 535 sf.
. The construction of the gravel access/driveway will disturb an additional 1,248 sf of high
ground in the Coastal Shoreline AEC, and 1,962 sf outside of the CAMA AECs.
o Impacts for the entire project will total 4,033 sf.

The subject property is located in Frisco, Dare County, North Carolina. The property is a
developed 1,17 acre lot with Coastal and Section 404 wetlands.
The proposed project is associated with the improvements to access an existing mobile
home. The property owners have been accessing the existing mobile home from the
adjacent property to the east over an existing bridge. This bridge access is no longer
available and the owners need to build a bridge to the access the mobile home and
property on the Pamlico Sound. The proposed bridge will be a 24' long 12' wide pile
supported wooden bridge elevated over an existing ditch. The access driveway to the
bridge will impact 535 square feet of Section 404 wetlands and will be constructed using
#57 stone.
Alternative Bridge Location:
The proposed bridge and driveway location have been chosen to minimize impacts to
the existing wetlands and mature live oaks on the property. The initial bridge design was
18' long x 12' wide crossing over a narrower portion of the waterway. This location would
have impacted 330 square feet of Section 404 wetlands but would have resulted in the
removal of 3 mature live oak trees. The proposed location will result in the construction
of a 24' long x 12' bridge that will impact 535 square feet of Section 404 wetlands with
no removal of mature live oak trees.
Submerged Aquatic Vegetation (SAV) Analysis:
An SAV (subaquatic vegetation) survey was conducted on 7/1/19 by Doug Dorman of
Atlantic Environmental Consultants, LLC. There was no SAV growth in the location of
the proposed bridge.
Wetland Fill Mitigation:
The proposed bridge project will impact 535 square feet of Section 404 wetlands for the
construction of the access driveway to the existing mobile home. The wetland impacts
have been limited to 535 Square feet therefore we are proposing no mitigation for this
project.
Wetland Delineation:
A wetland delineation was completed by Atlantic Environmental Consultants, LLC and
verified by the US Army Corp of Engineers on May 13, 2019. A copy of the Approved
Jurisdictional Determination signed by Billy Standridge is included with the application.

Construction Techniques:
The bridge pilings will be installed by jetting them in hydraulically. The remaining
construction will be done by hand using conventional framing techniques. As the bridge
is being constructed some matting may be placed temporarily over the existing wetlands
to provide a safe working platform. The matting will be removed when the bridge
construction is complete. A pickup truck and small tractor will be used to transport
material over the bridge as it is being constructed.

There will be no impact to your property. The bridge will be constructed from the McCollisters property. The notification is
required by the state because you are a ripparian landowner to the ditch/canal that is being crossed.
They have no intentions of using your bridge especially for heavy equipment. If they needed to go over for any reason 1
am sure they would contact you first and get permission.
I think the soonest they would start would be early next year.
Work would be done during normal business hours and I don't expect the noise to be any different than the construction of
a home.

The NC Division of Coastal Management hereby acknowledges receipt of your application for
State approval to construct a wooden elevated bridge over a man-made canal and a gravel access
driveway, located on Parcel #014909000 at 0 NC 12 Hwy, Lot 2, Block A of C H Fulcher Tract
subdivision, Frisco, in Dare County. It was received complete on September 9, 2019 and appears
to be adequate for processing at this time. The projected deadline for making a decision is
November 23, 2019. An additional 75-day review period is provided by law when such time is
necessary to complete the review. If you have not been notified of a final action by the initial
deadline stated above, you should consider the review period extended. Under those circumstances,
this letter will serve as your notice of an extended review. However, an additional letter will be
provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from September 9, 2019, you may
request a meeting with the Director of the Division of Coastal Management and permit staff to
discuss the status of your project. Such a meeting will be held within five working days from the
receipt of your written request and shall include the property owner, developer, and project
designer/consultant.
NCGS l 13A-1 19(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted
at the property of your proposed development. You should post this notice at a conspicuous point
along your property where it can be observed from a public road. Some examples would be:
Nailing the notice card to a telephone pole or tree along the road right-of-way fronting your
property, or at a point along the road right-of-way where a private road would lead one into your
property. Failure to post this notice could result in an incomplete application.
