HomeMy WebLinkAbout92-19 MM McCollister, Tim & DeborahPermit Class MODIFICATION/MAJOR STATE OF NORTH CAROLINA Department of Environmental Quality and Coastal Resources Commission Vermit for X Major Development in an Area of Environmental Concern pursuant to NCGS I I3A-118 X Excavation and/or filling pursuant to NCGS 113-229 Permit Number 92-19 Issued to Tim and Deborah McCollister, 1305 Equinox Landing, Chesapeake, VA 23322 Authorizing development in Dare County a man-made canal that connects to Pamlico Sound. at Lot 2, Block A of CH Fulcher Tract, in Frisco , as requested in the permittee's application dated 11/6/20, incl art workplan drawing (3), Sheets 1-2 of 3 both dtd "Revised 1/19/21" and Sheet 3 of 3 dtd "Revised 12/14/20". This permit, issued on June 25, 2021 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may )e suolect to rmes, imprisonment or crvu action; or may cause the permit to oe nun ana vora. Culvert and Earthen Causeway 1) Unless altered herein, this Major Modification authorizes the change from the previously authorized wooden vehicular bridge to a culvert and earthen causeway, all as expressly and specifically set forth in the attached permit application and workplan drawings. 2) All pipe and culvert inverts shall be buried at least one foot below normal bed elevation to allow for passage of water and aquatic life when they are placed within the Public Trust Area of Environmental Concern (AEC) as designated by the Coastal Area Management Act (CAMA). 3) No vegetated wetlands or open water shall be excavated or filled, even temporarily, outside of the approved bulkhead alignment. (See attached sheets for additional conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2024 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Tim and Deborah McCollister ADDITIONAL CONDITIONS Permit No. 92-19 Page 2 of 3 4) The alignment of the authorized earthen causeway shall be staked by the permittee and verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the alignment to be re -staked by permittee and verified by DCM within a maximum of 30 days prior to the new expected start of construction. 5) The alignment of the toe of the earthen causeway shall not exceed the alignment as depicted in the attached permit application and workplan drawings. 6) The fill material shall be clean and free of any pollutants except in trace quantities. 7) Unless altered herein, all backfill material shall be obtained from a high ground source. 8) No backfill material is to be placed within 30 feet of the normal water level, except that which will be used to create the earthen causeway. 9) Fill material shall be of a sufficient size and design to prevent its movement from the approved alignment by wave or current action. The permittee shall be responsible for immediate removal of any materials or debris that becomes dislodged or moves outside the authorized alignment. Sedimentation and Erosion Control 10) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 11) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. 12) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of any phase of grading on cut or filled slopes. General 13) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 14) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 15) All debris associated with the removal or construction of the permitted development shall be contained within the authorized project area and removed to an appropriate upland location. 16) This Major Modification shall be attached to Permit No. 92-19, which was issued to the permittee on 11/25/19, as well as all subsequent modifications, refinements, and renewals, and copies of all documents shall be readily available on site when a Division representative inspects the project for compliance. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required, including but not limited to any authorizations required from the U.S. Army Corps of Engineers. The property owners have used an adjacent property owners bridge to access the mobile home but ownership has changed and this is no longer an option. I have reviewed the Rules of the Coastal Resources (CRC) as they pertain to this proposal, and my findings are as follows: 15A NCAC 07H .0208 USE STANDARDS (a) General Use Standards (1) Uses which are not water dependent shall not be permitted in coastal wetlands, estuarine waters, and public trust areas. Restaurants, residences, apartments, motels, hotels, trailer parks, private roads, factories, and parking lots are examples of uses that are not water dependent. Uses that are water dependent include: utility crossings, wind energy facilities, docks, wharves, boat ramps, dredging, bridges and bridge approaches, revetments, bulkheads, culverts, groins, navigational aids, mooring pilings, navigational channels, access channels and drainage ditches; Consistent: The proposed culvert is water dependent. Overview: The 1.17 acre subject property has approximately 98 linear feet of shoreline along the Pamlico Sound and 142 linear feet of shoreline along a man-made canal that connects with the sound to the northeast, west and southwest. The man-made canal divides the upper 2/3rds of the property to the north with access to the sound from the lower 1/3 d that fronts onto NC 12. The canal is approximately 13 feet wide with water depths ranging from -1 foot to -1.5 feet below Normal Water Level (NWL) at this location. Site elevations range from 3 feet to 6 feet above NWL. Coastal Wetlands and Section 404 Wetlands are located on the site along with upland areas, with an area of Section 404 Wetlands located adjacent to the manmade canal. The property is located in the AE (6) Floodzone. Existing site improvements consist of a mobile home and associated septic system located north of the canal. Aerial images indicate that access to the mobile home has been provided through the developed property,under separate ownership to the east, which has a vehicular access bridge over the canal. Major Permit 91-19 issued in November of 2019 authorized installation of a 12 foot wide by 24 foot long wooden bridge over the man-made canal and a 10 foot to 12 foot wide by 150 foot long gravel access/driveway with parking area. The bridge proposal provides 4 feet of vertical navigational clearance. Some clearing has occurred north of the canal in front of the mobile home in preparation for the driveway. The culvert will be placed in the man-made canal and covered with clean fill. The driveway section will consist of geotextile fabric and #57 stone and will be constructed with a 3:1 side slope. It will connect to the previously approved driveway. Temporary matting may be used to cross wetlands during construction. The waters of the Pamlico Sound in this area are classified as SA waters and High Quality Waters, Coastal Waters, and are open to shellfish taking. There were no Submerged Aquatic Vegetation (SAV) found at the project site. There are no known archaeological sites on the property. Anticipated Impacts resulting from this project are expected to include: the filling of 370 sq. ft. of Public Trust Area/Estuarine Waters Areas of Environmental Concern (AEC). The culvert will reduce navigation along the man-made canal. As indicated by the DCM Field Representative, navigation is currently limited to kayaking given the shallow water depths, with deeper depths occurring only during high-wind/storm events. While a kayak could potentially navigate the canal to the northeast under two (2) small vehicular bridges to access the sound, a private culvert/driveway crossing (Morris Lane) is located 100 feet to the southwest in the canal. No trespassing signs on that property essentially prohibit the portage of kayaks across the culvert/driveway. Basis for Determination: The Dare County Land Classification Map identifies the subject property as "Transition Corridor'. As indicated on Page 217, the "Conservation" designation applies to all CAMA Areas of Environmental Concern (AECs). As indicated for "Conservation" areas on Page 217, "...development should be limited to residential development and traditional accessory uses permitted in the CAMA AECs such as but not limited to piers, docks, and crab -shedders... Authorized development should include provisions and conditions that minimize impacts to any natural, cultural, historic, and scenic values of the areas authorized for development". The following LUP policies may be applicable to this request. Public Access: Policy PA#1, Page 142. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: 1. All work authorized by this permit must be performed in strict compliance with the attached plans, which are a part of this permit. Any modification to these plans must be approved by the US Army Corps of Engineers (USACE) prior to implementation. 2. The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall be made against the United States on account of any such removal, relocation, or alteration. The permittee shall notify NOAA/NATIONAL OCEAN SERVICE Chief Source Data Unit N CS261, 1315 E West HWY- RM 7316, Silver Spring, MD 20910- 3282 at least two weeks prior to beginning work and upon completion of work. 3. Except as specified in the plans attached to this permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in the construction or maintenance of this project, in such a manner as to impair normal flows and circulation patterns within waters or wetlands or to reduce the reach of waters or wetlands. 4. Except as authorized by this permit or any USACE approved modification to this permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in the construction or maintenance of this project, within waters or wetlands. This permit does not authorize temporary placement or double handling of excavated or fill material within waters or wetlands outside the permitted area. This prohibition applies to all borrow and fill activities connected with this project. 5. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands shall be generated from an upland source and will be clean and free of any pollutants except in trace quantities. Metal products, organic materials (including debris from land clearing activities), or unsightly debris will not be used. 6. The authorized structure and associated activity must not interfere with the public's right to free navigation on all navigable waters of the United States. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work for reason other than safety. 7. The permittee shall advise the Corps in writing at least two weeks prior to beginning the work authorized by this permit and again upon completion of the work authorized by this permit. 8. The permittee shall require its contractors and/or agents to comply with the terms and conditions of this permit in the construction and maintenance of this project, and shall provide each of its contractors and/or agents associated with the construction or maintenance of this project with a copy of this permit. A copy of this permit, including all conditions, shall be available at the project site during construction and maintenance of this project. 9. The permittee shall employ all sedimentation and erosion control measures necessary to prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit area. This shall include, but is not limited to, the immediate installation of silt fencing or similar appropriate devices around all areas subject to soil disturbance or the movement of earthen fill, and the immediate stabilization of all disturbed areas. Additionally, the project must remain in full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North Carolina General Statutes Chapter 113A Article 4). 10. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction -related discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not considered significant. Field Investigation Report: Tim and Deborah McCollister; Major Modification to 92-19 Page 2 Project Setting Tim and Deborah McCollister's project is located on Parcel #014909000 at 0 NC 12 Hwy, Lot 2, Block A of C H Fulcher Tract subdivision, in Frisco, Dare County. The 1.7-acre lot is adjacent to their single-family residence at 52138 NC 12 Hwy, Frisco, and to a man-made canal that connects to the Pamlico Sound. Man-made features onsite include a mobile home and septic system. The shoreline length along the two sides of the canal totals 142 feet. The elevation of the tract ranges from 3' to 6' above normal water level (NWL). There was no notable erosion escarpment in the project area, and no known archeological sites on the property. Coastal wetland vegetation onsite consists of Black Needlerush (Juncus roemerianus), Salt meadow Cordgrass (Spartina patens), and Big Cordgrass (Spartina cynosuroides). High ground is overgrown with the following non -coastal vegetation: Live Oak (Quercus virginiana), Eastern Red Cedar (Juniperus virginiana), Wax Myrtle (Morella cerifera), Chinese Privet (aka Common Privet and Japanese Privet--Ligustrum sinense Lour), Adam's Needle Yucca (Yucca filamentosa), and indigenous grasses. The adjacent riparian property to the northeast is developed with a storage shed, and part- owner of a wooden vehicular bridge that is elevated 4' above NWL in the center. The applicants have purchased the vacant lot (Parcel #014908000) that is immediately next to/ west of the project site. The adjacent riparian property to the northwest is developed with a single-family residence, detached garage, and two -track driveway that has a culvert in place to cross the canal. Major Permit (MP) #92-19 was originally issued on 11/25/2019 for a wooden vehicular bridge with associated 404 wetland fill of 535 square feet (so and driveway using #57 stone. Some clearing has occurred north of the canal, in front of the existing mobile home, in preparation for the permitted driveway. The US Army Corps of Engineers (USAGE) authorized the fill project on 11/25/2019 via Programmatic General Permit #198000291 (Action ID SAW-2019-00951. The wetland delineation was verified by the USACE on 06/04/2019. The NC Division of Water Resources (DWR) authorized the project through Water Quality Certification 4175, project DWR Project No. 2019-1295. The Pamlico Sound is classified as Coastal Waters, and is in the Pasquotank River Basin. The Environmental Management Commission's water classifications for this tributary are SA and High Quality Waters (HQW). The area is closed to shellfishing. The water depths in the adjacent man-made canal range from -1' to -1.5' NWL at the project site. There were no submerged aquatic vegetation (SAVs) found at the project site. Due to the costs of bridge construction, the McCollisters are now requesting authorization to install a 20-foot by 42-inch corrugated metal culvert in the man-made ditch/canal and place clean fill material over the culvert. The new section of driveway is proposed to be 12 feet wide with 3:1 side slopes, using #57 stone and geotextile fabric, and connect to the permitted driveway. This project will impact 370± sf (18.5'x20') and require 555± cubic yards (cy) of fill below NWL. The culvert will be installed with an excavator, and matting may be used to temporarily cross over existing wetlands. Silt fencing will be installed around disturbed area(s) to prevent runoff into the adjacent wetlands and waterbody. Anticipated Impacts Filling of the canal will impact 370± shallow water habitat in the Estuarine Waters/Public Trust Areas AECs. The property is a developed 1.17 acre lot with Coastal and Section 404 wetlands. The existing permit was issued for wooden bridge and driveway to access an existing mobile home. The cost associated with constructing a bridge that will support vehicles is not economically feasible; therefore, the owners are proposing a culverted driveway over the existing manmade ditch/canal. The access driveway will be constructed by installing one 20 foot long by 42 inch corrugated metal culvert. The driveway will be 12 feet wide with 3:1 side slopes down to the culvert base and fill 555 cubic yards below normal water level. The driveway will be constructed as previously permitted using #57 stone and geotextile fabric. Wetland Fill Mitigation: The existing permit is authorized to impact 535 square feet of Section 404 wetlands for the construction of the access driveway to the existing mobile home. There are no additional wetland impacts associated with placement of the culvert; therefore, we are proposing no mitigation for the modification. Wetland Delineation: A wetland delineation was completed by Atlantic Environmental Consultants, LLC and verified by the US Army Corp of Engineers on June 4, 2019. A copy of the Approved Jurisdictional Determination signed by Billy Standridge is included with the application. Submerged Aquatic Vegetation (SAV) Analysis: An SAV (subaquatic vegetation) survey was conducted on 7/1/19 by Doug Dorman of Atlantic Environmental Consultants, LLC. There was no SAV growth in the location of the proposed driveway. Construction Technigues: The culvert will be installed with an excavator and clean fill material will be placed over the culvert to create the driveway. As the driveway is being constructed some matting may be placed temporarily over the existing wetlands to provide a safe working platform. The matting will be removed when the driveway construction is complete. A pickup truck and small tractor will be used to transport material over the driveway as it is being constructed.
