This permit, issued on January25, 2019 is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Docking Facility
1) This permit authorizes only the docks, piers, and other structures and uses located in or over the
water that are expressly and specifically set forth in the permit application. No other structure,
whether floating or stationary, shall become a permanent part of this docking facility without permit
modification. No non -water dependent uses of structures shall be conducted on, in or over Public
Trust waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced
throughout the entire existence of the permitted structure. REC

This permit action may be appealed by the permittee or orb
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2022
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
3) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
5) This permit authorizes one (1) additional formalized slip for a maximum of four (4) formalized boat
slips.
6) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
7) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must
implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein.

General
8) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
9) This permit shall not be assigned, transferred, sold, of otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
10) This permit does not authorize the interference with any existing or proposed Federal project, and the .
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
11) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of General Permit
197800056 (Action ID No. SAW-2008-00927. The N.C. Division of Water Resources assigned
the proposed project D)ATR Project No. 2018-01698v1.
NOTE: An application processing fee of $250 was received by DCM for this project.

This project is consistent and not in conflict with the New Hanover County
Comprehensive Land Use Plan.
The applicant proposes to expand an existing docking facility within Banks Channel.
The project is located at 10 Skimmer Road adjacent to Banks Channel and Middle Sound
on Figure Eight Island in New Hanover County.
Areas of Environmental Concern (AEC's) impacted by the proposal are EW and PT.
Waters at the project site are classified as SA-ORW and is open to the harvesting of
shellfish. The area is a not Primary Nursery Area.
I have reviewed this proposal for consistency with the New Hanover County
Comprehensive Land Use Plan and offer the following comments. RECEIVED
The general area of the project is classified as Developed while the AECs impacted by FEB _ 5 2018
the work are classified as Resource Protection.
DCM_MHO CITY
In general, New Hanover County allows development in Resource Protection classified
AECs, which is consistent with the State's minimum use standards. The New Hanover
County Land Use Plan contains some policies, which exceed the State's minimum use
standards. However, none of these standards appear to be applicable to this proposal.
This project is consistent with the New Hanover County Comprehensive Land Use Plan

Dear Mr. Long:
Through coordination with the North Carolina Division of Coastal Management we have
learned of your request to expand an existing docking facility within Banks Channel, located at
10 Skimmer Road, within_ the Figure Eight Island Community, New Hanover County, North
Carolina.
On January 1, 2017, we renewed general permit No. 197800056, (copy enclosed), that
authorizes the maintenance, repair, construction and installation of piers, docks, boathouses and
boat shelters, mooring piles, dolphins, jetties and breakwater structures in navigable waters of the
United States in the State of North Carolina pursuant to Section 10 of the Rivers and Harbors Act
of 1899.
Your work is authorized provided it is accomplished in strict accordance with your

submitted plans, the enclosed general conditions, and the following special conditions. ThfEB - 5 2018
expiration date of your DA permit is December 31, 2021. OC44
1. All work authorized by this permit must be performed in strict compliance with the MHD Ciry
revised submitted plans received on December 11, 2018, which are a part of this permit.
2. In order to further protect the endangered West Indian Manatee, Trichechus manatus, the
applicant must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and
strictly adhere to all requirements therein. The guidelines can be found at

The North Carolina Natural Heritage Program (NCNHP) appreciates the opportunity to provide
information about natural heritage resources for the project referenced above.
A query of the NCNHP database indicates that there are records for rare species, important natural
communities, natural areas, and/or conservation/managed areas within the proposed project
boundary. These results are presented in the attached 'Documented Occurrences' tables and map.
The attached 'Potential Occurrences' table summarizes rare species and natural communities that
have been documented within a one -mile radius of the property boundary. The proximity of these
records suggests that these natural heritage elements may potentially be present in the project area
if suitable habitat exists. Tables of natural areas and conservation/managed areas within a one -mile
radius of the project area, if any, are also included in this report.
If a Federally -listed species is documented within the project area or indicated within a one -mile
radius of the project area, the NCNHP recommends contacting the US Fish and Wildlife Service

The total area of floating dock and platform was calculated as follows:
Shoreline length = 110 ft. x 8 ft. = 880 sq. ft. allowable
Existing platform = 8 ft. x 10 ft. = 80 sq. ft. (credit applied for access)
Existing floating dock = 16 ft. x 16 ft. = 256 sq. ft.
Proposed floating dock = 10 ft. x 16 ft. =160 sq. ft.

The reconfiguration would provide docking space for the total up to four (4) vessels at this location. It is staffs
recommendation that the proposal is CONSISTENT with the use standards set forth in NCAC 07H .0208(b)(6), including
the 1/4 width rule, the eight square foot rule and the pier width rule. This office has no objection to the proposed work,
provided it is consistent with all other state and federal permitting requirements.

9. PROJECT DESCRIPTION
The project site is located at 10 Skimmer Road, within the Figure "8" Island community, adjacent to Banks Channel and
Middle Sound, in New Hanover County. The island is accessed from the mainland at the end of Edgewater Club Road
(SR 1402), by private bridge over the Atlantic Intracoastal Waterway(AIWW) and an earthen causeway, which traverses
Middle Sound. Heading east on the causeway, turn right on Beach Road South and travel south to Skimmer Road. Turn
right onto Skimmer Road and take the next left. The subject property will be located at the end of the cul-de-sac.
Existing structures on the lot includes a single-family residence and a private docking facility. The lot is approximately
0.69 acres in size and averages 5' above Normal Water Level. Upland vegetation consists primarily of ornamental trees,
shrubbery, and lawn grasses. The approximately 110 liner feet of shoreline is stabilized by a wooden bulkhead.
Waterward of the normal high water (NHW) is an intertidal strip of sand, which is approximately 6' in width. There are
currently no coastal wetlands on the property.
The existing docking facility was originally authorized under General Permit No. 16046-D on June 13, 1996 and consisted
of a new 6' wide by 60' long pier, an 8' wide by 10' long "T"-Head, and an accress leading to a 16' wide by 16' long
float. A 13' wide by 13' long boatlift was installed on the south facing side of the float sometime after the General Permit
was issued, however no permit history could be found for that structure. State Permit No. 53-08 was issued on April 8,
2008 and authorized the relocation of the existing float 6' to the south and the relocation of the existing boatlift to the
north side of the float to maintain three (3) slips at the docking facility.
The Wilmington -New Hanover County 2006 Land Use Plan classifies adjacent waters and high ground portion of the
property as Conservation. The waters of Banks Channel and Middle Sound are classified SA-ORW by the Division of
Water Resources. They are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries
and they are OPEN to the harvest of shellfish.
PROPOSED PROJECT
The applicant proposes to expand an existing docking facility within Banks Channel. The expansion would consist of
adding a 10' wide by 16' long float to the south end of existing float, and a 16' wide by 16' long boatlift on the south end
of the new float. The proposed new docking configuration would provide additional docking space for one (1) additional
vessel for a total of four (4) vessels at the existing facility within a water depth -6 ft. at Normal Low Water (See Sheets 2
and 3 of 4).
10. ANTICIPATED IMPACTS
The proposed floating dock and boatlift would incorporate an additional approximately 356 sq. ft. of Estuarine Waters and
Pubic Trust Area. The proposed structures would extend approximately 92 ft. into a waterbody, which measures
approximately 380 ft. across. This distance would conform to both the 1/4 width rule and the established pier lengths. The
proposed structure would not encroach into the channel or the adjacent 15' Riparian Corridor Setback Area requirement.
Minor increases in turbidity should be expected during construction.

The Division of Coastal Management hereby acknowledges that on November 20, 2018 we received your
completed application, acting as agent for Rodney Long, whereby you are requesting State approval for
the development of property located at 10 Skimmer Road, adjacent to Banks Channel, on Figure Eight
Island near Wilmington in New Hanover County. The projected deadline for making a decision on your
permit application is February 3, 2019. An additional 75-day review period is provided by law when such
time is necessary to complete the review. If you have not been notified of a final action by the initial
deadline stated above, you should consider the review period extended. Under those circumstances, this
letter will serve as your notice of an extended review. However, an additional letter will be provided on or
about the 75th day.
If this agency does not render a permit decision within 70 days from November 20, 2018 you may request
a meeting with the Director of the Division of Coastal Management and permit staff to discuss the status
of your project. Such a meeting will be held within five working days from the receipt of your written
request and shall include the property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the
property of your proposed development. You should post this notice at a conspicuous point along your
property where it can be observed from a public road. Some examples would be: Nailing the notice card
to a telephone pole or tree along the road right-of-way fronting your property; or at a point along the road
right-of-way where a private road would lead one into your property. Failure to post this notice could
result in an incomplete application.
