This permit, issued on October 18, 2019 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation )f these terms may be subject to tines, imprisonment or civti action; or may cause ttro yoruuL LU uc ILWI c 4, v= Upland Development and Wetland Fill 1) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities associated with the development of the above referenced property, including the homesite, driveway and culvert, and other associated infrastructure, and the fill of approximately 516ft of section 404 wetlands all as expressly and specifically set forth in the attached permit application and workplan drawings. 2) No vegetated wetlands shall be excavated or filled, even temporarily, outside of the approved culvert and associated fill alignment. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2022 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Parker and Shaobo Liu ADDITIONAL CONDITIONS Sedimentation and Erosion Control Permit No. 82-19 Page 2 of 3 3) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. 4) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of any phase of grading on cut or filled slopes. Stormwater Management 5) The Division Energy, Mineral and Land Resources (DEMLR) approval of this project under stormwater management rules of the Environmental Management Commission is covered by way of Stormwater Permit No. SW8-050325. Any violation of the permit approved by the DEMLR shall be considered a violation of this CAMA permit. General 6) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a'third party without the written approval of the Division of Coastal Management. 7) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Nationwide Permit 18 (Action ID SAW-2019-01574) issued 10/15/19. NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2019-1043. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 808-2808 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: An application processing fee of $400 was received by DCM for this project. No, Stormwater permit already in place with over subdivision. 2. Can you verify the BUA for just lot 83 and both lots (84+83). 1 believe the details on the revised workplan dated 7/17/19 of 5,700ftz are for both lots, but I want to be sure. Lot 83 has 175 s.f. and Lot 84 has 5,525 s.f. 3. MP-3 sections (g) and (i) notes a BUA for our AEC at 7%. If you would like I can make a notation that clarifies the BUA for both lots and overall based on your answer to #2. 1 would just need authorization from you to modify the permit application. This can be done in this email thread if you'd like: Please do. 4. Finally, once we've cleared these things up and Stormwater is satisfied, I will need 5 hard copies and the electronic copy to distribute if needed. It authorized three crossings within Section 404 Wetlands in the ORW Coastal horelineAEC. This proposed impact was one of the previously authorized crossings that was not completed prior to permit expiration. The property is adjacent to Stump Sound at 102-104 Oyster Catcher Way in Sneads Ferry, Onslow County. This 3.9-acre parcel is undeveloped. The adjacent properties are developed with single family residential dwellings. The elevation of the high ground of the parcel is about 7' above the normal high water level (NHW). Vegetation on the tract mainly consists of pine forest, Section 404 Wetlands, and Coastal Wetlands. These two lots have approximately 186' of continuous shoreline along Alligator Bay. There is not a cultural resource in the nearby vicinity of the project area. This area of Alligator Bay is approximately 2,000'across at this location. These estuarine waters are classified as a Primary Nursery Area. The area is closed to shellfish harvest. These waters of Alligator Bay are classified as SA; Outstanding Resource Waters by the EMC. channel within the vicinity of this project area. Proposed Development: There is not an established, defined navigation The applicants wish to construct a shared driveway with a culvert crossing Section 404 Wetlands and a single family residential dwelling, in Sneads Ferry. The proposed development will take place at 102-104 Oyster Catcher Way, Onslow County. The proposed 19' wide and 150' long shared concrete driveway would impact 516 square feet of Section 404 Wetlands. The purpose of this development is to access the northern portion of the tract where the owners' residences are proposed. This proposed crossing would be supported by a 20' long and 18" wide culvert. A single family residence is proposed at 104 Oyster Catcher Way. The total high ground disturbance would be approximately 14,000 square feet. The proposed driveway and dwelling would result in approximately 7,660 square feet of impervious surface within the 575' ORW Coastal Shoreline AEC. Anticipated Impacts: There is 4.44% of built upon impervious surface proposed within the 575' ORW Coastal Shoreline AEC. The proposed culvert would fill 516 square feet of Section 404 Wetlands adjacent to Alligator Bay. The proposed driveway and single family residential dwelling would impact approximately 14,000 square feet of high ground. There is not a cultural resource in the nearby vicinity of the project area. The property is 1.96 acres in size and is located on Alligator Bay. Elevation is approximately 7.43 to 10' above sea level. Residential and undeveloped lots border the lot. The upland portion of the site has been partially cleared and contains Live Oaks, Long Leaf pines, Hickory, Yaupons, and loblolly pines. A small area of 404 wetlands is located on the northern portion of the lot. The southern portion contains coastal wetlands and marsh containing, spartina alterlflora, Black Needle Rush, and salt grass. A previous CAMA Major permit and wetland fill permit were issued for the property. The permits have expired and the purpose of this request is to obtain a new permit so that a driveway can be installed in the 404 wetlands on the front of the property. The purpose of the driveway is for a residence on the property. The requested area of wetland fill is 19'x37' (516 sgft) and is located on the property line of lots 83 and 84. The area will require an 18" culvert that will be buried 20% of the pipe diameter to allow for free flow of water and aquatic wetland species. There are no coastal wetlands in the proposed fill area. The impact will be completed with heavy machinery and will involve filling the area with soil and culvert. Silt fence will be installed to reduce impacts and contain fill material to the impact area only. The area will be stablized with grass seed and straw to prevent any erosion. Once a permit form Coastal Management has been obtained a permit from the US Army Corps of Engineers will be applied for. We have spoken with Brad Shaver on the permit and he has stated that the mitigation for this impact has been paid and will not need to be replicated.
