This permit, issued on October 18, 2019 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation

Upland Development and Wetland Fill
1) Unless specifically altered herein, this permit authorizes the grading and other land disturbing
activities associated with the development of the above referenced property, including the homesite,
driveway and culvert, and other associated infrastructure, and the fill of approximately 516ft of
section 404 wetlands all as expressly and specifically set forth in the attached permit application and
workplan drawings.
2) No vegetated wetlands shall be excavated or filled, even temporarily, outside of the approved culvert
and associated fill alignment.
(See attached sheet for Additional Conditions)
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2022
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

3) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses or properties.
4) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of
any phase of grading on cut or filled slopes.
Stormwater Management
5) The Division Energy, Mineral and Land Resources (DEMLR) approval of this project under stormwater
management rules of the Environmental Management Commission is covered by way of Stormwater
Permit No. SW8-050325. Any violation of the permit approved by the DEMLR shall be considered a
violation of this CAMA permit.
General
6) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a'third party without the
written approval of the Division of Coastal Management.
7) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Nationwide Permit 18
(Action ID SAW-2019-01574) issued 10/15/19.
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 2019-1043.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at [phone] prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: An application processing fee of $400 was received by DCM for this project. This fee also
satisfied the Section 401 application processing fee requirements of the Division of Water
Resources.

This letter is in response to the above referenced CAMA permit application, which was accepted
as complete by the Division's Morehead City office on July 31, 2019. Processing of the
application is ongoing. However, it has been determined that additional information will be
required prior to the Division taking final action on your application. The required item is
summarized below:
1) In accordance with 15A NCAC 07H.0601 it is the policy of this Division that, prior to
taking final action on a project of this nature, the Division of Energy, Mineral and Land
Resources (DEMLR) Stormwater permit issued under SW8 050325 must be consistent.
Based upon the attached comments from the DEMLR dated August 22, 2019, it appears
as though the proposal is not consistent with the issued Stormwater permit. Additional
information from the applicant will be required before a final decision can be made.
Therefore, it is necessary that processing of your permit application be placed in abeyance until
such time as the required information is provided to the DEMLR and a copy of the approval
supplied to this office.

This request is a for a partial renewal of State Permit #87-05. The following is my assessment and consequent recommendations of
the above referenced proposal: This proposal will fill 516 square feet of Section 404 Wetlands and 14,148 square feet of high ground.
These waters of Alligator Bay are classified as Outstanding Resource Waters and are closed to shellfish harvest. This waterbody is a
Primary Nursery Area. Assuming that state and federal agencies concur with the proposal, I recommend the project be authorized as
proposed, contingent upon the following conditions:
The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The
permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party.
Effective sedimentation and erosion control devices, measures or structures must be implemented to ensure that eroded materials do not
enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, sand fence, etc.).
A ground cover sufficient to restrain erosion shall be provided within the shorter of 15 working or 30 calendar days of completion of any
phase of grading on cut or filled slopes.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations
that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the

This project is consistent and not in conflict with the Onslow County
Comprehensive Land Use Plan Update.
The applicant is proposing to install a new driveway culvert for private use traversing
Section 404 Wetlands adjacent to Alligator Bay in Sneads Ferry, Onslow County.
Areas of Environmental Concern (AEC's) impacted by the proposal are ES. Waters at
the project site are classified as SA; ORW and are not open to the harvesting of shellfish.
The area is a Primary Nursery Area.
I have reviewed this proposal for consistency with the Onslow County Comprehensive
Land Use Plan and offer the following comments.
The general area of the project is classified as Limited Transition.
In general, Onslow County allows development in Limited Transition classified AECs
which is consistent with the State's minimum use standards. The Onslow County Land
Use Plan contains some policies, which exceed the State's minimum use standards.
However, none of these more restrictive policies appear to be applicable to this project.
This project appears to be consistent with the Onslow County Land Use Plan
Update.

footprint. The proposed wetland fill area is 19' X37' and the proposed pipe is 20 If in length, correct? What is the actual
width of the driveway? What is the fill slope,from top of the road down to the edge of the fill? Is this a 2:1 rock slope or
a more gradual 3:1 fill slope?
Please provide a cross-section showing the wetland fill from the top of the road down the shoulder to the toe of slope.

Our standards of at least 1 foot below normal bed elevation applies to Public Trust and Estuarine Waters AECs. This
does not apply if culvert is placed in wetlands. For that we rely on the resource agencies' comments. To my knowledge
there are no stream features, but the agent may be able to clarify. I have also CC'd Brian Jarman on this as he is also an
agent of Mr. Parker. I believe Brian has the workplans, etc.

regional condition 3.6 which describes culvert burial requirements in CAMA AEC, which is why I'm asking. I haven't seen
the site, so I don't know what the wetland looks like, or if there is a stream -like feature within the wetland.

the permit.

Thanks for the updated drawings. Based on the conversation I just had with Mr. Pierce there are a few things I would
like to clarify that should help things along.
1. Was this the plan used for the Stormwater permit (SW8 050325)? No, Stormwater permit already in place with
over subdivision.
2. Can you verify the BUA for just lot 83 and both lots (84+83). 1 believe the details on the revised workplan dated
7/17/19 of 5,700ftz are for both lots, but I want to be sure. Lot 83 has 175 s.f. and Lot 84 has 5,525 s.f.
3. MP-3 sections (g) and (i) notes a BUA for our AEC at 7%. If you would like I can make a notation that clarifies the
BUA for both lots and overall based on your answer to #2. 1 would just need authorization from you to modify
the permit application. This can be done in this email thread if you'd like: Please do.
4. Finally, once we've cleared these things up and Stormwater is satisfied, I will need 5 hard copies and the
electronic copy to distribute if needed. At this time Stormwater's concerns are the only concerns I have to
date. So I can take the project off hold once I have Stormwater's final OK.

Approval of 401 Water Quality Certification with Additional Conditions
Dear Mr. Parker,
You have our approval, in accordance with the attached conditions and those listed below to
permanently impact approximately 0.012 acres of 404 wetlands area, in order for the
construction of a new shared driveway to allow for residential dwelling adjacent Alligator Bay
(SA; ORW), as described in your CAMA Major Development Permit application received by the
N.C. Division of Water Resources (DWR) on August 2, 2019. After reviewing your application,
we have decided that the additional impacts do require written concurrence and are covered by
General Water Quality Certification Number 4174 (GC4175).
This Certification allows you to use the Nationwide Permit 18 when issued by the U.S. Army
Corps of Engineers. In addition, you should obtain or otherwise comply with any other required
federal, state or local permits before you go ahead with your project including (but not limited to)
Erosion and Sediment Control, Non -discharge, and stormwater regulations. Also, this approval
to proceed with your proposed impacts or to conduct impacts to waters as depicted in your
application shall expire upon expiration of the 404 Permit. This Certification can also be found
on line at: hftp://portal.ncdenr.orq/web/wq/swp/ws/401/certsandpermits.
This approval is for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application.
If the property is sold, the new owner must be given a copy of this Certification and approval
letter and is thereby responsible for complying with all conditions. If total fills for this project
(now or in the.future) exceed one acre of wetland or 150 linear feet of stream, compensatory
mitigation may be required as described in 15A NCAC 2H .0506 (h). This approval requires
you to follow the conditions listed in the attached certification and any additional
conditions listed below.

change your project, you must notify the Division and you may be required to submit a new
application package with the appropriate fee. If the property is sold, the new owner must be
given a copy of this approval letter and General Certification and is responsible for complying
with all conditions. Any new owner must notify the Division and request the Certification be
issued in their name {15A NCAC 02H .0501 and .0502).

2. Any final construction plans for this project must include or reference the application and
plans approved by the Division under this authorization letter and certification. The applicant
will also be required to evaluate all acquired permits to assure that they are consistent and all
relative impacts are accounted for and shown on the construction plans. [15A NCAC 02H .0502
(b) and 15A NCAC 02H .0506 (4)] The applicant shall require his contractors (and/or agents) to
comply with all of the terms of this Certification, and shall provide each of its contractors (and/or
agents) a copy of this Certification.
3. A pre -construction meeting is recommended to be held with the Division prior to the start
of the project phases so that the contractors and/or agents fully understand the conditions
associated with this certification. [15A NCAC 02H .0507 (c) and 15A NCAC 02H .0502 (e)]
4. Turbidity Standard
The turbidity standard of 25 NTUs (Nephelometric Turbidity Units) shall not be exceeded as
described in 15 A NCAC 2B .0220. Appropriate sediment and erosion control practices must be
used to meet this standard. Turbidity curtains shall be used as appropriate. Please notify this
Office if any turbidity issues arise at 910.796.7215
5. All wetlands, streams, surface waters, and riparian buffers located within 50 feet of the
construction area on the project site shall be clearly marked (example- orange fabric fencing)
prior to any land disturbing activities and must be maintained on the property until the project
phase is completed. [15A NCAC 02H .0506 (b)(2) and (c)(2) and 15A NCAC 02H .0507 (c)]
6. Appropriate measures should be installed prior to any land clearing activities to protect
waters and wetlands from turbidity and/ or sedimentation. These measures should be routinely
inspected and properly maintained, and excavated materials should be contained outside the
wetland boundary. Excessive silt and sediment loads can have numerous detrimental effects on
aquatic resources including destruction of spawning habitat, suffocation of eggs, and clogging of

The applicant/permittee and their authorized agents shall conduct all activities in a manner
consistent with State water quality standards (including any requirements resulting from
compliance with 303(d) of the Clean Water Act), and any other appropriate requirements of
State and Federal law. If the Division determines that such standards or laws are not being
met, including failure to sustain a designated or achieved use, or that State or Federal law is
being violated, or that further conditions are necessary to assure compliance, than the Division
may reevaluate and modify this General Water Quality Certification. [15A NCAC.02H .0507(d)]
10. All mechanized equipment operated near surface waters or wetlands will be regularly
inspected and maintained to prevent contamination of waters and wetlands from fuels,
lubricants, hydraulic fluids or other potential toxic chemicals. In the event of a hydrocarbon or
chemical spill, the permittee/contractor shall immediately contact the Division of Water Quality,
between the hours of 8 am to 5 pm at the Wilmington Regional Office at 910.796.7215 and after
hours and on weekends call [phone]. Management of such spills shall comply with
provisions of the North Carolina Oil Pollution and Hazardous Substances Control Act. 115A
NCAC 02H .0506 (b)(3) and (c)(3), 15A NCAC 02B .0200 (3)(f), and GS 143 Article 21A].
11. Fueling, lubrication and general equipment maintenance should not take place within 50
feet of a waterbody or wetlands to prevent contamination by fuel and oils. [15A NCAC

12. This certification grants permission to the director, an authorized representative of the
Director, or DEQ staff, upon the presentation of proper credentials, to enter the property during

13. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or applicable
Buffer Rules, and any subsequent modifications, the applicant and/or authorized agent is
required to return a completed certificate of completion form to the NCDEQ DWR 401 and
Buffers Unit North Carolina Division of Water Resources, 1617 Mail Service Center, Raleigh,
NC, 27699 within ten days of project completion. The certification of completion is available at:

Violations of any condition herein set forth may result in revocation of this Certification
and may result in criminal and/or civil penalties. The authorization to proceed with your

Our standards of at least 1 foot below normal bed elevation applies to Public Trust and Estuarine Waters AECs. This
does not apply if culvert is placed in wetlands. For that we rely on the resource agencies' comments. To my knowledge
there are no stream features, but the agent may be able to clarify. I have also CC'd Brian Jarman on this as he is also an
agent of Mr. Parker. I believe Brian has the workplans, etc.

regional condition 3.6 which describes culvert burial requirements in CAMA AEC, which is why I'm asking. I haven't seen
the site, so I don't know what the wetland looks like, or if there is a stream -like feature within the wetland.
Haywood: Please provide the above requested size plan and additional information so that we can continue processing
the permit.

changes, and send me 3 copies since they are oversized?

Upon further review of the additional information submitted, I still have questions. If there is no stream, the pipe does
not need to be buried as shown in the profile provided last Friday. I'm also trying to better understand the impact
footprint. The proposed wetland fill area is 19' X37' and the proposed pipe is 20 If in length, correct? What is the actual
width of the driveway? What is the fill slope from top of the road down to the edge of the fill? Is this a 2:1 rock slope or
a more gradual 3:1 fill slope?
Please provide a cross-section showing the wetland fill from the top of the road down the shoulder to the toe of slope.

Narrative Description:
This request is for a partial renewal of CAMA Major Permit #87-05. It authorized three crossings
within Section 404 Wetlands in the ORW Coastal horelineAEC. This proposed impact was one
of the previously authorized crossings that was not completed prior to permit expiration.
The property is adjacent to Stump Sound at 102-104 Oyster Catcher Way in Sneads Ferry, Onslow
County. This 3.9-acre parcel is undeveloped. The adjacent properties are developed with single
family residential dwellings.
The elevation of the high ground of the parcel is about 7' above the normal high water level (NHW).
Vegetation on the tract mainly consists of pine forest, Section 404 Wetlands, and Coastal Wetlands.
These two lots have approximately 186' of continuous shoreline along Alligator Bay.
There is not a cultural resource in the nearby vicinity of the project area. This area of Alligator Bay is
approximately 2,000'across at this location. These estuarine waters are classified as a Primary
Nursery Area. The area is closed to shellfish harvest. These waters of Alligator Bay are classified as
SA; Outstanding Resource Waters by the EMC.

The applicants wish to construct a shared driveway with a culvert crossing Section 404 Wetlands and
a single family residential dwelling, in Sneads Ferry. The proposed development will take place at
102-104 Oyster Catcher Way, Onslow County. The proposed 19' wide and 150' long shared concrete
driveway would impact 516 square feet of Section 404 Wetlands. The purpose of this development is
to access the northern portion of the tract where the owners' residences are proposed. This proposed
crossing would be supported by a 20' long and 18" wide culvert. A single family residence is
proposed at 104 Oyster Catcher Way. The total high ground disturbance would be approximately
14,000 square feet. The proposed driveway and dwelling would result in approximately 7,660 square
feet of impervious surface within the 575' ORW Coastal Shoreline AEC.
Anticipated Impacts:
There is 4.44% of built upon impervious surface proposed within the 575' ORW Coastal Shoreline
AEC. The proposed culvert would fill 516 square feet of Section 404 Wetlands adjacent to Alligator
Bay. The proposed driveway and single family residential dwelling would impact approximately
14,000 square feet of high ground.
There is not a cultural resource in the nearby vicinity of the project area. This project area is
within the White Oak River Basin. These waters of Alligator Bay are classified as a Primary
Nursery Area and there is no. submerged aquatic vegetation present in the vicinity of the project
area. This area is closed to shellfish harvest. These waters are classified as SA; ORW.

The project site is located at Mimosa Bay lot 84, 104 Oyster Catcher Way in Sneads Ferry,
Onslow County, NC. to get to proposed site from Wilmington, head north on US Hwy 17, turn
right on Old Folkston road, turn right into Mimosa Bay, Take last road on right, Oyster Catcher
Way. The property is 1.96 acres in size and is located on Alligator Bay. Elevation is
approximately 7.43 to 10' above sea level. Residential and undeveloped lots border the lot.
The upland portion of the site has been partially cleared and contains Live Oaks, Long Leaf pines,
Hickory, Yaupons, and loblolly pines. A small area of 404 wetlands is located on the northern
portion of the lot. The southern portion contains coastal wetlands and marsh containing, spartina
alterlflora, Black Needle Rush, and salt grass.
A previous CAMA Major permit and wetland fill permit were issued for the property. The permits
have expired and the purpose of this request is to obtain a new permit so that a driveway can be
installed in the 404 wetlands on the front of the property. The purpose of the driveway is for a
residence on the property. The requested area of wetland fill is 19'x37' (516 sgft) and is located on
the property line of lots 83 and 84. The area will require an 18" culvert that will be buried 20% of
the pipe diameter to allow for free flow of water and aquatic wetland species. There are no coastal
wetlands in the proposed fill area.
The impact will be completed with heavy machinery and will involve filling the area with soil and
culvert. Silt fence will be installed to reduce impacts and contain fill material to the impact area
only. The area will be stablized with grass seed and straw to prevent any erosion.
Once a permit form Coastal Management has been obtained a permit from the US Army Corps of
Engineers will be applied for. We have spoken with Brad Shaver on the permit and he has stated
that the mitigation for this impact has been paid and will not need to be replicated. The new
contact person for this project will be Rachel Capito with the US Army Corps when the permit is
applied for.

On June 13, 2019, 1 received a revised CAMA major permit application, submitted by you on behalf of Donald Parker.
The application package rectified several deficiencies in your previously submitted request; however, there are
additional concerns and/or discrepancies with the project as proposed. Those items are noted below:
1) Page 3 of 4 on the MP-1 form (5)(f) identifies approximately 516 sq. ft. of total land disturbance associated with
the project; however, additional development (beyond the proposed wetland fill and culvert installation) is
proposed that would increase the limits of disturbance. Because the entire property is located within 575' of the
normal high water line associated with stump sound and alligator bay, the applicant is required to obtain a
CAMA permit for all development on the property, including any general grading, land clearing, home and
driveway construction, etc. This development activity should be accounted for on all applicable forms pertaining
to the CAMA major permit application. Please revise all forms to account for all proposed development activities
on the property.
2) On the site plan drawings, please show the location of the 575' Area of Environmental Concern (AEC) as
measured from the normal high water line.
3) The site plan drawing shows development proposed on the adjacent property, located at 102 Oyster Catcher
Way (Shaobo Liu and Ma Guangli). Please be advised that the owners of 102 Oyster Catcher Way will need to be
co -applicant's if any portion of the applicant's project falls within the boundaries of their property. If not, then
the applicant (Donald Parker) will need to confine all development to his/her property entirely. Should the
adjacent property owner be added as a co -applicant, then notification of the proposed project would need to be
served via certified mail (return receipt requested) to Eric and Rachel Corbett.
The items noted above were not addressed in the previous additional information request (sent by DCM on 5/17/19)
because the drawings submitted with the original submission were not legible.
In accordance with the Department of Environment and Natural Resources regulations, we note that the revised
application, as received by DCM on June 13, 2019, is incomplete for processing. Upon submission of the requested
information, a local decision will be made in 150 days, provided this period is not extended as provided by law. Please

Dear Mr. Parker:
The NC Division of Coastal Management hereby acknowledges receipt of your application for
State approval for development of your property located adjacent to Alligator Bay at 104 Oyster
Catcher Way near Sneads Ferry, Onslow County. It was received on July 31, 2019, and appears
to be adequate for processing at this time. The projected deadline for making a decision is October
16, 2019. An additional 75-day review period is provided by law when such time is necessary to
complete the review. If you have not been notified of a final action by the initial deadline stated
above, you should consider the review period extended. Under those circumstances, this letter will
serve as your notice of an extended review. However, an additional letter will be provided on or
about the 75th day.
If this agency does not render a permit decision within 70 days from July 31, 2019, you may
request a meeting with the Director of the Division of Coastal Management and permit staff to
discuss the status of your project. Such a meeting will be held within five working days from the
receipt of your written request and shall include the property owner, developer, and project
designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which
must be posted at the property of your proposed development. You should post this notice at a
conspicuous point along your property where it can be observed from a public road. Some
examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property, or at a point along the road right-of-way where a private road
would lead one into your property. Failure to post this notice could result in an incomplete
application.

The Department of Environment and Natural Resources hereby gives public notice as required by
NCGS 113A-119(b) that application for a development permit in an Area of Environmental Concern as
designated under the CAMA was received on July 24, 2019. According to said application, Donald Parker
proposes to construct a driveway and residence adjacent to Alligator Bay, at 104 Oyster Catcher Way,
Onslow County. A copy of the entire application may be examined or copied at the office of Brad Connell,

Being all of Lot Number 83 and 83A, Mimosa Bay, Phase One, Section Five, as the same
is shown and delineated on that certain map or plat recorded in Map Book 50, at Page
125D, in the office of the Register of Deeds of Onslow County, reference to which being
hereby made for a more perfect description of the aforesaid Lot.
This conveyance is made together with a 15 feet easement for the installation and repair
of septic system lines adjacent to 'Oyster Catcher Way and as shown on that certain map
or plat recorded in Map Book 50 at Page 125D, in the Office of the Register of Deeds of
Onslow County.
This conveyance is subject to easements and restrictive and protective covenants of
record in the office of the Register of Deeds Onslow County.
A portion of this Lot has been determined to meet the requirements for designation as a
wetland, stream or protected stream buffer. Any subsequent fill or alteration of this area
shall conform to the requirements of the state rules adopted by the State of North
Carolina in force at the time of the proposed alteration. The intent of this provision is to
prevent additional wetland, stream or buffer filling or draining, so the property owner
should not assume that a future application for filling or draining would be approved.
The property owner shall report the name of the subdivision on any application pertaining
to said rules. This covenant is intended to insure continued compliance with all rules
adopted by the State of North Carolina and therefore the State of North Carolina may
enforce benefits. This covenant is to run with the land and shall be binding on all Parties
