The applicant proposes to construct a new vinyl bulkhead 2 ft. waterward of an existing asbestos wall and fill 200 sq. ft. of Coastal Wetlands. The project is located at 8716 Bald Eagle Lane, adjacent to the AIWW in New Hanover County. Areas of Environmental Concern (AEC's) impacted by the proposal are ES, PTS, PTA, CW and EW. Waters at the project site are classified as SA- ORW and are open to the harvesting of shellfish. The area is not a Primary Nursery Area. I have reviewed this proposal for consistency with the 2016 New Hanover County Comprehensive Land Use Plan and offer the following comments. The general area of the project is classified as Conservation. In general, New Hanover County allows development in Conservation classified AECs, which is consistent with the State's minimum use standards. The 2016 New Hanover County Comprehensive Land Use Plan contains some policies, which exceed the State's minimum use standards. However, none of these standards appear to be applicable to this proposal. Cc: File RECEIVED JUN 04 2019 DCM-MHD CITY ROY COOPER Gnvemor MICHAEL S. RECEIVED MAR 18 2019 DCM-MHD CITY Darren Lee c/o Jimmy North Page 2 PROJECT DESCRIPTION: The project site is located at 8716 Bald Eagle Lane, adjacent to Middle Sound and the Atlantic Intracoastal Waterway (AIWW). The site is located in an area known as "Porters Neck" in Wilmington, New Hanover County. To locate the property from the WiRO travel north on Market Street/US 17 Bus N for approximately 5.3 miles. Turn right onto Porters Neck Road and continue straight through the first roundabout. Take a slight right to stay on Porters Neck Road and travel approximately 1.4 miles. Turn left on Bald Eagle Lane and travel 0.9 miles. The project site will be located on the right-hand side of the street. The project site is a residential lot with 100' of shoreline frontage along the AIWW and Middle Sound. The lot averages 10 ft. above Normal High Water (NHW). The property's shoreline is stabilized by an old asbestos bulkhead. The property is currently developed with a single-family residence and vegetation consists of lawn grasses and ornamental landscaping. Waterward of the existing bulkhead is an area of Coastal Wetlands spanning a maximum of 16 ft. consisting primarily of Smooth Cordgrass (Spartina Altemiflora). Normal High Water (NHW) is at the existing bulkhead. The property is bordered by residential properties to the north, south and west. The shorelines to the north and south have been stabilized with bulkheads and are developed with single-family residences and docking facilities. The property contains an existing residential docking facility extending into the AIWW. The existing docking facility consists of an approximately 16 ft. long by 16 ft. wide fixed platform adjacent to the bulkhead which leads, via ramp to a 40 ft. long by 8 ft. wide floating dock running parallel to the shoreline to the south. There is a boat lift measuring 13 ft. long by 13 ft. wide on the far southern and northern ends of the floating dock. The New Hanover County Land Use Plan classifies the adjacent waters as Conservation, and the adjacent high ground portion of the project area as Conservation/Residential. The waters of the AIWW, in the vicinity of the project site, are classified SA-ORW by the N.C. Division of Water Resources. They ARE NOT designated as a Primary Nursery Area by the N.C. Division of Marine Fisheries. They are OPEN to the harvest of shellfish. 10. PROPOSED PROJECT The applicant proposes to construct a new vinyl bulkhead 2 ft. waterward of an existing asbestos wall and fill 200 sq. ft. of Coastal Wetlands. According to the application a new 100 ft. long vinyl bulkhead would be installed 2 ft. waterward of the existing asbestos wall. Installation of the new bulkhead would result in the filling of 200 sq. ft. of Coastal Wetlands. The existing wall would essentially be the new NEW line. (see Sheet 1 of 2) 11. ANTICIPATED IMPACTS The proposed bulkhead installation would disturb approximately 2,000 sq. ft. of high ground within the 30 ft. Coastal Shoreline Buffer in the 575 ft. Coastal Shoreline/ORW AEC and would result in the filling of 200 sq. ft. of Coastal Wetlands below NHW. Submitted by: Tara MacPherson Date: 3/13/19 Office: Wilmington RECEIVED MAR 18 2019 DCM-MHD CITY Project Narrative Darren Lee of 8716 Bald Eagle Lane is proposing to construct a new bulkhead in front of the existing asbestos bulkhead. The existing bulkhead is failing in numerous places and needs replacing before more backfill escapes into the coastal wetlands. The new vinyl bulkhead is proposed to be 2' in front of the existing bulkhead. The new bulkhead is proposed to be installed 2' in front of the existing wall and coastal wetlands will be backfilled between the 2 walls. The length of the bulkhead is 100'. It was received as complete on March 13, 2019, 2019 and appears to be adequate for processing at this time. The projected deadline for making a decision is May 27, 2019. An additional 75-day review period is provided by law when such time is necessary to complete the review. If you have not been notified of a final action by the initial deadline stated above, you should consider the review period extended. Under those circumstances, this letter will serve as your notice of an extended review. However, an additional letter will be provided on or about the 75th day. If this agency does not render a permit decision within 70 days from March 13, 2019, you may request a meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a meeting will be held within five working days from the receipt of your written request and shall include the property owner, developer, and project designer/consultant. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed development. You should post this notice at a conspicuous point along your property where it can be observed from a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of- way fronting your property; or at a point along the road right-of-way where a private road would lead one into your property. Failure to post this notice could result in an incomplete application. An onsite inspection will be made, and if additional information is required, you will be contacted by the appropriate State or Federal agency. Please contact me if you have any questions and notify me in writing if you wish to receive a copy of my field report and/or comments from reviewing agencies. RECEIVED MM1RZ019 DCM-MHD CITY RECOMMENDATIONS FOR Darren Lee c/o Jimmv North 3/13/19 The applicant has an existing failing asbestos bulkhead. 15A NCAC 07H.0208 requires that bulkhead alignment shall approximate mean high water or normal water level and shall be landward of significant marshland or marshgrass fringes. It also states that bulkheads shall be permitted below approximate mean high water or normal water level only when the following standards are met: (i) the property to be bulkheaded has an identifiable erosion problem, whether it results from natural causes or adjacent bulkheads, or it has unusual geographic or geologic features, e.g. steep grade bank, which will cause the applicant unreasonable hardship under the other provisions of this Rule; (ii) the bulkhead alignment extends no further below approximate mean high water or normal water level than necessary to allow recovery of the area eroded in the year prior to the date of application, to align with adjacent bulkheads, or to mitigate the unreasonable hardship resulting from the unusual geographic or geologic features; (iii) the bulkhead alignment will not result in significant adverse impacts to public trust rights or to the property of adjacent riparian owners; (iv) the need for a bulkhead below approximate mean high water or normal water level is documented in the Field Investigation Report or other reports prepared by the Division of Coastal Management; and (v) the property to be bulkheaded is in a non -oceanfront area. The proposed bulkhead will extend no further below NHW than necessary to encapsulate the existing asbestos wall. The alignment should not result in significant adverse impacts to .public trust rights or to the property of adjacent riparian property owners because the bulkhead will not extend greater than 2 ft. waterward of the existing failing wall and because both adjacent properties are already bulkheaded. Based on these factors, it is recommended that a permit be issued to authorize the construction of bulkhead as proposed in the applicant's submittal. This office has no objection to the proposed work, provided it is consistent with all other state and federal permitting requirements. It is recommended that any permit issued should include standard conditions for upland development. RECEIVED MAR 18 2019 DCM-MFID CITY ROY COOPER Gowntor MICHAEL S.
