Street, Wrightsville Beach , as requested in the permittee's application dated 08/15/18, including
attached workplan drawings (3) 1-3 of 3 dated 08/15/18.
This permit, issued on January 9, 2019 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Dockine Facility
1) This permit authorizes only the docks, piers, and other structures and uses located in or over the
water that are expressly and specifically set forth in the permit application. No other structure,
whether floating or stationary, shall become a permanent part of this docking facility without permit
modification. No non -water dependent uses of structures shall be conducted on, in or over Public
Trust waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
pen -nit for which the permittee is responsible. This prohibition shall be applied and enforced
throughout the entire existence of the permitted structure.

This permit action may be appealed by the permittee or other Signed by the authority of the 5
qualified persons within twenty (20) days of the issuing date. Chairman of the Coastal Resources

Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2022
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
3) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
5) The pier and associated structures shall have a minimum setback distance of 15 feet between any new
parts of the structure and the adjacent property owner's riparian access corridor, which is determined by
drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that
intersects with the shore at the point where the upland property line meets the water's edge.
6) The authorized structures and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the established Wrightsville Beach pier head line.
7) This permit authorizes an additional three (3) slips for a total of five (5) formalized boat slips.
General
8) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
9) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
10) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
11) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of General Permit
197800056 (Action ID No. SAW-2018-02182), which was issued on 12/3/18.
NOTE: The N.C. Division of Water Resources assigned the proposed project DWR Project No. 2018-
1533v1.

The applicant proposes a floating dock and new boatlift at an existing docking facility for
a total of 5 slips. The project is located at 32 W. Henderson Street in Wrightsville Beach,
New Hanover County.
Areas of Environmental Concern (AEC's) impacted by the proposal are EW and PTA.
Waters at the project site are classified as SB and are not open to the harvesting of
shellfish. The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the Town of Wrightsville Beach Land
Use Plan and offer the following comments.
The general area of the project is classified Developed, while the AECs impacted by the
work are classified as Conservation/Resource Protection.
In general, the Town of Wrightsville Beach allows development in
Conservation/Resource Protection classified AECs which is consistent with the State's
minimum use standards. The Town of Wrightsville Beach Land Use Plan contains some
policies, which exceed the State's minimum use standards including those for piers and
marinas. However, none of these more restrictive policies seem to be applicable to this
project.
This project is consistent with the 2005 Town of Wrightsville Beach Land Use Plan.

Dear Mr. King:
Through coordination with the North Carolina Division of Coastal Management we have
learned of your request to construct a new floating dock and boatlift at an existing docking
facility located at 32 W. Henderson Street in Wilmington, New Hanover County, North Carolina.
Coordinates are: 34.2154 N,-77.7936 W.
On January 1, 2017, we renewed general permit No. 197800056, (copy enclosed), that
authorizes the maintenance, repair, construction and installation of piers, docks, boathouses and
boat shelters, mooring piles, dolphins, jetties and breakwater structures in navigable water; of the
United States in the State of North Carolina pursuant to Section 10 of the Rivers and Harbors Act
of 1899.
Your work is authorized provided it is accomplished in strict accordance with your
submitted plans, the enclosed general conditions, and the following special conditions. The
expiration date of your DA permit is December 31, 2021.
All work authorized by this permit must be performed in strict compliance with the
revised submitted plans received on November 8, 2018, which are a part of this permit.
2. In order to further protect the endangered West Indian Manatee, Trichechus manatus, the
applicant must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and
strictly adhere to all requirements therein. The guidelines can be found at
http://www.fws.gov/nc-es/mammal/manatee_guidelines.pdf.
Please read the enclosed permit to prevent an unintentional violation of Federal law. As
this Department of the Army regional general permit does not relieve you of the responsibility to
obtain any other required approvals, you should contact appropriate State and local agencies
before beginning work.

The project site is located at 32 West Henderson Street, adjacent to Banks Channel, in the town of Wrightsville
Beach, in New Hanover County. To locate the project site from the Wilmington Regional Office (WiRO), travel
east approximately 3.0 miles on Eastwood Rd towards Wrightsville Beach. Cross the drawbridge and proceed to
take a left onto West Salisbury Street. Cross a second bridge over Banks Channel, and take a right onto North
Lumina Avenue at the next intersection. Travel two blocks to the south and then take a right turn on West
Henderson. Travel until the end of the roadway and the subject property will be on the right.
Currently the property has an existing single-family residence, 3 slip private docking facility and timber bulkhead.
The bulkhead is approximately 90 feet in length, crossing the property in a southwest direction from the northern
edge of the parcel until it meets the south western property boundary. The bulkhead ties into existing bulkheads
at both the northern and southern neighboring properties. The existing docking facility consists of a 40' x 6'
access pier extending waterward to the northwest from the edge of the bulkhead. Along the left side of the pier,
there is a 4' x 20' `bumpout' platform section of the pier that is uncovered, extending outward to the south.
Along the right side of the pier, there is a 15' x 18' `bumpout' covered platform section extending outward to the
north. At the end of the pier, there is a 12' x 3' ramp that extends waterward to an `L head' 6' wide floating dock,
that extends waterward 20' to the northwest, and then,back 25' to the southwest. The 25' by 6' floating dock
serves as two of the existing slips. To the north side of the `L head' floating dock there is a 13' by 14' boatlift that
functions as a third existing slip at the facility.
Elevation at the site averages approximately 7'-0' above normal high water (NHW). The high ground portion of
the property contains ornamental grasses and landscaping and there are no coastal wetlands located along the
shoreline of the property. The Town of Wrightsville Beach Land Use Plan classifies the area in the vicinity of
the project area as developed. It is located in a VE Flood Zone. The waters in the project area are classified as SB
by the N.C. Division of Water Resources. They are not designated as a Primary Nursery Area (PNA) by the N.C.
Division of Marine Fisheries, and they are closed to the harvest of shellfish.
The applicant is proposing a floating dock and new boat lift at an existing docking facility, increasing the slip
count from 3 existing to 5 total. Originating from the 4' x 20' `bumpout' section along the fixed pier, a ramp (3'
x 12) would extend out to the southwest, landing on the northern edge of a proposed 14' x 6' floating dock.
From the proposed floating dock, the proposed boat lift (13' x 14') would extend in a waterward direction from
the center of the floating dock, towards the west. The proposed structures would not extend any further
waterward than the structures already existing on the location, not exceed the existing Town of Wrightsville
Beach pierhead line, or encroach into the 15' setback from neighboring properties to the north or south. The new
lift and floating dock would be installed using a floating work barge that would be stored on site.
10. ANTICIPATED IMPACTS
As proposed, the new boat lift and floating dock would result in the incorporation of approximately an additional
266 ftz of Public Trust Area and Estuarine Waters. The project area consists of open water, and there would be no
impact to vegetated wetlands or to the high ground area. As proposed, the constructed features would not
encroach into the adjacent 15' riparian corridor setback from properties on both the northern and southern
borders, nor encroach into the established pierhead line. The proposed lift would be located approximately 64'
away from adjacent docking facilities to the north and approximately 95' away from the adjacent docking
facilities to the south. According to the applicant, the water depth is -2' at normal low water (NLW) at the
location for the proposed floating dock and -3' at NLW at the location for the proposed boatlift. This depth
appears adequate to lower the potential for propwash and kicking. There appear to be no SAV present in the
project area. Minor increases in turbidity should be expected during project construction.

The Division of Coastal Management hereby acknowledges receipt of your application, as acting agent for Dr. Bill
King, for State approval for development of the subject property located at 32 West Henderson Street, adjacent to
Banks Channel, in Wrightsville Beach, in New Hanover County. It was received as complete on October 26, 2018
and appears to be adequate for processing at this time. The projected deadline for making a decision is January 9,
2019. An additional 75-day review period is provided by law when such time is necessary to complete the review. If
you have not been notified of a final action by the initial deadline stated above, you should consider the review period
extended. Under those circumstances, this letter will serve as your notice of an extended review. However, an
additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from October 26, 2018, you may request a meeting
with the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a
meeting will be held within five working days from the receipt of your written request and shall include the property
owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from
a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property; or at a point along the road right-of-way where a private road would lead one into your
property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the appropriate
State or Federal agency. Please contact me if you have any questions and notify me in writing if you wish to receive
a copy of my field report and/or comments from reviewing agencies.
