This permit, issued on May 28, 2019 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Dockine Facility 1) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other Signed by the authority of the Secreter qualified persons within twenty (20) days of the issuing date. of the Coastal Resources Commission. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2022 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 6) The boathouse shall not be completely enclosed or have side coverage more than one half the height of the side, from the roof waterward. 7) The authorized boathouse shall be single story, and shall not be designed to allow for second story use. 8) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish &c Wildlife Service's Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at httv://www.fws.gov/ne-es/manunal/manatee guidelines.odf. General 9) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 10) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 11) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to, the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 12) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. The applicant proposes to install a new boat house over two existing boat lifts. The project is located at 238 Gill Net Lane in Sneads Ferry, Onslow County. Areas of Environmental Concern (AFC's) impacted by the proposal are Estuarine Waters and Public Trust Areas. Waters at the project site are classified as SA and are not open to the harvesting of shellfish. The area is a Primary Nursery Area. I have reviewed this proposal for consistency with the Onslow County Land Use Plan Update and offer the following comments. The general area of the project is classified as Conservation. In general, Onslow County allows development in Conservation classified AECs which is consistent with the State's minimum use standards. The Onslow County Land Use Plan contains some policies, which exceed the State's minimum use standards. However, none of these more restrictive policies appear to be applicable to this project. Send all suspicRE41 arvi-TrIan attachment to report.spam@nc.gov<mailto:report.spam@nc.gov> JUN '04 2019 All, DCM-MHD CITY Pursuant to the CAMA-Corps Programmatic Permit process, the North Carolina Division of Coastal Management (NCDCM) has forwarded to our office a copy of the CAMA permit application, Field Investigation Report and BioReport for the subject project. The attached notice requests federal agency comments on this project by April 7, 2019. The proposed site is located at an existing docking facility within waters of Fullard Creek, at 238 Gill Net Lane, Snead's Ferry, in Onslow County, North Carolina. Coordinates are 34.534377 N,-77.389064 W. The applicant proposes to construct a 32'X38' (1,216 square feet) boathouse over an existing docking facility. Plans were not included with the application, so it is unclear if the structure will be enclosed. The application makes reference to a wood/roof cover several times and describes the structure as being constructed over the docking facility. Conventional truss and stick built construction method is proposed. Dredging is not proposed as a part of this project. The facility is not located near the Corps federal channel. Please see the attached field investigation report /application for more detailed information concerning the proposed project. Google Earth .kmz file is attached for reference. EFH: This notice initiates the Essential Fish Habitat (EFH) consultation requirements of the Magnuson -Stevens Fishery Conservation and Management Act. The Corps' initial determination is that the proposed project may affect, but not likely adversely affect EFH or associated fisheries managed by the South Atlantic or Mid Atlantic Fishery Management Councils or the National Marine Fisheries Service. Impacts are expected to be minimal since the construction activity does not appear involve 'in water' work. The waters within the project area ARE designated as PNA by the Division of Marine Fisheries, are classified as SA by the Division of Water Resources, and are closed to shell fishing. Based on the application, SAV is not present and there are no shellfish resources within the project area. Average water depth within the project area is -3.0It NLW. ESA: The Corps has reviewed the project area, examined all information provided by the applicant and consulted the latest North Carolina Natural Heritage Database. Based on available information, the Corps has determined that the project may affect, but is not likely to adversely affect the West Indian Manatee. The use of Manatee Guidelines may be required as a permit condition. The project would have No Effect on any other federally listed species. NHPA 106: Pursuant to Section 106 of the National Historic Preservation Act (NHPA) of 1966, Appendix C of 33 CFR Part 325, and the 2005 Revised Interim Guidance for Implementing Appendix C, the District Engineer consulted district files and records and the latest published version of the National Register of Historic Places and initially determines that no historic properties, nor properties eligible for inclusion in the National Register, are present within the Corps' permit area: therefore, there will be no historic properties affected. Specifically, the project consists of constructing a 32'X38' (1,216 square feet) boathouse over an existing docking facility. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the modification to the State authorization: 1. In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at http://www.fws.gov/nc-es/mammal/manateeguidelines.gdf. 2. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities. It appears the project is consistent with the use standards set forth in NCAC 07H .0208(b)(6), including the Y4 width rule, the eight -square foot rule and the pier width rule. The proposed structures would be located entirely over open water. This office has no objection to the proposed work. If the project is determined to be consistent with NCAC 07H .0208(b) (6), it is recommended that any permit issued should include the following conditions: 1. PROJECT DESCRIPTION: The project site is located at 238 Gill Net Lane, in Sneads Ferry. NC. The high ground property is adjacent to Fullard Creek which connects to the waters of Chadwick Bay in Sneads Ferry, Onslow County. To get to the site from Wilmington, take NC Highway 17 north toward Jacksonville. Turn right onto NC Highway 172 (approximately 28 miles from Wilmington) and continue approximately 5.9 miles. Turn right onto Sneads Ferry Road and travel approximately 0.75 miles. Turn right onto Clay Hill Road and then merge left onto Bill Canady Road at the sharp curve (curve with uneven double yellow lines). Continue along Bill Canady Road for 0.5 miles and turn right onto Biglings Creek Road. Travel along Biglings Creek Road for approximately 700' and then turn left onto Anchor Lane/Gill Net Lane. Continue to the terminus and the subject property will be located along the left-hand side of the road at house number 238. The project site is located along a peninsula and has approximately 638 linear feet of shoreline. Currently, the applicant maintains a single-family home (with amenities) on the property as well as a private pier and docking facility. High -ground elevations at the site range from 8'-12' above normal high water (NHW) and water depths average approximately -3.0' deep, relative to Normal Low Water (NLW). The property is bordered by residential properties to the north, east and west, and by Fullard Creek to the south. High ground vegetation on the site consists of mature Live Oak, lawn grasses and ornamentals. There are both "404" type and Coastal Wetland species bordering the property along the eastern, western and southern shoreline. Currently, the property has a naturally vegetated shoreline with no man-made retention. On 8/22/2012, CAMA General Permit No. 60614-D was issued, authorizing a platform extension (8' x 20'), boathouse/lift (10' x 10') and cat -walk (4' x 26'). The authorized work was partially completed (installed platform extension and cat -walk), but the boathouse was never erected. Now, the applicant is requesting authorization to install a larger boathouse to cover the existing boatlifts and finger piers. RECEIVED Prior to 2012, CAMA records show a General Permit (GP-45974) being issued to Don Charland on 8/8/2006. This permit authorized a platform expansion along with installation of several moori>FF�B — 5 2018 pilings (presumably the boat lift pilings). DCM-MHD CITY The existing pier facility includes an approximate 5' x 85' access pier, which originates along the eastern shoreline and terminates into an approximate 13' x 24' "L-head" shaped platform that extends into Fullard Creek. In addition, a 4' x 32' finger pier extends from the main pier (in a southerly direction) running parallel to the shoreline. This finger pier connects to two additional 4' x 25' finger piers, one of which runs perpendicular to the shoreline between the two existing boat lifts and the other running perpendicular to the shore, along the outer edge of the southern -most lift. In between the two -finger piers sits two, approximate 12' x 12' boatlifts. Water depths around the existing boat lifts averages 2.5', during periods of normal low water. The Onslow Land Use Plan classifies the upland areas of this project as conservation. The waters of the project site are classified as $A by the NC Division of Water Resources. The NC Division of Marine Fisheries HAS designated this area of Fullard Bay/Chadwick Bay as a Primary Nursery Area. and the waters adjacent to the proposed project are CLOSED to the harvesting of shellfish. As proposed, the applicant would construct a 32' x 38' boathouse above the two existing slips and finger piers. The boat house would extend beyond the dimensions of the existing docking facility but would not cover the existing platform. The boat house would extend approximately 3' beyond the edge of the existing docking facility, in a water body that measures approximately 500' in width The number of slips under this permit request would not change and would remain at two. Based on the July 2018 on -site visit, there does not appear to be any SAV present in the proposed development area. In addition, the area appears to be void of any shellfish beds. 10. ANTICIPATED IMPACTS The proposed boathouse would result in the shading and incorporation of approximately 1,216 sq. ft. of public trust and estuarine waters. According to the application this development is essentially within an area currently usurped by the existing docking facility. Based on the applicant's proposal, the development would not encroach into neither of the adjacent property owner's riparian corridor, nor would the structure encroach beyond 1/4 or the width of the water, pier -head line or channel.
